HomeMy WebLinkAbout2017-09-13 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, SEPTEMBER 13, 2017 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:21 p.m. on Wednesday, September 13, 2017, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner Michelle J. Gomez and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney David Tolces and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Commissioner Gomez led the Pledge of Allegiance. PROCLAMATIONS AND PRESENTATIONS: 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by BSO Captain Neal Glassman of a Life Saving Award to the family of Mauricio Mesquita for his actions in Saving a Life on February 21, 2016. — The Mesquita Family was unable to attend this meeting. b. Presentation of a Proclamation by Mayor Harry Dressler Commending Michelle Canazaro for Winning Two Silver Medals in the 2017 Special Olympics Winter World Games in Austria (Requested by Mayor Harry Dressler) c. Presentation of a proclamation by Mayor Harry Dressler congratulating the Academy of Finance at JP Taravella High School on being awarded NAF's Distinguished Level of Recognition for the fourth year in a row. (Requested by Commissioner Julie Fishman). This group was unable to attend this meeting and have rescheduled to the October 11, 2017 Commission Meeting. d. Presentation of a proclamation by Mayor Harry Dressler proclaiming September 15 - October 15, 2017 as "Hispanic Heritage Month". (Requested by Commissioner Marlon Bolton) 2. CITY COMMISSION REPORTS: Mayor Dressler and the Commission members applauded City Staff for the work they did prior to and after Hurricane Irma. a. Commissioner Bolton: Commissioner Bolton noted that people are stressed out with not having power. Commissioner Bolton said we survived even though there was some damage sustained by Tamarac communities. Commissioner Bolton said all is not lost we still have our lives. Commissioner Bolton said he wants to let people know that FEMA has added Broward County to the list of counties eligible for Individual Assistance and residents can apply for Page 1 of 9 COMMISSION MEETING September 13, 2017 funding from FEMA. For information and assistance you can call 1-800-621-3362 or go to www.disasterassistance.gov. Commissioner Bolton said people can check the status of their outage by going to https://www.fpl.com/my-account/web-outage.html. Commissioner Bolton encouraged people to like his Facebook page and if they need assistance they can call him at 954-275-3850. b. Commissioner Gomez: Commissioner Gomez welcomed everyone and said she loves Tamarac and thanked the employees for the work they did during and after Hurricane Irma. Commissioner Gomez said she drove through communities and met with residents. Commissioner Gomez said the infrastructure that was done in the past helped tremendously during the hurricane. Commissioner Gomez noted that she received all types of calls with varying concerns. People even complimented the Building Department for adhering to the best building standards. Commissioner Gomez said she spoke with people in other areas and they are not in as good of shape as Tamarac is. Commissioner Gomez said she appreciates everything that everyone has done and is proud to be an American and a Tamarac resident. Commissioner Gomez reported that she attended AFL/CIO gala recently and noted that both of her parents were members and also attended the Professional Firefighter Award Ceremony. c. Commissioner Fishman: Commissioner Fishman added her thanks to the wonderful job that Tamarac's staff and employees did as well as the first responders. Commissioner Fishman said spirits were high and people understood that we were very lucky that we did not get a direct hit and were thankful for the preparation that was done. d. Vice Mayor Placko: Vice Mayor Placko also thanked Tamarac's staff and employees. Vice Mayor Placko said some of these people were here 24/7 taking care of Tamarac and because of that dedication Tamarac is in great shape. Vice Mayor Placko said she was lucky enough to see the kindness of people before and after the storm — neighbors helping neighbors and everyone looking out for each other. Vice Mayor Placko said after the hurricane she was standing in her driveway where all her neighbors congregated and when they saw a Tamarac truck come down the street everyone cheered. Vice Mayor Placko said everyone was so caring and helping people put up shutters and then take them down after the storm. Vice Mayor Placko said she made calls to see if anyone needed anything and they were just grateful to talk with someone. Vice Mayor Placko said she hopes this will continue to spread and encouraged people to stay safe. e. Mayor Dressler: Mayor Dressler said his colleagues pretty much covered everything. Mayor Dressler said he also saw people helping in many different ways. Mayor Dressler said while he was out cleaning up his yard he saw his new neighbor giving him a hand by raking his lawn. Mayor Dressler said a neighbor lent him a battery charger to start his generator. Mayor Dressler said people in Tamarac have a big heart and it is nice to see people helping people. Mayor Dressler reported that FPL has committed to get the entire state up to speed within a week. Mayor Dressler said this is a community and we all participate as "Tamaracians". 