HomeMy WebLinkAbout2016-08-24 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, AUGUST 24, 2016 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 9:03 a.m. on Wednesday, August 24, 2016, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Michelle J. Gomez, Commissioner Debra Placko were in attendance. ABSENT: Vice Mayor Diane Glasser Also in attendance were: City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Mayor Dressler led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation to the Mayor and Commission of a FDEP check in the amount of $50,000 for Waters Edge Park for the development of a new playground with shade structure and safety surface, two new picnic pavilions/shelters and a new parking lot by Jennifer Roberts, Park Manager Hugh Taylor Birch State Park. b. Presentation of a Plaque to the Mayor and Commission by Randy Hibshman, Representing Challenger Baseball. c. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of October 2016 as "National Cyber Security Awareness Month". (Requested by Information Technology Director Levent Sucuoglu) d. Commissioner Bushnell: Commissioner Bushnell wished Commissioner Gomez a belated Happy Birthday and said she was happy to be back from the summer hiatus. Commissioner Bushnell said she and Commissioner Placko collected 71 bags of food for Family Central over the break. Commissioner Bushnell said she had a $250 gift card and was able to buy $500 worth of food. Commissioner Bushnell said she hopes this drive will continue. Commissioner Bushnell said there was an article in newsletter that came with the TRIM notice about how low-income seniors, over the age of 65, can be granted full homestead property tax relief if they have lived in their home for at least 25 years and meet certain qualifications. This is important and has to be approved by the City and Commissioner Bushnell asked the City Manager and the Commission for this to be placed on a Workshop agenda for discussion. b. Commissioner Gomez: Commissioner Gomez said she was glad to be back in session and noted that the Commission continued to work throughout the summer break. Commissioner Gomez said she attended the Tamarac BSO District 7 National Night Out; Quality Florida event honoring Broward County Mayor Marty Kiar and said she was very proud that Quality Florida was able to raise $8 million for the victims of the deadly shooting at the Pulse nightclub in Orlando. Commissioner Gomez said Channel 7 was at that event and she was happy to hear that they took some responsibility for how things are portrayed and how the media does have responsibility for how the news gets out. Commissioner Gomez also attended the 1st Annual High School Bowling Championship at Sawgrass Lanes in Tamarac; the Kiwanis Christmas in July event and a Murder Mystery Dinner Show at Colony West Golf Course. c. Vice Mayor Glasser: Absent. d. Commissioner Placko: Commissioner Placko said she went to Tennessee over the summer break and listened to a County Commission meeting where she learned that they share many of the same problems that cities are grappling with such as infrastructure and residents complaining about projects that are not getting done. Commissioner Placko thanked everyone who contributed food to be donated to Family Central. Commissioner Placko said staff gave a presentation on the PACE program at a WCA meeting and encouraged people to look into the program. Commissioner Placko said she attended her first University Hospital Board of Trustees meeting and commented on how much is going on at the hospital. e. Mayor Dressler: Mayor Dressler said he was asked to be on the Steering Committee for the Sales Tax Initiative which is Chaired by Weston Mayor Dan Stermer and Broward County Commissioner Lois Wexler. He has attended various meetings and conference calls regarding getting the information out to the public. Mayor Dressler said he was also asked to be Chairman of a Broward League of Cities Committee that will be observing what the County does during committee meetings such as the Ethics Committee and as such he will be attending four meetings each month and will report back to the Commission on his observations. Page 2 of 7 COMMISSION MEETING August 24, 2016 Mayor Dressler said the most important thing that he did over the commission break was attend the Harvard JFK School of Government Senior Executive Program. Mayor Dressler said it was one of the most intensive programs he has ever attended. Mayor Dressler spoke about the various people he met and the faculty that facilitated the program. Mayor Dressler said he honestly believes that all the things he learned will be applied over the next few years and noted that this experience has changed his life. 3. CITY ATTORNEY REPORT: City Attorney Goren said he had a quick update on the penny sales tax issue and noted that he sent information to Marie Abbandondo regarding the September 10th meeting from 9 a.m. to 11.00 a.m. at the Sunrise Civic Center. City Attorney Goren said he is not sure who is sponsoring the meeting and will learn more at the Broward League of Cities dinner tomorrow evening. At that meeting there will be a discussion about the Moving Broward Forward PAC which was formed by local leaders and chaired by Weston Dan Stermer and County Commissioner Lois Wexler. City Attorney Goren said that committee can raise funds to advocate for the sales surtax. They can publicize it, emphasize it and measure their approach by advertising their support for the penny sales tax. The MPO, Broward League of Cities and the County Commission have hired a consultant and they are raising contributions from cities for the educational side of the transportation side of the sales tax. The League of Cities is not a 501(c)(3) it is, however, a Non -Profit Corporation which is comprised of city officials and of various providers of public services which are private companies. The Broward League of Cities Executive Board of Directors has agreed to spend $50,000, of League money derived from associate membership fees, towards the advocacy side. City Attorney Goren said the Commission has the July 14, 2016 memo which will give them some guidelines with regard to this specific issue and which will be discussed at the meeting tomorrow evening and on September 10th. City Attorney Goren said that in his long career it has never happened that so many cities have signed on to the same commitment so quickly on such a committed basis. 