BOARD ORDER NO. 08 HEARING DATE: September 22, 2015 CASE NO. 6-B-15 Beall's Outlet 5837 North University Drive Tamarac, Florida Property Folio Identification Numbers: 494109370010 Property Legal Description: Parcel a of Midway Plaza as recorded in Plat Book 126, Page 14 of the public records of Broward County, Florida ORDER -APPROVING SIGN VARIANCE The Applicant, Steven Scott, Radiant Signs, designated agent for the property owner, DDRM Midway Plaza, LLC, (the "Applicant") filed an application with the City of Tamarac ("City") Department of Community Development for the following variance: SIGN VARIANCE FROM SECTION 18-51(B)(1)(B), TAMARAC CODE OF ORDINANCES, TO ALLOW THE MAXIMUM CHARACTER OR GRAPHIC HEIGHT AT SIXTY-SIX (66) INCHES WHERE ONLY THIRTY-EIGHT (38) INCH MAXIMUM CHARACTER AND GRAPHIC HEIGHT IS PERMITTED AND FROM SECTION 18- 51(13), TAMARAC CODE OF ORDINANCE, TO PERMIT THE INSTALLATION OF A WALL SIGN WITH AN UNOBSTRUCTED BORDER HEIGHT AND WIDTH EQUAL TO TWENTY-THREE (23) PERCENT OF THE SIGN'S LARGEST CHARACTER WHERE TWENTY-FIVE (25) PERCENT IS REQUIRED. Variance Order No. 6-B-15 Page 1 of 1 b d Temporary Board Order No. 08 Notice of the request for the Variance was given as required by law. The City Commission of the City of Tamarac ("the Commission") finds that the property located at 5837 North University Drive, Tamarac, Florida (the "Property") is located in the Mixed Use Zoning District. Pursuant to Section 18-42 of the City of Tamarac Code of Ordinances, and following consideration of all testimony and evidence presented at the hearing on September 22, 2015 the City Commission finds as follows: 1. That the Sign Variance is not contrary to the public interest. 2. That special conditions did not result from the actions of the applicant. 3. That literal enforcement of the provisions of the sign code regulations may result in an unnecessary hardship 4. The Public Record, including sworn testimony and evidence established before and presented to the City Commission on September 22, 2015, is hereby incorporated by reference and made a part hereof. Pursuant to the authority contained in Section 24-71 of the City of Tamarac Code of Ordinances, the Applicant's request for a Variance from Section 18-51(b)(1)(b); Tamarac Code of Ordinances, to allow the maximum character or graphic height at sixty-six (66) inches where only thirty-eight (38) inch maximum character and graphic height is permitted and from Section 18-51(13), Tamarac Code of Ordinance, to permit the installation of a wall sign with an unobstructed border height and width equal to twenty-three (23) percent of the sign's largest character where twenty-five (25) percent is required, as represented in the Application, is hereby GRANTED: 1. Pursuant to Section 2-370(a), of the City of Tamarac Code of Ordinances, the City Attorney has prepared this Order. 2. Pursuant to Section 2-370(g), of the City of Tamarac's Code of Ordinances, this Order shall be recorded in the public records of Broward County, Florida.
