CITY COMMISSION MEETING
WEDNESDAY, MARCH 22, 2017
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 9:10 a.m. on Wednesday, March 22, 2017 in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton,
Commissioner Michelle J. Gomez, and Commissioner Julie Fishman were in attendance.
Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney Julie
Klahr and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Commissioner Fishman led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of a proclamation by Mayor Harry Dressler proclaiming the week of April 9 -
15, 2017 as "National Public Safety Communicators Week Proclamation". (Requested by
Mayor Harry Dressler)
b. Presentation of a proclamation by Mayor Harry Dressler proclaiming Wednesday, March
22, 2017 as "Arthur Goldglantz Day". (Requested by Mayor Harry Dressler)
2. CITY COMMISSION REPORTS:
a. Commissioner Bolton: Commissioner Bolton said he traveled to Washington, D.C. to the
National League of Cities Conference and indicated that he was excited that he was able to
represent Tamarac. Commissioner Bolton said he learned -a lot from the seminars he
attended and how to work with staff. Commissioner Bolton said he met with Senator Bill
Nelson; Congressman Alcee Hastings' staff and Senator Marco Rubio's staff. Commissioner
Bolton said he also went to view the White House. Commissioner Bolton thanked staff for
making the trip possible and he looks forward to applying the knowledge he learned to
Tamarac.
b. Commissioner Gomez: Commissioner Gomez said she too traveled to the National League
of Cities Conference as part of the National Transportation and Infrastructure Steering
Committee Advocacy Group and attended meetings with Commissioners Fishman and Bolton
and Vice Mayor Placko. Commissioner Gomez said Infrastructure and transportation are the
most critical issues on the docket at this time. There also was a discussion regarding Public
Private Partnerships (PPP's). Commissioner Gomez said 2,500 people attended the
Conference and added that we should not be taking a stand on something we don't know
about as there is a big difference between PPP's and privatization. There were many
conversations about what other cities are doing to help with infrastructure and transportation
issues. Commissioner Gomez talked about the panic that set in with the looming blizzard
while she was there. Commissioner Gomez said on Wednesday she met with Congressman
Hastings' staff and Senator Nelson's staff as well as other individuals and asked them to
keep an open mind regarding budget cuts. We need to have our legislators looking at what

needs to be done and citizens need to be in touch with them to let them know how valuable
the programs are. Commissioner Gomez said that on Thursday she and Commissioner
Fishman met with Senators Rubio's and Nelson's aides and also met with Congressman Ted
Deutch. They also got a tour of the Department of Treasury. Commissioner Gomez said she
has attended the National League of Cities Conference five out of the last seven years and
was disappointed with people's attitudes. Commissioner Gomez noted that she had been
appointed to the Affordable Housing Committee. Commissioner Gomez invited people to
attend the 2"d Annual Hero Ball hosted by the Dellenbach Foundation on Saturday, March
25t" at 9:00 a.m. at the Auto Nation Field at Nova Southeastern University. There is a $10
entrance fee which will benefit homeless veterans.
C. Commissioner Fishman: Commissioner Fishman said she also attended the National
League of Cities Conference and as someone who has never been to the conference before,
was impressed by the variety of workshops. Commissioner Fishman said she was excited to
attend and to learn and attend two of the League's University classes. Commissioner
Fishman said she came back with information overload and hopes to use what she learned
for the benefit of the City of Tamarac. Commissioner Fishman said she attended the Energy,
Environment and Resource Committee meeting. Commissioner Fishman reported that she
and Commissioner Gomez joined the Women In Municipal Government Organization.
Commissioner Fishman noted that on the trip home she and Commissioner Gomez bumped
into Congresswoman Debbie Wasserman -Schultz. Commissioner Fishman said that she
attended the Broward Veteran's Coalition meeting on Monday afternoon and stated that this
is a group of organizations that represent veterans and encouraged people to get involved
with the Coalition.
d. Vice Mayor Placko: Vice Mayor Placko said she was glad to be back in Tamarac. Vice
Mayor Placko said at a recent MPO meeting they talked about the TOPS Program for
veterans that now brings veterans right to the door of the William "Bill" Kling VA Outpatient
Clinic on Commercial Blvd. This is a very good program and Broward County is looking into
using UBER as well, which ties into the PPP's. Broward County has been energetic about
making this program work and we are happy that Tamarac has worked on this for many years
to get the veterans to the door of the facility. Vice Mayor Placko said other cities have brought
forward resolutions about snipe signs and posters unlawfully placed on utility poles, utility
boxes, traffic control boxes, bus shelters, benches, trees or any other public property and
Tamarac will have such a resolution added to today's Consent Agenda. Vice Mayor Placko
said it is good to see that things we are talking about at the local level are being talked about
at the National League of Cities level.
Vice Mayor Placko said they are working on the Woodmont Project seven days a week and
one of her concerns is that during the final approval the primary concern was the placement
of the maintenance shed and in good faith that was approved and were told at that time that
the Country Club was denied ingress and egress onto University Drive. Vice Mayor Placko
said over the last two weeks she has tried to find out how the process went about and who
they spoke to and she has yet to receive an answer from the Country Club. Vice Mayor
Placko said if she does not receive an answer she will bring this back to the Commission.
City Manager Cernech said he has spoken with Mr. Backman and he has on two occasions
asked his client to provide documentation regarding Broward County's denial of ingress and
egress onto University Drive. Mr. Backman said he will get something in writing. It is just a
matter of them providing us documentation so that we can then provide it to Vice Mayor

