HomeMy WebLinkAbout2018-09-12 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, SEPTEMBER 12, 2018 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:10 p.m. on Wednesday, September 12, 2018, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Marlon Bolton, Commissioner Julie Fishman and Commissioner Debra Placko were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney David Tolces and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Gomez led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Harry Dressler proclaiming September 15 - October 15, 2018 as "Hispanic Heritage Month". (Requested by Commissioner Marlon Bolton) b. Presentation of a proclamation by Mayor Harry Dressler proclaiming September 25, 2018 as "National Voter Registration Day Proclamation". (Requested by Mayor Harry Dressler) 2. CITY COMMISSION REPORTS: Mayor Dressler asked for a moment of silence in remembrance of the September 11, 2001 victims and to keep the people living in North and South Carolina in your prayers because of Hurricane Florence. a. Commissioner Bolton: Commissioner Bolton said he had the pleasure of attending the Chamber Breakfast where he met a lot of business owners who are looking forward to attending more breakfasts in the future. Commissioner Bolton said he also attended the HOA/Condo Quarterly meeting; the Mainlands Community Leaders meeting; met with various HOA presidents and missed the Central Parc meeting. Commissioner Bolton said the City of Sunrise sent a resolution supporting the closure of schools on election day and hope that this Commission can support this as well. Commissioner Bolton thanked Mayor Dressler for the Hispanic Heritage Month proclamation. b. Vice Mayor Gomez: Vice Mayor Gomez said she appreciates the Hispanic Heritage proclamation as her family hails from Northern Spain. Vice Mayor Gomez invited people to the Family Fund Day on September 29th from 12:00 p.m. to 3:00 p.m., hosted by the City of Tamarac in partnership with the Hispanic Vote, at the Caporella Aquatic Center and noted that the Supervisor of Elections Office will be there to register people to vote. Vice Mayor Gomez said she attended the Broward County Planning Council meeting and attended an open house at the Fountains Business Park. Thanked Commissioner Bolton for hosting the Community Leaders meeting Vice Mayor Gomez talked about marching in Labor Day parades when she was growing up. Vice Mayor Gomez attended the NYPD 1013 Club meeting, where she sits on the Executive Board. They discussed the effects that the attacks of 9/11 has had on the health of the first responders and attended the Chamber Breakfast; Page 1 of 9 COMMISSION MEETING September 12, 2018 the Rock & Ride event. Vice Mayor Gomez invited people to join the send off for the veterans that were going on the Honor Flight on Saturday. c. Commissioner Fishman: Commissioner Fishman reported that she has spent the last few weeks battling Bronchitis. Commissioner Fishman said she did take a tour of the Hispanic Unity Organization and went over the numerous programs they offer; attended the Rock & Ride event; the Broward County Human Trafficking Coalition Quarterly meeting and share some of the statistics on Human Trafficking in Broward County and noted that two children were from Tamarac. Commissioner Fishman said she spoke to the Tamarac — North Lauderdale Chamber Latin Connection Group. d. Commissioner Placko: Commissioner Placko reported that she attended an FDOT meeting regarding the work that will be done on University Dr.; attended quite a few HOA meetings and thanked staff for attending those meetings with her; attended the Parking meeting that the Vice Mayor Gomez hosted and the Rock & Roll event. Commissioner Placko said the Honor Flight is leaving at 3:00 a.m. and invited people to join then to honor the Veterans as well as the Community Garage Sale later that day. Commissioner Placko said Family Central will be having their Motown Fund Raiser on October 27th and invited people to attend that event. Commissioner Placko reported that Pulte has started building their 8 model homes and a sales trailer is now on site. The trailer will be available for people to visit from December to February and the homes will be in the $453,000 to $526,000 price range with $160 HOA fee and a $250 a month County Club Membership. Commissioner Placko said they already have contracts pending on two homes. e. Mayor Dressler: Mayor Dressler said at the last meeting there were issues over the proposed Public Safety Tower behind City Hill and since then he has had conversation with some of the parents of children that were killed at Marjory Stoneman Douglas relative to safety in schools. Mayor Dressler said Tamarac is highly regarded because of the quality of the staff and Commission. Mayor Dressler noted that we are doing a video for Economic Development in Tamarac to attract people and noted that Tamarac's diversity is a huge plus. Mayor Dressler talked about the benefits of living in the USA compared to other countries. 3. CITY ATTORNEY REPORT: Assistant City Attorney Tolces had no report. 