3. CITY ATTORNEY REPORT: Assistant City Attorney Tolces said on behalf of City Attorney Goren and the other members of his firm he just wants to say how thankful they are that everyone in Tamarac is safe. Assistant City Tolces said they are proud to be Tamarac's City Attorney's Office and they will be here to offer their assistance. Page 2 of 9 COMMISSION MEETING September 13, 2017 4. CITY MANAGER REPORT: City Manager Cernech thanked the Commission for their kind words for the City's staff. City Manager Cernech noted that he gave his report at the Commission Workshop earlier today. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one wishing to speak, closed Public Participation. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Agenda and City Manager Cernech said there were no changes/additions to the Agenda. Commissioner Gomez seconded by Vice Mayor Placko moved approval of the Consent Agenda. Motion passed unanimously (5-0). a. Approval of the August 23, 2017 Regular Commission Meeting Minutes - APPROVED b. TR12991 - FMIT FY18 Annual Insurance Renewal: A resolution of the City Commission of the city of Tamarac, Florida; authorizing the renewal of general liability, automobile liability, automobile physical damage, workers' compensation, and property lines of coverage with the Florida Municipal Insurance Trust (FMIT) for a one (1) year period beginning October 1, 2017 at a cost of $897,445 and payment of any increase resulting from the annual premium audit; authorizing payment of an insurance option to increase the general liability coverage limit to $5,000,000 for a cost of $26,163; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-94 c. TR12990 - Greenleaf Filter Media Replacement at WTP Project — Change Order #3: A Resolution of the City Commission of the City of Tamarac, Florida, approving Change Order No.3: to the agreement between the City of Tamarac and RF Environmental Services, Inc. and authorizing the appropriate City Officials to accept and execute Change Order No. 3 to the contract between the City of Tamarac and RF Environmental Services, Inc. for an amount of $32,430.32 for funding the Greenleaf Filter floor leveling in all four cells and metal repairs in the Greenleaf Clearwell; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-95 d. TR12974 - Comprehensive Signage Program - Change Order: A Resolution of the City Commission of the City of Tamarac, Florida, approving a net increase of five hundred and five thousand and thirty-seven ($505,037.00) dollars in the contract value for Baron Sign Manufacturing for the fabrication and installation of signs under the Comprehensive Signage Program for a total estimated expenditure of two million two hundred and sixty four thousand two hundred and thirteen ($2,264,213.00) dollars; authorizing the approval of Change Order Number 002 in the amount of one hundred and seventy one thousand eighty seven ($171,087) dollars, attached hereto as Exhibit "A"'; authorizing the inclusion of a City controlled contingency in the project budget in the amount of two hundred and sixty one thousand four hundred and one dollars ($261,401); authorizing an appropriation and expenditure of four hundred and sixty six thousand four hundred and thirty eight ($466,438.00) dollars; authorizing the City Manager or designee to approve line item change Page 3 of 9 COMMISSION MEETING September 13, 2017 orders within the approved budget; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-96 e. TR13000 - Boulevards Drainage Repair Project: A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 17-16B to and approving an Agreement with Johnson -Davis, Inc. for the Boulevards Drainage Repair Project for a contract amount of $295,518.00, a contingency in the amount of $44,328.00 will be added to the account for a project total of $339,846.00; authorizing an appropriation in the amount of $165,496.00 which will be included in a Budget Amendment pursuant to F.S. 166.241(2); authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-97 f. TR 13006 - Change Order No. 1 for Grounds Maintenance Services: A Resolution of the City Commission of the City of Tamarac, Florida, to approve Change Order Number 1 to the Agreement with Prestige Property Management and Maintenance, Inc. for landscape maintenance services of certain public rights -of -way and City parks; authorizing an amount not to exceed $95,000.00 to be added to the contract for variable cost services for a total annual cost