ORDINANCE NO.2010- l 7
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA AMENDING ARTICLE III, "BOARDS,
COMMITTEES, COMMISSIONS" CHAPTERS, "BUILDINGS & BUILDING
REQUIREMENTS", ARTICLE IX, "PUBLIC ART PROGRAM," CHAPTER
15, "PARKS AND RECREATION", ARTICLE II, "ADMINISTRATION",
AND CHAPTER 24, "ZONING", ARTICLE 11, "ADMINISTRATION", OF
THE CITY'S CODE OF ORDINANCES TO PROVIDE FOR UNIFORM
NUMBERS OF REGULAR MEMBERS FOR CITY BOARDS; PROVIDING
FOR THE CONCLUSION OF EXISTING TERMS FOR SPECIFIC BOARD
MEMBERS; PROVIDING FOR UNIFORM MEETING REQUIREMENTS
FOR BOARDS; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission finds that it is prudent from an administrative
perspective to have the following City Boards consist of 5 regular members and no
alternates: Investment Advisory Committee, Parks and Recreation Board, Planning
Board, Public Art Committee, Public Information Committee, and Social Services Board;
and
WHEREAS, adoption of an ordinance to revise the number of regular members
for these Boards will continue the active role of City residents in City government; and
WHEREAS, due to the number of Boards and Committees, in order to insure the
efficient operation of the City's Boards and Committees, and in conjunction with
adopting uniform numbers of regular members, the City Commission finds that it is
necessary to adopt a uniform meeting requirement for the City's Boards and
Committees; and
WHEREAS, the adoption of this Ordinance has been reviewed by City
administration who recommend its adoption; and

WHEREAS, the City Commission finds that the adoption of this ordinance is in
the best interest of the public health, safety, and welfare of the citizens and residents of
the City of Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AS FOLLOWS:
SECTION 1. The foregoing recitals are hereby ratified and confirmed as being
true and correct and are hereby made a specific part of this Ordinance upon adoption
hereof.
SECTION 2. That Article III, "Boards, Committees, Commissions", of the City of
Tamarac Code of Ordinances, be, and the same is hereby amended to read as follows:
ARTICLE III. BOARDS, COMMITTEES, COMMISSIONS
DIVISION 1. GENERALLY
Sec. 2-58. Application process.

(h) For boards and committees with seven (7) members, the mayor shall appoint two
(2) regular members from the city at large. Each commissioner shall appoint one (1)
individual who meets the qualification requirements for the specific advisory board
and/or committee within their district to serve as a regular member. The seventh (71h)

() For boards and committees where the number of regular members is less than five
(5) and/or the regular members are to be representatives from a specific organization,
trade group, school, or other entity, the mayor and commissioners shall review the
applications for those member positions and provide the city manager, in writing, their
order of preference for the individuals to fill the respective member positions. The city
manager, or his designee, will review the rankings and provide a list of the
appointments in order of preference. The complete list of appointees will then be
presented to the city commission in the same manner as stated above.

DIVISION 5. INVESTMENT ADVISORY COMMITTEE
Sec.2-156. Creation.
There is created and established an investment advisory committee which shall consist
of fiveseven (5-7) members appointed by the city commission.
Sec. 2-158. Membership; compensation; chairman.
The members of the investment advisory committee shall be appointed by the city
commission ^����and serve at the pleasure of the city commission
without compensation. The chairman of the committee shall be appointed by the city
commission.

DIVISION 6. PUBLIC INFORMATION COMMITTEE*
Sec.2-176. Creation.
A public information committee is created as a permanent agency of the city and shall
consist of five (5) regular members appointed by the city
commission. , an

Sec. 2-177. Membership; compensation; chairman.
The regular and alternate —members of the public information committee shall be
appointed by the city commission on are -annual basisandserve at the pleasure of the
city commission without compensation. The chairman of the committee shall be
appointed by the city commission.
Sec. 2.178. Removal of members.
A regular member appointed by the city
commission serves at the pleasure of the city commission and shall be removed at any
time by a majority vote of the city commission.
Sec. 2-179. Resignation of members.
A resignation by a regular or altefflate publie information eerflrnittee member made
orally or in writing will be deemed accepted by the city commission when the regular or
alternate committee member announces his resignation to the committee, city manager
or city commission. The city commission need not take any formal action to accept the
resignation. Failure of a regular member to attend three (3) consecutive meetings
without being excused by the chairman shall be deemed a resignation.
DIVISION 7. SOCIAL SERVICES BOARD
Sec.2-201. Creation.
There is created and established a social services board which shall be a permanent
agency of the city and shall consist of five (5) regular members
mernbers-appointed by the city commission.
Sec. 2-202. Membership; compensation; chairman.
The members of the social services board shall be appointed by the city commission efr
an annual basis and serve at the pleasure of the city commission without compensation.
The chairman of the board shall be appointed by the city commission.

