R-2019 Lf 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PURCHASE OF TWO (2) MOBILE GENERATORS FROM GENERAC MOBILE PRODUCTS UTILIZING THE UNITED STATES GENERAL SERVICES ADMINISTRATION CONTRACT # GS-07F-0211 M; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE SAID GENERATORS UTILIZING GSA CONTRACT #GS-07F-0211M IN AN AMOUNT NOT TO EXCEED $84,629.74; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $84,629.74 FROM THE APPROPRIATE ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Public Services operates and maintains eighty-six (86) wastewater pump stations throughout the City; and WHEREAS, these stations operate using electrical services provided by Florida Power & Light; and, while electrical service is relatively reliable, failures occur which require the use of an alternate source, such as mobile generator; and WHEREAS, the City of Tamarac is vulnerable to power outages, in particular during the hurricane season, which requires the ready availability of emergency power to ensure the wastewater collection system is functioning; and WHEREAS, funds were appropriated in the Adopted Fiscal Year 2019 Budget for two (2) mobile generators to provide emergency power to lift stations; and WHEREAS, the timely replacement of Public Services Equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject Temp. Reso. #13239 June 12, 2019 Page 2 of 5 of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing equipment; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase replacement equipment as identified in "Exhibit 1", utilizing a current agreement available for cooperative purchase through the United States General Services Administration Contract GS-07F-0211 M Price List, and detailed quotation are attached hereto as "Exhibit 2"; copies of "Exhibit 1" and "Exhibit" 2 are hereto attached, and the Terms and Conditions for GSA GS-07F-0211M are incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, funds in the amount of $84,629.74 exist in the FY 2019 Adopted Budget and are available in the Utilities Fund; and WHEREAS, it is in the best interest of the City to authorize the appropriate City officials to select, approve, and award the most cost-effective procurement method utilizing competitive procurement methods and current agreements available for cooperative purchase at the time of purchase including, but not limited to, the agreement awarded by the United States General Services Administration Contract for the purchase of mobile generators at a cost not to exceed $84,629.74 and Temp. Reso. #13239 June 12, 2019 Page 3 of 5 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that the appropriate City Officials be authorized to select, approve and award the cost-effective choice for replacement equipment as identified in "Exhibit 1" be purchased utilizing a competitive procurement method and current agreement available for cooperative purchase, including but not limited to, the Agreement awarded by the United States General Services Administration Contract GS-07F-0211 M for the replacement of mobile generators at a cost not to exceed $84,629.74 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission of the City of Tamarac HEREBY authorizes the purchase of two (2) Mobile Generators utilizing competitive procurement methods and current agreements available or cooperative purchase, at the time of purchase, including, the Agreement awarded by the United States General Services Administration Contract authorizing an expenditure in an amount not to exceed $84,629.74 from the appropriate account for said equipment. The appropriate City Officials are further authorized to execute all appropriate agreements and do all things necessary to effectuate this Resolution. Temp Reso. #13239 June 12, 2019 Page 4 of 5 SECTION 3: Funds totaling $84,629.74 were appropriated in the Adopted Fiscal Year 2019 Budget for the purchase of Mobile Generators as identified in "Exhibit 1", attached hereto. SECTION 4: An expenditure in the amount of $84,629.74 is HEREBY authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
