HomeMy WebLinkAboutCity of Tamarac Ordinance O-2004-038Temp Ord #2066 — November 18, 2004 Revision No. 1 — November 18, 2004 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2004-3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING PRIOR ZONING OF CERTAIN REAL ESTATE PROPERTY FROM A-1 (UTILITY DISTRICT) TO R-3 (LOW -DENSITY MULTI- FAMILY RESIDENTIAL DISTRICT), LANDS COMMONLY KNOWN AS A PARCEL OF LAND LYING IN SECTION 6, TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS: COMMENCE AT THE POINT OF INTERSECTION OF THE SOUTH RIGHT- OF-WAY LINE OF CANAL C-14 OF CENTRAL AND SOUTHERN FLORIDA FLOOD CONTROL DISTRICT AND THE WEST LINE OF SAID SECTION 6: THENCE EASTERLY ALONG THE SAID SOUTH RIGHT-OF-WAY LINE OF CANAL C-14, 1200 FEET TO A POINT; THENCE SOUTHERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE, 286 FEET TO A POINT OF BEGINNING OF THE DESCRIPTION; THENCE CONTINUE SOUTHERLY, ALONG THE LAST DESCRIBED LINE, 435 FEET TO A POINT; THENCE EASTERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE 435 FEET TO A POINT; THENCE WESTERLY, PERPENDICULAR TO THE LAST DESCRIBED LINE, 400 FEET TO THE POINT OF BEGINNING, LOCATED ON THE SOUTH SIDE OF SOUTHGATE BOULEVARD, NEAR SAWGRASS EXPRESSWAY (CASE NO. 21-Z- 04); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Temp Ord #2066 — November 18, 2004 Revision No. 1 — November 18, 2004 Page 2 WHEREAS, petitioner has requested that certain real estate property located at the south side of Southgate Boulevard near the Sawgrass Expressway be rezoned from A-1 (Utility District) to R-3 (Low -Density Multi -Family Residential District) to be consistent with the City's adopted Comprehensive Plan, adjoining properties, and to accommodate future development; and WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, public notice has been given of the time and place of the public hearing regarding the rezoning of the property described herein and said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and WHEREAS, the public hearing has been held on Case No. 21-Z-04 by the City Commission pursuant to the Charter and Florida State Statutes; and WHEREAS, on November 17, 2004, the Planning Board held a duly advertised Public Hearing and recommended approval of the rezoning; and WHEREAS, the Director of Community Development recommends approval of this rezoning; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems the rezoning to be consistent with the City of Tamarac Comprehensive Plan; and H Temp Ord #2066 — November 18, 2004 Revision No. 1 — November 18, 2004 Page 3 WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to rezone the property from A-1 (Utility District) to R-3 (Low -Density Multi -Family Residential District), lands commonly known as a Parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described as: commence at the Point of Intersection of the South right-of-way line of Canal C-14 of Central and Southern Florida Flood Control District and the West line of said Section 6: thence Easterly along the said South right-of-way line of Canal C-14, 1200 feet to a point; thence Southerly, perpendicular to the last described line, 286 feet to a Point of Beginning of the description; thence continue Southerly, along the last described line, 435 feet to a point; thence Easterly, perpendicular to the last described line 435 feet to a point; thence Westerly, perpendicular to the last described line, 400 feet to the Point of Beginning, located at the south side of Southgate Boulevard near the Sawgrass Expressway (Case No. 21-Z-04). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the lands commonly known as a Parcel of land lying in Temp Ord #2066 — November 18, 2004 Revision No. 1 — November 18, 2004 Page 4 Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described as: commence at the Point of Intersection of the South right-of-way line of Canal C-14 of Central and Southern Florida Flood Control District and the West line of said Section 6: thence Easterly along the said South right-of-way line of Canal C-14, 1200 feet to a point; thence Southerly, perpendicular to the last described line, 286 feet to a Point of Beginning of the description; thence continue Southerly, along the last described line, 435 feet to a point; thence Easterly, perpendicular to the last described line 435 feet to a point; thence Westerly, perpendicular to the last described line, 400 feet to the Point of Beginning, located at the south side of Southgate Boulevard near the Sawgrass Expressway (attached hereto as Exhibit "A") are hereby rezoned from A-1 (Utility District) to R-3 (Low -Density Multi -Family Residential District). SECTION 3: That the official zoning map of the City of Tamarac shall be changed to reflect such zoning designation upon the effective date of this Ordinance. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions, in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