SECTION 3. That Chapter 15, "Parks and Recreation", Article II,
"Administration", Division 2, "Parks and Recreation Board" of the City of Tamarac Code
of Ordinances, be, and the same is hereby amended to read as follows:

DIVISION 2. PARKS AND RECREATION BOARD
Sec.15-41. Creation.
There is hereby created the parks and recreation board which shall consist of fiveseven
(57) regular members appointed by the city commission.
SECTION 4. That Chapter 5, "Buildings and Building Regulations", Article IX,
"Public Art Program", Section 5-205, "Public Art Committee", of the City of Tamarac
Code of Ordinances, be, and the same is hereby amended to read as follows:

Article IX Public Art Program
5-305. Public art committee.
(a) There is hereby established a committee to be known as the "public art
committee."
(1) Public art committee mission. The mission of the public art committee is to
expand cultural opportunities for residents and visitors and to enhance the appearance
of the city through the selection and integration of artwork in a public environment.
(2) Committee membership.
a. The public art committee consists of five (5) members, plus an

4. One (1) private citizen from the development community.
b. The city manager designates a city staff member to act as the city's
liaison with the board. The liaison will be responsible for budget
development and monitoring.
c. The committee shall elect a chairperson and vice -chairperson each
year.
(3) Membership terms.
a. The initial membership terms shall be staggered with three (3)
members having two-year terms and two (2) members having one-year
terms. initially, altefflates will have two year terms.
b. The staff liaison member's term is not limited.
C. Initial terms will be determined by drawing lots or other unbiased
method.
d. After initial terms, all future terms will be for two (2) years, with
staggered terminations.
e. Consecutive reappointments are permissible.
(4) Vacancies. Vacancies shall be handled in accordance with city policy.
SECTION 5. That Chapter 24, "Zoning", Article II, "Administration", Division 3,
"Planning Board" of the City of Tamarac Code of Ordinances, be, and the same is
hereby amended to read as follows:

Division 3 Planning Board
Sec. 24-61. Created; members.
(a) There is hereby created a planning board consisting of fivesevee-_(5-7) members
each of which shall serve a term of three (3) years; except that two (2) of the five.
(5-7) members of the commission shall be appointed for a term of two (2) years -end
three (3) of the seven (7) rnembeFS of th. . . . . .. . en shall be appointed fOF a term of
one (!) ear,_ so that the term of the members can be staggered, and shall expire on
April 15 of the appropriate year and an ex officio, non -voting member designated by the
school board of the county in accordance with F.S. ch. 163.3174, as may be amended
from time to time. The school board -appointed member may participate in all matters
related to land use and zoning matters which, if approved, would increase residential
density.

(be) Each member of the commission shall be a resident of the City of Tamarac. Any
interested citizen may be appointed to the commission, but those with experience or
interest in the following areas shall receive special consideration:
Architecture or Landscape architecture
The Law
Environmental Science
Real Estate Development of Sales
Urban Planning
Engineering
Neighborhood, Condominium or Homeowners Association Activist
SECTION 6. That Chapter 2, "Administration", Article III, "Boards, Committees,
Commissions", of the City's Code of Ordinances, shall be amended by repealing Sections
2-109, 2-159, 2-183, 2-204 in their entirety.
SECTION 7. That Chapter 2, "Administration", Article III, "Boards, Committees,
Commissions", of the City's Code of Ordinances shall be amended by enacting a new
Section 2-61, entitled "Meetings; Quorum; Procedure", to read as follows:

The City's Advisory Boards and Committees shall meet auarterly. or
on anas.._needed basis. Unless._ otherwiseprovided in the Code of

consist of a ,_majority of the membership of the respective Advisory
Board or Committee. The City's Adviso Boards and Committees
shall conduct theirmeetings pursuant to Robert's Rules of Order.

SECTION 8. The term of any current regular member of the following City Boards
shall expire upon the appointment of their successor by the City Commission: Insurance
Advisory Board, Investment Advisory Committee, Parks and Recreation Board,
Planning Board, Public Art Committee, Public Information Committee, and Social
Services Board.

SECTION 9. Upon the effective date of this Ordinance, the terms of the alternate
members of the following City Boards shall expire: Insurance Advisory Board,
Investment Advisory Committee, Parks and Recreation Board, Planning Board, Public
Art Committee, Public Information Committee, and Social Services Board.
SECTION 10. Conflicts. That all Ordinances or parts of Ordinances, Resolutions
or parts thereof in conflict herewith, be and the same are hereby repealed to the extent of
such conflict.
SECTION 11.Severability. Should any section, provision, paragraph, sentence,
clause of word of this Ordinance or portion hereof be held or declared by any court of
competent jurisdiction to be unconstitutional or invalid, in part or application, it shall be
considered as eliminated and shall not affect the validity of the remaining portions or
applications of this Ordinance.
SECTION 12. Effective Date. This Ordinance shall become effective upon
adoption.
