HomeMy WebLinkAbout2017-04-12 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, APRIL 12, 2017 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:19 p.m. on Wednesday, April 12, 2017 in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner Michelle J. Gomez, and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney Julie Klahr and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Placko led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation to the Mayor and Commission by Millennium Middle School Principal Dr. Cheryl Cendan. Dr. Cendan and students from Millennium Middle School presented certificates of appreciation to the Mayor and Commission. Dr. Cendan thanked the Commission for the City's support for the Millennium Middle School 6 through 12 initiative. b. Presentation of a proclamation by Mayor Harry Dressler proclaiming April 21, 2017 as "PowerTalk 21 Day". (Requested by Mayor Harry Dressler) c. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of April 2017 as "Water Conservation Month". (Requested by Public Services Director Jack Strain) d. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of April 2017 as "Child Abuse Prevention Month". (Requested by Commissioner Julie Fishman) 2. CITY COMMISSION REPORTS: a. Commissioner Bolton: Commissioner Bolton said he put forth some effort to attend HOA and COA meetings in his district. Commissioner Bolton invited people to attend the District 1 Neighborhood Meeting on May 3rd at 6:30 p.m. at the Mainlands 6 Clubhouse, 4920 NW 51st Court. Commissioner Bolton said he talked with 8 HOA's and also spoke with property managers for some apartment buildings about improving their common areas. Commissioner Bolton indicated that he enjoys talking about what we do in Tamarac. Commissioner Bolton reported that he drove around with Code Compliance Manager Scott Krajewski to better understand code enforcement in Tamarac and thanked Code Compliance Manager Krajewski for spending his time with him. Commissioner Bolton reported that the Ft. Lauderdale Executive Airport has a new tower which will help resolve some complaints that he receives. Commissioner Bolton noted that he attended the Land Development Code Re -write Workshop. Commissioner Bolton said that Peter Mason, Executive Director of the Tamarac Chamber of Commerce did an excellent job at the Arts & Crafts Festival and thanked anyone involved in that event. Commissioner Gomez: Commissioner Gomez attended the Broward County Planning Council Meeting and the Chamber of Commerce Ribbon Cutting for the Blue Fish Sushi Thai Restaurant. Commissioner Gomez said she represents Habitat for Humanity and attended a comprehensive meeting relative to affordable housing in Broward County which will have one of the largest communities of 77 Single Family homes when built. At that meeting she met and talked with Dr. Ben Carson as well as other people who attended that meeting. Commissioner Gomez said she appreciates the time that staff spent on the Land Development Code Re -write Workshop. Commissioner Gomez said she attended the Dellenbach Foundation Heroes Ball and the District 4 Neighborhood Meeting and encouraged people to attend the District 2 Neighborhood Meeting on April 27th at 6:30 p.m. at the Concord Village Clubhouse. Commissioner Gomez attended the Boys & Girls 31St Annual Golf Tournament and the Arts & Crafts Festival. Commissioner Gomez said she and Commissioner Fishman went to Tallahassee to meet with our legislators including Senator Lauren Book as well as numberous representatives. They also got to spend some time with Broward County Commissioner Michael Udine and Tamarac's Lobbyist Ron Book. Commissioner Gomez wished everyone a Happy Passover and Easter. c. Commissioner Fishman: Commissioner Fishman encouraged people to attend the District 3 Neighborhood Meeting on April 19th at 6:30 p.m. at the Kings Point Clubhouse. Commissioner Fishman congratulated the Chamber of Commerce on the Arts & Crafts Festival. Commissioner Fishman said that on her trip to Tallahassee she met with Representative Mike Miller and talked about infrastructure and discussed Tamarac's Pipe Bursting Project, vacation rentals, fracking and property rights. Commissioner Fishman talked about the numerous individuals she met in Tallahassee. Commissioner Fishman said she and City Manager Cernech met with Bob Swindell of the Greater Ft. Lauderdale Alliance earlier today and talked about the changing economics and the need for Tamarac to look at redevelopment. d. Vice Mayor Placko: Vice Mayor Placko said she attended a presentation by Pulte at Woodmont where actual pictures of the homes that are being built were presented. People at the meeting expressed their concerns about how close the lot line would be to existing homes. Vice Mayor Placko met with representatives of Pulte for two hours and visited the site and discussed adding additional landscaping. Vice Mayor Placko said this is one of the best deals around. Vice Mayor Placko said she attended the Board meeting of Family Central and thanked Chief Building Official/Director Claudio Grande for assisting with the permits to expedite their move. Once they are moved discussions will take place about new initiatives. Vice Mayor Placko said the District 4 Neighborhood Meeting was well attended and encouraged people to attend the other upcoming Neighborhood Meetings. Vice Mayor Placko said the vendors at the Arts & Crafts Festival were wonderful and everyone had a good time at