CITY COMMISSION MEETING
WEDNESDAY, SEPTEMBER 26, 2018
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 10:44 a.m. on Wednesday, September 26, 2018, in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Marlon
Bolton, Commissioner Julie Fishman and Commissioner Debra Placko were in attendance.
Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Commissioner Fishman led the Pledge of Allegiance.
a. Presentation by the Florida Department of Health recognizing the City of Tamarac as a
Healthy Community Champion, for taking a "Health in All Policies" approach to
comprehensive planning, a collaborative approach to improving health by incorporating
healthy considerations into decision making across sectors and policy areas.
b. Presentation of a Proclamation by Mayor Harry Dressler proclaiming the week of October 7
- 13, 2018 as "Fire Prevention Week". (Requested by Assistant Fire Marshal Tommy
Demopoulos)
c. Presentation of a Proclamation by Mayor Harry Dressler proclaiming the week of October 1
- 5, 2018 as "Customer Service Week". (Requested by Tamarac's Customer Focus Employee
Team)
2. CITY COMMISSION REPORTS:
a. Commissioner Bolton: Commissioner Bolton said he attended the "Take Your Child to
School Day" event at Challenger Elementary and noted that this was the highlight of the year
to see fathers taking their children to school. Commissioner Bolton talked about his
experience and his son's reaction when he took him to school this morning. Commissioner
Bolton encouraged fathers to get involved in their children's lives. Commissioner Bolton
talked about attending an HOA meeting where there were 200 in attendance and the
comradery among the attendees. Commissioner Bolton thanked City Manager Cernech and
Assistant City Manager Gunn for driving around his district with him to see some of the issues
and welcomed Mary Lou Tighe, the Executive Director of the Broward League of Cities to the
meeting. Commissioner Bolton said he serves on the Broward County Action Agency and at
a recent meeting they discussed helping residents in need and encouraged people to reach
out to him at 954-275-3850 or follow him on Facebook.
b. Vice Mayor Gomez: Vice Mayor Gomez thanked everyone for adjusting their schedules to
be here at a later hour. Vice Mayor Gomez also attended Tamarac Elementary & Challenger
Elementary schools for the "Take Your Child to School Day" event and thanked everyone
who worked on putting the event together. Vice Mayor Gomez said she attended the MPO

Round Table Steering Committee meeting, where they discussed items they are looking at
regarding transportation and the Transportation Surtax; the Honor Flight send-off; the
Community Garage Sale; thanked staff for the hard work on the budget; hosted the Roger H.
Staley Real Estate Seminar; the installation of Reverend Reginald W. Handsome, Jr. at All
Saints Lutheran Church. Vice Mayor Gomez said she is looking forward to the Taste of
Tamarac Chamber Launch Party; thanked Social Services for helping two elderly ladies find a
home and invited people to come out and enjoy Family Fun Day on Saturday.
c. Commissioner Fishman: Commissioner Fishman said she attended the Florida League of
Cities Legislative Policy meeting in Orlando and encouraged people to educate themselves
on Amendment 1; the Environmental Policy Committee for the Broward League of Cities and
the Florida League of Cities meeting relative to clean water; the Honor Flight send-off; the
Broward Human Rights Board meeting where they discussed changing the structure of said
board; the American Legion Post 365 installation of officers event and the "Take Your Child to
School" event at Tamarac Elementary.
d. Commissioner Placko: Commissioner Placko said she attended the "Take Your Child to
School" event and talked about how engaged the parents were; the Board meeting of the
MPO regarding funding increases and projects that were submitted by Tamarac; the Honor
Flight send-off and noted that we have brochures relative to Veterans benefits in City Hall;
the Community Garage Sale; the installation of Reverend Reginald W. Handsome, Jr. at All
Saints Lutheran Church as well as several HOA meetings where she learned neighbors are
looking out for each other. Commissioner Placko invited people to come out and attend the
Family Fun Day on Saturday.
e. Mayor Dressler: Mayor Dressler said people call him at home to talk about issues such as
TRIM Notices and the necessity to Homestead their residences. Mayor Dressler talked about
keeping the millage rate stable for the last few years and the challenges of being able to keep
providing quality services to the community. People also asked him about school issues such
as the quality of schools in Tamarac and their #1 concern is school safety. Mayor Dressler
encouraged people to research when they vote for the proposed Transportation Surtax and
we need to do outreach to educate people on this issue. Mayor Dressler said no one ever
complains to him about how Tamarac spends money, or the service Tamarac provides its
residents. Mayor Dressler said people want to talk about political issues, but the Tamarac
Commission is non -partisan and he will not discuss politics as it is not beneficial to Tamarac.
Mayor Dressler said we need to encourage people to get out and vote.
3. CITY ATTORNEY REPORT: City Attorney Goren said there are two items on the dais this
morning, one of which is a Conflict Waiver for Gary Resnick, Esq. who is an attorney for the
law firm of Gray Robinson and represents Tamarac in various telecommunications matters.
Mr. Resnick's partner, Stephen Tillbrook has been retained to represent Bridge Investment
Group, LLC with respect to certain real estate, zoning and development matters related to the
property located at 5601 Hiatus Rd. In the event there is any litigation related to this matter,
Gray Robinson has agreed to end their representation of Bridge Investment Group and not
represent any party in the action. City Attorney Goren said he needs a Motion and second to
approve the Waiver. Vice Mayor Gomez seconded by Commissioner Fishman moved
approval of the Waiver. Motion passed (4-0). Commissioner Placko had left the dais and
was not present for the vote.

