AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER
10 ENTITLED, "LAND DEVELOPMENT
REGULATIONS', ARTICLE V "IMPROVEMENTS",
DIVISION 1 "GENERALLY", SECTION 10-154
"ENGINEERING PLANS AND SPECIFICATIONS",
ADDING THE CITY ENGINEER TO PROVIDE FINAL
ENGINEERING PLAN REVIEW AND APPROVAL FOR
PUBLIC AND PRIVATE WATER AND WASTE WATER
IMPROVEMENTS; PROVIDING FOR CODIFICATION;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the final engineering plan review for all development projects within
the City are reviewed and approved by the City Engineer; and
WHEREAS, City Code Section 10-154 provides that all final engineering plans
for water and wastewater improvements be submitted only to the Director of Utilities for
review and approval; and
WHEREAS, certain sections of City Code need to be amended to allow for said
plan review either by the City Engineer or the Director of Utilities; and
WHEREAS, the proposed amendment to Section 10-154 of the City Code of
Ordinances will align the final engineering plan review process with current City
procedures and practices; and

WHEREAS, the Director of Public Works and the City Engineer recomlilend
approval of the proposed amendment to Chapter 10, Article V, Division 1,
154 of the City Code of Ordinances; and

WHEREAS, the City Commission of the City of Tamarac deems it to be irl the
best interests of the citizens and residents of the City of Tamarac to amend Chapte� 10,
"Land Development Regulations", Article V, "Improvements", Division 1, "Utilities",
Section 10-154 entitled, "Engineering Plans and Specifications" to provide for
and approval of final engineering plans for water and wastewater improvements b j the
City Engineer.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF HE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the
Ordinance upon adoption hereof.
SECTION 2: Chapter 10, "Land Development Regulations", Articl4 V,
"Improvements", Division 1, "Generally", Section 10-154, "Engineering Plans 'land
Specifications" of the City Code of Ordinances is hereby amended to read as follow
SECTION 10-154. Engineering Plans and Specifications.

(b) All final engineering plans for public and private water and wastewater
improvements, including but not limited to water distribution and sewage collection
systems, shall be submitted to the city engineer and/or director of utilities for review and
approval, prior to issuance of a building permit.
(c)(6) Fire flow and wastewater flow calculations in a form acceptable to the c
engineer and/or director of utilities.
SECTION 3: It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered or relettered and the word "Ordinance" may be changed
to "Section", "Article" or such other word or phrase in order to accomplish such intention.
SECTION 4: All Ordinances or parts of Ordinances and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 5: If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.

This Ordinance shall become effective immediately upon its
PASSED, FIRST READING THIS 9th day of February, 2005.
