HomeMy WebLinkAbout2010-09-07 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING TUESDAY, SEPTEMBER 7, 2010 CALL TO ORDER: Mayor Talabisco called the regular meeting of the City Commission to order at 7:00 p.m. on Tuesday, September 7, 2010 in Chambers, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. PRESENT: Mayor Beth Talabisco, Vice Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Michelle Gomez, and Commissioner Diane Glasser. ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Jacob Horowitz and Interim City Clerk Patricia Teufel. Mayor Talabisco asked for a moment of silence in observance of the 9th Anniversary of 911 on Saturday. PLEDGE OF ALLEGIANCE: Vice Mayor Dressler led the pledge of allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Beth Talabisco proclaiming September 23, 2010 as "Tamarac Play Day". (Requested by Parks & Recreation Director Greg Warner) 2. CITY COMMISSION REPORTS: a. Commissioner Bushnell reported that over the last two weeks she, along with staff, visited many communities to view the various conditions in her district. Commissioner Bushnell expressed her appreciation to staff for accompanying her and providing some excellent ideas. b. Commissioner Gomez reported she attended a Woodlands Homeowner meeting regarding the Woodland Neighborhood Improvement District and thanked staff for putting together a very thorough and informative presentation. Commissioner Gomez also attended the Chamber of Commerce "Staycation" event on August 28th at the Colony West Country Club. c. Commissioner Glasser reported that over the last two weeks she attended the Chamber of Commerce event at the Colony West County Club as well as the retirement luncheon for City Clerk Marion Swenson. Commissioner Glasser said that Congressman Ted Deutch hosted a town hall meeting at Kings Point on Prescription Drug Safety that was very well attended and she will distribute fliers that she received. Page 1 of 5 City Commission Regular Meeting September 7, 2010 Mayor Talabisco said that since Congressman Deutch assumed office he has been a good friend to the residents of Tamarac. d. Vice Mayor Dressler reported he attended various community meetings and thanked Community Development Director Bramley for her assistance at a meeting he attended on the east side of Tamarac. e. Mayor Talabisco wished everyone a happy and healthy New Year and reported that on a recent visit to the Buddhist Temple she was told that since they were unable to attend the opening of the new Temple Beth Torah, they will bring flowers for the temple altar. Mayor Talabisco read a letter of congratulations from Senator Bill Nelson on Tamarac being named a "Playful City USA" Community (attached hereto and made a part of these minutes). 3. CITY ATTORNEY REPORT: Assistant City Attorney Horowitz had no report 4. CITY MANAGER REPORT: City Manager Miller reported that this morning there was a collision between a school bus and a car on University Drive. Fortunately, no students were injured and the driver of the car was not seriously injured. There will be Budget Hearings on September 13th and September 22"d at 5:05 p.m. The Prospect Bend Annexation becomes effective September 15, 2010 with Tamarac assuming services to the community effective October 1, 2010. BSO put in a plan to ensure that the first day of school went well by placing extra units at the schools and is happy to report there were no incidents or problems. BSO also reports that Saturday evenings at the Sports Complex are packed due to football season and extra personnel have been assigned to deter car break-ins, which has proven to be effective as there have been no incidents over the last two weeks. Fire Rescue will continue municipal fire drills over the next few weeks and drills at businesses at Commerce Park will continue for the rest of the year. There is also continued training at TFR involving 20 different state agencies as well as Emergency Management training for local managers. Parks & Recreation reports that the Princess Party on August 28th was well attended. Utilities and IT provided a tour of their facilities for 10 Kings Point residents and if anyone is interested in a tour of city facilities, they should contact the Public Information Office. City Manager Miller reported on the following building projects: area