4. CITY MANAGER REPORT: City Manager Cernech said the P.A.R.O.T. Foundation awarded two $1,000 scholarships to Tamarac Summer Camp staff employees, Joseph Libio and Sydney Alexander, on August 4th. The Memorial Scholarships were established to honor the memory of three outstanding youths who were lost in a car crash in 2015. Upcoming Events: Back to School Dive in Movie will be held on Saturday, August 27, 2016 at 8.00 p.m. at Caporella Aquatic Center featuring the movie "Zootopia". Play Day will take place at Tamarac Park on Thursday, September 15th (early release day) from 1:30 p.m. to 3:30 p.m. City Manager Cernech said Public Services has announced that it has begun work on the NW 77th St. Multi -purpose Trail on the north side of NW 77th St. between 96th Ave. and the entrance to the Sports Complex. This project is expected to be completed in December 2016. City Manager Cernech noted that there is a tropical disturbance in the tropics and advised that the City is already preparing for the event. City Manager Cernech said staff will keep the Commission updated on the projected track of the disturbance. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individual spoke: Doris Span, 8603 NW 59th Ct., advised the commission that she is the widow of Willie Span the veteran who was killed in 2014 while attempting to cross Page 3 of 7 COMMISSION MEETING August 24, 2016 Commercial Blvd. to get to the VA clinic. Mrs. Span asked for assistance from the Commission in getting a crosswalk with an on demand light at the VA Clinic. Ms. Span also asked the Commission to support the Memorial Service that will take place on Saturday, October 1, 2016 at 3:00 p.m. at Day Break Assembly in Tamarac and the vigil at the Memorial Marker on Commercial Blvd. at starting at 6:00 a.m. on Sunday, October 2, 2016. Mayor Dressler said Tamarac approached the County about this issue but it didn't go anywhere and he is not sure why. City Manager Cernech said in November we will have a new County Commissioner representing us and we may have better luck at that time. Commissioner Placko said public safety is a concern and will bring this issue up with the MPO to see if they can be of some assistance. All were in agreement to do whatever they can to assist Mrs. Span. Mrs. Span said she is on the County Commission Agenda in October and may call on the City to assist her in gathering more information. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech replied that there were no changes/additions to the Consent Agenda. Commissioner Placko seconded by Commissioner Gomez moved approval of the Consent Agenda. Motion passed unanimously (4-0). a. Approval of the June 23, 2016 Special Commission Meeting - APPROVED b. Approval of the July 13, 2016 Regular Commission Meeting Minutes - APPROVED c. TR12836 - Continuing Services Agreement: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate City Officials to Select, Approve, Award, and execute Agreements with the qualified Consulting Firms to provide professional services for a period of three (3) years with an option to renew for an additional two (2) year period on an "As Needed" basis to qualified firms that responded to Request for Qualifications #16-23Q for Professional Services Continuing Services Agreements, which was competitively solicited for Architectural, Engineering, Surveying and Landscape Architectural Services as defined in Florida Statutes Chapter 287.055, the Consultants' Competitive Negotiation Act (CCNA) for various professional services disciplines as determined by the evaluation of the Selection Advisory Committee in the best interest of the City; effective upon approval; providing for conflicts; providing for severability; and providing for an effective date RESOLUTION R-2016 - 80 d. TR12827 - Reimbursement Resolution: A Resolution of the City Commission of the City of Tamarac, Florida establishing its intent to reimburse certain capital expenditures incurred in connection with the acquisition, construction and equipping of various capital improvements to the City's Water and Wastewater Utility System with proceeds of a future tax-exempt financing; providing certain other matters in connection therewith; and providing an effective date. RESOLUTION R-2016 - 81 e. TR12817 - Perpetual Easement and Maintenance Agreement: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the acceptance and recordation of a Perpetual Easement and Maintenance Agreement, attached hereto as Exhibit 1", from the Florida Conference Association of Seventh Day Adventists for the purpose of installing and maintaining a shared use path for pedestrian and bicycle activity on a 12 foot strip of land Page 4 of 7 COMMISSION MEETING August 24, 2016 f lying within a portion of Tract 13, Fort Lauderdale Truck Farms Subdivision of Section 3, Township 49 South, Range 41 East, according to the Plat thereof, as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida being more particularly described in Exhibit "A", attached hereto and incorporated herein; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2016 - 82 f. TR12821 - Medical Billing Services Contract Award: A Resolution of the City Commission of the City of Tamarac Florida authorizing the appropriate City Officials to award RFP 16-14R "Medical Billing Services" and to execute an agreement with Advanced Data Processing, Inc. for a period from October 1, 2016 through September 30, 2021, to provide for the