HomeMy WebLinkAbout2017-03-29 - City Commission Special Workshop Meeting MinutesCITY OF TAMARAC CITY COMMISSION SPECIAL WORKSHOP WEDNESDAY, MARCH 29, 2017 CALL TO ORDER: Mayor Harry Dressler called the Special Workshop of the City Commission to order at 10:11 a.m. on Wednesday, March 29, 2017 in Conference Room 105, City Hall, 7525 NW 88t" Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner Michelle J. Gomez and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Manager Diane Phillips, City Attorney Samuel S. Goren and Assistant City Clerk Lillian Pabon. Mayor Dressler welcomed everyone and noted this is a Special Workshop meeting of the City Commission for the City of Tamarac to review part 2 of the Land Development Regulations Module. The Mayor introduced Community Development Maxine Calloway as presenter. Community Development Maxine Calloway opened her presentation providing background information stating that in 2015 the City has brought Clarion and Associates to conduct an assessment related to Land Development Regulations and briefly recapped Proposed Module 1-Administration which talks about authority given to City staff, to Planning Board and to City Commission, covered at the Land Development Regulations Special Workshop meeting held September 29, 2017. Proposed Module 2- Zoning District and Land Uses will be discussed today related to the Permitted Master List. Module 3-Development and Design Standards has been submitted to staff, will be uploaded today until the end of May. A comprehensive report for all three modules will be presented before the City Commission at a future workshop to present to the public, contemplating completion the summer of 2017. Mayor Dressler asked if this item should be approved before the Legislative Session is over relative to the Home Rule. City Attorney Goren responded it is good to consider this issue earlier rather than later but there is no legal impact. Attorney Goren spoke about provisions related to the pre-emption of bills and that he could argue this is an incipient policy which is better than having nothing at all. This process is similar, if not a classic zoning in progress. Attorney Goren said he would not stop the process. Mayor Dressler provided additional background information for the benefit of the newly elected Commissioners that occurred prior to their elections. Community Development Maxine Calloway continued presenting an outline of the five (5) key themes covered. Ms. Calloway talked about the Update on zoning districts related to Lineup, amendment of allowable uses, update use classification systems and update use of specific standards. She compared the current code structure with the new code structure and said the attempt is to repeal seven chapters into one chapter with a more fluid structure. Page 1 of 3 COMMISSION SPECIAL WORKSHOP March 29, 2017 Commissioner Gomez asked questions related to the Proposed Districts Table and if traffic issues are taken into consideration. Ms. Calloway responded to a certain degree and it is also part of the applicant's application. Ms. Calloway added that Rock Island and Commercial Boulevard are not a part of the re -write Development Zone. Ms. Calloway continued with the presentation. Commissioner Gomez and Commissioner Fishman had questions regarding the methodology used by the hired consultants. City Manager Cernech recommended future Commission Workshops may be scheduled for additional discussion. Mayor Dressler directed staff to schedule a Commission Workshop meeting having the consultant provide a short presentation about their standard methodology. Mayor asked anyone to bring questions through the appropriate channels. Commissioner Bolton left the meeting at 11:19 a.m. and returned at 11:20 a.m. Community Development Director Maxine Calloway continued with presentation and entertained additional questions from the Commissioners related to color palettes. Ms. Calloway said color palettes were excluded from the current rewrite. Commissioner Gomez expressed her concerns related to color palettes. Ms. Calloway recommended and Mayor Dressler agreed to eliminate color palettes. Discussion took place regarding the Overlay District. Ms. Calloway said the City will maintain the Overlay District however, there is a lot of duplication and language already exists that protects the Overlay District. Ms. Calloway said she will give the consultant a recommendation for inclusion on the general draft that will be brought back to the City Commission. Mayor Dressler commented on the Woodlands District sunsetting. City Attorney Goren noted sunsetting within a time period. Ms. Calloway said the time is already amortized into the sunsetting then continued with her presentation. Commissioner Bolton asked about section 10.32 related to shopping centers and treatment of schools and churches. Commissioner Gomez had questions related to multiple principal uses. Vice Mayor Placko asked about manufactured homes built in a community that currently does not have it. Ms. Calloway said proposed provided specifications will not have a manufactured home in a built community. Mayor Dressler asked the Commissioners for a consensus to hold five meetings each 2 hours long and a consensus of 5-0 was made. Discussion took place on scheduling future meetings. Ms. Calloway continued with her presentation and answered questions from the City Commission. Meeting recessed at 12:47 p.m. Meeting reconvened at 1:18 p.m. 1 Page 2 of 3 COMMISSION SPECIAL WORKSHOP March 29, 2017 1 Community Development Director Calloway continued her presentation and reviewed the areas to date the City Commission identified for enforcement. Ms. Calloway responded to Commissioners questions related to use standards. City Manager Cernech asked Commissioner Gomez to e-mail a list of questions and answers would be provided at the next meeting. Commissioner Gomez left the meeting at 1:54 p.m. Community Development Director Calloway provided feedback to Commissioner Bolton related to Churches. Ms. Calloway provided a process timeline. City Attorney Goren responded to questions made by Commissioner Bolton. Ms. Calloway continued discussion on churches in the City responding to questions made by Vice Mayor Placko and Commissioner Bolton. Commissioner Bolton left the meeting at 2:10 p.m. Community Development Director Maxine Calloway discussed Use Specific Standards Section 10-3.3. Mayor Dressler asked to limit the time to speak on an issue per the Charter and what the Code allows. City Attorney Goren read Rules of Conduct as revised in 2007 and it typically relates to Regular or Special meetings. Attorney Goren noted this is a Workshop meeting. City Manager Cernech said staff will come back with a meeting schedule at the next meeting and address the issues brought up to this point. Mayor Dressler said Commissioner Bolton's issue may be addressed at the next meeting for further discussion.
