BOARD ORDER APPROVING VARIANCE
Dunay, Miskel & Backman LLP designated agent for the property owner, Sunshine
MZL, LLC, is requesting approval for two sign variances from Sections 18-25(19) and 18-
51(19)a, Tamarac Code of Ordinances, to allow two (2) pole signs, one located along
,- Commercial Boulevard and the other along U.S. Highway 441.
Variance Request 1: Section 18-25(19) & 18-51(19)a., Code of Ordinances:
1. Variance from Section 18-25(19) to allow for a pole sign, where pole signs are prohibited.
2. Variance from the Section 18-51(19)a., dimensional requirements, to allow (1) a maximum
sign height of eighteen feet (18') where a maximum height of eight feet (8') is permitted; and
(2) a maximum sign area of one hundred twenty (120) square feet where a maximum sign area of

seventy-two (72) square feet is permitted.
Variance Request 2: Section 18-25(19) & 18-51(19)a., Code of Ordinances:
1. Variance from Section 18-25(19) to allow for a pole sign, where pole signs are prohibited.
2. Variance from the Section 18-51(19)a., dimensional requirements, to allow (1) a maximum
letter height of twenty-four inches (24") where a maximum letter height of eighteen inches (18")
is permitted; (2) a maximum sign height of twenty-one feet (2l') where a maximum height of
eight feet (8') is permitted; and (3) a maximum sign area of one hundred ninety-five (195)
square feet where a maximum sign area of seventy-two (72) square feet is permitted.
Notice of the request for the Variance was given as required by law. The City
Commission of Tamarac ("Commission") has identified that the properties located within the
existing Publix at Sunshine Plaza Shopping Center, Tamarac, Florida (the "Properties") are
located in the B-2, Planned Community Buisiness District, and following consideration of all
testimony and evidence presented at the hearing on May 24, 2017, the Commission finds as
follows:
1. Sign Variances are not contrary to the public interest.
2. Special conditions did not result from the actions of the applicant.
3. Literal enforcement of the provisions of the sign code regulations may
result in an unnecessary hardship.
4. The Public Record, including sworn testimony and evidence established
before and presented to the City Commission on May 24, 2017 is hereby incorporated by
reference and made a part hereof.
Pursuant to the authority contained in Sections 18-42 and 2-367 of the City of Tamarac Code of
Ordinances, the Applicants' request for Variance approval as outlined is hereby GRANTED.
