HomeMy WebLinkAbout2010-02-24 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL - COMMISSION CHAMBERS WEDNESDAY FEBRUARY 24, 2010 CALL TO ORDER: Mayor Talabisco called the regular meeting of the City Commission to order at 9:00 a.m. on Wednesday, February 24, 2010, in Chambers, 7525 NW 88 Avenue, Tamarac, FL 33321. PRESENT: Mayor Beth Talabisco, Vice -Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Patricia Atkins -Grad, and Commissioner Diane Glasser. ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr, and City Clerk Marion Swenson. PLEDGE OF ALLEGIANCE: Commissioner Glasser PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Talabisco honoring Ben Chicofsky, Chair of the Public Information Committee. (Requested by Mayor Beth Talabisco) b. Presentation by Mayor Talabisco and City Commission of a check in the amount of 12,173 to the American Red Cross for the Haiti Relief Fund. (Requested by City Manager Jeffrey L. Miller) City Manager Miller said there is a significant Haitian community in Tamarac and many of our employees suffered family losses in the wake of the earthquakes. It is a pleasure to work with Family Central and the Red Cross to do what we can for Haitian relief. Public Information Specialist Quinn has done a marvelous job on behalf of the City. Cariann Moore, Director of Donor Relations for the American Red Cross and Jennifer Taylor, Director of Human Resources representing Family Central accepted the check. Mayor Talabisco added many of our sister cities as well as the Kiwanis have donated money to the relief effort. Vice -Mayor Dressler said this is a gallant effort which must continue. C. Reports: a. Commissioner Bushnell commended the Mayor and City Commission, staff, and all who attended the Sunrise Commission meeting last night. Commissioner Bushnell spoke of the artwork that was unveiled at Tephford Park, and said she was invited to speak to an informational group on two topics of interest — Prestige/Monterey and Sunrise Transfer Station. Commissioner Bushnell said she has joined the Friends of the Library and realizes that the economic situation affects all groups. b. Commissioner Atkins Grad attended the Sunrise Commission meeting and is pleased to see the Transfer Station did not get approved. A great legacy this Commission will leave for the City of Tamarac is the art work, which taxpayers do not pay for. Friday at 6:00 p.m., artist George Gadsden will be honored at Citibank. Commissioner Atkins -Grad attended Homeowner/Condominium Association meetings and participated in the Adopt -A -Street program cleanup. C. Commissioner Glasser said she organized many people to go to Sunrise last evening both from Tamarac as well as Sunrise Lakes. When the City of Sunrise saw the outcry from the people, they decided not to move forward with the Transfer Station. d. Vice Mayor Dressler congratulated his colleagues and staff on a favorable outcome with regard to the Transfer Station. Everyone was professional and effective, and he is proud to serve and work with the Mayor and City Commission in Tamarac. e. Mayor Talabisco echoed Vice -Mayor Dressler's sentiments. Regarding First Lady Obama's childhood obesity initiative, Mayor Talabisco received more information which she will share with the Mayor and City Commission and she will ask staff to figure out how we can promote this effort, keeping costs at a minimum. Additionally, Mayor Talabisco spoke with the Manager of Walgreens and he indicated he would like to get involved with the initiative along with the City of Tamarac. A few weeks ago the South Florida Conference of Mayors announced a campaign called "Stop Passing the Buck", which has to do with the legislature respecting Home Rule. Mayor Slesnick of Coral Gables contacted fellow Mayors to see if they would tandem skydive in support of our troops on Saturday at Homestead Air Force Base. Mayor Talabisco said she signed up to participate. Mayor Talabisco received a phone call from Representative Ari Porth yesterday regarding the Prospect Bend Annexation. It appears several businesses in the community have been in touch with Senator Ring and they have some concerns regarding the annexation. Mayor Talabisco, City Manager Miller, and Public and Economic Affairs Officer Berns are going to meet with the business owners again and reiterate our intentions and hopefully allay their fears. 3. Assistant City Attorney Klahr had no report. 4. City Manager Miller thanked Public Works Director Strain, Budget/Contracts Manager Gies, Community Development Director Bramley, Planning and Zoning Manager Zickar, and Public and Economic Affairs Officer Berns for their help with the Transfer Station discussions. Tamarac Fire Department graduated 24 volunteers through the CERT Program; another class of 17 will graduate shortly. We are already preparing for hurricane season; the Broward County EOC is beginning a certification class for staff. Parks and Recreation reports that Social Services hosted an FAC Social Worker Student who was studying public services Page 2 of 6 Commission Meeting February 24, 2010 offered for Veterans. The student was extremely impressed with what we had to offer. Volunteers are being recruited to work at City Hall, assisting residents who visit the facility. The Senior Valentine's Day party on February 11 th was a great success with 140 participants. The next Twilight @Tamarac Concern Series will take place on March 12th at 7:00 p.m. at the Sports Complex. Public Works Director Strain reports the Veterans' Park Boar Ramp is now completed. The Utilities Department reports we have become a partner in the U.S. Environmental Protection Agency's Water Sense Program. 