wide installation of ADA compliant ramps; sidewalk installation and repair on Lagos De Campo will commence in October; 20 parking spaces will be added to Sunset Park; the parking lots at FS 41, BSO and behind City Hall will be resurfaced in the near future; work on the roof at the Multipurpose Center has started; renovations to FS 78 are completed and FS41 is almost completed, as soon as the renovations at FS 41 are completed, there will be a tour for the Commission and public and the installation of speed bumps in Plum Bay/Plum Harbor has been completed. Vice Mayor Dressler complimented Sheriff Lamberti and Chief Duguay on the new design of the patrol cars. 5. PUBLIC PARTICIPATION: Terry E. Morris, 4626 NW 45tn Monterey Golf Course and asked the Mayor and Commission from the State Attorney General's office regarding a change Court, spoke about the to request an Opinion in the zoning. After a Page 2 of 5 City Commission Regular Meeting September 7, 2010 discussion it was agreed that Assistant Attorney Horowitz would do an overview memo regarding land use and zoning. 6. CONSENT AGENDA: Commissioner Gomez seconded by Vice Mayor Dressler moved approval of all items on the consent agenda. On roll call Commissioner Bushnell "yes", Commissioner Glasser "yes", Vice Mayor Dressler "yes", Commissioner Gomez "yes" and Mayor Talabisco "yes". Motion carried. a. APPROVAL OF THE AUGUST 25, 2010 COMMISSION MEETING MINUTES APPROVED b. TR11909 - APPROVAL OF SHIP ANNUAL REPORTS: A Resolution of the City Commission of the City of Tamarac, Florida, approving the annual report for the State Housing Initiative Partnership for the Close Out Report FY 2007/2008 and the Interim Reports for FY 2008/2009 and FY 2009/2010. RESOLUTION NO. R2010-117 c. TR11919 - SUBMISSION OF RCMP GRANT:A Resolution of the City Commission of the City of Tamarac, Florida approving and authorizing the appropriate City officials to submit an application to the Florida Division of Emergency Management for Residential Construction Mitigation Program grant funds to improve storm resistance of residences in the City of Tamarac in the amount of $100,000 providing for a 2:1 match in local funds in the amount of $200,000 in the event of approval of the application; providing for acceptance of the award and executing of documents upon approval of the application. RESOLUTION NO. R2010-118 d. TR11920 - EXECUTE DISTRICT FOUR AGREEMENT BETWEEN STATE FDOT FOR ROW LANDSCAPING-COM. BLVD./UNIV. DRIVE/NW 64TH AVE: A Resolution of the City Commission of the City of Tamarac, Florida approving a District Four Maintenance Memorandum of Agreement between the State of Florida Department of Transportation (FDOT) and the City of Tamarac for Right -of -Way landscaping on Commercial Boulevard between University Drive and NW 64th Avenue; authorizing the appropriate City Officials to approve said Memorandum of Agreement. RESOLUTION NO. R2010-119 e. TR11921 FMIT INSURANCE RENEWAL: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the renewal of General Liability, Automobile Liability, Automobile Physical Damage, Workers' Compensation, and Property lines of coverage with the Florida Municipal Insurance Trust (FMIT) for a one (1) year period beginning October 1, 2010 at a cost of $971,139 and payment of any increase resulting from the annual premium audit. RESOLUTION NO. R2010-120 f. TR11913 - PROSPECT BEND ANNEXATION: A Resolution of the City Commission of the City of Tamarac, Florida, approving the Interlocal Agreement between the City of Tamarac and Broward County to provide for the implementation of the annexation of the Prospect Bend area into the City of Tamarac; authorizing the appropriate city officials to do all things necessary to effectuate the intent of this resolution; providing for recordation. T02207 - PUBLIC SCHOOL CONCURRENCY: Motion to adopt an Ordinance of the City of Tamarac, Florida, on first reading amending Chapter X Article VI entitled, "Land Development and Consistency Standards" of the City of Tamarac Land Development Code, by creating Section 10-333, "Public School Concurrency", establishing public school facilities concurrency requirements; providing for inclusion in the code; providing for severability; providing for conflict; and providing for an effective date. Assistant City Attorney Horowitz read Temporary