CITY COMMISSION MEETING
WEDNESDAY, FEBRUARY 28, 2018
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 9:10 a.m. on Wednesday, February 28, 2018, in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Marlon
Bolton, Commissioner Julie Fishman and Commissioner Debra Placko were in attendance.
Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Commissioner Bolton led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of a check by the Mayor, City Commission and Employees of the City of
Tamarac, in the amount of $34,000 to the United Way of Broward County, representing the
City of Tamarac's 2017 Employee Campaign total. Accepting on behalf of the United Way
Kathryn Holcomb (Requested by Human Resources Director Lerenzo Calhoun and Parks &
Recreation Director Greg Warner)
b. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of March
2018 as "Procurement Month". (Requested by Purchasing/Contracts Manager Keith Glatz)
c. Presentation by Mayor Harry Dressler of Employee Service Awards-
5 - Year Awards: Alaina Gordon, Administrative Coordinator, Community Development;
William Wareham, Structural Inspector Plans Examiner, Building; Robert Bauman,

2. CITY COMMISSION REPORTS:
a. Commissioner Bolton: Commissioner Bolton thanked the Commission for supporting him at
the last meeting when we recognized African American achievers and Black History Month.
Commissioner Bolton said he attended the vigil of the Tamarac Swim Team member that was
killed in the shooting at Stoneman Douglas High School and said he is circulating a list of
counselors for the survivors and their families. Commissioner Bolton reported that he
attended the Mainlands 3 & 4 HOA meeting and is glad to see that the residents are
becoming more engaged in the Community. Commissioner Bolton said he has been

contacted by residents of Meadow Parc and Central Parc about their high tax bills and asked
City Manager Cernech to look into their concerns. Commissioner Bolton said he can be

b. Vice Mayor Gomez: Vice Mayor Gomez said she loves to see Tamarac employees here
paying tribute the other employees being recognized for their years of service. Vice Mayor
Gomez spoke of the tragedy at Stoneman Douglas High School and said she attended
numerous vigils which were very touching. Vice Mayor Gomez talked about Tamarac
employees who responded to Stoneman Douglas High School from Tamarac Fire Rescue,
BSO, Parks & Recreation and Public Services. Vice Mayor Gomez said she attended the
Millennium Collegiate Academy Career Day, Challenger Elementary Art Club; Commission
Quarterly Update meeting on February 21 st; the 72"d West Apartments grand opening; the
Kings Point African American Black History month celebration; the Concert in the Park and
the Public Hearing regarding Bus Fares. Vice Mayor Gomez asked the HOA's to contact the
City when changes in their Boards occur so that we have current information to contact them
should the need arise.
c. Commissioner Fishman: Commissioner Fishman spoke about the tragedy at Stoneman
Douglas High School. Commissioner Fishman attended the Commission Quarterly Update
Meeting where she was able to share information an Early Childhood Education Initiative; the
CNN Town Hall meeting for the victims and survivors of the Stoneman Douglas shooting, the
Kings Point African American Black History Month Celebration; the Concert in the Park and
the Broward Veterans Coalition meeting.
d. Commissioner Placko: Commissioner Placko said she attended the Commission Quarterly
Update meeting and the Public Art Committee meeting where they are looking at ways to
better showcase all the art work in Tamarac. Commissioner Placko said she also attended
the CNN Town Hall meeting where the young men and women that spoke were very proud,
intelligent, poised and commented that the future will be in good hands with this generation.
Commissioner Placko said the ADRC is accepting applications for their Senior Hall of Fame
until March 6th. People must live in Broward County, and have at least 5 years of voluntary
service and if you want to nominate someone you can contact her or go online.
Commissioner Placko reported that she too attended several vigils for the victims of the
Stoneman Douglas shooting and thanked Parks & Recreation Director Warner and his staff
for putting on the vigil for the Tamarac Swim Team member on such short notice.
e. Mayor Dressler: Mayor Dressler commented that the loss of a child is incomprehensible
and should not happen. Mayor Dressler briefly talked about his grandchildren.
3. CITY ATTORNEY REPORT: City Attorney Goren said Broward League of Cities President
Dan Daley has called for a special meeting for City Mayors and Attorneys tomorrow morning,
March 1, 2018, at the Lauderdale Lakes Education Center at 10:30 a.m., 3580 W. Oakland
Park Blvd., 2"d Floor, Lauderdale Lakes, regarding firearm issues and filing a lawsuit
challenging the constitutionality of Section 790.33 F.S. President Daley is asking other cities
to join in the litigation and has contacted an anti -gun violence group "Every Town" to discuss
their potential offering to assist, pro bono, with the litigation. Weston's City Commission
authorized a lawsuit on Monday and that City Attorney will be there to discuss his plan. City
Attorney Goren said he has no position to argue either way as this Commission has not
digested or reviewed or does not have basic information.

