HomeMy WebLinkAbout2011-05-25 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING WEDNESDAY, MAY 25, 2011 CALL TO ORDER: Mayor Bushnell called the regular meeting of the City Commission to order at 9:07 a.m. on Wednesday, May 25, 2011 in City Commission Chambers, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. PRESENT: Mayor Pamela Bushnell, Vice Mayor Michelle J. Gomez, Commissioner Marion Swenson, Commissioner Diane Glasser and Commissioner Harry Dressler. ALSO PRESENT: City Manager Michael C. Cernech, Assistant City Attorney Julie Klahr and City Clerk Peter M.J. Richardson. PLEDGE OF ALLEGIANCE: Mayor Bushnell led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a Proclamation by Mayor Pamela Bushnell proclaiming May 25, 2011 as "National Senior Health & Fitness Day. Part of Older Americans Month". (Requested by Parks & Recreation Director Greg Warner). b. Presentation of a proclamation by Mayor Pamela Bushnell acknowledging and commending Ed Temple for his act of heroism. (Requested by Fire Chief Mike Burton) 2. CITY COMMISSION REPORTS: a. Commissioner Swenson: Noting that she had recently been contacted by Kathy Goldstein, representing the Rohr Bais Academy, expressed appreciation to Chad Quinn for making arrangements for a tour of City facilities by academy students. She expressed hope that the tours could possibly be arranged on an annual basis. b. Vice Mayor Gomez: Stated that the recent quarterly financial and operational update by City staff was very informative and productive. Noted that she had enjoyed the City's "Concert on the Green" recently held at Colony West Country Club. Also said she was looking forward to attending the art exhibit this evening at 6:30 p.m. at the Community Center. Stated that she was not able to attend the memorial service for Randee Reid. Vice Mayor Gomez also said that her heart went out to Vicki Reid and her family for the loss of Randee. Vice Mayor Gomez expressed grateful appreciation to all of the men and women who proudly served to defend our nation. c. Commissioner Glasser: Noted that she had attended the recent Broward League of Cities installation dinner where Mayor Bushnell was installed as the City's voting delegate and Commissioner Glasser was installed as the City of Tamarac's alternate voting delegate. Noted that she had attended the recent Concert on the Green at the Colony West Country Club which was well attended and enjoyed by many Tamarac residents. Stated that she attended the recent AFDC Senior Hall of Fame ceremony, recognizing a variety of community volunteers over the age of sixty (60). Commended City staff for providing the Mayor and City Commissioners with an excellent comprehensive report at the recent quarterly update meeting. d. Commissioner Dressler: Noted that he had the honor to attend the memorial service for Randee Reid and also had the opportunity to meet a number of Mr. Reid's long-time friends, including those involved with his community charitable efforts for children. Commissioner Dressler noted that Commissioner Swenson and Mr. Cernech had also attended Mr. Reid's memorial service. Also stated that he had attended the memorial service for EMS Division Chief Tom Sheridan's wife. Stated that he had attended the very well attended the recent "Go Green" Health Expo this past Saturday at the Tamarac Community Center. Reported that the General Employees Pension Board had recently met and noted that the portfolio for the plan was up by fifteen percent, one of the best performances in the State of Florida. e. Mayor Bushnell: Commended her fellow City Commissioners and City staff for attending as many community events as possible to represent the citizens of the City of Tamarac. Noted that she had attended the Concert on the Green event at the Colony West Country Club, including partnerships with area businesses. Expressed appreciation to Financial Services Director for updating the Mayor and City Commissioners on financially -related matters. Page 2 of 6 REGULAR COMMISSION MEETING May 25, 2011 Revised June 6, 2011 1 Stated that she had attended a seminar by a local firm, PuroClean, in the Tamarac Commerce Park, a national home and family remediation company, wherein trainees cleaned an on -site home which had been intentionally flooded by staff. Noted that this firm would be assisting the Interfaith Council with a variety of community projects. Noted that she had attended the installation of the Broward League of Cities Board of Directors at a beautiful temple in Cooper City. Made note that she had attended a breakfast of the Broward County Association of Realtors for Mayors throughout Broward County. Stated that she had attended the Buddha birthday celebration at the local Buddhist Temple, which was a wonderful and peaceful event. Noted that she had also recently attended an event for the City's "Orioles" baseball team of the Challenger Baseball League for physically and mentally challenged persons. Noted that she had attended the service for Chief Sheridan's wife and was sorry that she was not able to attend the services for Randee Reid. 3. CITY ATTORNEY REPORT: Assistant City Attorney Klahr made introductory remarks regarding the City Commission's potential options relative to providing input on the pending application of certain elements of the Broward County Ethics Code upon municipalities and municipal officials in Broward County. Commissioner Glasser presented a brief summary of the efforts of the Broward League of Cities to date relative to review of the proposed Broward County Ethics Code and related matters. Ms. Klahr noted that the Mayor and City Commissioners were potentially providing direction to their Broward League of Cities representative for the June 2, 2011 Broward League of Cities meeting, not approving the provisions of Broward County's Ethics ordinance. Commissioner Dressler stated that by voting "yes" on this matter, he was not making a blanket endorsement for what Broward County might choose to do relative to the subject