Mayor Dressler asked if this item should be approved before the Legislative Session is
over relative to the Home Rule. City Attorney Goren responded it is good to consider
this issue earlier rather than later but there is no legal impact. Attorney Goren spoke
about provisions related to the pre-emption of bills and that he could argue this is an
incipient policy which is better than having nothing at all. This process is similar, if not a
classic zoning in progress. Attorney Goren said he would not stop the process.
Mayor Dressler provided additional background information for the benefit of the newly
elected Commissioners that occurred prior to their elections.
Community Development Maxine Calloway continued presenting an outline of the five
(5) key themes covered. Ms. Calloway talked about the Update on zoning districts
related to Lineup, amendment of allowable uses, update use classification systems and
update use of specific standards. She compared the current code structure with the new
code structure and said the attempt is to repeal seven chapters into one chapter with a
more fluid structure.
