Ord. #2063 Page 1 August 10, 2004 Revision #1 — August 30, 2004 Revision #2 — August 31, 2004 Revision #3 — September 15, 2004 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2004-SR' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 14 OF THE CITY CODE ENTITLED, "MOTOR VEHICLES AND TRAFFIC', ARTICLE II, "STOPPING, STANDING AND PARKING", SECTION 14-27, "SAME -FIRE LANES AND FIRE ACCESS AREAS", INCREASING THE PENALTY FOR PARKING IN A FIRE LANE OR FIRE ACCESS AREA; DESIGNATING THE ADDITIONAL FEES COLLECTED TO BE DEDICATED TO FUNDING FIREFIGHTER TRAINING AND EDUCATION PURSUANT TO FLORIDA STATE STATUTES 5316.008(5)(b); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the fire lanes and fire access areas are established as fire safety zones and are used to provide access for emergency vehicles; and WHEREAS, Section 14-27 of the City Code provides for violation penalties for illegally parking in fire lanes and fire access areas; and WHEREAS, the existing fifty dollar ($50) fine has not been a deterrent to parking in the fire lanes; and Coding: Words in stFE164( through are deletions from existing law; Words in underscored type are additions. Ord. #2063 Page 2 August 10, 2004 Revision #1 — August 30, 2004 Revision #2 — August 31, 2004 Revision #3 — September 15, 2004 WHEREAS, increasing the penalty for parking in a fire lane or access area to one hundred dollars ($100.00) will be a stronger deterrent and facilitate emergency access; and WHEREAS, Florida State Statute permits increasing the fire lane fee as long as the fees are designated for a firefighter education program; and WHEREAS, Tamarac will designate the additional revenue collected for each violation of fire safety zones for firefighter education programs; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the fire access and fire lane sections of the City Code by increasing the penalty for illegal parking. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: That Chapter 14 of the Tamarac City Code, entitled, "Motor Vehicles and Traffic", Article II, "Stopping, Standing and Parking", Section 14-27, "Same -Fire Lanes and Fire Access Areas", is hereby amended as follows: Coding: Words in StRiek thFeugh are deletions from existing law; Words in underscored type are additions. (a) Violation. It shall be unlawful for any person to park a vehicle in or otherwise obstruct a fire lane or fire access area, except for the immediate temporary loading or unloading of the attended vehicle. (b) Penalty. Any person issued a citation for violating the provisions of this section shall be subject to a fine of fifty delleFS 0) one hundred_ dollars ($100.00) for each citation. SECTION 3: Designating the additional fees collected to be dedicated to funding firefighter training and education pursuant to Florida State Statutes, 5316.008(5)(b). SECTION 4: It is the intention of the City Commission and it is hereby ordained that the provisions of this Section shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 5: All Ordinances or parts of Ordinances, and all Resolutions and parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