City Attorney Goren said the Carter Review Commission met in a special session last Friday;
however, they did not have quorum. The objective was to consider potential Charter
Amendment(s) regarding gun management and firearm regulation. They are trying to
reschedule a meeting within the next two weeks to have a conversation about this issue.
Several aspects of which might be litigation being filed challenging the statute as opposed to
potential violations of that statute, which bear significant penalties for public officials,
professional staff and others with regards to fines, removal from office as well as third party
claims by those affected by the challenge; i.e. the NRA, manufacturers of weapons, etc. City
Attorney Goren noted that at the Charter Review Meeting on Friday there were about a dozen
Stoneman Douglas young people to speak, they were articulate, sincere and very engaged
and it was very sad to be in that room at that time as I had to tell them what the law says and
what the law means. City Attorney Goren said as recently as last evening the City of Coral
Gables adopted an ordinance on first reading to regulate assault weapons in the City of Coral
Gables. City Attorney Goren said he will be happy to update the Commission on this issue.
City Attorney Goren said the session in Tallahassee ends on March 9th and everything is
changing daily. City Attorney Goren said his firm is keeping an eye on the home rule bills that
are out there and will keep the Commission updated on these as well.
4. CITY MANAGER REPORT: City Manager Cernech said the next Operation Medicine
Cabinet/Shred-a-Thon will take place at Kings Point, 7620 Nob Hill Rd. on Saturday, April
14th from 10:00 a.m. to 1:00 p.m. Early participants will receive a $5 gift card while supplies
last.
Upcoming Events: The Bike Rodeo will take place on Saturday March 3rd from 10.00 a.m. to
noon at Tamarac Park. This is a free event sponsored by State Farm Insurance and
presented by the Tamarac Parks & Recreation Dept. and BSO. This event, which is open to
all kids, features helpful bike safety tips, bicycle obstacle course, bike races, bike safety
inspections and more as well as a free bike give -a -way. The "One Tamarac" Multi -cultural
festival will be held on Saturday, March loth from 3:00 p.m. to 9:00 p.m. at the Tamarac
Sports Complex. The Festival will celebrate unity while showcasing the diverse makeup of
our City and will feature live music by Ed Calle, Mamblue and T-Wave Caribbean Band, as
well as other entertainers. There will be food trucks, entertainment, a cultural exhibition area
and a children's fun zone and will be capped off with a display of fireworks.
City Manager Cernech said he will be working with Commissioner Bolton to continue to
explain the way their tax bills work. The reality is that it could be true that an individual's tax
bill went up $800 per month. City Manager Cernech explained that the first year the tax is
based on the value of the lot and the second year it includes the value of the home as well.
City Manager Cernech explained they also have a CDD which funds the infrastructure in the
case of Manor Parc and Central Parc for which residents pay between $1,800 to $2,200 a
year, which is also on the tax bill. For a new home buyer this is all very confusing and 13th
Floor does have a process when people buy a home that verifies the tax process. People are
walked through the process and they sign an acknowledgement that they understand this
process. Staff will continue to work with Commissioner Bolton to make sure people
understand their tax bill.
City Manager Cernech said on February 14th we had folks from Tamarac BSO and Fire
Rescue who responded to the tragedy at Stoneman Douglas and did a good job helping.
Public Services did a good job directing traffic at the Parkland Vigil that had 8,000 people in
attendance. Other cities also helped. The vigil that was in Tamarac was put together hurriedly

