ORDINANCE NO. 0-2004- 0
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AMENDING THE CITY OF
TAMARAC CODE, CHAPTER 6 "FINANCE AND
TAXATION," ARTICLE V "PURCHASING PROCEDURES,"
SECTION 6-153, "SURPLUS STOCK," AMENDING
PROCEDURES FOR THE DISPOSAL OF SURPLUS
PROPERTY TO PROVIDE FOR THE GREATER
FLEXIBILITY OF THE DISPOSAL OF CITY SURPLUS
STOCK PROPERTY BY INCORPORATING COMPETITIVE
SEALED BID, ESTABLISHED MARKET SALES, SALES AT
POSTED PRICES, DONATION OR TRADE-IN AS
ADDITIONAL METHODS FOR DISPOSAL OF SURPLUS
STOCK; PROVIDING FOR CODIFICATION; PROVIDING
FOR CONFLICTS, PROVIDING FOR SEVERABILITY, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City regularly has a need to dispose of surplus property,
including supplies which are no longer used or which have become obsolete, worn out,
excess, scrapped or uneconomically repairable; and
WHEREAS, the only currently prescribed method for disposal of surplus property
is by Auction; and
WHEREAS, in order to enhance departmental productivity, efficiency, and
expediency, it is desirable to provide for methods for disposal of surplus property in
addition to the Auction method; and
WHEREAS, the use of other methods of disposal, including competitive sealed
bids, established markets, sales at posted prices, donation or trade-in, may be more
advantageous, convenient and economical to the City; and

WHEREAS, the City Manager, Director of Finance and Purchasing and
Contracts Manager recommend amending Chapter 6, Article V, Section 6-153 "Surplus
Stock" to provide greater flexibility in the methodology for the disposal of surplus
property; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be
in the best interest of the citizens and residents of the City of Tamarac to amend
Tamarac City Code Chapter 6, "Finance and Taxation", Article V, "Purchasing
Procedures", Section 6-153, "Surplus Stock" to provide for greater flexibility in the
disposal of surplus property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Ordinance upon adoption hereof.
Section 2. That Chapter 6, "Finance and Taxation", Article V, "Purchasing
Procedures", Section 6-153, "Surplus Stock" is hereby amended as follows:

Whenever in the opinion of the city manager or designee there exists on the
official municipal inventory obsolete, worn out, excess, scrapped or not cost effective to
repair items of personal property, the following shall occur:
1 Using agencies shall submit to the city mans er or designee at such time
and on such forms that may be prescribed, reports showing stock of all supplies which
are no longer used -or which have become obsolete. worn out, excess, scrapped or that
are not cost effective to repair. The using agency may suggest a dollar value per item
or per lot of items, however, such suggestion shall not constitute the minimum sale
amount. The purchasing officer shall have the authority to transfer sur lus stock to
other using agencies.
0*0 When the city manager or designee determines that the amount of surplus or
obsolete equipment or materials reaches a level sufficient to warrant a blie efien
disposal as determined by the eity manager from the using agency reports, the city
manager shall report this condition to the city commission. The city commission, by

be most advantageous, convenient and economical to the city. and any et

competitive sealed bidspublic auction established markets sales at posted prices.

donation or trade-in as may be -prescribed for the individual situation. In the event that
either the competitive sealed bid _or -public auction methods for disposal are used, notice
of a proposed sale of property shall be advertised in a newspaper of general circulation
within the city once a week for at _least 2 weeks. The property shall be available to
prospective buyers at a designated time in advance of the bid opening or the -auction.
The proceeds from any sale shall be used as directed by the city commission for a
city purpose. This subsection is supplemental to the procedure outlined in section 2-
Section 3. Codification: It is the intention of the City Commission and it is
hereby ordained that the provisions of this Ordinance shall become and be made a part
of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered, relettered and the word "Ordinance" may be changed
to "Section", "Article" or such other word or phrase in order to accomplish such
intention.
Section 4. That all Ordinances or parts of Ordinances, and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such
conflict.
Section 5. That if any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other
provisions or applications of this Ordinance that can be given affect without the invalid
provision or application, and to this end the provisions of this Ordinance are declared to
be severable.

Section 6. That the provisions of this Ordinance shall become effective
immediately upon its passage and adoption.
