AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AMENDING PRIOR ZONING OF CERTAIN
REAL ESTATE PROPERTY (AKA: BRUCE
PLAT) FROM B-2 (COMMUNITY BUSINESS
DISTRICT) TO R-4A (PLANNED APARTMENT
RESIDENTIAL DISTRICT) LANDS COMMONLY
KNOWN AS A PORTION OF PARCEL "A" OF
THE "BRUCE PLAT", ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT
BOOK 135, PAGE 11 OF THE PUBLIC
RECORDS OF BROWARD COUNTY, FLORIDA,
LOCATED 120 FEET SOUTH OF THE
SOUTHEAST CORNER OF NORTH
UNIVERSITY DRIVE AND NW 64T" STREET
(CASE NO. 2-Z-04); PROVIDING FOR
AMENDMENT OF THE OFFICIAL ZONING MAP
TO REFLECT SUCH CHANGE; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, petitioner has requested that certain real estate property located 120
feet south of the southeast corner of North University Drive and NW 64" Street be rezoned
from B-2 (Community Business District) to R-4A (Planned Apartment Residential District) to
be consistent with the City's adopted Comprehensive Plan, adjoining properties, and to
accommodate future development; and
WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of
Tamarac, Florida, public notice has been given of the time and place of the public hearing

regarding the rezoning of the property described herein and said public hearing has been
held in accordance with the notice and the public has been given an opportunity to be, and
has been heard; and
WHEREAS, the public hearing has been held on Case No. 2-Z-04 by the City
Commission pursuant to the Charter and Florida State Statutes; and
WHEREAS, on March 17, 2004, the Planning Board held a duly advertised Public
Hearing and recommended approval of the rezoning; and
WHEREAS, the Director of Community Development recommends approval of this
rezoning; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems the
rezoning to be consistent with the City of Tamarac Comprehensive Plan; and
WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the
best interest of the citizens and residents of the City of Tamarac to rezone the property
(aka: Bruce Plat) from B-2 (Community Business District) to R-4A (Planned Apartment
Residential District) lands commonly known as a portion of Parcel "A" of the "Bruce Plat",
according to the Plat thereof as recorded in Plat Book 135, Page 11 of the Public Records
of Broward County, Florida, located 120 feet south of the southeast corner of North
University Drive and NW 64' Street (Case No. 2-Z-04).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE

CITY OF TAMARAC, FLORIDA:
SECTION 1_ That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the Ordinance
upon adoption hereof.
SECTION 2: That the lands commonly known as a portion of Parcel "A" of
the "Bruce Plat", according to the Plat thereof as recorded in Plat Book 135, Page 11 of
the Public Records of Broward County, Florida, located 120 feet south of the southeast
corner of North University Drive and NW 64" Street (attached hereto as Exhibit "A") are
hereby rezoned from B-2 (Community Business District) to R-4A (Planned Apartment
Residential District).
SECTION 3: That the official zoning map of the City of Tamarac shall be
changed to reflect such zoning designation upon the effective date of this Ordinance.
SECTION. 4: All Ordinances or parts of Ordinances, and all Resolutions or
parts of Resolutions, in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 5: If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.
SECTION 6: This Ordinance shall become effective immediately upon its
adoption.
