HomeMy WebLinkAbout2013-05-22 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING W ED N ES DAY, MAY 2212013 CALL TO ORDER: Mayor Talabisco called the regular meeting of the City Commission to order at 9:03 a.m. on Wednesday, May 22, 2013 in City Commission Chambers, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Beth Talabisco, Vice Mayor Bushnell, Commissioner Patricia Atkins -Grad and attendance. Harry Dressler, Commissioner Pamela Commissioner Diane Glasser were in Also in attendance were Assistant City Manager Diane Phillips, City Attorney Samuel S. Goren and Interim City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Mayor Talabisco asked for a moment of silence after the Pledge of Allegiance for the victims of the tornado in Moore, Oklahoma. Mayor Talabisco led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Beth Talabisco proclaiming the month of June 2013 as "Safety Month". (Requested by the Tamarac Employee Safety Committee) Mayor Talabisco presented Parks & Recreation Director Warner with a plaque from the Relay for Life Committee in recognition of the help that staff provided at the Relay for Life Event last weekend. 2. CITY COMMISSION REPORTS: a. Mayor Talabisco: Said she watched the tragedy unfold in Moore Oklahoma with mixed emotions; that of a wife, grandmother, daughter, sister and Mayor. Mayor Talabisco said on May 3, 1999 Moore experienced its first tragedy and had another incident a few years later and the odds of this happening to one city a third time is astronomical. Coverage is 24 hours a day and what was fascinating were the videos that were breathtaking and stunning and said she was amazed how the governor, mayor, elected officials, first responders and teachers all came together through the chaos to get the job done. Mayor Talabisco said Florida is better prepared to handle hurricane events, but there is no way for anyone to be prepared for a Tornado of this magnitude. There was a lot of talk about code and the significance of safe houses both in homes and in schools and how they were going to figure out how to make these affordable. What was very interesting was the first thing they did was put street signs back up so people knew where they were. We saw the people of Moore come together and over the past few months the people in Newtown, CT, Boston, MA, West, TX and New York as well and all in all it has been a rough year for America. Mayor Talabisco said this makes her feel stronger about our community being able to handle a disaster. Residents have been urged over the years to prepare and she believes they have heeded the warnings to be prepared and have a plan. Mayor Talabisco said the people of Moore had only 16 minutes to make decisions about what to do to prepare for the tornado and it is a miracle that only twenty-four people were lost. Mayor Talabisco said she felt a tremendous Page 1 of 8 REGULAR COMMISSION MEETING MAY 222 2013 need to share what her experiences were over the past 48 hours and how strongly she feels about Tamarac, as well as the county, being prepared for a disaster. Mayor Talabisco reported she was out and about over the weekend and attended the exceptional Buddha's Birthday celebration at the Buddhist Temple. b. Commissioner Bushnell said she too was astounded by the event in Moore and listened to the eloquent speech given by the Governor of Oklahoma. Commissioner Bushnell expressed her amazement that the tornado was 2 miles wide and cut a swath twelve miles long and said it is hard to imagine the magnitude of the damage that was done. Commissioner Bushnell attended the Senior Hall of Fame dinner where Tamarac Resident Margaret Riley was inducted into the Hall of Fame; Broward League of Cities event honoring military families; Northwest Council of Elected Officials luncheon; Broward County Alliance Business Forum; MPO workshop which Tamarac hosted; Relay for Life event last weekend; Health Fair at the Community Center and Buddha's Birthday Celebration at the Temple on Sunday. c. Commissioner Atkins -Grad: Attended the Antique Car Parade; several meetings; Northwest Council of Elected Officials luncheon; the Woodlands HOA meeting; Art Exhibit at the TCC by the children of Challenger Elementary; Senior Hall of Fame installation dinner; Relay for Life event and Buddha's Birthday Celebration. d. Commissioner Glasser said she also attended the events mentioned by Commissioner Bushnell and Commissioner Atkins -Grad. Commissioner Glasser commented that she attended Buddha's Birthday Celebration for the first time and was impressed with their hospitality, friendship and warmth. Attended a two day seminar in Pembroke Pines for ADRC about Medicare and was very impressed with the speaker and came away with a lot of good information and said she will be travelling to Washington D.C. this summer to meet with the speaker and get more information which she will share with the Commission. Commissioner Glasser