Ord. #2099 October 10, 2005 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2005-d,& AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 24, "ZONING", ARTICLE III, "DISTRICT REGULATIONS", BY DELETING DIVISION 11, "R-5 MOTEL DISTRICT', DIVISION 12, 7-1 TRAILER PARK DISTRICT", AND DIVISION 21, "A-5 AGRICULTURAL - EVACUATION DISTRICT" OF THE CITY OF TAMARAC CODE OF ORDINANCES IN THEIR ENTIRETY AS THE ZONING DESIGNATIONS HAVE NOT BEEN UTILIZED AND ARE NO LONGER RELEVANT TO DEVELOPMENT OCCURRING WITHIN THE CITY OF TAMARAC (CASE NO. 20-Z-05); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac determined that there is a need to amend Chapter 24, "Zoning", Article III, "District Regulations", by deleting the existing "R-5 Motel District", 7-1 Trailer Park District", and "A-5 Agricultural -Evacuation District" due to nonuse of the districts' regulations since inception of the City's Code of Ordinances in 1975; and WHEREAS, the City of Tamarac's current "R-5 Motel District", 7-1 Trailer Park District", and "A-5 Agricultural -Evacuation District" have become obsolete due to changing development trends associated with the City of Tamarac nearing build -out; and WHEREAS, it was determined that those regulations and specifications outlined in CODING: Words in stFUelF#FeUgq type are deletions from existing law; Words in underscored type are additions. Ord. #2099 October 10, 2005 Page 2 the zoning districts are no longer relevant to the City's current development trends, and permitted uses allowed in these districts are better served under other existing commercial, institutional, residential, mixed use and industrial zoning designations within the City's Code of Ordinances in order to accomplish development which the "R-5 Motel District", 7- 1 Trailer Park District", and "A-5 Agricultural -Evacuation District" would otherwise permit; F,W WHEREAS, the City of Tamarac's current commercial, institutional, residential, and mixed use zoning districts permit those uses and encompass regulations to better serve the uses and the development of those uses that are currently permitted within the "R-5 Motel District", 7-1 Trailer Park District", and "A-5 Agricultural -Evacuation District"; and WHEREAS, the City of Tamarac finds that there is a need to eliminate those existing zoning districts that are not currently utilized, nor have been utilized, in order to ensure consistency and quality of development throughout the City; and WHEREAS, the Director of Community Development recommends approval of this Ordinance Amendment; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 24, "Zoning", Article III, "District Regulations", by deleting Division 11, "R-5 Motel District", Division 12, "T-1 Trailer Park District", and Division 21, "A-5 Agricultural -Evacuation District" in their entirety as the zoning designations have not been utilized and are no longer CODING: Words in Neagh type are deletions from existing law; Words in underscored type are additions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. Ord. #2099 October 10, 2005 Page 14 SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
