HomeMy WebLinkAbout2017-10-11 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, OCTOBER 11, 2017 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:09 p.m. on Wednesday, October 11, 2017, in City Commission Chambers, Tamarac City Hall, 7525 NW 88t" Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner Michelle J. Gomez and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Placko led the Pledge of Allegiance. Mayor Dressler called for a moment of silence in memory of former Commissioner Diane Glasser. Mayor Dressler talked about Ms. Glasser's many years of dedicated service to Tamarac and the residents of Broward County. Mayor Dressler said the lowering of the Flag is decreed by the Governor by law. We have not done this before for a City Commissioner or Mayor and he does not oppose lowering the flag in honor of Ms. Glasser. Commissioner Fishman seconded by Vice Mayor Placko moved to lower the flag to half-staff in honor of former Commissioner Diane Glasser through Sunday, October 15, 2017. Motion passed unanimously (5-0). Mayor Dressler said he is moving out of the order of the agenda to let representatives from AshBritt address the Commission relative to debris removal. AshBritt Chairman Randy Perkins introduced himself and AshBritt CEO Brittney Perkins to the Commission. Mr. Perkins said Executive Vice President Jared Moskowitz asked for a meeting with City Manager Cernech and city managers from three other cities - Pompano Beach, Deerfield Beach and Parkland - as there was a commitment made by AshBritt to stabilize the market throughout Florida. Mr. Perkins went over in great detail the events of the debris collection after Irma, and also discussed contract issues. Mr. Perkins said AshBritt came before the Commission in order to stabilize the market and stop the exodus of trucks from Tamarac. Mr. Perkins said they were able to stabilize the market, and as such he is here tonight asking to revoke the surcharge agreement and go back to the regular rate as set forth in the original agreement. Mr. Perkins talked about conversations he had with Governor Scott prior to Irma. Mr. Perkins talked about meeting with the Attorney General's Office. Mr. Perkins said they were going back to the original contract amount of $8.60 per cubic yard, and doing away with the surcharge that was agreed to on September 27, 2017. Mayor Dressler said this is not politics this is business. City Attorney Goren said AshBritt never signed the Amendment to the Agreement so the contract in force is the original contract. Mr. Perkins said he will sign whatever documents are requested by the City relative to rescinding the Amendment to the Agreement. Mayor Dressler expressed his concern about not having enough equipment to expeditiously pick up the storm debris. Mr. Perkins said he wants it on the record that AshBritt will make sure that Tamarac is cleaned up, the time line will not change and that the surcharge goes away. Ms. Perkins, Ashbritt CEO, also made a commitment that resources Page 1 of 6 COMMISSION MEETING October 11, 2017 will stay at current capacity. Mr. Perkins noted that they will look at things differently in the future and take away the lessons learned from this historic event. Mayor Dressler moved back into the order of the Agenda to take up Proclamations and Presentations. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by BSO Captain Neal Glassman of a Life Saving Award to the family of Mauricio Mesquita for his actions in Saving a Life on February 21, 2016 b. Presentation of a proclamation by Mayor Harry Dressler congratulating the Academy of Finance at JP Taravella High School on being awarded NAF's Distinguished Level of Recognition for the fourth year in a row. (Requested by Commissioner Julie Fishman). c. Presentation of a proclamation by Mayor Harry Dressler proclaiming October 22, 2017 as "Bicentenary of the Birth of Baha'u'llah". (Requested by Mayor Harry Dressler) d. Presentation of Certificates of Appreciation to Hurricane Irma Volunteers from Tamarac CERT and Tamarac Fire Rescue Cadets. (Requested by Tamarac Fire Rescue Public Education and Emergency Preparedness Specialist Van Schoen) e. Presentation of a proclamation by Mayor Harry Dressler proclaiming the week of October 15 - 21, 2017 as "Freedom From Workplace Bullies Week". (Requested by Commissioners Julie Fishman and Marlon Bolton) f. Presentation of a proclamation by Mayor Harry Dressler proclaiming the Month of October 2017 as "National