Ord. #2058 August 5, 2004 Page 1 Revision #1 August 17, 2004 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2004- 1I AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 2 OF THE TAMARAC CODE, ENTITLED "ADMINISTRATION", ARTICLE II, "CITY COMMISSION", SECTION 2-31, "APPOINTED BOARDS, COMMISSIONS, COMMITTEES TO ELECT CHAIRMAN, VICE CHAIRMAN; ABSENTEEISM OF MEMBERS; VACANCIES" PROVIDING FOR REMOVAL OF ALTERNATE MEMBERS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 2-31 of the City Code provides that a Committee or Board member shall be deemed to have forfeited his appointment should he be absent from all the regular meetings of the Committee or Board to which the member is appointed over a period of seventy- five (75) days excluding the month of July; and WHEREAS, Chapter 2, Article III. "Boards, Committees, Commissions" of the City Code provides for the resignation of a member of the Consumer Affairs Committee, Insurance Advisory Board, Investment Advisory Committee, Public Information Committee, Social Services Board, Veterans Affairs Committee, Annexation Committee, Privatization Committee, Sister Cities Committee and the Economic Development Advisory Committee for failure to attend three (3) consecutive meetings without being excused by the Chairman; and WHEREAS, Chapter 15, Article II, Division 2. "Parks and Recreation Board" Section 15- 49. Ord. #2058 August 5, 2004 Page 2 Revision #1 August 17, 2004 Parks and Recreation Board for failure to attend (3) consecutive meetings without being excused by the Chairman; and WHEREAS, through an expression of interest at the Special City Commission meeting held on June 21, 2004, the City Commission has determined that an individual appointed to a Committee or Board as an alternate member should be held to the same absentee provisions as regular members; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Section 2-31 of the Tamarac Code be amended to require that any alternate member appointed to a Committee or Board by the City Commission be subject to the resignation provision governing the particular committee or board, or when no provision exists, or the Code is silent, alternate members may be removed by the absentee provision in Section 2-31. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Ord. #2058 August 5, 2004 Page 3 Revision #1 August 17, 2004 SECTION 2: That Chapter 2 of the Tamarac City Code, entitled "Administration", Article II, entitled "City Commission" is hereby amended as follows: Section 2-31. Appointed boards, commissions, committees to elect chairman, vice- chairman; absenteeism of members; vacancies. (a) Each board, commission or committee whose members are appointed by the city commission shall annually meet to appoint a chairman and a vice-chairman unless otherwise provided in this Code. Such selections shall occur at the next regular meeting after commission action to reappoint or replace members whose normal term has expired. If the chairman or vice-chairman ceases to be a member of the board, commission or committee during his term of office, the remaining members shall select a new chairman or vice-chairman, as appropriate, for the balance of the term. (b) If over a period of seventy-five (75) consecutive days excluding the month of July, a committee or board member should be absent from all the regular meetings of the committee or board to which he has been appointed by city commission, the member shall be deemed to have forfeited his appointment. The city commission shall announce the vacancy at the first or second regular commission meeting following the seventy-fifth day of absence. The chairman shall be responsible to notify the city clerk and the mayor of any appointed member that is absent from the regular meetings over such a time period. c) When the code aovernina a Darticular committee or board Drovides for removal by resignation of a member due to unexcused absences, an alternate member may be removed by the same criteria. When the code governing a particular committee or board does not specify an absentee provision, alternate members shall forfeit their appointment in the same manner ass ecified in this section. (e) The absentee provision of this section shall not apply to the board of social services. (d-) Appointments to boards and committees for those members who serve one-year terms shall be made at an annual special meeting of the city commission. In the event of vacancies on boards and committees, due to resignation, forfeiture of appointment, death or removal of members, appointments to fill vacancies shall be made six months after the initial appointments. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption.