of $1,331,078.39; authorizing a Budget Amendment in the amount of $95,000.00 which will be included in a budget amendment pursuant to F.S. 166.241(2); providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-98 g. TR12997 - Agreement with City College for Emergency Medical Services (EMS) Internship Program: A Resolution of the City Commission of the City of Tamarac, Florida, approving a five (5) year term Agreement for Emergency Medical Services (EMS) Internship Program between the City of Tamarac and City College to allow Emergency Medical Services (EMS) students to ride along on City's fire rescue vehicles as part of a preceptorship program and receive education and training from Tamarac Fire Rescue personnel with an effective date upon execution by all parties, authorizing appropriate City Officials to execute the Agreements for EMS Internship Program and Business Associate; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-99 h. TR 13007 - Water and Sewer Rate - FY 2018: A Resolution of the City Commission of the City of Tamarac, Florida, establishing the adjustment factor to be applied to the annual water and sewer rate schedule for the Fiscal Year beginning October 1, 2017; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-100 i. TR13005 - Reaffirming the City's Ongoing Commitment to Inclusive Community: A Resolution of the City Commission of the City of Tamarac, Florida, reaffirming Tamarac's ongoing commitment to being an Inclusive Community and continuing to provide programs and services that meet the needs of our diverse community; directing the City Clerk to transmit a copy of this Resolution to the National League of Cities, the Florida League of Cities, the Broward League of Cities, the other Cities throughout Broward County, and any other interested parties; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-102 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this hearing. 8. ORDINANCE(S) - FIRST READING: a. TO2360 - General Employees' Pension Fund Amendment: An Ordinance of the City Commission of the City of Tamarac, Florida; amending Chapter 16, Pension and Retirement, Article III, Employees' Pension Plan and Article IV, Benefits, providing for the purchase of credited service for qualifying service in the United States Military; providing for the purchase of prior service following subsequent re-employment with the City; providing for language which limits the selection of a lump sum benefit option; providing for a non -service connected disability after two or more years of service; providing for a cost of living adjustment for Deferred Retirement Option Plan participants; providing for a savings clause; providing for severability; providing for codification and providing for an effective date. APPROVED ON FIRST READING SEPTEMBER 13, 2017. 9. PUBLIC HEARING(S) Mayor Dressler welcomed everyone and said this is a Regular Meeting of the City Commission of the City of Tamarac to hold Public Hearings on the Annual Fire Assessment, the Annual Stormwater Utility Management Fee Assessment, the Annual Solid Waste Collection Services Assessment, the Nuisance Abatement Assessment and the setting of the Tentative Millage Rate and the Tentative City Budget for Fiscal Year 2018. These public hearings are the culmination of an entire year's work by this City Commission, the City Manager and staff. For the benefit of the public tonight, the City Commission held workshops throughout the year as well as a budget workshop on June 29, 2017 to provide direction to the staff on this submittal. I would like to thank my colleagues on the dais for their participation at the workshops and for their suggestions as we deliberated on the staff recommendations. City Manager Cernech made the following statement: "The City of Tamarac has used the Fire Rescue Assessment since 1997 to provide specific funding for the purpose of providing fire rescue services in the City of Tamarac. As the City Commission is aware, the Fire Rescue Assessment has been determined to be an equitable and efficient methodology to use in Page 5 of 9 COMMISSION MEETING September 13, 2017 apportioning the cost of Fire Rescue Services to improved properties thus reducing the overall burden on the ad valorem tax rate. The residential rate for FY 2018 will remain at $350 per dwelling unit with no change from last year. The City conducted a study on the Fire Rescue Assessment in 2016 and based upon calls for service and a five-year budget forecast for the cost of providing Fire Rescue Services, Staff recommends the City Commission approve the rates that have been proposed and approved for publication at the July 12, 2017 Preliminary Fire Assessment Rate hearing and subsequently advertised for public hearing on August 21, 2017." a. TR 12992 Fiscal Year 2018 Fire Rescue Assessment Resolution: A Resolution of the City Commission of the City of Tamarac, Florida, relating