reported that she attended the HOA Liaison Seminar to educate boards about the legal aspects of foreclosures, service animals among other topics hosted by Manager Bauldree and also the MPO workshop. collections, unauthorized occupants and Housing and Neighborhood Programs Mayor Talabisco said that Commissioner Glasser serves as the Vice Chair of the Advisory Council for the ADRC and she recently had lunch with Edith Lederberg who told the Mayor of her trips to Tallahassee to obtain funds to continue to offer programs to the elderly. e. Vice Mayor Dressler said the key to survival in any natural catastrophe is preparation and Florida's Hurricane season starts in 8 days. Vice Mayor Dressler encouraged people to attend the Memorial Day Ceremony on Monday, May 27th at 10:30 a.m. Vice Mayor Dressler said he also attended the events mentioned by Commissioners Bushnell, Atkins -Grad and Glasser and said all of those events are meaningful. Vice Mayor Dressler reported that the MPO did come to Tamarac as part of an initiative to get the members out and about in the different cities in Broward County and educate people Page 2 of 8 REGULAR COMMISSION MEETING MAY 22, 2013 i. about the fact that the organization is a county wide regional planning organization whose key goal is to focus on mass transportation. Vice Mayor Dressler addressed the issue of the redevelopment of the Woodmont Country Club. Vice Mayor Dressler said the Commission recently approved the transmittal of an application for redevelopment and at the time the Commission said yes to the transmittal it was noted that this was the beginning of a process. At a recent neighborhood BBQ he had a conversation with board members from the Woodmont Estates and Isles HOA's and two issues emerged as significant issues that needed to be addressed in the Developer's Agreement. The first issue is with the layout of the golf course and the second is the location of the aqua range. Vice Mayor Dressler advised City Manager Cernech and senior staff that these two items need to be addressed with the various parties now rather than later at site planning. Vice Mayor Dressler said he wants people to understand that this is a work in progress and wants people to understand that if they do not demonstrate sustainability and there is no evidence of performance of what everyone promised to do to a standard that is acceptable to the Commission, that it is a risk for the applicant. Vice Mayor Dressler said he will talk about these issues in the future and wants people to know that the Commission is keenly paying attention to these issues. Vice Mayor Dressler ended by encouraging people to view the meetings on line in order to be more informed about this issue. Commissioner Bushnell said she saw an article in the SunSentinel about a Tamarac Resident, Jordon Hessler, who won a contest for designing a bag that will be used by Whole Foods Market for their groceries. Commissioner Bushnell reported that she had the opportunity to go see the new EMS vehicle and it is quite impressive. 3. CITY ATTORNEY REPORT: City Attorney Goren said he has not yet seen the lawsuit on the Woodmont matter regarding the covenants issue in which the City of Tamarac has been included as a defendant. City Attorney Goren said that the City has not been served with the lawsuit and he has been advised by Dr. Appel that there has been a filing of some sort. As soon as the City is served they will defend the lawsuit as it applies to the City's issues and its responsibilities under the terms of any covenants or relationships that we have discussed in public as well as in private. They will defend the City vigorously to the extent that the City's interests are affected by the lawsuit. City Attorney Goren said the Development Agreement is an item that was left open during the transmittal hearing for both the zoning issue and the land use issue subject to further review between the parties in order to bring back to the Commission a document which will be acceptable. This is an item which is in play and requires further Commission analysis, evaluation and ultimately approval. City Attorney Goren reminded the Commission that on July 1st they have an obligation under the County Ethics Code to file their outside/concurrent statement with the Clerk. City Attorney Goren said he has offered the Commission and the Commission has requested a legal interpretation of the definition of compensation or salary as defined by the Code. This will enable the Commission to properly file the form on July 1st. City Attorney Goren clarifiedthat this is the County form and not the State Form 1. The Commission will be receiving the Opinion shortly. City Attorney Goren said there will be a four hour ethics seminar on June 21St. City Attorney Goren said his law firm and other firms have issued multiple opinions over the past year and they will take all the opinions from the panel members and put them into a