Ord. #2074 — December 10, 2004 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2005-01 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 24 ENTITLED, "ZONING", ARTICLE II "ADMINISTRATION", DIVISION 3 "PLANNING BOARD", SECTION 24- 61 "CREATED; MEMBERS" OF THE CITY OF TAMARAC CODE OF ORDINANCES TO AMEND THE MEMBERSHIP OF THE PLANNING BOARD TO PROVIDE FOR THE INCLUSION OF A REPRESENTATIVE OF THE SCHOOL BOARD AS A NON -VOTING MEMBER OF THE CITY'S PLANNING BOARD ACCORDING TO CHAPTER 163.3174, FLORIDA STATUTES, AND IN ACCORDANCE WITH THE INTERLOCAL AGREEMENT FOR PUBLIC SCHOOL FACILITY PLANNING BROWARD COUNTY, FLORIDA, BY APPOINTING A BROWARD COUNTY SCHOOL BOARD REPRESENTATIVE AS AN EX OFFICIO NON -VOTING MEMBER TO THE CITY OF TAMARAC PLANNING BOARD IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 163.3177 AND 1013.33, FLORIDA STATUTES (CASE NO. 4-Z-05); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of Ordinances of the City of Tamarac provides for the creation, existence and duties of the Planning Board; and WHEREAS, Chapter 163.3174, Florida Statutes, provides for the inclusion of a representative of the School Board as a non -voting member of the City's Planning Board; CODING: Words in s#rueak threugh type are deletions from existing law; Words in underscored type are additions. Ord. #2074 — December 10, 2004 Page 2 and WHEREAS, on April 28, 2003, the City Commission of the City of Tamarac authorized approval of an Interlocal Agreement for Public School Facility Planning Broward County, Florida regarding certain land planning issues, including the appointment of an ex officio member to the Planning Board in accordance with the provisions of Chapter 163.3177 and 1013.33, Florida Statutes; and WHEREAS, the Director of Community Development recommends approval of this ordinance amendment; and WHEREAS, the City Commission hereby desires to amend the membership Of the City's Planning Board to abide by the requirements of Chapter 163.3174, Florida Statutes, and in accordance with the Interlocal Agreement for Public School Facility Planning with the School Board; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be i rl the best interest of the citizens and residents of the City of Tamarac to amend Chapter 24 entitled, "Zoning", Article II "Administration", Division 3 "Planning Board", Section 74-61 "Created; Members" of the City of Tamarac Code of Ordinances to amend the membership of the Planning Board to provide for the inclusion of a representative of the School board as a non -voting member of the City's Planning Board according to Chapter 163.3174, Florida Statutes, and in accordance with the Interlocal Agreement for Public School Facility Planning Broward County, Florida, by appointing a Broward County School Board CODING: Words instruok pugh type are deletions from existing law; Words in underscored type are additions. 1 1 1 Temp. Ord. #2074 — December 10, 2004 Page 3 representative as an ex officio non -voting member to the City of Tamarac Planning Board in accordance with the provisions of Chapter 163.3177 and 1013.33, Florida Statutes, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That Chapter 24 of the Code of Ordinances of the City of Tamarac, Florida entitled, "Zoning", Article II "Administration", Division 3 "Planning Board", Section 24-61 "Created; members" is hereby amended to read as follows: Sec. 24-61. Created; members. (a) There is hereby created a planning board consisting of seven (7) members each of which shall serve a term of three (3) years; except that two (2) of the seven (7) members of the commission shall be appointed for a term of two (2) years and three (3) of the seven (7) members of the commission shall be appointed for a term of one (1) year, so that the term of the members can be staggered, and shall expire on April 15 of the appropriate year.. and an ex officio non -voting member designated by the School Board of Broward CODING: Words in stFUOlF tk►rsegh type are deletions from existing law; Words in underscored type are additions. The School use and zonina matters wh residential density. in all SECTION 3: It is the intention of the City Commission and it is h�reby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
