Ordinance #2031 12/2/03 Page 1 of C CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2004 0 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 10, "LAND DEVELOPMENT REGULATIONS", ARTICLE V, "IMPROVEMENTS", DIVISION 2, "ROADS AND PUBLIC RIGHTS -OF -WAY", SECTION 10-191, "STREET LIGHTING", (b)(1), "DESIGN AND CONSTRUCTION STANDARDS", AMENDING THE IDENTIFICATION OF MINIMUM STANDARD FOR STREET LIGHTING DESIGN AND CONSTRUCTION WITHIN THE CODE TO THE CURRENT EDITION OF THE IESNA LIGHTING HANDBOOK, PUBLISHED BY THE ILLUMINATING ENGINEERS SOCIETY OF NORTH AMERICA; AMENDING CHAPTER 24, "ZONING", ARTICLE V, "OFF-STREET PARKING AND LOADING", SECTION 24-579, "LIGHTING STANDARDS", (a)(2)c, "INTENSITY", AMENDING THE IDENTIFICATION OF THE CURRENT STANDARD WITHIN THE CODE TO THE CURRENT EDITION OF THE IESNA LIGHTING HANDBOOK, PUBLISHED BY THE ILLUMINATING ENGINEERS SOCIETY OF NORTH AMERICA; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Director of Public Works has reviewed Chapter 10 entitled, "Land Development Regulations", relating to minimum standard for street lighting design and construction; and Chapter 24 entitled, "Zoning", relating to the current lighting standard for parking facilities and has identified specific standards that are not consistent with current engineering standards and practices; and CODING: Words in struel( through type are deletions from existing law. Ordinance #2031 12/2/03 Page 2 of 6 WHEREAS, based upon such review the Director of Public Works has determined that certain sections need to be amended or clarified requiring property owners, builders or developers to refer to the Current Edition of the IESNA Lighting Handbook to identify the minimum requirements for design and construction standards of street and parking facility lighting; and WHEREAS, the Director of Public Works has determined that the proposed amendment to Sections 10-250 and 24-579 of the City Code of Ordinances will align the minimum requirements for design and construction standards of street and parking facility lighting requirements with current standards and practices; and WHEREAS, the Director of Public Works recommends approval of the proposed amendment to Chapter 10, Article V, Division 2, Section 10-191 and Chapter 24, Article V, Section 24-579 of the City Code of Ordinances; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interests of the citizens and residents of the City of Tamarac to amend Chapter 10 entitled, "Land Development Regulations", Section 10-191 and Chapter 24 entitled "Zoning", Section 24-579. Ordinance #2031 12/2/03 Page 3 of 6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: Chapter 10 entitled, "Land Development Regulations", Article V entitled, "Improvements", Division 2 entitled, "Roads and Public Rights -of -Way", Section 10-191 entitled, "Street Lighting", Item (b)(1) entitled, "Design and Construction Standards" of the City Code of Ordinances is hereby amended to read as follows: Sec. 10-191. Street Lighting (b) Design and construction standards. All street lighting as required by this division shall conform to the following standards of design and construction: (1) All designs for lighting shall be approved by the city engineer and the franchised electric utility, who will follow, as a minimum, the current edition of the LE.S. Standard Praefice for Street. err. ■ ■ rr-� snreeri ■� _MAr SECTION 3: Chapter 24 entitled "Zoning", Article V, entitled, "Off - Street Parking and Loading", Section 24-579, entitled "Lighting Standards", Item (a)(2)c entitled, "Intensity", of the City Code of Ordinances is hereby amended to read as follows: Sec. 24-579. Lighting standards. Sec. (a)(2)c.The current edition of the 1ES IESNA Lighting Handbook, published by the Illuminating Engineers Society, 315 East 47-t"—Street, New N.Y.10017, of North America is the standard to be used by the architect or engineer as a guide for the design and testing of parking facility lighting. Ordinance #2031 12/2/Q3 Page 5 of 6 and adopted by this section or subsequent amendments are more severe, in which case the more restrictive standards shall apply. SECTION 4 : It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Chapter", "Article" or such other word or phrase in order to accomplish such intention. SECTION 5 All Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6 If any provisions of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
