The City Commission ("Commission") finds that the property is located in B-3 (General Business) Zoning District. Pursuant to Sections 24-434 and 24-548 of the City of Tamarac Code of Ordinances, and following the consideration of all testimony and evidence presented at the hearing on June 24, 2015, the City Commission further finds: A. The use is only allowed by Special Exception in the district where the property is located. B. Special Exception uses require consideration and approval by the City Commission. C. The use as proposed is compatible with the existing natural environment and community character of the properties within the immediate neighborhood. . D. The use as proposed is deemed desirable for public convenience, and not injurious or otherwise detrimental to the public health, safety, comfort and welfare. E. The use as proposed shall minimize adverse effects, including noise, light, dust or other potential nuisances, of the use on adjacent properties through the use of building orientation, setbacks, buffer, landscaping and other design criteria consistent with the City regulations. F. There are adequate parking areas consistent with the parking requirements of the Code, and the layout of the parking and vehicular use areas is convenient and conducive to safe operation consistent with the City standards to the greatest extent possible. G. There is adequate provisions for traffic movement, both vehicular and pedestrian internal for the use and adequate measures exist to provide ingress and egress to the proposed use, for both vehicles and pedestrian, in a manner that minimizes traffic congestion in the public streets. The part use results in significantly less traffic on local streets than would result from a development permitted by right. H. The land area is sufficient, appropriate and adequate for the proposed use and for any reasonably anticipated expansion thereof. I. The Public Record, including sworn and presented to the City Commission on reference and made a part hereof testimony and evidence established' before June 24, 2015, is hereby incorporated by Pursuant to the authority contained in Sections 24-448 and 24-552 of the City of Tamarac Code of Ordinances, Applicant's request for a Special Exception Use, as requested, and as set forth above for the location at South side of West Commercial Boulevard approximately one third of a mile to the east of State Road 7/441 is hereby, APPROVED upon the following conditions to which the Applicant has agreed. 1. This document shall be recorded in the public records of Broward County, Florida. 2. A Payment in Lieu of Taxes fee of Five Hundred Thousand Dollars ($500,000) and R No Cents payable to the City of Tamarac at issuance of first building permit. 3. Installation of a bus shelter consistent with the City' s approved design, to be installed at the Project entry (NW corner). 4. Provide additional onsite lighting and security cameras as might be reasonably requested and specified by the City of Tamarac. 5. Coordinate and provide Interlocal Agreement between the City of Tamarac and the City of Lauderdale Lakes, memorializing the fair and equitable distribution of property taxes generated from the Project.