the fashion show. Vice Mayor Placko said she attended the Reaching for the Stars luncheon last week and it was gratifying to see the comradery between the employees, e. Mayor Dressler: Mayor Dressler thanked all those involved in the Arts & Crafts Festival and noted that the fashion show was fun and everyone did a fabulous job. Mayor Dressler said he and City Manager Cernech met with a representative from a new medical related business that is coming into Tamarac near University Hospital. The new facility will be a diabetes treatment center. Mayor Dressler talked about conversations with people from Broward League of Cities with respect to an editorial in the Sun Sentinel attacking Weston Mayor Dan Stermer for the work he did relative to the infrastructure surtax. Mayor Dressler said he wants to have a meeting with the corporate people at the Sun Sentinel. Mayor Stermer is a Page 2 of 2 COMMISSION MEETING April 12, 2017 representative without a portfolio and has spent many hours doing public service work for the residents of Broward County. Other mayors, including Sunrise Mayor Ryan, objected to the editorial and Mayor Dressler said he wants the Sun Sentinel to know if a Mayor is attacked people will object. Mayor Dressler said he will provide the Commission with an update once he has met with the Sun Sentinel. Mayor Dressler complimented Commissioners Gomez and Fishman for going to Tallahassee to meet with our legislators. Commissioner Gomez wished City Clerk Teufel a Happy Birthday and apologized for not being able to attend the Reaching for the Stars Luncheon. Commissioner Gomez said at the last meeting there was a lengthy discussion about appointments to boards and committees and is making a motion to reconsider the appointments to the Parks & Recreation Board. Mayor Dressler explained Roberts Rules of Order relative to a motion to reconsider. City Attorney Goren explained Tamarac's Code of Ordinances relative to a motion to reconsider and noted that the member must make a motion and carried by 3/5 of the vote. Commissioner Gomez said there is a motion to Reconsider TR12919 which appeared as item 6 (h) on the March 22, 2017 agenda. Vice Mayor Placko seconded the motion and motion passed unanimously (5-0). City Attorney Goren said the Commission can now take some action to repeal or modify and it can be done tonight or at the next regular meeting. Commissioner Gomez made a motion to discuss this matter tonight. Commissioner Fishman seconded the motion. City Attorney Goren said this is now open for discussion. Commissioner Gomez asked if the Commission wants to wait to discuss this after the rest of the reports or do it now and Mayor Dressler suggested that we take this up for discussion after Public Participation. All were in agreement. 3. CITY ATTORNEY REPORT: City Attorney Goren said late this afternoon his office sent to the Mayor and Commission and Professional Staff their most recent legislative report. It is a lengthy document that is rife with many different challenges and questions. As the legislature rounds the last turn of the session a lot of things are happening that are hard to report accurately as it changes on a daily basis. The other aspect that you have heard from Commissioners Gomez and Fishman is that even though bills may pass in one house they may not pass in both houses. City Attorney Goren explained how the legislative process works. The report they sent out today is worth looking at and will change in the next week or so once the legislature gets into the final stretch. City Attorney Goren said there are some bills that we need to look at: the Ethics bill, the drone bill, red light camera bills, open carry bills, some constitutional amendments related to constitutional officers and others. City Attorney Goren said there is no litigation to report in the context of pending matters. City Attorney Goren said for the record the Woodmont — Zaveco case has concluded and the Judge does not have a time frame in which to act. At this time there has been no decision, however, the developer is fulfilling his obligations on a daily basis. There are items that are set to come before the Commission in the near term with regard to platting and site planning which are consistent with the committed obligation. City Attorney Goren wished everyone a very Happy and Healthy Holiday, which ever one you support this week, and be mindful of the importance of the days being celebrated. 4. CITY MANAGER REPORT: City Manager Cernech congratulated BSO Deputies Rausch and Krickovich who received Lifesaving Awards at ceremony held on Tuesday, March 281n The Deputies are credited for saving the life of a shooting victim by utilizing a newly issued BSO tourniquet to stop the bleeding from a gunshot wound. City Manager Cernech reported Page 3 of 3 COMMISSION MEETING April 12, 2017 that Deputy Guzman saved two drug overdose victims when responding to a call by performing chest compressions on one victim while giving life-saving instructions to another individual to perform on the second victim. If not for his quick response and life-saving efforts the two victims would have died. Rookie Deputy Viera assisted a Good Samaritan who discovered an unconscious woman in a canal. Further investigation indicated that the woman had suicidal thoughts the day before this incident and was drinking enormous amounts of alcohol prior to entering the canal. The victim was pulled out of the canal using a floatation device from the BSO