HomeMy WebLinkAbout2017-05-10 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, MAY 10, 2017 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:18 p.m. on Wednesday, May 10, 2017 in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner Michelle J. Gomez, and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Commissioner Bolton led the Pledge of Allegiance. 1. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of May 2017 as "Haitian Heritage Month". (Requested by Commissioner Marlon Bolton) 2. CITY COMMISSION REPORTS: a. Commissioner Bolton: Commissioner Bolton thanked staff for putting together the District 1 Neighborhood meeting at the Mainlands 6 Clubhouse. The meeting was well organized and well attended. Commissioner Bolton said he attended, along with other members of the Commission, the Protect the Children Gala which raises funds for children who have been abused. Commissioner Bolton congratulated the Tamarac University Students and encouraged them to Page 1 of 1 COMMISSION MEETING May 10, 2017 get out into the community and talk about their experience. Commissioner Bolton announced that he has been appointed to the National League of Cities Public Safety and Crime Prevention Committee and briefly went over the issues the Committee will be addressing. Commissioner Bolton said this is Haitian Heritage Month and this is about the culture and not the color of someone's skin. Commissioner Bolton said he will be bringing forth a resolution for Haitian Relief. Commissioner Bolton wished everyone a Happy Mother's Day. b. Commissioner Gomez: Commissioner Gomez wished everyone a Happy Mother's Day. Commissioner Gomez said she also attended the Protect the Children Gala which raises awareness about child exploitation. Commissioner Gomez said the P.A.R.O.T Golf event was a great fund raiser. Commissioner Gomez said she was glad to see that some of the TU students stayed for the meeting and acknowledged TU alumni that were in attendance. Commissioner Gomez attended the Alazhar School Breakfast Ceremony, the Broward 211 Breakfast and the Chamber of Commerce Breakfast. Commissioner Gomez noted that Dr. Barbara Weinstein was honored at the Protect the Children Gala and that she is looking forward to the dedication of Fire Station 78 tomorrow. c. Commissioner Fishman: Commissioner Fishman said she attended the Kings Point Hadassah Israel Independence Day Celebration; the Broward 211 Breakfast where Tamarac resident Sandra Bastien was recognized for her work; the Kiwanis Christmas in July Breakfast which aides homeless children in Tamarac and the Tamarac Veteran's Affairs Committee meeting. d. Vice Mayor Placko: Vice Mayor Placko said she met with corporate representatives from 711 last week as they have promotions to help schools. Tamarac Elementary Principal Roberta Ray was also in attendance. Tamarac Elementary will receive a $711 check each year to be used for whatever they need and they were given coupons for the children to use. Vice Mayor Placko said she also met with Peter Mason, Executive Director of the Tamarac Chamber of Commerce as well as individuals from BSO to talk to the representatives from 711 and they were also provided with coupons that they can distribute to Tamarac residents. Vice Mayor Placko said 711 will also contribute to BSO's Night Out event and indicated that she is looking forward to working with 711. Vice Mayor Placko said that she formed a Woodmont Advisory Committee to keep the community engaged and address issues before they get out of control. Vice Mayor Placko said she attended the Faircrest 14 HOA meeting. Vice Mayor Placko said we have to do something about children going hungry and announced there will a food drive conducted beginning May 15th through May 31St. Drop off boxes will be in City Hall and the Community Center for the collection of non-perishable foods. Vice Mayor Placko asked the Commission members to get this information out to the residents in their Districts. Tamarac elementary will also be conducting a food drive. Vice Mayor Placko thanked everyone who helped last year and hoped they will help out again this year. e. Mayor Dressler: Mayor Dressler said the numerous meetings that the Commission attend are very much a part of their lives. Mayor Dressler announced he will be installed as the Vice President of the Broward League of Cities Executive Board at their meeting in June. Mayor Dressler noted that he attended an event and was interviewed by a Jamaican TV station regarding the issue of child abuse. Mayor Dressler talked