ROLL CALL: PLEDGE OF ALLEGIANCE: Mayor Joe Schreiber INTRODUCTION 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by Mayor Schreiber proclaiming September as National Prostate Cancer Awareness Month. b. Presentation of the Florence Goldmann Award to the City of Tamarac by the Florida Commission on Aging (FCOA). C. Presentation by Mayor Schreiber of a proclamation commending Mitchell S. PUBLIC PARTICIPATION - Any member of the public may speak to any issue that is not agendized for public hearing at this meeting. Speakers will be limited to three minutes during this item and at public hearings. There will be a thirty (30) minute aggregate time limit for this item, and speakers are encouraged to sign up in advance with the City Clerk prior to their participation. When an issue has been designated as quasi-judicial, public remarks shall only be heard during a quasi-judicial hearing that has been properly noticed for that matter. ANNOUNCEMENT OF TIME ALLOCATIONS -MOTIONS TO TABLE - The Chair at this time will announce those items that have been given a specific time to be heard, and will entertain motions from the Commission members to table those items that require research. The Commission may agendize by majority consent matters of an urgent nature that have come to the Commission's attention after publication. CONSENT AGENDA 6. Motion to adopt items 6(a) through 6(n). Items listed under Consent Agenda are viewed to be routine and the recommendation will be enacted by ONE MOTION in the form listed below. If discussion is desired, then, in accordance with Resolution 2003-15, Sec. 4.5, the item(s) will be removed from the Consent Agenda and will be considered separately. a. APPROVE the minutes of the August 24, 2005 Regular City Commission meeting. b. APPROVE the minutes of the September 6, 2005 Special City Commission meeting. C. RENEWAL OF AGREEMENT — CITYWIDE MAILING SERVICES WITH POSTAL CENTER INTERNATIONAL. INC.: (TR10781) Renewing the agreement with Postal Center International, Inc. for city-wide mailing services, utilizing Southeast Florida Governmental Purchasing Cooperative Group Contract No. 582-8053 effective October 5, 2005 through October 4, 2008. d. BLANKET PUBLIC SAFETY INGRESS/EGRESS EASEMENT — PROGRESSIVE INSURANCE SERVICE CENTER PROJECT: (TR10786) Executing a Blanket Public Safety Ingress/Egress Easement with Progressive Casualty Insurance Company, for the Progressive Insurance Service Center Project, located at 3710 West Commercial Boulevard, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County. BILL OF SALE ABSOLUTE — SAWGRASS INFINITI PROJECT: (TR10790) Accepting a Bill of Sale Absolute from T.T. of Water Distribution and Sewage Collection System Sawgrass Infiniti, located at 5801 Madison authorizing and directing the City Clerk to recor records of Broward County. Lighthouse Point, Inc., for the Improvements installed for the Avenue, for City ownership; d said document in the public INSURANCE RENEWAL — PROPERTY, GENERAL LIA BILITY, AUTOMOBILE LIABILITY, AUTOMOBILE PHYSICAL DAMAGE, A_ND WORKERS' COMPENSATION COVERAGE: (TR10791) Renewing property, general liability, automobile liability, automobile physical damage, and workers' compensation lines of coverage with the Florida Municipal Insurance Trust (FMIT) for a one (1) year period beginning October 1, 2005 at a cost of $1,115,341 and payment of any increase resulting from the annual premium audit. g. BILL OF SALE ABSOLUTE — UNIVERSITY LANDINGS PROJECT: (TR10795) Accepting a Bill of Sale Absolute from Prestige Homes of Tamarac, Inc., for the Water Distribution and Sewage Collection System Improvements installed for the University Landings Project, located at NW 64t" Street & University Drive, for City ownership; authorizing and directing the City Clerk to record said document in the public records of Broward County. h. INTERLOCAL AGREEMENT — EMERGENCY/NON GUARANTEED SUPPLEMENTAL SUPPORT: (TR10775) Executing the Interlocal Agreement for Emergency/Non Guaranteed Supplemental Support between Broward County and the City of Tamarac for inspection and plan review services to be performed by the Broward County Building Code Services Division in the event there is a staff shortage at a rate of Fifty Four Dollars and Five Cents ($54.05) per hour for Building Code Inspector, Fifty Seven Dollars and Twenty -Nine Cents ($57.29) per hour for Building Official Services, including annual increase of 5% effective October 1, 2006 and overtime upon approval by the city at 1-1/2 times the hourly rate; for a two year period commencing October 1, 2005. BUILDING DEPARTMENT PERMIT FEES: (TR10770) Amending the Building and Code Compliance Department schedule of permit fees. INTERLOCAL AGREEMENT — HEARINGS BY BROWARD COUNTY MINIMUM HOUSING/UNSAFE STRUCTURES BOARD: (TR10774) Executing an Interlocal Agreement between Broward County and the City of Tamarac providing for hearings by the Broward County Minimum Housing/Unsafe Structures Board at a rate of Fifty -Four Dollars and Five Cents ($54.05) per hour for the Code Enforcement Officer and Twenty Eight Dollars and Thirty -Eight Cents ($28.38) per hour for clerical support, including annual increase of 5% effective October 1, 2006 and overtime upon approval by the City at 1-1/2 times the hourly rate, with a maximum case cost of Three Hundred Dollars ($300.00) per noticed case; unless written authorization from the City has been received, for a period through September 30, 2007. TAMARAC WATER AND SEWER UTILITY EASEMENT — SAWGRASS INFINITI PROJECT: (TR10789) Executing a "Tamarac Water and Sewer Utility Easement" with T.T. of Lighthouse Point, Inc., for the Sawgrass Infiniti Project, located at 5801 Madison Avenue, to allow legal access by City Utility Personnel for installing, maintaining, and operating the Water Distribution and Sewage Collection System Improvements; authorizing and directing the City Clerk to record said document in the public records of Broward County. Book, P.A., for Lobbying Services extending the agreement through September 10, 2006 at a cost not to exceed $60,000. AMENDING CHAPTER 2 OF THE TAMARAC CODE — FINANCE DEPARTMENT: (T02089) Motion to adopt Ordinance on second reading amending Chapter 2, Administration, Article IV., Departments, Division 1., Generally, Section 2-235(2), establishment of certain departments and offices of the Tamarac City Code, changing Finance Department to Financial Services Department; providing for codification. APPROVED ON FIRST READING AUGUST 24, 2005 9, AMENDING CHAPTER 22 OF THE TAMARAC CODE — STORMWATER FEES: (T02090) Motion to adopt Ordinance on second reading amending Chapter 22 entitled, "Utilities", Article VI, °Stormwater Management Utility", Section 22-254, "Schedule of rates", adding the requirement for automatic annual adjustments to the stormwater management utility fee pursuant to the U.S. Consumer Price Index for the period; providing for codification. APPROVED ON FIRST READING AUGUST 24, 2006 10. AMENDING CHAPTER 13 OF THE TAMARAC CODE — MISCELLANEOUS OFFENSES: (T02093) Motion to adopt Ordinance on second reading amending the City of Tamarac Code of Ordinances by specifically amending Chapter 13, entitled, "Miscellaneous offenses," to create section 13-20, entitled "Sex offender residency prohibition;" providing for findings and intent; enacting section 13-21 entitled "Definitions;" enacting section 13-22, entitled "Sexual offender and sexual predator residence prohibition; penalties; exceptions," providing for a prohibition for sexual offenders and sexual predators convicted of crimes under certain Florida statutes from living within 2500 feet of specified locations within the City of Tamarac; enacting section 13-23, entitled "Property owners prohibited from renting real property to certain sexual offenders and sexual predators; penalties," prohibiting owners of real property from renting or leasing any place, structure, or part thereof, trailer or other conveyance located within 2500 feet of specified locations within the City of Tamarac to sexual offenders and sexual predators convicted of crimes under certain Florida statutes; providing for codification. AMENDING PRIOR ZONING — PARCEL "R" OF THE "KINGS POINT REPL_AT", AXIA KINGS POINT ROCKFORD PARCEL: (T02094) Motion to adopt Ordinance on first reading amending prior zoning of certain real estate property Rockford Parcel (aka: Kings Point Rockford Parcel) from R-3 (Low - Density Multi -Family Residential District) to S-1 (Recreational District), lands commonly known as Parcel "R" of the "Kings Point Replat", according to the Plat thereof as recorded in Plat Book 156, Page 13 of the Public Records of Broward County, Florida, located northeast of the Tamarac Sports Complex at the northeast intersection of Nob Hill Road and NW 77t" Street (Case No. 17-Z-05); providing for amendment of the official zoning map to reflect such change. 12. PARKING WAIVER — 7171 BUILDING: (TR10784) Motion to approve Resolution granting a Parking Waiver of thirty-six (36) parking spaces to reduce the number of required parking spaces from two -hundred twenty-four (224) to one -hundred eighty-eight (188) parking spaces for the 7171 Building, located at 7171 North University Drive, specifically Parcel "A" and "B" of the "Melaur Medical Plaza" Plat, according to the Plat thereof as recorded in Plat Book 146, Page 50 of the Public Records of Broward County, Florida (Case No. 5-Z-05); providing for conditions of approval. In the event this agenda must be revised, such revised copies will be available to the public at the City Commission meeting.