City Attorney Goren said the second item on the dais is a First Renewal of License
Agreement between Tamarac and Broward County. This is for leasing the space at the back
of the Chambers for County Commissioner Michael Udine or members of his staff to use. The
First Renewal is for one year through September 30, 2019. City Attorney Goren said this
extension was approved by the County yesterday. City Attorney Goren responded to a few
questions from Vice Mayor Gomez relative to the term of the lease. Commissioner Fishman
seconded by Commissioner Bolton moved approval of the First Renewal of License
Agreement between Tamarac and Broward County. Motion passed unanimously (5-0).
4. CITY MANAGER REPORT: City Manager Cernech invited people to attend the Family Fun
Day on September 29th hosted by the City of Tamarac in partnership with the Hispanic Vote.
This will take place at the Caporella Aquatic Center from noon until 3:00 p.m. In addition to
the free food, music, swimming and dominoes, attendees can register to vote or update their
voter registration card with individuals from the Supervisor of Elections Office.
City Manager Cernech also invited people to the 7th Annual P.A.R.O.T Bowling Tournament
on Tuesday, October 9th at Strikers Family Sports Center. Registration begins at 6:00 p.m.
with bowling starting at 6:30 p.m. The cost is $40 for adult bowler, $30/under 18 years of age
and includes two games of bowling, shoes, wings, pizza, beverages, raffles and prizes.
Registration forms are available at the Parks and Recreation Administration Building located
at 6001 Nob Hill Rd., you can pre -register by September 26th as an individual or a team and
you will receive a tournament shirt.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one
wishing to speak, closed Public Participation.
6. CONSENT AGENDA: Mayor Dressler asked if there were any changes/additions to the
Consent Agenda and City Manager Cernech said there were no changes/additions to the
Consent Agenda. Vice Mayor Gomez seconded by Commissioner Fishman moved approval
of the Consent Agenda as presented. Motion Passed unanimously (5-0).
a. Approval of the August 22, 2018 Regular Commission Meeting Minutes — APPROVED

c. TR 13168 - Award Bid No. 18-26B Public Service South Build -out Project: A Resolution of
the City Commission of the City of Tamarac, Florida, Awarding Bid No. 18-26B to and
approving an Agreement with Conbuild, LLC for the Public Services South Build -Out Project
at the Public Services Building located at 10101 State Street, in accordance with Bid No. 18-
26B for a contract amount of $76,337, a contingency in an amount of $7,633, will be added to
the project for a total project budget of $83,970 authorizing an expenditure from the
appropriate accounts; authorizing Budget Amendments as needed for proper accounting
purposes; providing for conflicts; providing for severability; and providing for an effective date.

d. TR13033 - First Amendment to Software License and Services Agreement with Superion:
A Resolution of the City Commission of the City of Tamarac, Florida, approving and
authorizing the appropriate City Officials to execute the First Amendment to the Software

License and Services Agreement to make minor contract language corrections; providing for
conflicts; providing for severability; and providing for an effective date.

e. TR 13164 - Lime Sludge Contract Renewal: A Resolution of the City Commission of the
City of Tamarac, Florida, approving Amendment No. 1 to the Agreement with Westwind
Contracting, Inc. for Bid No. 16-25B, Lime Sludge Removal, Hauling and Disposal Project
authorizing an expenditure of funds for an amount not to exceed the approved Annual
Budget, and authorizing contract escalation / de-escalation as provided under the Agreement
beginning October 1, 2018 through September 30, 2020, to exercise the first two-year
Renewal option; authorizing the appropriate City Officials to accept and execute said
Amendment; providing for conflicts; providing for severability; and providing for an effective
date.