to the provision of fire rescue services, facilities and programs in the City of Tamarac, Florida; reimposing Fire Rescue Assessments against assessed property located within the City of Tamarac for the Fiscal Year beginning October 1, 2017; approving the rate of assessment; approving the assessment roll; providing for conflicts; providing for severability; providing an effective date. Motion passed unanimously (5-0). RESOLUTION R-2017-103 City Manager Cernech made the following statement: "The City of Tamarac has been using a special assessment for the collection of the Stormwater Utility Management Services Fees since 2014. This assessment is an equitable and efficient method of allocating and collecting the Stormwater Utility Management Services Fee Assessed Cost among all the parcels in the City. The rate per equivalent residential unit (ERU) for FY 2018 is $124.09 and is an increase of $3.60 or 3% over the previous year in accordance with our Code of Ordinances. Staff recommends the City Commission approve the rate that has been proposed and approved for publication at the July 12, 2017 Preliminary Stormwater Utility Management Fee Assessment Rate hearing and subsequently advertised for public hearing on August 21, 2017." b. TR 12993 - FY 2018 Annual Stormwater Fee Assessment: A Resolution of the City Commission of the City of Tamarac, Florida, relating to the levy and collection of the City's Stormwater Management Utility Fee within the municipal boundaries of the City of Tamarac for the Fiscal Year beginning October 1, 2017; approving, confirming, and adopting the Stormwater Management Utility Fee and Stormwater Management Utility Fee roll, providing for other matters relating to the levy and collection of the Stormwater Management Utility Fee on the annual property tax bills; providing for conflict; providing for severability; and providing for an effective date. RESOLUTION R. 2017-104 Page 6 of 9 COMMISSION MEETING September 13, 2017 City Manager Cernech made the following statement: "The City of Tamarac has been using a special assessment for residential solid waste collection services since 2013. This assessment is an equitable and efficient method of allocating and collecting the Residential Solid Waste Collection Services Assessed Cost among single family residential type parcels. The residential rate for FY 2018 is $273.75 per residential dwelling unit receiving curbside pickup and is the same rate as the previous five years. Staff recommends the City Commission approve the rate that has been proposed and approved for publication at the July 12, 2017 Preliminary Solid Waste Collection Services Assessment Rate hearing and subsequently advertised for public hearing on August 21, 2017." c. TR 12994 FY 2018 Residential Solid Waste Assessment Resolution.. A Resolution of the City of Tamarac, Florida, relating to the provision of Residential Solid Waste Collection Services in the City of Tamarac, Florida; approving the assessment rate for Residential Solid Waste Collection Services for the Fiscal Year beginning on October 1, 2017; imposing a Residential Solid Waste Collection Assessment against assessed property located within the City of Tamarac for the Fiscal Year beginning on October 1, 2017; providing for severability; providing for conflicts; and providing an effective date. Motion passed unanimously (5-0). RESOLUTION R. 2017-105 City Manager Cernech made the following statement: "In 2012, the City Commission adopted the Public Nuisance Abatement Ordinance. As part of that ordinance, the City Commission authorized the use of special assessments for amounts billed but unpaid as of June 1 of the year following the abatement of the public nuisance. The City abated fourteen (14) public nuisances between June 1, 2016 and May 31, 2017 on ten (10) properties one of which has paid. The remainder of the amounts are delinquent as of this date. City Staff has prepared the special assessments against each property with unsettled liens, the total of which is $6,054.88 to be collected on the tax bills for Fiscal Year 2018. This is the fifth year using this type of assessment. Staff recommends the City Commission approve the Public Nuisance Abatement Special Assessment that was approved for publication at the July 12, 2017 Preliminary Public Nuisance Abatement Assessments hearing and subsequently advertised for public hearing on August 21, 2017." d. TR 12995 FY 2018 Nuisance Abatement Assessment Resolution.. A Resolution of the City Commission of the City of Tamarac, Florida, relating to the provision of nuisance abatement on certain real properties by the City in accordance with Chapter 9, article II, Division V of the City's Code of Ordinances, approving the collection of a Nuisance Abatement Special Assessment on real property that has been specially benefited by the City's abatement of nuisances thereon; approving a Nuisance