matter. Vice Mayor Gomez expressed appreciation to Commissioner Glasser and Mr. Goren and his staff for their efforts relative to review of the Broward County Ethics ordinance and the application to municipalities in Broward County. Commissioner Glasser noted that most of the current Broward County Commissioners had previously served as municipal (local) elected officials in cities or towns in Broward County. Mayor Bushnell commended Commissioner Glasser and Mr. Goren for their efforts in reviewing the Broward County Code of Ethics in detail on behalf of the City Commission. Commissioner Dressler moved, seconded by Vice Mayor Gomez, that the Tamarac City Commission accept the current recommendations of the Broward League of Cities Committee relative to the Broward County Ethics Code and to authorize the conveyance of this recommendation to the Broward League of Cities Board of Directors. CITY MANAGER REPORT: City Manager Michael Cernech expressed his condolences to Vicki Reid upon the recent passing of her husband, Randee. Mr. Cernech also expressed condolences to EMS Division Chief Tom Sheridan upon the recent passing of his wife, Toni Crimi. Mr. Cernech also reported that Human Resources Director Maria Swanson continued to make a good recovery and hoped to return to the office sometime in the near future. Mr. Cernech invited everyone to attend the City of Tamarac's Memorial Day observation on Monday, May 30t" at 10:30 a.m. at Veteran's Memorial Park to recognize and honor all military service personnel and their families. Mr. Cernech noted that over 250 persons attended the recent Concert on the Green event at the Colony West Country Club and over 250 people participated in the recent "Get Healthy, Go Green" Health Expo at the Tamarac Community Center. Finally, Mr. Cernech reported that BSO personnel believed that they had apprehended the party responsible for the theft of eleven backflow devices on May 11th. In response to a question from Mayor Bushnell about the requirements for selling scrap metals, Mr. Cernech stated that the existing laws were written several years ago and did not contemplate the perpetration of such potential property -related activities. Commissioner Dressler provided a brief investment report, noting that although the yield curve was very low, the City of Tamarac's cash flows needs continued to be met in an appropriate manner. 5. PUBLIC PARTICIPATION: Ronald Barish provided an update on various anti -bullying and school related programs. He also requested that Mayor Bushnell forward a letter to Governor Scott to express opposition to proposed layoffs from Broward County Schools. Mayor Bushnell and Commissioner Dressler suggested that Mr. Barish possibly consider contacting legislative representatives who had supported Governor Scott's reductions in the State budget relative to funding support for the Broward Schools and other districts throughout the State of Florida. Patti Lynn to request the potential delay of the implementation of screening -related requirements for trash receptacles and mechanical equipment. Mr. Cernech noted that no action was necessary on this matter, since the City Commission had not discussed nor decided upon the refuse container matter related to the City's solid waste franchise agreement. Swati Yadav briefly outlined her concerns regarding the unanticipated cancellation of her mother and baby dance classes at the City's Community Center. Mr. Cernech stated that Parks and Recreation Director Greg Warner would follow-up with Ms. Yadav about this matter. Page 4 of 6 REGULAR COMMISSION MEETING May 25, 2011 Revised June 6, 2011 6. CONSENT AGENDA: Vice Mayor Gomez moved, seconded by Commissioner Dressler to approve the consent agenda as presented. The motion was adopted unanimously (5-0). a. Approval of the May 11, 2011 Regular Commission Meeting Minutes. APPROVED b. TR11988 - BUS SHELTER PROGRAM: A Resolution of the City Commission of the City of Tamarac, Florida, to execute an agreement between Broward County and the City of Tamarac for a Maintenance Agreement in conjunction with the Broward County Bus Shelter Grant Program; providing for conditions of approval; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2011-51 c. TR12017 - AMENDMENT TO INTERLOCAL AGREEMENT LOCAL OPTION GAS TAX: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate city officials to execute the 2011 Amendment to Interlocal Agreement between Broward County and City of Tamarac providing for division and distribution of the proceeds of the local option gas tax imposed by the Broward County local option gas tax ordinance; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2011-52 d. TR12018 - AMENDMENT TO INTIERL'OCAL AGREEMENT ADDITIONAL LOCAL OPTION GAS TAX: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate city officials to execute the 2011 Amendment to Interlocal Agreement between Broward County and City of Tamarac providing for division and distribution of the proceeds from the Broward County additional local option gas tax on motor fuel ordinance; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2011-53 e. TR12019 - AMENDMENT TO INTERLOCAL AGREEMENT FIFTH CENT ADDITIONAL LOCAL OPTION GAS TAX: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate city officials to execute the 2011 Amendment to Interlocal agreement between Broward County and City of Tamarac providing for division and distribution of the proceeds from the Broward County fifth cent additional local option gas tax on motor fuel for transit; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2011-54 f. TR12027 PURCHASE OF SOLAR SALT FROM MORTON SALT: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to approve the participation in a purchasing agreement for solar salt for water treatment from Morton Salt, utilizing the Southeast Florida Governmental Purchasing Cooperative Group Bid #2009-004 for an estimated total cost of $35,381.50 annually, approving funding from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date.