4. CITY MANAGER REPORT: Upcoming Events: The next Community Garage Sale will be held this Saturday, September 15th, from 7:30 a.m. to noon at Tamarac Park. City Manager Cernech said on Saturday, September 15th the City of Tamarac will provide transportation for six Tamarac Resident Veterans to the Miami International Airport. The Veterans will be accompanied by their Guardians for the Day who will fly to Washington D.C. to visit the war memorials dedicated in their honor. The group will depart City Hall at 3:45 a.m. and City Manager Cernech invited people to come out to City Hall prior to 3:45 a.m. to show their appreciation. The City will also be providing return transportation from the Airport to City Hall for the Veterans. City Manager Cernech said the 7th Annual P.A.R.O.T. Bowling Tournament will be held on Tuesday, October 9th at Striker Family Sportscenter. Registration begins at 6:00 PM with bowling starting at 6.30 p.m. The cost is $40/adult bowler; $30/under 18 years of age. This includes two games of bowling, shoes, wings, pizza, beverages, raffles and prizes. Registration forms are available at the Parks & Recreation Administration and if you pre -register by September 26th as an individual or team you will receive a free tournament shirt. Page 2 of 9 COMMISSION MEETING September 12, 2018 City Manager Cernech said Public Services has advised that the University Drive improvement projects are currently underway. The improvement work by FDOT will be along University Dr. south of McNab Rd. to north of NW 78th St. This project is expected to be completed in Summer 2019. City Manager Cernech reported that trees were installed on the Mainlands medians and Public Services will spray the weeds and plant shrubs in 3 to 4 weeks. The project should be completed in early October. City Manager Cernech also reported that there no issues during Tropical Storm Gordon as Stormwater did another great job. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke: Ron Wasserman, 8577 Jade Dr. thank the veterans for their service and also thanked the first responders to the 9-11-01 attacks and about being robbed in the parking lot of Milands. Stewart Webster, 7900 Colony Dr., talked about how caring and responsive Tamarac's first responders are and invited people to attend the Hispanic Unity 2018 Entrepreneur Summit on Friday, September 28, 2018 and to call 954-964-8884 to get more information. Mr. Webster also talked about Tamarac not participating in the Low - Income Seniors Who Maintain Long -Term Residency Tax Exemption. City Manager Cernech commented that the City has looked into this exemption but is waiting to see what will happen with the additional exemption that is on the upcoming ballot in November. With no one else wishing to speak, Mayor Dressler closed Public Participation 6. CONSENT AGENDA: Mayor Dressler asked if there were any changes/additions to the Consent Agenda and City Manager Cernech responded that there were no changes/additions to the Consent Agenda. Vice Mayor Gomez seconded by Commissioner Placko moved approval of the Consent Agenda as presented. Motion passed unanimously (5-0). a. Approval of the August 22, 2018 Regular Commission Meeting Minutes. Item deferred to the September 26, 2018 Regular Commission Meeting. b. TR 13155 - BID AWARD 18-20RB Culvert Cleaning: A Resolution of the City Commission of the City of Tamarac, Florida, Awarding Bid No. 18-20RB to and approving an Agreement with TV Diversified, LLC for Citywide Storm Drain Pipe and Culvert Cleaning; authorizing an expenditure from the appropriate accounts not to exceed the approved budget annually for said purpose; effective upon approval through September 11, 2021; authorizing proper City Officials to execute contract renewals; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-107 c. TR13170 - Addendum to the BSO Agreement for an additional SRO: A Resolution by the City Commission of the City of Tamarac, Florida Approving the Fifth Amendment to the Law Enforcement Services Agreement Between the City of Tamarac and the Broward Sheriff's Office; Authorizing the Appropriate City Officials to Execute the Fifth Amendment to the Agreement for Police Services; Providing for Conflicts; Providing for Severability and Providing for an Effective Date. RESOLUTION R-2018-108 d. TR13165 - Revising Building Department Fee Schedule: A Resolution of the City Commission of the City of Tamarac, Florida revising the City's Building Department Permit Fees to become effective January 1, 2019 pursuant to Exhibit "A" attached hereto and Page 3 of 9 COMMISSION MEETING September 12, 2018 incorporated herein; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2018-109 e. TR13167 - Approve and Execute Change Order No. 1 to the Agreement with CC Control for SCADA System Improvements: A Resolution of the City Commission of the City of Tamarac, Florida, approving Change Order Number 1 to the Agreement with CC Control Corporation utilizing pricing from an Agreement obtained through a formal competitive process by the City of Oakland Park, RFP No. 022414 for the Lift Stations / Wells SCADA improvements project, for additional items identified