5. PUBLIC PARTICIPATION: Marc Sultanof, 7262 Fairfax Drive, commended the Mayor and City Commission for their participation in the Sunrise Commission meeting where discussions were held regarding the Transfer Station, and in particular, commended Commissioner Glasser for gathering troops from Kings Point. Ronald B. Barish, 7555 NW 99 Avenue, commended the Mayor and City Commission and the City of Tamarac for their donation to Haitian Relief. Mr. Barish spoke in favor of placing two traffic lights in Tamarac — one at Westwood Drive and Nob Hill Road and one exiting the Dairy Queen on Pine Island Road. Commissioner Glasser said she worked on the traffic light at Westwood Drive for many years but was repeatedly told that another light could not be put between the two already in place. Commissioner Glasser said she supports the initiative and will work with Mr. Barish to get traffic lights. Gene Pupilli, Pangea Mini -Mall spoke about working with the City with regard to sign issues. City Manager Miller said the City is working with Pangea on all permitting issues. It is a great addition to Tamarac and we are supportive of the project; however we do have a sign code and there are some issues that need to be addressed. City Manager Miller asked Public and Economic Affairs Officer Berns and Community Development Director Bramley to meet with representatives of Pangea to seek a creative solution. Vice -Mayor Dressler asked to be kept in the loop as this is in his district. Commissioner Atkins -Grad said she supports the project. Commissioner Bushnell said many snow birds are faithful to the Festival Flea Market, and this business needs to be marketed so people know about it. Nina Glazar, 8399 University Drive (Pangea) spoke about cooperation between the Flea Market and the City. Commissioner Glasser agreed the business needs to be marketed throughout the community, and she would be willing to assist. CONSENT AGENDA 6. TR11768 APPLEBEE'S NEIGHBORHOOD GRILL & BAR A Resolution of the City Commission of the City of Tamarac, Florida, granting approval of the Special Extended Hours Permit, requested by George W. Werden, representative of Applebee's Neighborhood Grill & Bar, to extend the hours of the on -premise sale and consumption of alcoholic beverages and to open for business at 11:00 a.m. on Sundays, Page 3 of 6 Commission Meeting February 24, 2010 pursuant to the City of Tamarac Ordinance No. 0-85-38, for the Applebee's Neighborhood Grill & Bar, located in the Washington Mutual Plaza at 6005 North University Drive (Case No. 3-MI- 10); providing for conditions of approval; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION NO. R2010-21 C. TR11764 TEMPLE BETH TORAH INGRESS -EGRESS EASEMENT A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to accept and execute a Blanket Public Safety Ingress/Egress Easement with Tamarac Jewish Center, Inc., for the Temple Beth Torah Project, located at 5700 NW 94th Avenue, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency and other public safety services; authorizing and directing the City Clerk to record said document in the public records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION NO. T02190 PROVIDING A NEW DEFINITION FOR THE TERM "FRANCHISE": Motion to adopt an Ordinance of the City of Tamarac, Florida, on second reading amending Chapter 5 of the City's Code of Ordinances, entitled "Cable Television", by specifically amending Section 5.5-22, entitled "Definitions"; providing a new definition for the term "Franchise"; providing for codification; providing for conflicts; providing for severability; and proving for an effective date. Assistant City Attorney Klahr read Temporary Ordinance 2190 on second reading by title. Vice -Mayor Dressler seconded by Commissioner Atkins -Grad moved adoption. Mayor Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. Assistant City Attorney Klahr read Temporary Ordinance 2187 on first reading by title. An ordinance of the City of Tamarac, Florida submitting to referendum an amendment to the Charter of the City of Tamarac at Article VII, entitled "Financial Procedures," and in particular amending Section 7.11 entitled "Requirements for Public Bidding"; providing that the City Commission shall establish by Ordinance a competitive solicitation financial threshold for procurement; providing that the City Commission shall establish by Ordinance the advertising requirements for solicitation of competitive bids, in accordance with the requirements of the Florida Statutes; providing for a notice of an advertisement of the referendum election to be published in accordance with the Code of Ordinances and the Charter of the City of Tamarac, Florida, as well as the State of Florida Election Code; providing that this Ordinance, when adopted, shall be submitted to the qualified electors of the City of Tamarac, on the November 2010 General Election Ballot and it shall become effective as provided by law; providing for severability; providing for inclusion in the code; and providing for an effective date. Minimum Reserve Funds: An Ordinance of the City of Tamarac, Florida, submitting to referendum an amendment to the Charter of the City of Tamarac at Article VII, entitled "Financial Procedures," and in particular amending Section 7.03 entitled "Form and Content of Budget and limitation on Unappropriated Surplus"; removing the limit on the Unappropriated Surplus Funds that the City is able to maintain in its reserves providing for a notice of an advertisement of the referendum election to be published in accordance with the Code of Ordinances and the Charter of the City of Tamarac, Florida, as well a the State of Florida Election Code; providing that this Ordinance, when adopted, shall be submitted to the qualified electors of the City of Tamarac, on the November 2010 General Election Ballot and it shall become effective as provided by law; providing for the place and places where said election is to be held; providing for conflicts; providing for severability; providing for inclusion in the code; and providing for an effective date. ADOPTED ON FIRST READING — FEBRUARY 24, 2010 Mayor Talabisco thanked the Charter Review Board for the work put forth and asked Assistant City Attorney Klahr to thank Assistant City Attorney Horowitz for the new language and getting the draft ordinances to the Mayor and City Commission in a timely fashion.