f. TR13172 - BSO Permit for Special Details for FY19: A Resolution of the City Commission
of the City of Tamarac, Florida, authorizing the appropriate City Officials to approve and
execute a Broward Sheriffs Office Permit Application for Special Details for police services to
be used by the Parks and Recreation Department in an amount not to exceed $98,550 in FY
19, October 1, 2018-September 30, 2019; approving funding from the appropriate Parks and
Recreation Accounts; providing for conflicts; providing for severability; and providing for an
effective date.

g. TR13169 - Addendum to BSO Agreement for the P-25 Radios Acquisition: A Resolution by
the City Commission of the City of Tamarac, Florida Approving the Addendum to the Law
Enforcement Service Agreement between the City of Tamarac and the Sheriff of Broward
County; Authorizing the Appropriate City Officials to Execute the Addendum to the
Agreement for Law Enforcement Services; Providing for Conflicts; Providing for Severability;
and Providing for an Effective Date.

h. TR13174 - A Resolution Awarding RFP 18-21 R - Records Conversion Services to
Advanced Data Solutions, Inc. A Resolution of the City Commission of the City of Tamarac,
Florida, authorizing the appropriate City Officials to award RFP 18-21 R Entitled "Records
Conversion Services" to Advanced Data Solutions, Inc. and execute an agreement to provide
records conversion services to the City of Tamarac for a total up to the appropriated budget
amount for each individual fiscal year, for an initial period of 36 months effective with the
approval of this agreement, with two (2) additional one (1) year renewal options; approving
funding from the appropriate account; Providing for conflicts; providing for severability; and
providing an effective date.

i. TR13176 - Temp Permit Technician (CGA): A Resolution of the City Commission of the City
of Tamarac, Florida, increasing purchases made against City of Parkland contract #2017-08
from the original agreement amount for building inspection services of $15,000 annually to
add permit technician services from the same agreement in the amount of $75,000 for an
amended amount of $90,000 annually for a term to run concurrent with the City of Parkland
contract #2017-08 through March 7, 2020 including the exercising of any renewal options or

extensions as may be approved by the City of Parkland, authorizing the appropriate city
officials to take the necessary steps to effectuate the approved increase.
RESOLUTION R-2018-124
j. TR13180 - Transportation Surtax ILA: A Resolution of the City Commission of the City of
Tamarac, Florida, pertaining to the subject of Taxation; approving and authorizing the proper
City Officials of the City of Tamarac, Florida to approve a draft of an Interlocal Agreement
with Broward County, other municipalities that may also join, and the Broward County
Metropolitan Planning Organization relating to the County 1 % Transportation Surtax Levy
which is on the November 6, 2018 ballot, in form attached to this Resolution, making the
findings required by the Interlocal Agreement as a condition precedent to the City's execution
as well as other findings; directing the Mayor or City Manager to execute the Interlocal
Agreement attached hereto as Exhibit 1" and take the steps required to have the City
become a party to the Interlocal Agreement by September 30, 2018; providing for conflicts;
providing for severability; and providing an effective date.

k. TR 13183 — Support for Closure of Schools Serving as Polling Places on Election Days: A
Resolution of the City Commission of the City of Tamarac, Florida, supporting the closure of
Broward County Public Schools on election day or the relocation of voting precincts from
Broward County Public Schools; directing the City Clerk to transmit the copy of this resolution
to the appropriate officials; providing for conflicts; providing for severability; and providing for
an effective date.

I. TR13185 —Amendment 1, Homestead Exemption: A Resolution of the City Commission of
the City of Tamarac, Florida, concerning Amendment 1 to the Florida Constitution, urging the
voters to consider potential adverse consequences of Amendment 1; directing the City Clerk
to transmit a copy of this resolution to the Florida League of Cities; providing for conflicts;
providing for severability; and providing for an effective date.

10. ORDINANCE(S) - SECOND READING:
Mayor Dressler recognized Mary Lou Tighe the Executive Director of the Broward League of
Cities who was in attendance at the meeting.
a. T02385 - Blue House of Tamarac - Small Scale Land Use Plan Amendment: An
Ordinance of the City Commission of the City of Tamarac, Florida, adopting a Small Scale
Land Use Plan Amendment to the City of Tamarac's Comprehensive Plan Future Land Use
Map in accordance with Chapter 163, specifically Section 163.3187 of the Florida State
Statutes, for an area of approximately 2.33 acres in size, contained in a portion of the
Southern Bell Telephone Company property on the Northeast corner of NW 76 Street and