patrol car and Deputy Viera used chest compressions until she was rushed to University Hospital by Fire Rescue. City Manager Cernech said he is extremely pleased with the success of the 2017 Arts & Crafts Festival which was attended by 2,500 visitors who enjoyed shopping, the fashion show and the robotics demonstration. City Manager Cernech encouraged people to attend the District 3 Neighborhood Meeting on April 19th at 6:30 p.m. at the Kings Point Clubhouse. Tamarac's elected officials and staff will be on hand to provide vital information on projects that are underway in District 3 as well as projects planned for the future. City Manager Cernech said for more information please call 954-597-3530. City Manager Cernech said Fire Rescue reports that Tamarac CERT members participated with the City of Pembroke Pines CERT members extinguishing fires, search and rescue and first aid training at their facility. Tamarac's Emergency Management team participated in tabletop exercises for disaster housing and mass sheltering at the Broward County EOC. Code -Red and WEB-EOC training has been scheduled at Fire Station 15 in preparation for the 2017 hurricane season. City Manager Cernech reported that fire drills were conducted in the Tamarac Commerce Park. The first of two fire drills of all City of Tamarac public and private schools, day care centers and assisted living facilities has been completed. City Manager Cernech said Fire Inspectors Doblas and Escobedo were awarded a full scholarship and attended the Florida Advisory Committee's Arson Prevention Seminar in Ocala for four days. Upcoming Events: The next Concert in the Park featuring "The Railway Kings" will take place on Saturday, April 21st at the Sports Complex from 7:00 p.m. to 9:00 p.m. City Manager Cernech said the Parks and Recreation Department is currently accepting applications for teens ages 15-17 for their Teen Summer Program. Only seven teens are accepted into the program due to transportation capacity and Department participation. The program will include volunteering in a number of city departments, taking trips and being educated on career topics. Applications are available on the City's website. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke: Stewart Webster, 7900 Colony Circle South, expressed his frustration after contacting individuals in the City to resolve an issue and no one responded, Peter Mason, Executive Director of the Tamarac Chamber of Commerce, 11620 NW 2"d Ct., Coral Springs, thanked the Mayor and Commission for their support for the 2"d Annual Arts and Crafts Festival and said this event could not happen without that support and cooperation. Mayor Dressler said we will now take up the discuss on TR12919 and City Attorney Goren said there is a motion on the table and the next thing is to open it for discussion. Page 4 of 4 COMMISSION MEETING April 12, 2017 Commissioner Gomez said there was a lot of discussion regarding procedures relative to making appointments to boards and committees which got confusing. Commissioner Gomez said the Commission believed procedures were followed for the appointments to the Parks & Recreation Board; however, information came out that we did not go through the proper procedures. There was a lengthy discussion about applications being submitted on time and appointments made from those applications. Commissioner Gomez said it is not fair when residents try to participate and they are not heard. Vice Mayor Placko noted that since this item was on the Consent Agenda it was not discussed at the time of the appointment. Commissioner Gomez responded that it was not discussed like the appointments to the Public Art Committee and the Planning Board were at the March 22, 2017 meeting. Mayor Dressler said it is at the discretion of a Commissioner to appoint who they want to a board or committee and it is our procedure to select someone in their district. Commissioner Gomez said the rest of Commission did not get the packet of applications for the board and committee appointments and without that information their voting on those appointments seems unfair. Commissioner Gomez said as such we have not given the Parks & Recreation Board the proper review. Commissioner Gomez asked for copies of the other applications to the Parks & Recreation Board be distributed to all the Commission members for their review. Mayor Dressler asked if the Commission wished to do this now or at a later date and schedule a discussion at a subsequent meeting. Mayor Dressler moved to review actual applications. City Attorney Goren said if the Commission feels they need more time to review the documents that is an option and you can defer further review and table this to a time certain. City Attorney Goren asked if the Commission wanted to look at these applications now or table this to a time certain. Commissioner Bolton said he would like to review now; however, the rest of the Commission said they would like time to review the applications and bring this back for discussion at a later date. City Attorney Goren said we will need a motion to table this item to the April 26, 2017 meeting. Commissioner Fishman seconded by Commissioner Gomez moved to table the item to the April 26, 2017 for further consideration. Motion passed unanimously (5-0). 