by the Parks & Recreation staff and BSO and Fire Rescue were also there. City Manager
Cernech acknowledged that Public Information & Media Specialist Boston spent a lot of time
on the phone with CNN and was able to discourage them from attending the vigil at the
request of the parents. City Manager Cernech talked about the major issues relative to the
response and how things were handled, however, there will be some good that comes out of
this. The Broward County Commission has called for an evaluation about how we handle this
type of an event. There will be a careful look at how we respond as well as a look at the
Broward County Safety System. City Manager Cernech said there were issues with
transports of victims and there are a lot of questions that will have to be asked about how this
played out.
City Manager Cernech said he lives in Parkland and as such it should be no surprise he had
neighbors that were impacted by the shooting. City Manager Cernech said he has no words
about what these people had to endure. City Manager Cernech talked about two of his
neighbor's sons experiences and said that David Hogg and his sister Lauren, who was also
at the school, babysits his two children and live down the street from him. City Manager
Cernech talked about what some of the surviving students have been accused of. City
Manager Cernech said the point is that as a parent we are entitled to expect that schools
should be safe, and this has demonstrated that this is not the case. City Manager Cernech
said the SRO Program was never designed to provide security; it is to have police embedded
in students lives and they can trust and learn from them. One police officer with a gun cannot
provide security for 3,500 children and we will have to look at how security is provided, and it
will end up with who will be paying for the security. City Manager Cernech said we have three
schools in Tamarac and we have two SRO's. At some point we are going to have a
discussion county wide that our students should be safe in schools. This should be on the
minds of the Commission as it will be coming to City Halls very shortly and there should be
uniform protection for all schools in Broward County.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one
wishing to speak, Mayor Dressler closed Public Participation.
6. CONSENT AGENDA: Mayor Dressler asked if there were any changes/additions to the
Consent Agenda and City Manager Cernech said there were no changes/additions to the
Consent Agenda. Commissioner Placko seconded by Vice Mayor Gomez moved approval of
the Consent agenda. Motion passed unanimously (5-0).
a. Approval of the February 14, 2018 Regular Commission Meeting Minutes - APPROVED
b. TR13063 - Marketplace at Tamarac Second Amendment to the WSDA: A Resolution of the
City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to
accept and execute a Second Amendment to the Water and Sewer Developer's Agreement
with Marketplace at Tamarac, LLC., for the Marketplace at Tamarac, located at 6801-6997
W. Commercial Blvd., requiring a reduction of 4 ERC'S for water and an increase of 5 ERC'S
for sewer; the reduction and increase in ERC'S will modify the usage for water from 25.5
ERC'S to 21.5 ERC'S and a 4 ERC credit and from 17.5 ERC'S to 21.5 ERC'S for sewer;
requiring payment of $0 for water and $8,800.00 for sewer, in CIAC fees; authorizing and
directing the City Clerk to record said Agreement in the public records of Broward County;
providing for conflicts; providing for severability; and providing for an effective date.

c. TR13064 - Woodsprings Suites WSDA: A Resolution of the City Commission of the City of
Tamarac, Florida, authorizing the appropriate City Officials to accept and execute a Water
and Sewer Developer's Agreement with Gold Coast Premier Properties III, LLC., for the
Woodspirngs Suites Project, located at 5801 Madison Avenue, requiring 18.5 ERC'S for
water and 17 ERC'S for sewer; and requiring payment of $31,450.00 for water and
$37,400.00 for sewer; and requiring a total payment of $68,850.00 in CIAC fees; authorizing
and directing the City Clerk to record said Agreement in the Public Records of Broward
County, providing for conflicts; providing for severability; and providing for an effective date.

d. TR13069 - Renewal of Original Six -Cent Local Option Gas Tax Agreement: Resolution of
the City Commission of the City of Tamarac, Florida authorizing the appropriate City Officials
to execute the 2018 renewal of the Original Broward County Six Cent Local Option Gas Tax
levied in 1988 expiring on August 31, 2018 to be reestablished, reimpose and levied through
December 31, 2047 between Broward County and City Of Tamarac providing for division and
distribution of the proceeds from the Six -Cent Local Option Gas Tax on every gallon of motor
fuel and special fuel sold in the county and taxed under the provision of Chapter 206, Florida
Statutes; providing for conflicts; providing for severability; and providing for an effective date.

