PUBLIC PARTICIPATION - Any member of the public may speak to any issue that is not agendized for public hearing at this meeting. Speakers will be limited to three minutes during this item and at public hearings. There will be a thirty (30) minute aggregate time limit for this item, and speakers are encouraged to sign up in advance with the City Clerk prior to their participation. When an issue has been designated as quasi-judicial, public remarks shall only be heard during a quasi-judicial hearing that has been properly noticed for that matter. ANNOUNCEMENT OF TIME ALLOCATIONS -MOTIONS TO TABLE - The Chair at this time will announce those items that have been given a specific time to be heard, and will entertain motions from the Commission members to table those items that require research. The Commission may agendize by majority consent matters of an urgent nature which have come to the Commission's attention after publication. CONSENT AGENDA 6. Motion to adopt items 6(a) through 6(v). Items listed under Consent Agenda are viewed to be routine and the recommendation will be enacted by ONE MOTION in the form listed below. If discussion is desired, then, in accordance with Resolution 2003-15, Sec. 4.5, the item(s) will be removed from the Consent Agenda and will be considered separately. a. APPROVE the minutes of the June 22, 2005 Regular City Commission meeting. b. APPROVE the minutes of the June 22, 2005 Special City Commission meeting. C. REJECTING BID —FIRE STATION NO. 41 ROOF REPLACEMENT: (TR10750) Rejecting bid under Bid No. 05-14B for the Fire Station No. 41 roof replacement. d. ACCEPTING THE STATE HOUSING INITIATIVES PARTNERSHIP SHIP PROGRAM BUDGET: (TR10752) Accepting the State of Florida's State Housing Initiatives Partnership (SHIP) Program Budget in the amount of $422,978 by accepting the Fiscal Year 2005-2006 allocation of the program funds to be utilized according to the City's Local Housing Assistance Plan and Housing Delivery Goals Chart; appropriating said funds, during the next quarterly budget amendment (Case No. 9-MI-05). BLANKET PUBLIC SAFETY INGRESS/EGRESS EASEMENT—SANTA MONICA TOWNHOMES PROJECT: (TR10739) Executing a Blanket Public Safety Ingress/Egress Easement with Santa Monica Townhomes, Inc., for the Santa Monica Townhomes Project, located on Southgate Boulevard east of Sanibel Drive, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County. f. BLANKET PUBLIC SAFETY INGRESS/EGRESS EASEMENT —WOODLAND TOWNHOMES: (TR10742) Executing a Blanket Public Safety Ingress/Egress Easement with Woodland Townhomes, Inc., for the Woodland Townhomes Project, located on 44t" Street West of Rock Island Road, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County. g. BLANKET PUBLIC SAFETY INGRESS/EGRESS EASEMENT—CHEDDAR'S CASUAL CAFE PROJECT: (TR10746) Executing a Blanket Public Safety Ingress/Egress Easement with 7951 Commercial Blvd. LLC, for the Cheddar's Casual Cafe Project, located at 7951 W Commercial Blvd., to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County. h. PERFORMING ARTS FEASIBILITY STUDY: (TR10753) Adopting the findings of the "Performing Arts Feasibility Study" document (Case No. 10-MI-05). AMENDING TERMS OF EMPLOYMENT: (TR10735) Amending the terms of employment of City Manager Jeffrey L. Miller, as set forth in Resolution No. R- 99-226; as amended by Resolution Nos. R-2000-91, R-2001-123, R-2002-116, R-2003-90 and R-2004-72. BLANKET PUBLIC SAFETY INGRESS/EGRESS EASEMENT —UNIVERSITY HOSPITAL MEDICAL OFFICE BUILDING PROJECT: (TR10729) Executing a Blanket Public Safety Ingress/Egress Easement with University Hospital, Ltd, for the University Hospital Medical Office Building Project, located at 7225 North University Drive, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County. WATER AND SEWER DEVELOPER'S AGREEMENT—CHEDDAR'S CASUAL CAFE PROJECT: (TR10748) Executing a Water and Sewer Developer's Agreement with 7951 Commercial Boulevard LLC, for the Cheddar's Casual Cafe Project, located at 7951 W Commercial Blvd, requiring 8 ERC's for water and 9 ERC's for sewer; requiring the payment of $27,400.00 in CIAC fees; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS): (TR10749) Adopting the National Incident Management System (NIMS) per Homeland Security Presidential Directive HSPD-5 to provide for domestic incident management. M. 57T" STREET/MAIN STREET STUDY: (TR10754) Adopting the findings of the "57 Street/Main Street Study" document (Case No. 11-MI-05). n. AGREEMENT FOR TRAFFIC CONTROL AND ENFORCEMENT —SPYGLASS CONDOMINIUM, INC.: (TR10755) Executing an agreement with Spyglass Condominium, Inc., for the City of Tamarac through the Broward County Sheriff's Office to exercise jurisdictional authority for traffic control and enforcement within the property of the Spyglass Condominium, Inc. o. GRANTING PERPETUAL EASEMENT TO FPL, BELLSOUTH, AND COMCAST—CAPORELLA AQUATIC CENTER: (TR10750) Granting a perpetual public utility easement to Florida Power and Light, Bellsouth, and Comcast for the installation of underground utility facilities through the Caporella Aquatic Center project located at 9301 NW 58t" Street; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. P. WATER AND SEWER DEVELOPER'S AGREEMENT — WASHINGTON MUTUAL PLAZA PROJECT: (TR10723) Executing a Water and Sewer Developer's Agreement with Boca Warehousing, Inc., for the Washington Mutual Plaza Project, located at 