Abatement Assessment Roll; providing for conflict; providing for severability; and providing for an effective date. Commissioner Fishman seconded by Commissioner Bolton moved approval of TR12995. Motion passed unanimously (5-0). RESOLUTION R-2017-106 Mayor Dressler made the following statement: "This is the first public hearing for establishing the Operating Millage Rate for Fiscal Year 2018. A second public hearing on Temporary Ordinance Number 2362 will be held on Monday, September 25, 2017 at 5:05 pm." City Manager Cernech made the following statement: "In accordance with the Truth in Millage requirements of Florida Statutes, the City is required to announce the percentage difference between the proposed millage rate and the rolled -back rate. As such, the following is read into the record: The proposed operating millage rate of 7.2899 mills for Fiscal Year 2018 is .6115 mills or 9.16% more than the rolled -back rate of 6.6784 mills." e. T02362 - FY 2018 Millage Rate Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida to establish and levy ad valorem taxes within the corporate limits of the City of Tamarac, Florida, for the Tax Year 2017; providing for the levy of ad valorem taxes in the amount of 7.2899 mills ($7.2899 per $1,000) based upon the assessed value on non- exempt real and personal property located within the city limits of the City of Tamarac; providing for conflicts; providing for severability; and providing for an effective date. Mayor Dressler opened the public hearing and with no one wishing to speak, closed the Public Hearing. Commissioner Fishman seconded by Commissioner Gomez moved approval of T02362. Motion passed 4-1 with Commissioner Bolton dissenting PASSED ON FIRST READING SEPTEMBER 13, 2017. Mayor Dressler made the following statement: "This is the first public hearing to establish the Fiscal Year 2018 Operating Budget, Capital Budget and Financial Policies. A second public hearing on Temporary Ordinance Number 2363 will be held on Monday, September 25, 2017 at 5:05 p.m. City Manager Cernech made the following statement: "The tentative operating and capital budget for Fiscal Year 2018 is $156,357,304 which is $39,666,993 less than the Amended Budget of $196,024,297 for Fiscal Year 2017. The tentative general fund budget, which is the primary fund for providing governmental services such as, our contract with BSO, general and administrative services, public services, and parks and recreation, is $62,905,031 which is $1,656,823 more than the Amended Budget of $61,248,208 for Fiscal Year 2017. In addition, the financial policies are included as part of the adoption of the annual budget. These financial policies are an integral part of our long-term financial planning for the City. These policies set parameters for operating management, including establishing reserves for specific purposes, establishing accounts management and financial planning policies and establishing policies on economic resources. f. TO 2363 FY 2018 Budget Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida, adopting the operating budget, revenues and expenditures, the capital Page 8 of 9 COMMISSION MEETING September 13, 2017 budget, and the financial policies for the Fiscal Year 2018; providing for conflicts; providing for severability; and providing for an effective date. Assistant City Attorney Tolces read T02363 by title into the record. Finance Director Mason gave a presentation, a copy of which is on file in the City Clerk's Office. Commissioner Bolton said that this is his first budget hearing and when he got his budget book he read through the whole book. He sought advice from people other than City Staff. Commissioner Bolton said he supports a majority of the budget; however, the only thing he does not like is the millage rate and thinks we can do more with less. Commissioner Bolton said he wants it on the record that he supports the budget but not the millage rate. Mayor Dressler opened the public hearing and the following individual spoke: Lisa Aronson of Family Central 1415 Cypress Creek Rd., Coconut Creek, FL., said Family Central is grateful for Tamarac's continued support of their facility and for the increase in support that Tamarac has given Family Central. Ms. Aronson thanked the Commission for their support of the food drive and thanked Vice Mayor Placko for her service on the Family Central Board. With no one else wishing to speak, Mayor Dressler closed the Public Hearing. Vice Mayor Placko seconded by Commissioner Gomez moved approval of T02363 on first reading. Motion passed unanimously (5-0). PASSED ON FIRST READING SEPTEMBER 13, 2017 Mayor Dressler thanked everyone for their work on the budget. Mayor Dressler said staff has done a tremendous job of providing the Commission with quarterly budget reviews. Mayor Dressler thanked the Finance Department and anyone who provided input in the budget process. 10.