during construction, at a cost not to exceed $68,402.00; authorizing the appropriate City Officials to execute Change Order Number 1; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2018-110 f. TR13171 - Utility Rates Resolution: A Resolution of the City Commission of the City of Tamarac, Florida, Establishing the Adjustment Factor to be Applied to the Annual Water and Sewer Rate Schedule for the Fiscal Year Beginning October 1, 2018; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date. RESOLUTION R-2018-111 g. TR13166 FMIT Insurance Renewal FY 2019: TR13166 A Resolution of the City Commission of the City of Tamarac, Florida; authorizing the renewal of General Liability, Automobile Liability, Automobile Physical Damage, Workers' Compensation, and property lines of coverage with the Florida Municipal Insurance Trust (FMIT) for a one (1) year period beginning October 1, 2018 at a cost of $954,096 and payment of any increase resulting from the annual premium audit and any endorsements; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-112 h. TR13175 - Confirm Appointment of 5th Member Trustee to the Police Pension Board: A Resolution of the City Commission of the City of Tamarac, Florida, confirming appointment of Philip E. Forsberg, III as a Trustee of the Police Pension Board to serve a two-year term ending September 2, 2020 or until new appointments are made; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-113 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) - FIRST READING: There were no Ordinance(s) — First Reading scheduled for this meeting. 9. PUBLIC HEARING(S): Mayor Dressler welcomed everyone and said this is a Regular Meeting of the City Commission of the City of Tamarac to hold Public Hearings on the Annual Fire Assessment, the Annual Stormwater Utility Management Fee Assessment, the Annual Solid Waste Collection Services Assessment, the Nuisance Abatement Assessment and the setting of the Tentative Millage Rate and the Tentative City Budget for Fiscal Year 2019. These public hearings are the culmination of an entire year's work by this City Commission, the City Manager and staff. For the benefit of the public tonight, the City Commission held workshops Page 4 of 9 COMMISSION MEETING September 12, 2018 throughout the year as well as a budget workshop on June 20, 2018 to provide direction to the staff on this submittal. I would like to thank my colleagues on the dais for their participation at the workshops and for their suggestions as we deliberated on the staff recommendations. OK ... I believe we are ready to begin. City Manager Cernech to read the following statement: "The City of Tamarac has used the Fire Rescue Assessment since 1997 to provide specific funding for the purpose of providing fire rescue services in the City of Tamarac. As the City Commission is aware, the Fire Rescue Assessment has been determined to be an equitable and efficient methodology to use in apportioning the cost of Fire Rescue Services to improved properties thus reducing the overall burden on the ad valorem tax rate. The residential rate for FY 2019 will remain at $350 per dwelling unit with no change from last year. The City conducted a study on the Fire Rescue Assessment in 2016 and based upon calls for service and a five-year budget forecast for the cost of providing Fire Rescue Services, Staff recommends the City Commission approve the rates that have been proposed and approved for publication at the July 11, 2018 Preliminary Fire Assessment Rate hearing and subsequently advertised for public hearing on August 19, 2018." a. TR13145 - Fire Assessment Rate Resolution: A Resolution of The City Commission of The City Of Tamarac, Florida, relating to the provision of Fire Rescue Services, Facilities and Programs in The City Of Tamarac, Florida; Reimposing Fire Rescue Assessments against assessed property located within The City Of Tamarac for the fiscal year Beginning October 1, 2018; approving the rate of assessment; approving the assessment roll; providing for conflicts; providing for severability; providing an effective date. Motion passed unanimously (5-0). RESOLUTION R. 2018-114 City Manager Cernech made the following statement: "The City of Tamarac has been using a special assessment for the collection of the Stormwater Utility Management Services Fees since 2014. This assessment is an equitable and efficient method of allocating and collecting the Stormwater Utility Management Services Fee Assessed Cost among all the parcels in the City. The rate per equivalent residential unit (ERU) for FY 2019 is $127.79 and is an increase of $3.70 or 3% over the previous year in accordance with our Code of Ordinances. Staff recommends the City Commission approve the rate that has been proposed and approved for publication at the July 11, 2018 Preliminary Stormwater Utility Management Fee Assessment Rate hearing and subsequently advertised for public hearing on August 19, 2018." b. TR13146 - FY19 Stormwater Utility Management Fee Special Assessments: A Resolution of The City Commission of The City Of Tamarac, Florida, relating to the levy and collection