Placko. Mayor Dressler said they have two weeks to provide that information and if it is not
provided staff can add his name to the request and Commissioners Gomez and Fishman
asked to have them added as well.
e. Mayor Dressler: Mayor Dressler read an email from a resident praising Tamarac Fire
Rescue for assisting her when she had a fall and could not get up. The resident asked Mayor
Dressler to have Fire Chief Burton have Michel Boyhan and Matt Castro acknowledged by
their peers. Mayor Dressler asked Captain Glassman how many calls they receive from 911
and Captain Glassman said about 36,000 last year. Mayor Dressler said we get one call for
every two residents that live in Tamarac this is reflective of the exemplary level of service we
provide people. Mayor Dressler commented that the concert last Friday was excellent.
Mayor Dressler said he recently attended a pension meeting to discuss management of the
$40 million on that plan and listen to the actuarial report on the fund. Mayor Dressler said the
fund Chairperson is Human Resources Director Maria Swanson and added that she does an
excellent job. Mayor Dressler said he also attended a series of meetings at Kings Point; sat in
on Florida League of Cities Conference call relative to a legislative update and weekly HOA
meetings.
Mayor Dressler said in his opinion the Woodmont project is the most significant
redevelopment in Tamarac. There will be 27 holes in the Woodmont golf course which will
increase property values. The 32 communities surrounding the golf course are jewels in
Tamarac. Mayor Dressler requested an update relative to the City's request for $400,000 for
infrastructure and City Manager Cernech said it is still progressing.
Mayor Dressler said he sat in on a stock market webinar on autonomous vehicles and noted
that there will be a dramatic reduction in the need for roads. Mayor Dressler talked about the
benefits of autonomous vehicles.
Mayor Dressler asked Commissioner Fishman for an update on HB17 and Commissioner
Fishman said it has strong legs. Commissioner Gomez said that when she and
Commissioner Fishman met with the Federal legislators they did ask them to reach out to the
State legislators and remind them that Home Rule is important for cities. Commissioner
Gomez said when she meets with Broward County Officials tomorrow she will ask for
assistance as well.
3. CITY ATTORNEY REPORT: Assistant City Attorney Klahr said the City Attorney's Office is
monitoring the legislation in Tallahassee and the Commission will be provided the most
update shortly.
4. CITY MANAGER REPORT: City Manager Cernech said the Building Department issued 6
new Certificates of Occupancy for new businesses and 4 Certificates of Occupancy for single
family homes in the Manor Parc development. City Manager Cernech invited people to attend
the District 4 Neighborhood meeting scheduled for Wednesday, March 29, 2017 at the
Community Center. People can call the Community Development Department at 954-597-
3530 for additional information. City Manager Cernech said the Housing Division hosts an
HOD Liaison Meeting on a quarterly basis and if you are a Condo or HOA Board member in
need of Insurance and Financial Management or Elective Manager credits, please join us on
May 16, 2017 at 6:30 p.m. at the Community Center located at 8601 West Commercial Blvd.