Bullying Prevention Month". (Requested by Commissioner Marlon Bolton) 2. CITY COMMISSION REPORTS: a. Commissioner Bolton: Commissioner Bolton said he was advised by Broward County School Board Member Dr. Rosalind Osgood to back a cause, and make sure that our youth are always looked after. Commissioner Bolton said bullying is not given enough attention: 49% of children in grades 4 to 12 reported being bullied, and 30.8% of children report bullying other children. Commissioner Bolton said this is a problem we have in our communities and work places. Commissioner Bolton thanked Mayor Dressler for making sure the two proclamations went forward. Commissioner Bolton said for the short time he knew Diane Glasser she was very supportive of him and had many conversations with her. Commissioner Bolton said he knows her soul is resting in peace. Commissioner Gomez: Commissioner Gomez expressed her condolences to the family of Diane Glasser, and noted that everybody knew and loved her. Commissioner Gomez also expressed her condolences to the victims and families of the Las Vegas shooting. Commissioner Gomez said bullying also happens to adults. Commissioner Gomez said if you put something on Facebook let it be positive, and don't post anything negative. Commissioner Gomez said she attended the Affordable Housing Committee meeting of the Broward County Planning Council, the Taste of Tamarac Launch Party, invited people to the Page 2 of 6 COMMISSION MEETING October 11, 2017 Taste of Tamarac on October 14th at the Community Center from 11:30 a.m. to 3.00 p.m., attended the National League of Cities transportation Infrastructure Services Committee meeting, toured the Wheelabrator facility along with Vice Mayor Placko, attended the Chamber of Commerce Farewell event for Fire Chief Mike Burton, Tamarac Fire Rescue Awards/Pinning Ceremonies, Juke Box Bingo, Employee appreciation luncheon and the sixth annual P.A.R.O.T. bowling event. Commissioner Gomez invited everyone to join her at her Conversation with the Commissioner on October 30, 2017 at 10:30 a.m. at the Metro Diner. c. Commissioner Fishman: Commissioner Fishman said she echoed the sentiments of colleagues relative to the passing of Diane Glasser and added that she has sent condolences to her family and friends. Commissioner Fishman said that for the remainder of her term she knows it will be Diane Glasser's seat she is in. d. Vice Mayor Placko: Vice Mayor Placko said Diane Glasser was a colleague and a friend, and will be missed. Vice Mayor Placko said she attended the Tamarac Fire Rescue Awards/Pinning Ceremonies and took a tour of the Wheelabrator facility which was a fascinating tour. Vice Mayor Placko invited people to the Taste of Tamarac event on Saturday, October 14th from 11:30 a.m. to 3:00 p.m., and the reception for the Artist Phil Prentice at the Community Center on Thursday, October 12, 2017 from 4:30 p.m. to 8:30 p.m. Vice Mayor Placko said each year they try to collect Thanksgiving food baskets for distribution through Family Central. This year Vice Mayor Placko said she hopes her colleagues will join with her in this endeavor. Vice Mayor Placko said we have so many families who will not have Thanksgiving dinner. Vice Mayor Placko went over a list of nonperishable items that could be included in the baskets. Vice Mayor Placko said if anyone has any questions to please call her. e. Mayor Dressler: Mayor Dressler said that every two weeks the Commission members attend numerous events. One of the events he attended was the Tamarac Fire Rescue Award/Pinning Ceremonies, and noted that it was a very meaningful event because of the families that attended. Mayor Dressler talked about hanging out at the fire station in his neighborhood in Boston when he was a child. Mayor Dressler said Tamarac hosted the Northwest Council of Elected Officials on Monday where the main topic of discussion was the collection of storm debris. Mayor Dressler noted that Tamarac's employees are the best. Commissioner Bolton said he forgot to mention that he will not be able to attend the Taste of Tamarac event on Saturday as he has a conflict of interest with his church, and will be out of town. 3. CITY ATTORNEY REPORT: City Attorney Goren said a sub -committee of the Charter Review Commission of Broward County was about to consider an issue with regards to the County's potential siting of facilities, projects and pertinences within municipalities as a Charter issue. City Attorney