about the extensive problem of abuse in many forms during the interview. Mayor Dressler said he wrote a piece about insurance companies requesting rate increases and being granted increases in excess of what they requested. Mayor Dressler noted that Homeowner Choice asked for a 3.3% increase in their rates, however, they were granted an 8% increase in rates. Mayor Dressler opined that this is clearly outrageous and someone in the legislature or the Governor's office should keep this kind of robbery from happening. CITY ATTORNEY REPORT: City Attorney Goren said on the dais this evening there is a request for a conflict waiver from the Gray Robinson law firm which represents Tamarac in various telecommunications matters. Attorney Paul H. Minoff of that firm has been asked to represent JPMorgan Chase with respect to code violations issued by the City against property located at 8211 NW 74th Ave. City Attorney Goren said in the event of litigation related to this matter, Gray Robinson has agreed to end their representation of Chase. Mayor Dressler said he is a good friend of Gary Resnick, a member of the Gray Robinson law firm, and has no conflicts other members of the Commission said they also did not have any conflicts. Commissioner Gomez seconded by Commissioner Bolton moved to adopt the waiver. Motion passed unanimously (5-0). City Attorney Goren said his firm will be forwarding a copy of their legislative report to the Commission shortly. City Attorney Goren said there are two bills they are looking at; S.B. 80 which is relative to public records. City Attorney Goren talked about several instances of frivolous records requests. City Attorney Goren read several pertinent sections of the bill into the record. City Attorney Goren said his office will be providing a form of notice to the City to be posted in City Hall with regards to noting the agency's custodian of record and contact information as is required by this bill. City Attorney Goren said HB 687 creates the Advanced Wireless Infrastructure Deployment Act, which establishes a process by which wireless providers may place certain "small wireless facilities" on, under, within, or adjacent to certain utility poles or wireless support structures within public rights -of -way that are under the jurisdiction and control of an "authority" (i.e. a municipality). The bill provides that an authority may not prohibit, regulate, or charge for the collocation of small wireless facilities in the public rights -of -way, except as specified in the bill. The bill caps the rate for collocation on an authority utility pole at $150 annually. City Attorney Goren noted that Tamarac does have an ordinance in place and there may be some play for us relative to this issue. 4. CITY MANAGER REPORT: City Manager Cernech invited people to attend the dedication of Tamarac's New Fire Station 78 at on Thursday, May 11, 2017 at 10:30 a.m. at 4801 West Commercial Blvd. Tours will be conducted and there will be an opportunity to meet Albert Paley the artist who created the building's signature sculpture "Vigilance". City Manager Cernech announced that Tamarac was notified that we will be receiving the U.S. Centers for Disease Control and Prevention (CDC) Water Fluoridation Quality Water Award for the year 2015. This award recognized communities that achieved excellence in Community Water Fluoridation by maintaining a consistent level of fluoridated water throughout 2015. City Manager Cernech reported Tamarac Veterans will be taking part in the Honor Flight on Saturday, May 20, 2017. Tamarac will provide transportation for six Tamarac Veterans to the Miami International Airport where they will catch a flight to Washington, D.C. to visit the war memorials dedicated in their honor. Our veterans are part of a group of 692 World War II and Korean War Veterans participating in the May 20th flight. The Veterans and their Guardians will depart from City Hall at 3:45 a.m. and we encourage people to give our Veterans a great send off and join us at City Hall prior to 3:45 a.m. to show your appreciation. Tamarac will also be providing return transportation. City Manager Cernech invited people to attend the Concert on the Green in Partnership with the City of Tamarac and Colony West Golf Club on Friday, May 19, 2017 from 7:00 p.m. to 9:00 p.m. Page 3 of 3 COMMISSION MEETING May 10, 2017 featuring the band "TK Blu & the Uncool". Food and drinks are available for purchase and coolers and pets are not allowed. City Manager Cernech said Public Services has reported that the Sunset Point Park Sunset Hammock Artwork at 11000 W. McNab Road will reflect the spirit of Tamarac and be visible to pedestrians and passerby traffic from the Sawgrass Expressway both day and night. This project includes the fabrication and installation of a custom piece of artwork and staff is currently preparing the final documentations to advertise this project for bidding. The estimated start date is in the fall of 2017 and will take one year to complete. