HomeMy WebLinkAbout2010-12-22 - City Commission Special Meeting MinutesCITY OF TAMARAC SPECIAL CITY COMMISSION MEETING WEDNESDAY, DECEMBER 22, 2010 CALL TO ORDER: Mayor Talabisco called the special City Commission meeting to order at 9:07 a.m. on Wednesday, December 22, 2010 in Room 105, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL. PRESENT: Mayor Beth Talabisco, Vice Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Michelle J. Gomez, and Commissioner Diane Glasser. ALSO PRESENT: City Manager Jeffrey L. Miller, Deputy City Manager Michael Cernech, City Attorney Sam Goren and City Clerk Peter M. J. Richardson. PLEDGE OF ALLEGIANCE: Mayor Talabisco led the pledge of allegiance. Mr. Goren read the following resolution title into the record of the special City Commission meeting: (TR 11972) A resolution of the City Commission of the City of Tamarac, Florida, approving the purchase and sale agreement with T&C Realty Group, Inc., a Florida corporation; authorizing the appropriate City officials to execute the purchase and sale agreement between the City of Tamarac and T&C Realty Group, Inc., for the City to purchase real property generally located immediately east and west of NW 91st Avenue on the north side of Commercial Boulevard, within the City of Tamarac; providing for authorization for the appropriate City officials to execute any and all documents necessary to close the transactions consistent with the purchase and sale agreements and the assignments of the purchase and sale agreements; providing for funding; providing for conflicts; providing for severability; and providing for an effective date Mr. Goren noted that as a matter of law Section 7.3 of the terms of the Purchase and Sale agreement, would be waived. Public and Economic Affairs Officer Andy Berns made a presentation to the Mayor and City Commissioners regarding the potential approval of a purchase and sale agreement with T&C Realty Group, Inc. for the purchase of real property (3.24 acres +/-) generally located immediately east and west of NW 91 st Avenue on the north side of Commercial Boulevard in the City of Tamarac. Mr. Berns responded to questions from the Mayor and members of the City Commission relative to the property itself, land assembly matters and related topics. Mr. Goren stated that paragraph 7.3 would be waived as part of the motion, as required by State statute. He noted that City staff had provided compelling evidence in back-up materials and this morning's presentation to support pay slightly more for the property as a premium. Mr. Goren stated that a four -vote minimum was required to approve the potential property acquisition. Special City Commission Meeting December 22, 2010 Commissioner Dressler moved, seconded by Vice Mayor Bushnell, to approve TR11927, including the waiver of Section 7.3 of the purchase and sale agreement. The motion was approved unanimously (5-0). Mr. Miller thanked the Mayor and City Commissioners for approving the acquisition of the property for planning of the Tamarac Village project. He also expressed appreciation to Deputy City Manager Mike Cernech, Assistant City Manager Diane Phillips, Finance Director Mark Mason, Public and Economic Affairs Officer Andy Berns, and City Attorney Sam Goren for their efforts relative to the property acquisition matter. Deputy City Manager Mike Cernech presented a brief update regarding the proposed disposition of stained glass in the former Temple Beth Torah property. Following a brief discussion, there was City Commission concurrence to authorize City staff to coordinate with Temple Beth Torah officials to provide them with one or two pieces of the stained glass and provide one or two pieces to the Tamarac Historical Society, and dispose of the balance of the pieces of stained glass. Mr. Cernech noted that City officials and staff would work with the demolition firm and trained professionals to arrange for the safe removal of the stained glass from the building prior to demolition. He also stated that the disposition of stained glass from the former Temple Beth Torah property was surplus to the City of Tamarac, and could be lawfully disposed of as permitted by the City's Code of Ordinances. Mr. Goren said he concurred with this conclusion. Likewise, Mr. Mark Mason, the City's Finance Director, expressed his concurrence with Mr. Cernech's and Mr. Goren's summary of the matter. Mayor Talabisco and members of the City Commission extended best wishes for happy holidays to all.
