HomeMy WebLinkAbout2010-09-13 - City Commission Special Meeting MinutesCITY OF TAMARAC SPECIAL CITY COMMISSION MEETING CITY HALL CHAMBERS MONDAY SEPTEMBER 13, 2010 CALL TO ORDER: Mayor Talabisco called the Special Meeting of the City Commission to order on Monday, September 13, 2010 at 5:05 p.m., in the Commission Chambers at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, Florida. PRESENT: Mayor Beth Talabisco, Vice Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Michelle J. Gomez and Commissioner Diane Glasser, ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Jacob Horowitz, and Interim City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Mayor Talabisco led the pledge of allegiance. Mayor Talabisco welcomed everyone and said this is a Special Meeting of the City Commission of the City of Tamarac to hold Public Hearings on the Annual Fire Assessment, the setting of the Tentative Millage Rates and the Tentative City Budget for Fiscal Year 2011. These public hearings are literally the culmination of an entire year's work by this City Commission, the City Manager and staff. The City Commission held four budget workshops on March 4, 2010, April 6, 2010, May 5, 2010, and July 7, 2010 to provide direction to the staff on this submittal. Mayor Talabisco thanked her colleagues for their participation at the workshops and for their suggestions as they deliberated on staffs recommendations. City Manager Miller read the following statement: The City of Tamarac has used the Fire Service Assessment since 1997 to provide specific funding for the purpose of providing fire services in the City of Tamarac. As the City Commission is aware, the Fire Service Assessment has been determined to be an equitable and efficient methodology to use in apportioning the cost of Fire Services to improved properties thus reducing the overall burden on the ad valorem tax rate. The residential rate for FY 2011 is $193 per dwelling unit which is the same rate as the past two years. Staff recommends the City Commission approve the rates that have been proposed and approved for publication at the July 14, 2010 Preliminary Fire Assessment Rate hearing. Assistant City Attorney Horowitz read TR11922 by title. A Resolution of the City Commission of the City of Tamarac, Florida, relating to the provision of Fire Rescue Services, facilities and programs in the City of Tamarac, Florida; reimposing Fire Rescue Assessments against assessed property located within the City of Tamarac for the fiscal year beginning October 1, 2010; approving the rate of assessment; approving the assessment roll; providing for conflicts; providing for severability; providing an effective date. Special Commission Meeting September 13, 2010 Page 1 of 5 Financial Services Director Mason gave a presentation (attached hereto and incorporated herein). Commissioner Bushnell asked if the rates for the annexed area is the same as they paid in the past. Financial Services Director Mason responded yes. Mayor Talabisco opened the public hearing: Joe Schreiber, 10504 East Clairmont Circle, spoke in opposition to imposing the Fire Rescue Assessment Fee. With no one else wishing to speak closed the public hearing. Commission Glasser seconded by Commissioner Gomez moved approval. On roll call Commissioner Bushnell "yes", Vice Mayor Dressler "yes", Commissioner Glasser "yes", Commissioner Gomez "yes" and Mayor Talabisco "yes". Motion carried. RESOLUTION R-2010-123 Mayor Talabisco said this is the first public hearing for establishing the Operating Millage Rate and Debt Service Millage Rate for Fiscal Year 2011. A second public hearing on Temporary Ordinance Number 2209 will be held on September 22, 2010 at 5:05 pm and asked City Manager Miller to read his statement. City Manager Miller read the following statement: In accordance with the Truth in Millage requirements of Florida Statutes, the City is required to announce the percentage difference between the proposed millage rate and the rolled -back rate. As such, the following is read into the record: The proposed operating millage rate of 6.5000 mills for Fiscal Year 2011 is .9965 mills or 13.29% less than the rolled -back rate of 7.4965 mills. Assistant City Attorney Horowitz read T02209 by title. An Ordinance of the City Commission of the City of Tamarac, Florida to establish and levy ad valorem taxes within the corporate limits of the City of Tamarac, Florida, for the tax year 2010; providing for the levy of ad valorem taxes in the amount of 6.5000 mills ($6.5000 per $1,000) based upon the assessed value on non-exempt real and personal property located within the city limits of the City of Tamarac; providing for the levy of ad valorem taxes in the amount of .0894 mills ($.0894 per $1,000) based upon the assessed value of the non-exempt real and personal property located within the city limits of the City of Tamarac, for funds for annual debt service for the City of Tamarac, Florida general obligation refunding bonds, series 1998; providing for conflicts; providing for severability; and providing for an effective date. Financial Services Director Mason gave a presentation (attached hereto and incorporated herein). Vice Mayor Dressler confirmed that Tamarac had a significant reduction in property value and ad valorem taxes over the last two years. Vice Mayor Dressler spoke of the state formula for calculating roll back rates and said that the majority of cities in calculating their FY11 budget would be compelled to use the state's formula for the roll back rate and/or borrow from their operating funds in order to balance their budget. Financial Services Director Mason said all cities are required to calculate the roll back rate using the state formula and 3 or 4 cities have set their rates higher than the roll Special Commission Meeting September 13, 2010 Page 2 of 5 back. Vice Mayor Dressier confirmed that when a city sets a higher roll back rate, it would require a super majority vote of the city commission. Financial Services Director Mason said it sets the bar moving forward to what your roll back will be calculated to in the future. Vice Mayor Dressler said that at the 6.5 millage rate, we will be collecting less