format where we Page 3 of 8 ' REGULAR COMMISSION MEETING MAY 22, 2013 a ask questions and make it a Q & A session. City Attorney Goren encouraged everyone to attend the session on June 21 St 4. ASSISTANT CITY MANAGER REPORT: Assistant City Manager Phillips said the Human Resources department recently posted seven firefighter/paramedic position openings. After the first week only 31 applications had been received and thanks to the creative minds of Whitney Neff, HR, and Jim Twigger, IT, the existing Robocall system was configured to call potential candidates in the Municipal Employees Screening and Hiring Database which resulted in 116 additional applications being submitted. As of May 22"d the number of applications stands at 161. Assistant City Manager Phillips encouraged people to attend the Memorial Day Ceremony on Monday, May 27, at Veteran's Park at 10:30 a.m. Past Events: The Mother's Day Brunch on March 11 th had 40 people in attendance; the Spring Into a Healthy You" health fair had over 500 attendees and the Hazardous Household Waste & Electronics Recycling Collection event on May 5th had 515 users, which was approximately 10% less than the last event in Tamarac. Additionally, Recyclebank participated by providing points vouchers for people dropping. off hazardous household and electronic waste. Assistant City Manager Phillips reported that today and tomorrow key city staff in Tamarac and other municipalities in Broward County are participating in a disaster preparedness simulation that is designed to take us through a series of exercises to ensure that we remain vigilant and understand what our roles are in order to be able to respond appropriately should a disaster happen on a local level. This effort was coordinated through Tamarac Fire Rescue by Assistant Chief Jeff Moral and Community Education Preparedness Specialist Van Schoen. Mayor Talabisco asked Fire Chief Burton to give a status report on the disaster in Moore, OK. Fire Chief Burton said the preliminary and secondary searches have been completed on all structures and vehicles and they are now in recovery mode vs. a rescue mode which is pretty significant as local authorities feel very comfortable that they have located all survivors. The state and regional resources are handling this incident now and when compared to a hurricane, where there is often wide spread destruction, the path of destruction from a tornado is relatively small so they first reach out to regional resources and then to state resources to handle their needs. We reached out as a city on Monday morning to offer assistance through the Broward County Emergency Management should Oklahoma need additional assistance. The Urban Search teams from Oklahoma, Tennessee and Texas are on site working now. We are doing what we can from a responder level to offer up assistance. Fire Chief Burton said there are challenges with donated goods and goods are not their need now as they can obtain them on a local level. Monetary donations are needed as it goes the greatest distance and encouraged people to go to the FEMA website to view different organizations that they can make donations to. Fire Chief Burton showed a brief video on the benefits of making cash donations in lieu of goods. There was a brief discussion about getting information out to the residents on organizations that they can make donations to. Mayor Talabisco suggested using blast emails. 5. PUBLIC PARTICIPATION: Mayor Talabisco opened Public Participation and the following individuals spoke: Barbara Tarnove, 8632 NW 79th St., President of the Tamarac Historical Society, provided an update on three items they have been working on for the 50th Page 4 of 8 REGULAR COMMISSION MEETING MAY 22, 2013 Anniversary Celebration; Patti Lynn, 6411 NW 58t" St., commended Parks & Recreation Director Warner regarding the community buses now driving up to the Veteran's Center and said Broward County needs to address the issue of having their buses stop on the south side of Commercial Boulevard thereby eliminating the need for veterans crossing six lanes of traffic and asked Commissioner Atkins -Grad to resign; Sharon Aaron Baron, 4709 Woodlands Blvd., asked that during the budget process Tamarac look into purchasing power washers to clean sidewalks in order to make Tamarac more attractive to potential newcomers; Stan Kravitz, 10466 E. Clairmont Circle, spoke about Moore, Oklahoma and the two Senators voting against funds for FEMA and Super Storm Sandy. 