North University Drive, originally addressed as 7600 North University Drive, more specifically
described as parcel "A" and Parcel "C", "Southern Bell — Tamarac", according to the Plat
thereof, as recorded in Plat Book 89, Page 39, of the public records of Broward County, less
and except therefrom that certain right-of-way as described in Official Records Book 8066,
Page 444, of the Public Records of Broward County and shown in Exhibit "A", to change the
Future Land Use designation from "Utilities" to "Community Facilities" in order to allow for the
development of a Special Residential Facility, Category 3 (Case No. 1-LAU-18) consistent
with the intent of the City of Tamarac Comprehensive Plan; providing for amendment to the
land use plan to reflect such change; providing for conflicts; providing for severability; and
providing for an effective date. City Attorney Goren read TO2385 by title into the record.
Attorney Tracy H. Lautenschlager and William Gallo, Architect appeared on behalf of the
applicant. Ms. Lautenschlager and Mr. Gallo responded to questions from the Commission
relative to Community outreach and security at the facility. Mayor Dressler opened the Public
Hearing and with no one wishing to speak, closed the public hearing. Vice Mayor Gomez
seconded by Commissioner Bolton moved approval of TO2385 on second reading. Motion
passed unanimously (5-0).
ORDINANCE NO. 0-2018-13
11. QUASI-JUDICIAL HEARING(S):"
a. TBO26 - Safe & Secure Self -Storage - Special Exception Modification.. Special Exception
Approval to allow for the modification of Special Exception conditions of approval, to allow for
the installation of one (1) illuminated reverse channel letter wall sign approximately 30 square
feet in size on the south -facing facade. City Attorney Goren read TBO26 by title into the
record. City Attorney Goren went over the Quasi -Judicial processes and procedures. City
Clerk Teufel swore in all affected parties. Community Development Director Calloway gave a
presentation, a copy of which is on file in the City Clerk's Office. Community Development
Director Calloway said the Planning Board and Staff recommend approval. Attorney Dennis
Mele appeared on behalf of the applicant. Commissioner Placko seconded by Vice Mayor
Gomez moved approval of TBO26. Mr. Mele responded to a few questions from
Commissioner Placko. Mayor Dressler opened the floor for Commission discussion. Mayor
Dressler opened the public hearing and with no one wishing to speak, closed the Public
Hearing. Mayor Dressler asked if anyone had any exparte communication to disclose relative
to this item and all said no. Motion passed unanimously (5-0).
BOARD ORDER NO. BO-2018-07
City Attorney Goren said that TBO27 and TR13178 are companion items and will be heard
together but voted on separately and said the same rules apply to these Quasi -Judicial Items
as the previous item. City Attorney Goren read TBO27 and TR13178 by titles into the record
and both items will be considered during the Public Hearing. City Clerk Teufel swore in all
affected parties. Community Development Director Calloway gave a presentation on TBO27
and TR1378, a copy of which is on file in the City Clerk's Office. Mr. Saleh Elrowemy
appeared on behalf of the applicant and gave a presentation relative to the site improvements
and safety and security of the facility, a copy of which is on file in the City Clerk's Office.
Mayor Dressler opened the floor for Commission discussion. Mr. Elrowemy responded to
questions from Commissioner Placko relative to security at the school. Commissioner Placko
asked Mr. Elrowemy to consider altering some of the colors to fit in with the City's rebranding
and Mr. Elrowmey yes, he will work with staff on that. Vice Mayor Gomez said she is pleased
to see what the applicant has brought before the Commission and the presentations were
excellent and answered a lot of questions. Commissioner Bolton said he is pleased to see a

resident from District 1 operate his business in Tamarac. Mayor Dressler asked if anyone had
any exparte communication to disclose and all said no. Mayor Dressler opened the public
hearing and with no one wishing to speak, closed the Public Hearing.
b. TBO27 - Alazhar School - Special Exception: Special Exception approval to allow for the
use of a private Pre-K — 8th grade school (Alazhar School) in a B-2 Planned Community
Business District) Zoning District pursuant to the Tamarac Code of Ordinances. Vice Mayor
Gomez seconded by Commissioner Bolton moved approval of TBO27. Motion passed
unanimously (5-0).
BOARD ORDER NO. BO-2018-08
c. TR13178 - Alazhar School - Major Revised Site Plan: A Resolution of the City Commission
of the City of Tamarac, Florida, granting Major Revised Site Plan approval (with conditions)
for Alazhar School, to allow for the construction of two (2) new two-story buildings
encompassing 30,385 square feet on the school's existing campus, for the subject property
located at 7201 West McNab Road (Case No. 20-SP-17); providing for conflicts; providing
for severability; and providing for an effective date. Commissioner Bolton seconded by
Commissioner Placko moved approval of TR13178. Motion passed unanimously (5-0).