Ordinance 2208 on first reading by title. Vice Mayor Dressler seconded by Commissioner Bushnell moved adoption. Community Development Director Bramley appeared and gave a presentation. Vice Mayor Dressler asked if there was any legislation pending that would have an impact on concurrency and Assistant City Attorney Horowitz said not at this time. On roll call Vice Mayor Dressler "yes", Commissioner Gomez "yes", Commissioner Bushnell "yes", Commissioner Glasser "yes" and Mayor Talabisco "yes". Motion carried. ADOPTED ON FIRST READING SEPTEMBER 7, 2010 9. PUBLIC HEARING(S) a. TR11910 - NSP AMENDMENT - FY 2008/2009 CDBG ANNUAL ACTION PLAN: A Resolution of the City of Tamarac, Florida approving the fifth amendment to the Community Development Block Grant ("CDBG") Program, fiscal year 2008 Annual Action Plan Ninth Program Year to provide for the reallocation of funds within the City's Neighborhood Stabilization Program ("NSP"); authorizing and directing the City Administration to take action consistent with the intent of this resolution; providing for conflict; providing for severability; and providing for an effective date. Assistant City Attorney Horowitz read TR11910 by title. Housing Administrator Bauldree appeared and gave a presentation. Commissioner Gomez seconded by Commissioner Bushnell moved adoption. Mayor Talabisco opened the public hearing and with no one wishing to speak closed the public hearing. On roll call Vice Mayor Dressler "yes", Commissioner Bushnell "yes", Commissioner Glasser "yes", Commissioner Gomez "yes" and Mayor Talabisco "yes". Motion carried. RESOLUTION NO. R2010-122 10. ORDINANCE(S) — SECOND READINGS a. T02208 - REVISING CHAPTER 14.5 OF THE CITY CODE OF ORDINANCES "THE TAMARAC DANGEROUS INTERSECTION SAFETY ACT": Motion to adopt an Ordinance of the City Commission of the City of Tamarac, Florida, on second reading amending and restating Chapter 14.5 of the Code of Ordinances of the City of Tamarac, "The Tamarac Dangerous Intersection Safety Act", in its entirety; authorizing the City to permit and implement the use of traffic infraction detectors for red light .infractions pursuant to state law; providing for definitions; providing for. Traffic".4h faction Enforcement Officers; authorizing City Administration to take all steps necessary to implement and operate the enforcement program pursuant to the requirements of state law; providing for the location of traffic infraction detectors within the city; providing for severability; providing for codification; providing an effective date. Commissioner Gomez seconded by Vice Mayor Dressler moved adoption. Commissioner Dressler asked if the Ordinance included a rolling right infraction. Public Works Director Strain said that will be decided when we go out for an RFQ and when we come up with a contract the Commission will decide what is an offense and what is not. Mayor Talabisco opened the public hearing and with no one wishing to speak closed the public hearing. On roll call Commissioner Gomez "yes", Commissioner Bushnell "yes", Vice Mayor Dressler "yes", Commissioner Glasser "yes" and Mayor Talabisco "yes". Motion Carried ADOPTED ON FIRST READING AUGUST 25, 2010 ADOPTED ON SECOND READING SEPTEMBER 7, 2010 ORDINANCE NO.0-2010-16 b. T02212 - BOARD AND COMMITTEE SELECTION PROCESS: Motion to Adopt an Ordinance of the City Commission of the City of Tamarac, Florida on second reading amending Article III, "Boards, Committees, Commissions" Chapter 5, "Buildings & Building Requirements", Article IX, "Public Art Program," Chapter 15, "Parks and Recreation", Article II, "Administration", and Chapter 24, "Zoning", Article II, "Administration", of the City's Code of Ordinances to provide for uniform numbers of regular members for City Boards; providing for the conclusion of existing terms for specific Board Members; providing for uniform meeting requirements for Boards; providing for conflicts; providing for severability; and providing for an effective date. Assistant City Attorney Horowitz read Temporary Ordinance 2212 on second reading by title. Commissioner Glasser seconded by Commissioner Gomez moved adoption. Mayor Talabisco opened the public hearing and with no one wishing to speak closed the public hearing. QUASI-JUDICIAL HEARING(S): There were no quasi-judicial hearings scheduled for this meeting. 12.