of The City's Stormwater Management Utility Fee within the Municipal boundaries of The City Of Tamarac for the fiscal year beginning October 1, 2018; approving, confirming, and adopting the Stormwater Management Utility Fee and Stormwater Management Utility Fee Roll; providing for other matters relating to the levy and collection of The Stormwater Management Page 5 of 9 COMMISSION MEETING September 12, 2018 Utility Fee on the Annual Property Tax Bills; providing for conflict; providing for severability; and providing for an effective date. RESOLUTION R. 2018-115 City Manager Cernech made the following statement: "The City of Tamarac has been using a special assessment for residential solid waste collection services since 2013. This assessment is an equitable and efficient method of allocating and collecting the Residential Solid Waste Collection Services Assessed Cost among single family residential type parcels. The residential rate for FY 2019 is $278.75 per residential dwelling unit receiving curbside pickup which is a $5.00 increase over Fiscal Year 2018 and includes the cost of RecycleBank for recycling services approved by the City Commission. Staff recommends the City Commission approve the rate that has been proposed and approved for publication at the July 11, 2018 Preliminary Solid Waste Collection Services Assessment Rate hearing and subsequently advertised for public hearing on August 19, 2018." c. TR13147 - FY 2019 Solid Waste Collection Annual Rate Assessment: A Resolution of The City Of Tamarac, Florida, relating to the provision of Residential Solid Waste Collection Services in The City Of Tamarac, Florida; approving the assessment rate for Residential Solid Waste Collection Services for the fiscal year beginning on October 1, 2018; imposing a residential Solid Waste Collection Assessment against assessed property located within The City Of Tamarac for the fiscal year beginning on October 1, 2018; providing for severability; providing for conflicts; and providing an effective date. RESOLUTION R. 2018-116 City Manager Cernech made the following statement: "In 2012, the City Commission adopted the Public Nuisance Abatement Ordinance. As part of that ordinance, the City Commission authorized the use of special assessments for amounts billed but unpaid as of June 1 of the year following the abatement of the public nuisance. The City abated four (4) public nuisances between June 1, 2016 and May 31, 2017 on four (4) properties. The amounts are delinquent as of this date. City Staff has prepared the special assessments against each property with unsettled liens, the total of which is $3,545.85 to be collected on the tax bills for Fiscal Year 2019. This is the sixth year using this type of assessment. Staff recommends the City Commission approve the Public Nuisance Abatement Special Assessment that was approved for publication at the July 11, 2018 Preliminary Public Nuisance Abatement Assessments hearing and subsequently advertised for public hearing on August 19, 2018. d. TR13148 - FY 2019 Nuisance Abatement Special Assessments: A Resolution of The City Commission of The City Of Tamarac, Florida, relating to The Provision of Nuisance Page 6 of 9 COMMISSION MEETING September 12, 2018 Abatement on certain real properties by The City in accordance with Chapter 9, Article II, Division V of The City's Code of Ordinances; approving The Collection of a Nuisance Abatement Special Assessment on real property that has been specially benefited by The City's Abatement Of Nuisances thereon; approving a Nuisance Abatement Assessment Roll; providing for conflict; providing for severability; and providing for an effective date. Mayor Dressler opened the Public Hearing and with no one wishing to speak, closed the Public Hearing. Commissioner Placko seconded by Vice Mayor Gomez moved approval of TR13148. Motion passed unanimously (5-0). RESOLUTION R. 2018-117 Mayor Dressler made the following statement: "This is the first public hearing for establishing the Operating Millage Rate for Fiscal Year 2019. A second public hearing on Temporary Ordinance Number 2383 will be held on Thursday, September 20, 2018 at 5:05 pm." City Manager Cernech made the following statement: "In accordance with the Truth in Millage requirements of Florida Statutes, the City is required to announce the percentage difference between the proposed millage rate and the rolled -back rate. As such, the following is read into the record: The proposed operating millage rate of 7.2899 mills for Fiscal Year 2019 is .5847 mills or 8.72% more than the rolled -back rate of 6.7052 mills." e. T02383 - FY2019 Millage Rate Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida to Establish and Levy Ad: Valorem Taxes Within the Corporate Limits of the City of Tamarac, Florida, for the Tax Year 2018; Providing for the Levy of Ad Valorem Taxes in the Amount of 7.2899 Mills ($7.2899 Per $1,000) Based Upon the Assessed Value on Non -Exempt Real and Personal Property Located Within the City Limits of the City of Tamarac; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date. Assistant City Attorney Tolces read