For additional information please call 954-597-3530. City Manager Cernech reported that
since January 1, 2017 the City has welcomed 77 new businesses into Tamarac.
City Manager Cernech reported that Fire Chief Burton attended a Leadership and Guidance
Conference "Breaching the Ceiling Together" in Gainesville on February 4th and the subject
was a difficult and controversial topic. Fire Chief Burton's topic was "Men of Conscience
Standing Up Against Sexism" which was very well received and Fire Chief Burton received a
thank you letter from the City of Gainesville Fire Department.
Upcoming event: On Friday March 24, 2017 we will be presenting a Movie in the Park
featuring "Storks". Pre -movie activities will start at 6:30 p.m. and the movie starts at 8:00
p.m.
City Manager Cernech said the pool at the Caporella Aquatic Center is expected to close to
the public on April 3, 2017 for a slide renovation project for approximately three to four
weeks. During that time there will be no swim lessons, aerobic classes or lap swim. Swim
team practice will continue as usual.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following
individual spoke: Fred Kahook, 6980 W. McNab Rd., said he is the owner of Tubby's Drive
Thru and asked the Commission to look into Tamarac's Sunday Blue Law as his business
loses money to surrounding cities that have repealed their Blue Laws. City Manager Cernech
said he has spoken to Mr. Kahook and his request had been forwarded on to the
Commission. Commissioner Gomez agrees to looking into repealing the Blue Law and Mayor
Dressler said he wants to move quickly on this. With no one else wishing to speak, Mayor
Dressler closed Public Participation.
6. CONSENT AGENDA: Mayor Dressler asked if there were any changes/additions to the
Consent Agenda and Commissioner Bolton said he is pulling item 6 (d) TR12920 for
discussion and Commissioner Fishman said she is item
pulling 6 0) TR12919 for discussion.
City Manager Cernech said pursuant to a consensus of the Mayor and Commission at the
Workshop on March 20, 2017 TR12930 is being added to the Consent Agenda. Assistant
City Attorney Klahr read TR12930 by title into the record. Commissioner Gomez seconded
by Vice Mayor Placko moved approval of adding TR12930 to the Consent Agenda. Motion
passed unanimously (5-0). Commissioner Gomez seconded by Vice Mayor Placko moved
approval of the Consent Agenda as amended. Motion passed unanimously (5-0).

d. TR12915 - Gasoline & Diesel Co-op: A Resolution of the City Commission of the City of
Tamarac, Florida approving the purchase of Diesel Fuel and Gasoline from Port
Consolidated, Inc. utilizing the City of Pompano Beach RFP E-13-17
number on behalf of the
Southeast Florida Government Purchasing Cooperative; authorizing purchase of Diesel Fuel
and Gasoline in the quantities needed based on the OPIS Fuel Index Cost at the time of
delivery; effective April 1, 2017 through
March 31, 2020 or as extended by the City of

Pompano Beach; authorizing proper City Officials to execute Contract renewals; providing for

e. TR12922 - Amendment 1 to Lease Agreement with Ramada Plaza: A Resolution of the
City Commission of the City of Tamarac, Florida, approving and authorizing the appropriate
City Officials to execute the First Amendment to the lease agreement with VL Bldg. West
DBA Ramada Plaza extending the lease term for the City's 800 MHz radio antenna site
located at 5100 N. State Road 7, Fort Lauderdale, FL; providing for conflicts; providing for
severability; and providing for an effective date.

f. TR12910 - Awarding Bid 16-24RB Sports Complex LED Lighting: A Resolution of the City
Commission of the City of Tamarac, Florida, awarding Bid No. 16-24RB to and approving an
agreement with Electrical Contracting Service, Inc. for the Sports Complex Walkway LED
Project, in accordance with Bid No. 16-24RB for a contract amount not to exceed
$119,000.00- a contingency in an amount of $11,900.00 will be added to the project account,
for a total project budget of $130,900.00; authorizing an expenditure from the appropriate
accounts; providing for conflicts; providing for severability; and providing for an effective date.

g. TR12911 - SCADA Upgrades for Water Plant Wells and Wastewater Pump Stations: A
Resolution of the City Commission of the City of Tamarac, Florida, awarding a contract to CC
Control Corporation utilizing pricing from an agreement obtained through a formal competitive
process by the City of Oakland Park, RFP Number 022414 for SCADA Upgrades for 19 water
plant wells and 83 wastewater pump stations; authorizing the appropriate City Officials to
execute a Purchase Order Agreement with CC Control Corporation for a project cost of
$837,727.00, with a contingency of 10% or $83,772.70 for an amount not to exceed
$921,499.70; authorizing an additional appropriation of $71,500; authorizing the appropriate
City Officials to administer the contract; providing for conflicts; providing for severability; and
providing for an effective date.