money than we did last year in property taxes and that is because we are not using the maximum roll back rate. Vice Mayor Dressler confirmed that we are also setting debt service millage rate at .0894 today. Commissioner Bushnell thanked Financial Services Director Mason for holding the four workshops and said it was beneficial to everyone in setting the budget and being able to go back into the community and provide them with an understandable explanation of the millage rate. Mayor Talabisco opened the public hearing: Miriam Marin, 9202 NW 73rd Street and Joe Schreiber, 10504 East Clairmont Circle, spoke in opposition to the proposed millage rate. City Manager Miller said that 65% of residents will actually pay less in taxes, 11 % do not pay any taxes and that 25% of residents will pay an increase in taxes and said that staff is available in the back of the chambers to assist you in determining your actual taxes With no one else wishing to speak Mayor Talabisco closed the public hearing. Vice Mayor Dressler seconded by Commissioner Gomez moved approval. Commissioner Bushnell said that there are so many exemptions seniors can take and with the help of staff they were able to lower one resident's taxes by $1,000. Vice Mayor Dressler encouraged people to look at their TRIM notices and said if they do not understand anything they should call the Property Appraiser's Office. Vice Mayor Dressler spoke of an excellent article in the Miami Herald which addressed the way homes are assessed taxes. On roll call Vice Mayor Dressier "yes", Commissioner Glasser "yes", Commissioner Bushnell "yes", Commissioner Gomez "yes" and Mayor Talabisco "yes". Motion carried. ADOPTED ON FIRST READING SEPTEMBER 13, 2010 Mayor Talabisco said this is the first public hearing for establishing the Fiscal Year 2011 Operating Budget, Capital Budget and Financial Policies. A second public hearing on Temporary Ordinance Number 2210 will be held on September 22, 2010 at 5:05 p.m. and asked City Manager Miller to read his statement. City Manager Miller read the following statement: The proposed operating and capital budget for Fiscal Year 2011 is $102,053,361 which is $25,316,659 less than the Amended Budget for Fiscal Year 2010. The proposed general fund budget, which is the primary fund for providing governmental services such as, our contract with BSO, general and administrative services, public works, and parks and recreation, is $44,734,223 which is $2,015,775 less than the Amended Budget for Fiscal Year 2010. In addition, this will be the first year that we are including the financial policies as part of Special Commission Meeting September 13, 2010 Page 3 of 5 the adoption of the annual budget. These financial policies are an enhancement of our long-term financial planning for the City. These policies set parameters for operating management, including establishing reserves for specific purposes, establishing accounts management and financial planning policies and establishing policies on economic resources. An Ordinance of the City Commission of the City of Tamarac, Florida adopting the operating budget, revenues and expenditures, the capital budget, and the financial policies for the fiscal year 2011; repealing all ordinances in conflict with this ordinance; providing for conflicts; providing for severability; and providing for an effective date. Financial Services Director Mason gave a presentation (attached hereto and incorporated herein. Vice Mayor Dressler thanked Financial Services Director Mason and asked how much in FY10 Tamarac expended on BSO and Fire Rescue Services. Financial Services Director Mason responded $28 million. Vice Mayor Dressler confirmed that the $28 million did not include any other services and that we only collected $18 million in property taxes. Vice Mayor Dressler asked how much those same services would cost in FY11 and Financial Services Director Mason responded approximately $29 million and we taking in less taxes than in FY10. Vice Mayor Dressler asked how many positions have been lost over and Financial Services Director Mason said 75 over the last three years. Commissioner Bushnell commented that with the loss of the 75 positions people are working harder, this is asking a lot of staff and she is very proud of how they have stepped up to the plate. Commissioner Glasser spoke of the lost of a position in the Mayor's Office and how duties have been reassigned. Mayor Talabisco opened the public hearing and with no one wishing to speak closed the public hearing. Commissioner Bushnell seconded by Commissioner Gomez moved approval. On roll call Commissioner Gomez "yes", Vice Mayor Dressler "yes", Commissioner Glasser "yes", Commissioner Bushnell "yes", and Mayor Talabisco "yes". Motion carried. ADOPTED ON FIRST READING SEPTEMBER 13, 2010 Mayor Talabisco announced the second public hearing on setting the operating and debt service millage rates and adopting the budget will be held on September 22, 2010 at 5:05 p.m. Mayor Talabisco said setting a budget for a city of 60,000 is a daunting task and everyone wrestled to make the best possible decisions for the majority of the residents. Mayor Talabisco recognized Cindi Watts, Business Developer for Family Central, and apologized for not having asked her to come up and speak earlier in the meeting. Ms. Watts gave a brief overview of the services they provide for the residents of Tamarac. Ms. Watts said Family Central has made a request for $21,969 from Tamarac as a match in order for them to qualify for $1,267,380 in state and federal aid which will allow Special Commission Meeting September 13, 2010 Page 4 of 5 them to continue to provide services for 553 children in Tamarac. Ms. Watts stated that only 1.60/6 of the funds are used for administrative purposes. Ms. Watts thanked the Mayor and Commission for their consideration. Mayor Talabisco said that the Commission is proud to be partners with Family Central and the Interfaith and Community Leadership Council. Mayor Talabisco said this is an example of something the Commission has to consider when setting a budget. Mayor Talabisco spoke of a prior meeting and the civility code Tamarac has in place for meetings.