6. CONSENT AGENDA: Mayor Dressler asked if there were any changes or additions to the Consent Agenda and City Manager Cernech said item No. 6 (e) TR12934 — Panasonic Toughbook Lease with HPE - has been replaced with an updated version to provide for further cost savings. City Attorney Goren read TR12934 by title into the record. Vice Mayor Placko seconded by Commissioner Gomez move approval of TR12934 as updated. Motion passed unanimously (5-0). Commissioner Gomez seconded by Commissioner Fishman moved approval of the Consent Agenda. Motion passed unanimously (5-0). a. Approval of the March 22, 2017 Regular Commission Meeting Minutes- APPROVED b. TR12908 - FEMA Grant: Water Treatment Plant: A Resolution of the City Commission of the City of Tamarac, Florida accepting a grant award in the amount of $250,000 from the Federal Emergency Management Agency (FEMA) through the Florida Division of Emergency Management; authorizing the appropriate city officials to execute a project agreement between the Florida Division of Emergency Management and the City of Tamarac for grant funding in the amount of $250,000 with a $1,250,000 match in local funds for the water treatment plant control room project; providing for acceptance of the award and execution of documents; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-30 Page 5 of 5 COMMISSION MEETING April 12, 2017 c. TR12924 Authorizing Four Week Vacation for the Mayor and City Commission: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing a four -week Consecutive Period (July 16, 2017 — August 13, 2017) during which time the City Commission will not schedule any regular meetings pursuant to Section 4.06(a) of the City Charter; providing for Conflicts; providing for severability; and providing an effective date. RESOLUTION R-2017-31 d. TR12932 - Appointment of A Special Magistrate for Red Light Camera Hearings: A Resolution of the City Commission of the City of Tamarac appointing Tony Rodriquez to serve as Special Magistrate for Local Red Light Camera Hearings; providing for conflicts; providing for severability and providing for an effective date. RESOLUTION R-2017-32 e. TR12934 - Panasonic Toughbook Lease with HPE: Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to execute a Master State & Local Government lease agreement with HPE Financial Services to lease twelve (12) Panasonic Toughbook tablets and twelve (12) docking stations for three (3) years at an annual cost of $13,336.16 for a total cost of $40,008.48 at the end of the three years, providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2017-33 Mayor Dressler recessed the meeting at 9:14 p.m. and reconvened the meeting at 9:26 p.m. with all present as before. 7. REGULAR AGENDA: a. TR12917 - Colony West Clubhouse - Construction Contract: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to execute that certain construction contract between AD1 Management Inc., and the City of Tamarac, attached hereto as Exhibit "1 ", for the construction of the new Colony West Clubhouse facility located at 6800 NW 88th Avenue to include property commonly referred to as Cypress Walk Terrace, being more particularly described in Exhibit "A-1 ", attached hereto and incorporated herein; authorizing an appropriation and expenditure of seven million four hundred and five thousand ($7,405,000.00) dollars; authorizing the City Manager to approve non -monetary amendments to the construction contract, authorizing the City Manager or designee to approve line item change orders within the approved budget; providing for conflicts; providing for severability; and providing an effective date. City Attorney Goren read TR12917 by title into the record. Commissioner Fishman seconded by Commissioner Bolton moved approval of TR12917. Motion passed unanimously (5-0). RESOLUTION R-2017-34 8. ORDINANCE(S) - FIRST READING: a. T02354 - 1st Budget Amendment: An Ordinance of the City Commission of the City of Tamarac, Florida, amending Ordinance 2016-14, which adopted the City of Tamarac Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2017, by increasing the total revenues and expenditures by a total of $33,451,597 as detailed in attachment A attached hereto and summarized in attachment B; providing for conflicts; providing for severability; providing for Page 6 of 6 . TO2356 - General Employees' Pension Plan Amendments: An Ordinance of the City Commission of the City of Tamarac, Florida; amending Chapter 16, Pension and Retirement, Article III, Employees' Pension Plan, providing for eligibility of DROP participation for certain members of the Elected and Appointed Officers and Non -Represented employees retirement plan; providing for severability; providing for codification and providing for an effective date. City Attorney Goren read TO2356 by title into the record. Commissioner Bolton seconded by Commissioner Gomez moved approval of TO2356 on first reading. Motion passed unanimously (5-0). TO2357 - Non -Rep Pension Plan amendment: An Ordinance of the City Commission of the City of Tamarac, Florida; amending Chapter 16, Pension and Retirement, Article IX, Elected and Appointed Officers and Non -Represented Employees' Retirement Plan, providing for eligibility of certain members of the Elected and Appointed Officers and Non -Represented Employees Retirement Plan to participate in the Employees' Pension Plan DROP, providing for a savings clause; providing for severability; providing for codification and providing for an effective date. City Attorney Goren read TO2357 by title into the record. Commissioner Gomez seconded by Commissioner Bolton moved approval of TO2357 on first reading. Motion passed unanimously (5-0).