h. TR12919 - Appointing Two Members to the Parks and Recreation Board: A Resolution of
the City Commission of the City of Tamarac, Florida, appointing two (2) members to the
Parks and Recreation Board to serve terms concurrent with the appointing Commission
Member or until such time as new appointments are made; providing for conflicts, providing
for severability; and providing for an effective date.

i. TR12916 - Appointing Two (2) Resident Trustees to the Police Pension Board of Trustees:
A Resolution of the City Commission of the City of Tamarac, Florida, appointing two Resident
Trustees to the Police Pension Board to serve a two-year term ending March 23, 2019, or
until new appointments are made; providing for conflicts; providing for severability; and
providing for an effective date.

I. TR12918 - Opposition to HB 17 that would preempt regulation of businesses, licenses and

occupations to the state: A Resolution of the City Commission of the City of Tamarac, Florida,
opposing the proposed HB 17 that would severely negatively impact the City's home rule
authority by preempting the regulation of businesses, professions and occupations to the
state unless expressly authorized by general law thus impairing the City's ability to protect the
health, safety, welfare and property rights of City residents and businesses; directing the City
Clerk to transmit the copy of this Resolution to the appropriate parties; providing for conflicts;
providing for severability; and providing for an effective date.

m. TR12925 - Authorization of One Time Merit Award: A Resolution of the City Commission
of the City of Tamarac, Florida, authorizing payment of a one-time merit award to City
Manager Michael C. Cernech, as set forth in Resolution No. R-2011-04; providing for
conflicts; providing for severability; and providing for an effective date.

n. TR12930 — Snipe Signs and Posters: A Resolution of the City Commission of the City of
Tamarac Florida, urging the Broward County Commission to adopt a countywide ordinance
which holds venues, businesses, and other responsible parties accountable for snipe signs
and posters unlawfully placed on utility poles, utility boxes, traffic control boxes, bus shelters,
benches, trees, or any other public property; directing the city clerk to transmit a copy of this
resolution to Broward County, the Broward League of Cities, and each municipality within
Broward County; providing for severability; providing for conflicts; and providing for an
effective date.

k. TR12920 - Appointing Two Members to the Public Art Committee: A Resolution of the City
Commission of the City of Tamarac, Florida, appointing two (2) members to the Public Art
Committee; providing for conflicts; providing for severability; and providing an effective date.
Commissioner Bolton said he made appointments to several boards and was able to appoint
Elvin Villalobos to the Parks & Recreation Board who resides in District 1. Commissioner
Bolton said he would like to appoint residents from District 1 to the Planning Board and Public
Art Committee; however, no applications were received from anyone in his district.
Yesterday he said he met with a resident who was interested in serving on either the
Planning Board or the Public Art Committee and after looking at her resume he felt she would
be a good choice for the Public Art Committee. Commissioner Bolton said he submitted an
application and resume on her behalf to the City Clerk. Commissioner Bolton said he
previously appointed Brian Zambrano to the Public Art Committee who resides in District 4
and he would like to change his original selection and appoint Maura Beutel to the Public Art
Committee.
Vice Mayor Placko said she sits on the Public Art Committee and this group is very dedicated
and they do a good job and agreed that the Commissioners should appoint people from their
own districts. Vice Mayor Placko said Brian Zambrano is a vital asset to the committee and
would like to see if there is a way to keep Mr. Zambrano on the committee as we need young
talent on this committee. Vice Mayor Placko suggested adding alternates to the committee
and asked staff to look into keeping Mr. Zambrano on the Committee.