administration, processing and receipt of payments associated with transporting Emergency Medical Service (EMS) patients on behalf of the City of Tamarac Fire Rescue Department; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2016 - 83 g. TR12832 - Comprehensive Signage Award Agreement: A Resolution of the City Commission of the City of Tamarac, Florida, approving the award of Re -Bid Number 15- 23BR, and execution of an agreement between the City of Tamarac and Baron Sign Manufacturing, a Florida Corporation, attached hereto as Exhibit "A" and incorporated herein; for the Comprehensive Signage Program for a contract term effective upon contract award through September 30, 2018, in an estimated amount of one million three hundred and fifty four thousand, seventy eight ($1,354,078) dollars and approving a contingency expenditure of four hundred and twenty five thousand ($425,000) dollars for a total estimated expenditure of one million seven hundred and seventy nine thousand, seventy eight ($1,779,078.00) dollars; authorizing an appropriation of nine hundred and forty-one thousand five hundred and eighteen ($941,518) dollars; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2016 - 84 h. TR12826 - Interlocal Agreement Unsafe Structures Board Hearings: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate City Officials to execute an Interlocal Agreement between Broward County and the City of Tamarac providing for hearings by the Broward County Minimum Housing/Unsafe Structures Board at a rate of seventy eight dollars and forty cents ($78.40) per hour for the Code Enforcement Officer and thirty nine dollars and twenty cents ($39.20) per hour for Clerical Support, with a maximum case cost of five hundred dollars ($500.00) unless written authorization from the City has been received; per noticed case, for a five year period through September 30, 2021; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2016 - 85 i. TR12816 - Extension of Zoning in Progress / Hospital Similar Uses: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing a reasonable time extension of the Zoning in Progress of one hundred and eighty (180) days in accordance with Chapter 24, Article II, Division 6, Section 24-91 of the City of Tamarac Code of Ordinances; authorizing and directing the City Manager to undertake further study and review of the City's regulations relating to health care uses to include hospital, public or private, medical clinic or uses similar to a hospital or medical clinic; providing that upon the adoption of this Resolution extending Page 5 of 7 COMMISSION MEETING August 24, 2016 the Zoning in Progress an additional one hundred and eighty (180) days , no permits or applications shall be issued or processed for hospitals or medical clinics or uses similar to a hospital or medical clinic within the City of Tamarac for a total of three hundred and sixty (360) days from the date of the administrative order, consistent with this resolution; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2016 - 86 j. TR12825 - Interlocal Agreement Inspections/Plan Review: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate City Officials to execute the Interlocal Agreement for emergency/non-guaranteed supplemental support between Broward County and the City of Tamarac for inspection and plan review services to be performed by the Broward County Building Code Services Division in the event there is a staff shortage at rate of seventy eight dollars and forty cents ($78.40) per hour for a Building Code Inspector, eighty nine dollars and thirty cents ($89.30) per hour for a Plans Examiner, ninety dollars and twenty cents ($90.20) for a Chief Building Code Inspector, ninety nine dollars and eighty cents ($99.80) per hour for Building Official services. Overtime, when approved by the city, shall be at one and one half the normal hourly rate, including annual increase of 5%, for a five year period commencing October 1, 2016; providing for conflicts; providing severability; and providing for an effective date. RESOLUTION R-2016 - 87 k. TR12819 - Sabal Palm North: Quit Claim Deed: A Resolution of the City Commission of the City of Tamarac, Florida, declaring property surplus and authorizing the conveyance of a five foot (5) strip of real property to the Sabal Palm Community Development District in accordance with Section 6-156.2 of the City of Tamarac Code of Ordinances, pursuant to the Quit Claim Deed attached hereto as Exhibit "A"; authorizing the appropriate City Officials to take all necessary actions consistent with this resolution, providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2016 - 88 I. TR12837 - Medical Director Contract: A Resolution of the City Commission of the City of Tamarac, Florida to execute an agreement with Menendez MD & Brooks MD PA, for emergency medical services direction and supervision of the Tamarac Fire Rescue medical services, for an initial term of three (3) years at a cost of thirty-nine thousand dollars ($39,000) annually, with two (2) additional two-year renewal terms; the agreement shall commenced after City execution of this agreement, providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2016 - 89 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) - FIRST READING: a. T02348 - Firefighters Pension Plan Amendment: An Ordinance of the City Commission of the City of Tamarac, Florida; amending Chapter 16, Pensions and Retirement, Article VI, Pension Plan, providing for implementation of defined contribution plan component; providing for compliance with Section 175.351, Florida Statutes, providing for a savings clause; providing for severability; providing for codification and providing for an effective date. City Attorney Goren read T02348 by title into the record. Human Resources Director Swanson appeared and gave an overview of the ordinance amendment and responded to a few questions from the Commission. Motion passed unanimously (4-0).