6. CONSENT AGENDA: Mayor Talabisco asked if there were any changes/additions to the Consent Agenda and Assistant City Manager Phillips responded there were no changes/additions to the Consent Agenda. Vice Mayor Dressler seconded by Commissioner Atkins -Grad moved approval of the Consent Agenda as presented. Motion passed unanimously (5-0). a. Approval of the May 8, 2013 Regular Commission Meeting Minutes - APPROVED b. TR12328 - Roof Tarps: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to exercise the Second Renewal Option for Bid Number 11-24B for Roof Tarps to Abel Unlimited, Inc. For Roof Tarps to provide for the purchase of annual requirements for Roof Tarps for the City of Tamarac and on behalf of the Southeast Florida Governmental Purchasing Cooperative for a period of one, ear, providing Y P 9 for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-44 c. TR 12332 - ILA with Town of Southwest Ranches for Information Technology Support Services: A Resolution of the City Commission of the City of Tamarac, Florida, approving an pp g Interlocal Agreement between the City of Tamarac and the Town of Southwest Ranches to replace and enhance the technology used by the Town of Southwest Ranches, and to provide remote monitoring and information technology support services; authorizing the appropriate City Officials to execute said agreements and take all steps necessary to effectuate the intent of the resolution; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-45 d. TR12343 - Donation of TVs from Way of Life Church: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate CityOfficials to accept a donation p of four (4) flat screen televisions valued at approximately $5,220 from Way of Life Church for use in the Tamarac Community Center; providing for conflicts; providing for severability; and providing- an effective date. City Attorney Goren further stated that 11(c) TR12340 and 11(d) TR12340 are companion items and will be presented at the same time but voted on separately. Commissioner Glasser seconded by Commissioner Bushnell moved approval of TR12338 and TR12339. a. TR12338 - Tamarac Commerce Center II — Plat: A Resolution of the City Commission of the City of Tamarac, Florida, issuing Development Order No. 341 and granting Plat approval for the "Tamarac Commerce Center II Plat", as requested by Leigh R. Kerr of Leigh Robinson Kerr and Associates, Inc., Designated Agent for the Property Owner, IIT Tamarac Commerce Center II, LLC., to allow for 110,000 square feet of industrial use; for the property located on a 7.7± acre parcel, on the west side of Nob Hill Road, just south of NW 67th Street; (Case No. 1-P-13); providing for execution of said plat; providing for conflicts; providing for severability; and providing for an effective date. b. Leigh Kerr and Malcolm Butters appeared on behalf of the applicant. Mr. Butters and Mr. Zickar responded to a few questions from the Commission. Mayor Talabisco opened the public hearing: Ryan Hinton, 9907 N. Grand Duke Circle, expressed his concerns about the noise, light and traffic that would be generated by this project. Messrs. Butters and Zickar addressed Mr. Hinton's concerns and Mayor Talabisco suggested that Mr. Hinton meet with Mr. Butters and Mr. Zickar to discuss his issues. With no one else wishing to speak, Mayor Talabisco closed the public hearing. Clairmont Circle.,- said he felt the ingress and egress to the site was correct and did not need to be chan'bd, With no one else wishing to speak, Mayor Talabisco closed the public hearing. TR12342 - Palm Cove — Plat: A Resolution of the City Commission of the City of Tamarac, Florida, issuing Revised Development Order No. 338.3 and granting Re -Plat approval for the "Palm Cove Plat", to allow for the development of sixty-one (61) single-family homes and one hundred and sixty-four (164) townhouse units as requested by Jane Storms of Pulice Land Surveyors, Inc., the Designated Agent for the property owner LDC Monterey Ventures, LLC., for the property located on Monterey Drive, just east of the Florida Turnpike, and is comprised of 33.38± acres; (Case No. 4-P-13); providing for conditions of approval; providing for execution of said plat; providing for conflicts; providing for severability; and providing for an effective date. Commissioner Bushnell seconded by Commissioner Glasser moved approval of TR 12342. City Attorney Goren read TR 12342 by title into the record. City Attorney Goren went over the Quasi -Judicial proceedings and Interim City Clerk Teufel swore in all affected parties. Vice Mayor Dressler said that the map for this plat has a North orientation arrow on it and requested that it appear on all maps in future presentations as it makes it easier to visualize the property properly. Planning & Zoning Manager Zickar appeared and gave staff's presentation, a copy of which is on file in the City Clerk's Office. Jane Storms/Pulice Land Surveyors, Inc. and Dick Coker, Esquire appeared on behalf of the applicant. Vice Mayor Dressler asked staff to include the difference between previous density and current density in future presentations. Mr. Coker explained the reason for the replat is to conform the plat to actual single family lot configuration because it is easier for people to understand. Mayor Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. Motion passed unanimously (5-0) RESOLUTION R-2013-51 12.