e. TR13071 - Woodmont POD F Project WSDA: A Resolution of the City Commission of the
City of Tamarac, Florida, authorizing the appropriate City Officials to accept and execute a
Water and Sewer Developer's Agreement with Pulte Home Company, LLC., for the
Woodmont Pod F Project, located at the corner of NW 78th Street and NW 80th Avenue,
requiring 14 ERC'S for water and 14 ERC'S for sewer; and requiring payment of $23,800.00
for water and $30,800.00 for sewer; and requiring a total payment of $54,600.00 in CIAC
fees; authorizing and directing the City Clerk to record said Agreement in the public Records
of Broward County; providing for conflicts; providing for severability; and providing for an
effective date.

f. TR13073 - Zoning In Progress - Overnight Medical Clinic Extension: A Resolution of the
City Commission of the City of Tamarac, Florida, authorizing a Reasonable Time Extension
of the Zoning In Progress of one hundred and eighty (180) days Nunc Pro Tunc, in
accordance with Chapter 24, Article II, Division 6, Section 24-91 of the City of Tamarac Code
of Ordinances; authorizing and directing the City Manager to undertake further study and
review of the City's regulations relating to health care uses to include hospital, public or
private, medical clinic or uses similar to a hospital or medical clinic; providing that upon the
adoption of this resolution extending the Zoning in Progress an additional one hundred and
eighty (180) days Nunc Pro Tunc, no permits or applications shall be issued or processed for
hospitals or medical clinics or uses similar to a hospital or medical clinic within the City of
Tamarac for a total of nine hundred (900) days from the date of the Administrative Order,
consistent with this resolution; providing for conflicts; providing for severability; and providing
for an effective date.

11. QUASI-JUDICIAL HEARING(S):
a. T02373 - Tamarac Village — Rezoning: An Ordinance of the City Commission of the City of
Tamarac, Florida, amending the Official Zoning Map of the City of Tamarac referenced in
Section 24-3 of Chapter 24 of the City of Tamarac Code of Ordinances to reflect the
Rezoning of certain real estate property described as portions of Blocks 3 and 4, Lyons
Industrial Park, as recorded in Plat Book 71, Page 1 of the public records of Broward County,
Florida and portions of Blocks 9 and 10, Lyons Commercial Subdivision Unit No. 2, as
recorded in Plat Book 69, Page 43 of the public records of Broward County, Florida, more
legally described in Exhibit "A", from the current MXD (Mixed Use District) zoning
classification to Commissioner Placko (Planned Development District) zoning classification,
for the subject property located on the north side of Commercial Boulevard, generally
between NW 94th Avenue to the west and Pine Island Road to the east with portions located
north of NW 57th Street, generally known as "Tamarac Village", in order to provide
consistency with the Land Development regulations in accordance with the intent of the
Comprehensive Plan of the City of Tamarac; (Case No. 4-Z-17); providing for amendment to
the Official Zoning Map to reflect such change; providing for conflicts; providing for
severability; and providing for an effective date. City Attorney Goren went over the Quasi -
Judicial procedures and processes. City Clerk Teufel swore in all affected parties. City
Attorney Goren read T02373 by title into the record. Vice Mayor Gomez seconded by
Commissioner Bolton moved approval of T02373 on first reading. Mayor Dressler asked if
any Commission Member had any disclosures. Vice Mayor Gomez, Commissioners Bolton,
Fishman, Placko and Mayor Dressler all said no. Community Development Director Calloway
appeared and gave a presentation, a copy of which is on file in the City Clerk's Office. John
Markey appeared on behalf of the applicant. Mayor Dressler opened the Public Hearing and
with no one wishing to speak, closed the Public Hearing. Mayor Dressler opened the floor for
Commission discussion. Vice Mayor Gomez and Commissioner Fishman said they will
reserve their comments and questions when this is discussed, along with the site plan and
plat, at the March 28, 2018 Commission Meeting. Community Development Director
Calloway responded to a few questions from the Commission.
Motion passed unanimously (5-0).

There being no further business to come before the City Commission, Mayor Dressler