Goren noted, for the record that, he serves as general counsel for the Charter Review Commission for the Infrastructure Sub -Committee on this specific item as the League of Cities will be looking at the subject matter very carefully. The proposal which will be appearing before the Infrastructure Sub -Committee on October 30, 2017 is a proposal from the County to change the Charter to basically allow for pre-emptive rights of the County Commission to provide the siting of facilities, projects and pertinences which is like the pre-emption for land use items. City Attorney Goren said the proposal is only before a sub -committee; there are four sub -committees: Governance, Ethics, Infrastructure and Page 3 of 6 COMMISSION MEETING October 11, 2017 Human Services. The fact is that this particular sub -committee is looking at the subject matter, and will take ten members, under Charter, of the entire Commission to actually draft a Charter Amendment, and it takes thirteen members of the entire Review Commission to actually place an item on the ballot. Proposed ballot questions are required to be submitted by June of 2018 for access to the November 2018 ballot. The Sub -committees have to wind up their work by November allowing for some review time, and to hold public hearings that will occur between December and probably May of 2018. Mayor Stermer from Weston has picked up the banner on this item, and he will be aggressively involved with the League and with the Committee with regards to opposing the document. City Attorney Goren talked about some issues in Broward County whereby the Commission wanted to take over siting issues. City Attorney Goren said the Governance Sub -Committee last Friday voted to support an elected Mayor in Broward County who would have a term of two consecutive four years of service; it would be a partisan position with a full-time salary. The consequence of which nobody is happy. The Committee will meet next month to recommend to the full Commission a proposal to draft an actual ballot question. There is still debate regarding creating a separate position which would be a 9+1; there would exist nine separate districts, and one member to have veto power which means that person could commiserate with members of the County Commission without a Sunshine issue. There was a discussion regarding the Sunshine law relative to this issue, and the voting process. City Attorney Goren responded to a few questions and comments from the Commission. Mayor Dressler said he felt this was the worst idea he has heard, and concentrations of power should be avoided at all costs. 4. CITY MANAGER REPORT: City Manager Cernech said BSO will be holding its Operation Medicine Cabinet and Shred-A-Thon on Saturday, October 21st from 10:00 a.m. to 1:00 p.m. at Kings Point 7620 Nob Hill Rd. You can bring unused, unwanted or expired medications for safe disposal, and if you have any questions you can call 954-831-8902. Broward County residents can also bring their personal documents for shredding Which is cost free. City Manager Cernech reported that the Chamber of Commerce will be hosting its annual Taste of Tamarac on Saturday, October 14, 2017 from 11:30 a.m. to 3:00 p.m. at the Community Center. City Manager Cernech invited people to the free Halloween Hoopla on Friday, October 20th from 6:00 p.m. to 8:00 p.m. at the Tamarac Recreation Center. City Manager Cernech said he will be adding an item to the Consent Agenda tonight for the appointment of Percy Sayles as the new Fire Chief asking the Commission to confirm the appointment. City Manager Cernech said when he arrived in Tamarac in 2001 there was conversation about creating succession planning in the Fire Rescue Department. That discussion continued until 2010 when we brought in Fire Chief Mike Burton to address succession planning in order to be able to promote from within, and not having to go outside. One of the things Fire Chief Burton was tasked with was to develop a leadership group within the department which he accomplished, and where Chief Sayles was the leader. City Manager Cernech said he is proud to be able to promote Chief Sayles, and proud to see that he has made the same commitment for the people in the department and give them the opportunity to advance their careers in Tamarac Fire Rescue. City Manager Cernech added that if there is no opportunity for advancement in the department talent will be lost. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke: Percy Johnson, 7379 N. Devon Dr., thanked the Commission for making Page 4 of 6 COMMISSION MEETING October 11, 2017 the decision to lower the flag in honor of Diane Glasser who devoted herself to Tamarac. Mr. Johnson said he worked with Ms. Glasser for six years, and she was more than a mentor and friend, she was family. Mr. Johnson said services will be held at the Star of David on Saturday, October 15th at 10:30 a.m. Joel Davidson, 4608 Norfolk Pine Island Dr., expressed his condolences to Diane Glasser's family, and asked the City to honor her memory in some other way as well. Mr. Davidson said he was not able to attend the workshop on Monday, but viewed the audio and he agrees that vacation rentals are a huge problem in Tamarac and is in favor of a registration program. 6. CONSENT AGENDA: Mayor Dressler asked if there were any changes/additions to the Consent Agenda, and City Manager Cernech said Item No. 6 (d) TR13013 — 2018 State Legislative Agenda has been amended to incorporate two Florida League of Cities priorities: water funding and transportation funding as discussed at the October 9, 2017 workshop. City Manager Cernech said that Commissioner Fishman has requested that the actual priorities in the League's Agenda be incorporated into our Agenda verbatim. Commissioner Gomez seconded by Vice Mayor Placko moved approval of TR13013 as amended. City Attorney Goren read TR13013 by title into the record. Motion passed unanimously (5-0). City Manager Cernech said as discussed TR13018 - Appointment of Fire Chief is being added to the Consent Agenda as item 6 (f). City Manager Cernech read TR13018 by title into the record. Vice Mayor Placko seconded by Commissioner Gomez moved approval to add TR13018 to the Consent Agenda. Motion passed unanimously (5-0). Commissioner Gomez seconded by Commissioner Fishman moved approval of the Consent Agenda as amended. Motion passed unanimously (5-0). Mayor Dressler congratulated Fire Chief Sayles on his promotion and noted that it is good that we did not have to go outside of the organization. Fire Chief Sayles thanked the Commission and said he is excited to accept the position, and he will continue to provide excellent service to the City of Tamarac. a. TR12989 - SBA Towers Lease Agreement - Aquatic Center: A Resolution of the City Commission of the City of Tamarac, Florida, approving the option & land lease agreement, memorandum of land lease and the memorandum of option and land lease with SBA Towers IX, LLC and authorizing the appropriate City Officials to execute the said documents for the construction of a stealth cellular facility in the City's Aquatic Center property located at 9300 NW 58th street, Tamarac, Florida 33321 at a monthly rent of $2,200 per month for a maximum term of fifty-five (55) years. RESOLUTION R-2017-113 d. TR13013 - 2018 State Legislative Agenda: A Resolution of the City Commission of the City of Tamarac, Florida, approving the City of Tamarac Legislative Agenda for the 2018 State of Florida Legislative Session; directing the City Clerk to transmit a copy of the City of Tamarac Legislative Agenda for the 2018 State Legislative Session to the Florida League of Cities, the Broward League of Cities, the Broward County Legislative Delegation and the Broward County Board of County Commissioners; providing for conflicts; providing for severability; and providing for an effective date. TR13001 - Renewal of Liability Waiver Agreement with BSO Regional Logistics Unit: A Resolution of the City Commission of the City of Tamarac, Florida, to approve a liability waiver agreement renewal with Broward Sheriff's Office (BSO) to purchase emergency medical and firefighting equipment, and supplies from Broward County Sheriff's Office Fire Rescue Regional Logistics Unit in an amount of one hundred fifty seven thousand ($157,000) dollars annually for FY18 and FY19, a total amount not to exceed three hundred fourteen thousand ($314,000) dollars for a two year period; authorizing the appropriate City Officials to execute a liability waiver agreement for the purchases; providing for conflicts, providing for severability; and providing for an effective date. RESOLUTION R-2017-115 f. TR13018 — Appointment of Fire Chief: A Resolution of the City of Tamarac, Florida, appointing Percy Sayles as Fire Chief, effective October 7, 2017, or at such date is mutually agreed upon; providing for conflicts; providing for severability; and providing for an effective date.
