Ord. #2097 -- September 21, 2005 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2005--)s3 ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE REZONING APPLICATION INITIATED BY THE CITY OF TAMARAC PROVIDING FOR REZONING FROM B-1 (NEIGHBORHOOD BUSINESS DISTRICT), B-2 (PLANNED COMMUNITY BUSINESS DISTRICT), B-3 (GENERAL BUSINESS DISTRICT), B-6 (BUSINESS DISTRICT) AND I-1 (INSTITUTIONAL DISTRICT) TO MXD (MIXED USE DISTRICT) PERTAINING TO THE APPROXIMATE 127.32 ACRE NW 57T"STREET CORRIDOR, MORE PARTICULARLY DESCRIBED BY EXHIBIT "A" AND GENERALLY LOCATED WEST OF NORTH UNIVERSITY DRIVE, EAST OF NW 94T" AVENUE, NORTH OF COMMERCIAL BOULEVARD (CASE NO. 19- Z-05); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, public notice has been given of the time and place of the public hearing regarding the rezoning of the property described herein and said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and WHEREAS, the public hearing has been held on Case No. 19-Z-05 by the City Temp. Ord. #2097 —September 21, 2005 Page 2 Commission pursuant to the Charter and Florida State Statutes; and WHEREAS, the City Commission of the City of Tamarac wishes to preserve the health, welfare and quality of life of its residents by promoting a vibrant social and economic center by encouraging a mixture of complementary mixed uses, to include housing, retail, office, commercial services, and recreational and civic uses; and WHEREAS, the City Commission and the City of Tamarac determines and finds to generate and stimulate economic growth within the City of Tamarac so as to improve the general welfare and safety of its citizens and residents so that the public purpose will be served with the adoption of the Rezoning application; and WHEREAS, on July 13, 2005, the City Commission of the City of Tamarac adopted the findings of the "57th Street/Main Street Study" documents (Case No. 11-MI-05); and WHEREAS, on July 13, 2005, the City Commission of the City of Tamarac adopted three (3) Ordinances (Ordinance Nos. 0-2005-12, 0-2005-13, and 0-2005-14), amending Chapter 24, "Zoning", to include the addition of definitions and illustrations to assist in the implementation of the Mixed Use Zoning District, repealing the City's Master Business List and establishing a new "Permitted Uses Master List" to establish new uses and a new zoning district referred to as the Mixed Use Zoning District, and creating district regulations for the newly created Mixed Use District (MXD); and WHEREAS, the City Commission of the City of Tamarac will allow the use of flexibility in the approximate 127.32 acre NW 57th Street Corridor, more particularly 1 Temp. Ord. #2097 — September 21, 2005 Page 3 described in Exhibit "A" (attached hereto), and generally located west of North University Drive, east of NW 94th Avenue, north of Commercial Boulevard Case No. 19-Z-05 in order to allow for a residential component; and WHEREAS, on September 21, 2005, the Planning Board held a duly advertised Public Hearing and recommended approval of the Rezoning; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac deems the Rezoning to be consistent and in compliance with the City of Tamarac Comprehensive Plan; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interests of the citizens and residents of the City of Tamarac to approve the rezoning application initiated by the City of Tamarac providing for rezoning from B-1 (Neighborhood Business District), B-2 (Planned Community Business District), B-3 (General Business District), B-6 (Business District) and I-1 (Institutional District) to MXD (Mixed Use District) pertaining to the approximate127.32 acre NW 57th Street Corridor, more particularly described by Exhibit "A" and generally located west of North University Drive, east of NW 94th Avenue, north of Commercial Boulevard. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Temp. Ord. #2097 — September 21, 2005 Page 4 SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the lands commonly known as the approximate 127.32 acres of the project known as NW 57th Street Corridor, more particularly described in Exhibit "A" and generally located west of North University Drive, east of NW 94th Avenue, north of Commercial Boulevard are hereby rezoned from B-1 (Neighborhood Business District), B-2 (Planned Community Business District), B-3 (General Business District), B-6 (Business District) and I-1 (Institutional District) to MXD (Mixed Use District). SECTION I That the Official zoning map of the City of Tamarac shall be changed to reflect such zoning, said changes to be made by the Director of Community Development, together with the effective date of this Ordinance. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions Temp. Ord. #2097 — September 21, 2005 Page 5 or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
