T 2 3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY 4 OF TAMARAC, FLORIDA AMENDING CHAPTER 5 OF THE 5 CITY'S CODE OF ORDINANCES, ENTITLED "BUILDINGS AND 6 BUILDING REGULATIONS". BY CREATING SECTION 5-35, TO 7 BE ENTITLED "EXPEDITED PERMITTING FOR QUALIFIED 8 BUSINESSES"; PROVIDING AN EXPEDITED PERMITTING 9 PROCESS FOR CERTAIN QUALIFIED NEW, EXPANDING OR 10 RELOCATING BUSINESSES; PROVIDING FOR 11 CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING 12 FOR SEVERABILTTY; AND PROVIDING FOR AN EFFECTIVE 13 DATE. 14 15 WHEREAS, the City Commission of the City of Tamarac deems it to be in the best 16 interests of its residents and businesses to provide an expedited permitted process for certain 17 qualified new, expanding or relocating businesses. 18 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 19 THE CITY OF TAMARAC, FLORIDA: 20 Section 1: The foregoing "WHEREAS" clause is hereby ratified and 21 confirmed as being true and correct and is hereby made a specific part of this Ordinance. 22 Section 2: The City of Tamarac, Florida hereby amends Chapter 5 of the City's 23 Code of Ordinances, entitled "Buildings and Building Regulations", by creating Section 5- 24 35, to be entitled "Expedited Permitting for Qualified Businesses", as follows: 25 Section 5-35_ _ Expedited Permitting for Qualified Businesses 26 A) Intent. The, intent of this section Is to provide an. expedited pertnittin 27 process f.br qualified new, expanding, or retocating businesses within the 28 City of Tarnarac. 29 30 (B) The City Manager, or his or her designee. shall make the final. 31 determination re =ardin.r whether a business is entitted to utilize the 32 enedited penmitting process, _ 11W accordance with the eligibility criteria. Tiit revicw comments 1.11 real time. 33 34 Section 3: It is the intention of the City Commission of the City Tamarac, that 35 the provisions of this Ordinance shall become and made a part of the Charter of the City of 36 Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re -lettered 37 and the word "Ordinance" may be changed to "Section," "Article" or other word or phrase in 38 order to accomplish such intention. Section 5: If any clause, section or other part or application of this ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect.