T02383 by title into the record. Finance Director Mason gave a presentation, a copy of which is on file in the City Clerk's Office. Commissioner Bolton commented that he believed that we can do more with less and 7.2899 mills is higher than surrounding cities. Commissioner Bolton said there are any areas in the budget that can be reduced; like reducing the salaries of the elected officials and City Manager which would be a drop in the bucket, but we need money to fund some of our priorities in Tamarac. Commissioner Bolton said the Commission could donate their salaries back for other priorities like assisting families that cannot make ends meet. Commissioner Bolton talked about a conversation he had with a constituent who wanted to pull a permit to get some work done but could not afford the permit fee. Commissioner Bolton said if he was the only one to give back his salary he could run afoul of the law, but it could be done if it was done as a body. Commissioner Bolton said some residents have restricted income and they are looking to the Commission to be an example and thinks that next Thursday at second reading the millage rate should be reduced. Commissioner Bolton talked about City Manager Cernech's salary and said we should benchmark with other cities to make sure we are on par with them. Commissioner Bolton said that the Commission in Oakland Park serve for free. Commissioner Bolton commented that the Commission should not be receiving a car allowance. Others may think this is a political statement, but it comes from his heart. Vice Mayor Gomez asked the Mayor to have the City Manager do a benchmark study. Commissioner Fishman seconded by Vice Mayor Gomez moved approval of TO2383. Motion passed (4-1) with Commissioner Bolton dissenting. PASSED ON FIRST READING SEPTEMBER 12, 2018 Mayor Dressler made the following statement: "This is the first public hearing to establish the Fiscal Year 2019 Operating Budget, Capital Budget and Financial Policies. A second public hearing on Temporary Ordinance Number 2384 will be held on Thursday, September 20, 2018 at 5.05 p.m." City Manager Cernech made the following statement: "The tentative operating and capital budget for Fiscal Year 2019 is $165,063,670 which is $6,606,254 more than the Amended Budget of $158,457,416 for Fiscal Year 2018. The tentative general fund budget, which is the primary fund for providing governmental services such as, our contract with BSO, general and administrative services, public services, and parks and recreation, is $69,580,890 which is $6,647,391 more than the Amended Budget of $62,933,499 for Fiscal Year 2018. In addition, the financial policies are included as part of the adoption of the annual budget. These financial policies are an integral part of our long-term financial planning for the City. These policies set parameters for operating management, including establishing reserves for specific purposes, establishing accounts management and financial planning policies and establishing policies on economic resources." f. TO2384 - FY 2019 Budget Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida, Adopting the Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2019; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date. Assistant City Attorney Tolces read TO2384 by title into the record. Finance Director Mason gave a presentation, a copy of which is on file in the City Clerk's Office. Finance Director Mason responded to questions from the Commission throughout the presentation. Commissioner Bolton said he likes the budget and thinks it is well put together and was improved over last year's budget. Commissioner Bolton said he will be publishing his own opinion on the budget and some line items that are not in the best interest of Tamarac. Anyone who wants a copy can contact him. Commissioner Bolton said he will support the budget tonight but does not want people to think that his support of the budget does not mean he agrees with the budget. Mayor Dressler opened the Public Hearing and the following individual spoke: Jeanine Adrienne Laster,4967 NW 59th St., asked if the storage facility was part of this budget and Finance Director Mason said no. Ms. Laster asked about a statement made at a Shade Session at the meeting with the developer and Assistant City Attorney Tolces said that until the litigation has been settled no one can comment on what was said at the Shade Session. Commissioner Bolton said the storage facility is not being built by the City, it is being built by an outside developer. With no one else wishing to speak, Mayor Dressler closed the Public Hearing. Commissioner Bolton seconded by Vice Mayor Gomez moved approval of TO2384. Motion passed unanimously (5-0). PASSED ON FIRST READING SEPTEMBER 12, 2018 Page 8 of 9 COMMISSION MEETING September 12, 2018 Mayor Dressler made the following statement: "The second public hearing on setting the operating millage rate and adopting the budget for Fiscal Year 2019 will be held on Thursday, September 20, 2018 at 5:05 p.m." 10. QUASI-JUDICIAL HEARING(S): There were no Quasi -Judicial Hearing(s) scheduled for this meeting. 12.
