ORDINANCE NO. 2011- D1
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA AMENDING
ORDINANCE NO. 2010-14, ADOPTED ON JULY 14,
2010, BY SPECIFICALLY AMENDING THE PROCESS
FOR THE APPOINTMENT OF INDIVIDUALS TO SERVE
ON THE BOARD OF DIRECTORS OF THE
WOODLANDS COMMUNITY NEIGHBORHOOD
IMPROVEMENT DISTRICT TO ALLOW FOR THE
APPOINTMENT OF BOARD MEMBERS BY
RESOLUTION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on July 14, 2010, the City Commission of the City of Tamarac (the
"City") adopted Ordinance No. 2010-14 (the "Ordinance"), thereby creating the
Woodlands Community Neighborhood Improvement District in accordance with Section
163.506, F.S.; and
WHEREAS, the Ordinance expressly provided for the appointment of a Board of
Directors; and
WHEREAS, Section 163.506(3), F.S., provides that vacancies on the Board of
Directors shall be filled "in the same manner in which the initial appointments were
made"; and
WHEREAS, the City Commission seeks to amend the process for appointing
future members of the Board of Directors to allow for the appointment of the same by
resolution; and
WHEREAS, the City Commission finds that appointment members of the Board
of Directors for the Woodlands Community Neighborhood Improvement District by

resolution is in the best interests of the citizens and residents of the City.

NOW, THEREFORE, BE IT OR BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AS FOLLOWS:
SECTION 1. The foregoing recitals are hereby ratified and confirmed as being
true and correct and are hereby made a specific part of this Ordinance upon adoption
hereof.
SECTION 2. The City Commission of the City of Tamarac Florida hereby
amends Section 2 of Ordinance No. 2010-14 as follows:
5) The City Commission hereby designates a Board of Directors to
govern the District to be comprised of the persons set forth in Exhibit
"B" attached hereto and incorporated herein. Future appointments to
the Board of Directors may be made pursuant to a resolution, adopted
by a majority of the then -sitting City Commission.
SECTION 3. Conflicts. That all Ordinances or parts of Ordinances, Resolutions or
parts thereof in conflict herewith, be and the same are hereby repealed to the extent of
such conflict.
SECTION 4. SeverabilitY. Should any section, provision, paragraph, sentence,
clause of word of this Ordinance or portion hereof be held or declared by any court of
competent jurisdiction to be unconstitutional or invalid, in part or application, it shall be

considered as eliminated and shall not affect the validity of the remaining portions or
applications of this Ordinance.
SECTION 5. Effective Date. This Ordinance shall become effective upon
adoption.