Commissioner Fishman agreed that the Commissioners should always appoint people from
their own district and was concerned because Mr. Zambrano was already told he was
appointed and then at the last minute it is being switched. Commissioner Fishman said there
is a process for appointments and that process must be followed and timelines adhered to.
Commissioner Gomez said she also agrees with following the procedures that are in place.
Commissioner Gomez wondered why Ms. Beutel took so long to submit an application.
Commissioner Gomez said that Mr. Zambrano has been very active on the committee and
she understands that Ms. Beutel is in District 1; however, Mr. Zambrano did everything in a
timely manner and should not be penalized for that. Commissioner Gomez asked that this
item be tabled.
Commissioner Bolton said he worked hard to find people from District 1. He carefully looked
at all the applications and the stability of the people who had applied and wants to respect his
colleagues. Commissioner Bolton said to keep the item as is and keep Brian Zambrano as
his appointment. There was a lengthy discussion on adhering to appointment process,
timelines and past practices of making appointments to Boards & Committees. Assistant City
Attorney Klahr responded to questions and concerns expressed by the Commission.
Assistant City Attorney Klahr read Section 2-58 of the Code relating to the appointment
process for the boards and committees.
Commissioner Gomez said she asked for a deferral of this item due procedural issues.
Commissioner Bolton said he tried his best to appoint people to the boards and committees
from his district. There was a lengthy discussion about amending the code relative to the
appointment process. Commissioner Fishman said since the application for the District 1
appointment to the Parks & Recreation Board came in after the deadline that appointment
should not have been made and we should reconsider that item.
Commissioner Bolton said that as a Commissioner he has the right to make an appointment
and stated that Mr. Zambrano's application is on par with Ms. Beutel's. Commissioner Bolton
said he wants to keep all his appointments and not table these items.
Mayor Dressler recessed the meeting at 12:00 p.m. and reconvened the meeting at 12:21
p.m. with all present as before.
Mayor Dressler asked Assistant City Attorney Klahr to again read Section 2-58 of the
Tamarac Code of Ordinances into the record. Commissioner Bolton again asked to keep
items 6 h, j & k as they are. Mayor Dressler asked for a motion to remain with Brian
Zambrano as Commissioner Bolton's appointment to the Public Art Committee.
Commissioner Bolton seconded by Commissioner Fishman move approval of TR12920 with
the appointment of Brian Zambrano to the Public Art Committee. Motion passed unanimously
(5-0).

j. TR12921- Appointing Three Regular Members to the Planning Board: A Resolution of the
City Commission of the City of Tamarac, Florida appointing three (3) regular members to the
Planning Board; providing for conflicts; providing for severability; and providing an effective
date.

Commissioner Gomez said she pulled this item for discussion because while she has no
personal problems with Mike Gelin she felt that he does not have the recommended
qualifications for the Planning Board. Commissioner Gomez said she wants to see the
applications of the other applicants.
Commissioner Bolton said he respected Commissioner Fishman's appointments when she
made them without asking for the qualifications of the individuals she chose and added that
Vice Mayor Placko also did not ask for qualifications of the people appointed. We all agreed
to her appointments. Commissioner Bolton said now Commissioner Gomez wants to look at
the qualifications of the people he has appointed and he feels this is not a reasonable request
because she did not ask that for all the other appointments.
Mayor Dressler asked for the actual language in the ordinance as it pertains to the Planning
Board and Assistant City Attorney Klahr read Section 24-61(b) into the record relative to the
recommended qualifications for board members. Mayor Dressler said it is perfectly
acceptable for Commissioner Gomez to raise a question as to an applicant's qualifications.
Commissioner Gomez talked about Commissioner Fishman's selections and reiterated her
assertion that Mike Gelin is not qualified for the Planning Board and again asked for copies of
all the applicants for the Planning Board. Mayor Dressler said he is opposed to the
appointment of Mike Gelin to the Planning Board and he does not feel it is necessary to
review the other applications to see who is qualified.
Assistant City Attorney Klahr read Section 2-58(e) relative to the appointing process into the
record. Mayor Dressler passed the gavel to Vice Mayor Placko and made a motion to reject
the appointment of Mike Gelin to the Planning Board. Commissioner Gomez seconded Mayor
Dressler's motion. Motion passed 4-1 with Commissioner Bolton dissenting. Vice Mayor
Placko returned the gavel to Mayor Dressler. Commissioner Gomez, seconded by
Commissioner Fishman moved approval of TR12921 with the exception of the appointment
Mike Gelin. Motion passed unanimously (5-0).

Commissioner Bolton asked the City Clerk to re -advertise for the Planning Board.
Commissioner Gomez asked Mayor Dressler to workshop the process of ointing
members to boards and committees. Mayor Dressler said he had no objection toa reviewing
ewing
the process and look at changes that could be beneficial to the appointment process.