5900 University Drive, requiring 20 ERC's for water and 17.5 ERC's for sewer; requiring the payment of $59,500.00 in CIAC fees; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. q. WATER AND SEWER DEVELOPER'S AGREEMENT — SANTA MONICA TOWNHOMES PROJECT: (TR10743) Executing a Water and Sewer Developer's Agreement with Santa Monica Townhomes, Inc., for the Santa Monica Townhomes Project, located on Southgate Boulevard east of Sanibel Drive, requiring 45 ERC's for water and 45 ERC's for sewer; requiring the payment of $144,000.00 in CIAC fees; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. WATER AND SEWER DEVELOPER'S AGREEMENT — WOODLAND TOWNHOMES PROJECT: (TR10744) Executing a Water and Sewer Developer's Agreement with Woodland Townhomes, Inc., for the Woodland Townhomes Project, located on 44t" Street West of Rock Island Road, requiring 30 ERC's for water and 30 ERC's for sewer; requiring the payment of $96,000.00 in CIAC fees; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. S. BID AWARD AND AGREEMENT FOR WOODLANDS WATER MAIN PROJECT — 44TH STREET AND QUEEN PALM LANE: (TR10758) Awarding Bid No. 05-11 B to Man Con, Inc., and executing an agreement between the City of Tamarac and Man Con, Inc., for an amount of $84,243.80 for the Woodlands Water Main Project - 44th Street and Queen Palm Lane; approving funding for this project from the appropriate utilities operational account; authorizing the appropriate City officials to administer the contract. t. ESTABLISHING ASSESSMENT RATE FOR FIRE RESCUE ASSESSMENTS FOR FY 2006: (TR10757) Relating to the provision of fire rescue services, facilities and programs in the City of Tamarac, Florida; establishing the estimated assessment rate for fire rescue assessments for the fiscal year beginning October 1, 2005; directing the preparation of an assessment roll; authorizing a public hearing and directing the provision of notice thereof. U. PROPOSED MILLAGE RATE AND SETTING PUBLIC HEARINGS: (TR10756) Authorizing the City Manager to send a proposed millage rate of 6.2499 mills to the property appraiser for Fiscal Year 2006 and setting September 14, 2005 at 6:30 p.m. at the Tamarac Commission Chambers, 7525 NW 88th Avenue, Tamarac, Florida as the date, time and place for the first public budget hearing; setting September 21, 2005 at 5:15 p.m. at the Tamarac Commission Chambers, 7525 NW 88th Avenue, Tamarac, Florida as the date, time, and place for the second public budget hearing. V. SURPLUS EQUIPMENT AND MATERIAL: (TR10751) Declaring certain equipment and material as surplus and directing that equipment be disposed via sale through established Internet markets to be selected; placing all proceeds into the appropriate fund from which the assets were originally purchased. ADOPTING CITY OF TAMARAC CONSOLIDATED PLAN: (TR10717) Motion to approve Resolution adopting the City of Tamarac Consolidated Plan; authorizing the appropriate City officials to submit said consolidated plan program funds for HUD's Fiscal Year 2005-2010; together with the Fiscal Year 2005 (City's Sixth Program Year) Annual Action Plan to the U.S. Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG); (Case No. 7-MI-05). ORDINANCES - SECOND READINGS 8. AMENDING CHAPTER 24 OF THE TAMARAC CODE — ADDITION OF DEFINITIONS AND ILLUSTRATIONS TO ASSIST IN IMPLEMENTATION OF MIXED USE ZONING DISTRICT: (T02083) Motion to adopt Ordinance on second reading amending Chapter 24, "Zoning", Article I "In General", Section 24-1, "Definitions" of the City of Tamarac Code of Ordinances through the addition of definitions and illustrations to assist in the implementation of the Mixed Use Zoning District (Case No. 12-Z-05); providing for codification. APPROVED ON FIRST READING JUNE 22, 2005 9. AMENDING CHAPTER 24 OF THE TAMARAC CODE — CREATING A NEW SECTION 24-434, "PERMITTEDLIST": (T02084) Motion to adopt USES MASTER ,,. adopt Ordinance on second read ing amending Chapter 24, "Zoning", Article III, "District Regulations", Division 19, "Business and Commercial Uses Master List", Section 24-431(b)(c)(d), "Intent and Application", Repealing Section 24-434, "Business and Commercial Uses Master List" of the City of Tamarac Code of Ordinances in its entirety and creating a new Section 24-434, "Permitted Uses Master List", establishing new uses and a new zoning district referred to as the Mixed Use Zoning District (Case No. 9-Z-05); providing for codification. APPROVED ON FIRST READING JUNE 22, 2005 10. AMENDING CHAPTER 24 OF THE TAMARAC CODE — CREATING DIVISION 25, "MXD MIXED .USE DISTRICT": (T02085) Motion to adopt Ordinance on second reading a- mending Chapter 24 entitled "Zoning", Article III, "District Regulations", of the City of Tamarac Code of Ordinances by creating Division 25, "MXD Mixed Use District", providing for the regulation of redevelopment revitalization and new construction within the Mixed Use District to include the following sections: 24-535, "Purpose and Intent", 24-536, "Mixed -Use Corridor Designation", 24-537, "Permitted Uses", 24-538, "Property Development Regulations", 24-539, "Development Intensity", and 24-540, "Special Regulations", and to provide additional development requirements and provisions for Mixed Use zoned properties (Case No. 14-Z-05); providing for codification. In the event this agenda must be revised, such revised copies will be available to the public at the City Commission meeting.