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one wishing to speak, closed the public hearing. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda. City Manager Cernech said there were no changes/additions to the Consent Agenda, however, Item 6 (d) TR12938 — Reciprocal Use Agreement between the City and the School Board of Broward County has been redistributed to the Commission due to a scrivener's error; all of the terms and conditions of the agreement have remained the same. Commissioner Bolton seconded by Commissioner Gomez moved approval of the Consent Agenda. Motion passed unanimously (5-0). a. Approval of the April 26, 2017 Regular Commission Meeting Minutes. — APPROVED. b. TR12931 - Execution of Agreement with SAK Construction - FY17 Wastewater Cured -In -Place Pipe Lining Inflow & Infiltration Project UT17D: A Resolution of the City Commission of the City of Tamarac, Florida, awarding a contract to SAK Construction, LLC, utilizing pricing from an agreement obtained through a formal competitive process by City of Mobile Alabama, Mobile Area Water and Sewer System, Contract Number 100316.22 for the FY17 Wastewater Cured -In - Place Pipe Lining Inflow and Infiltration Project; authorizing the appropriate City Officials to execute a Purchase Order Agreement with SAK Construction, LLC for a project cost of $2,077,398.00, with a contingency of 5% or $103,869.90 for an amount not to exceed $2,181,267.90; authorizing the appropriate City Officials to administer the contract; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-44 c. TR 12946 - Award Bid No. 17-12B for Refurbishing City Hall Cooling Towers: A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 17-12B to and approving an agreement with A-1 Paradise Plumbing, Inc. d/b/a Paradise Service Technologies for refurbishing the two cooling towers at City Hall located at 7525 N.W. 88th Avenue for a contract amount of $63,280.00 and a contingency in an amount of $6,328.00, will be added to the project for a total project budget of $69,608.00; authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-45 d. TR12938 - Reciprocal Use Agreement between the City and the School Board of Broward County: A Resolution of the City of Tamarac, Florida, authorizing the appropriate City Officials to execute a Reciprocal Use Agreement between the City of Tamarac and the School Board of Broward County, Florida, to provide reciprocal use of City and School Board facilities for a term of five (5) years, commencing on June 3, 2017 and expiring on June 2, 2022; providing for conflicts; providing for severability; and providing an effective date. TR12945 Grant Award Amendment: Broward Redevelopment Program — Tamarac Village A Resolution of the City Commission of the City of Tamarac, Florida amending the Broward Redevelopment Grant Program grant agreement between Broward County and the City of Tamarac through the Broward County Environmental Protection and Growth Management Department for the Tamarac Village Development Project; authorizing and providing for the appropriate city officials to execute necessary documents required to amend this agreement; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-47 f. TR12948 - Server Replacement: A Resolution of the City Commission of the City of Tamarac, Florida approving the acquisition of Cisco servers from Prosys Information Systems; authorizing an expenditure for an amount not to exceed $100,129.66; authorizing budget amendments for proper accounting purposes; providing for conflicts; providing for severability; and providing for an effective date. T02358 - Ordinance Eliminating Ban on Sunday Morning Alcohol Sales: An Ordinance Of The City Commission Of The City Of Tamarac, Florida, Amending Chapter 3, Of The City Of Tamarac Code Of Ordinances, Entitled "Alcoholic Beverages", Specifically Deleting Section 3-2 Regarding Sunday Sales of Alcohol; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. City Attorney Goren read T02358 by title into the record. Commissioner Gomez seconded by Vice Mayor Placko moved approval of T02358 on First Reading.
