HomeMy WebLinkAbout2013-09-11 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING WEDNESDAY, SEPTEMBER 11, 2013 CALL TO ORDER: Mayor Talabisco called the regular meeting of the City Commission to order at 7:02 p.m. on Wednesday, September 11, 2013 in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Beth Talabisco, Vice Mayor Harry Dressler, Commissioner Pamela Bushnell, and Commissioner Diane Glasser were in attendance. ABSENT: Commissioner Patricia Atkins -Grad Also in attendance were City Manager Michael Cernech, Assistant City Attorney David Tolces and City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Mayor Talabisco led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation to the Mayor and Commission of the Employer Support for Guard and Reserve "Above and Beyond Award" by Warren Lubow, Broward County Area Chair, Department of Defense Employers Support of the Guard and Reserve (ESGR). b. Presentation of a proclamation by Mayor Beth Talabisco proclaiming the month of September 2013 as "Childhood Obesity Awareness Month". (Requested by Mayor Beth Talabisco) c. Presentation of a proclamation by Mayor Beth Talabisco proclaiming the Month of September 2013 as "National Preparedness Month". (Requested by Assistant Chief Jeff Moral) 2. CITY COMMISSION REPORTS: a. Commissioner Bushnell: Commented that she attended the BSO 9/11 event this morning. Expressed amazement about how many people are involved in our communities. Commissioner Bushnell said the Commission has been working on the budget and trying to make sure everything goes forward in the most positive way it can. Commissioner Bushnell asked everyone to visit the new Tamarac Historical website. b. Commissioner Atkins Grad: Absent c. Commissioner Glasser: Wished everyone a Happy New Year and stated that she was glad to see people attending tonight's meeting. d. Vice Mayor Dressler:- Commented how wonderful Tamarac is and said not enough people know how wonderful the City, residents and employees are because they care about the City and each other. Mayor Talabisco: Echoed Vice Mayor Dressler's sentiment and said the Commission is in touch with staff and residents daily trying to make the best decisions they can. Mayor Talabisco quoted a Buddhist saying: "Think Good Thoughts, Say Good Things and Do Good Deeds' . Mayor Talabisco said that on August 27th Congressman Alcee Hastings visited Tamarac and toured the City with her, City Manager Cernech, Assistant City Manager Phillips and Val Galnovich of the Ferguson Group. They talked about projects we have been advocating for in Washington and said she felt it was a very productive visit. Mayor Talabisco said that a few weeks ago City Manager Cernech informed her that Tamarac ranked #2 out of 12 cities in the Broward Redevelopment Program for 2013 and we were in line to receive a $1.5 Million grant for Tamarac Village. Mayor Talabisco said she was in contact with Broward County Commissioners to make sure that they were in our court. However, on the day the award was to be on the County Commission Agenda she received notification that the item had been pulled because some cities were not happy with the ranking or monies received. Commissioner Kiar said he expects to see it back before the County Commission in the next few weeks. Mayor Talabisco said Tamarac received a score of 93.4 because of the great job that Assistant City Manager Phillips and Grants Administrator Michael Gresek did in writing the grant. There was a discussion regarding the Broward County Ethics Ordinance which bars elected officials from the selection process because of conflicts of interest. Assistant City Attorney Tolces said his office is working to find out why the item was pulled and will report back to the Commission with their findings. Vice Mayor Dressler said that it is his perception that the County Commissioners are not allowed to play politics with staff's selection process. Mayor Talabisco said the list came out and some cities got money and some did not. The same way she advocated for Tamarac other cities did also and they are now asking why they did not make the list. Mayor Talabisco said she did not mean to imply any impropriety. Commissioner Glasser said it is politics as usual and we don't know what is behind the item being pulled and it may not be as bad as we think and we just have to see how it plays out. Commissioner Bushnell said we should not judge anybody until we find out why it was pulled. 3. CITY ATTORNEY REPORT: Assistant City Attorney Tolces said Tamarac received a request from Oakland Park to use our buses for their Octoberfest celebration and the City Attorneys Office has been asked to assist in developing an agreement. As the Commission knows, his office represents the City of Oakland Park and they. will need a motion on record waving any kind of conflict for their firm to represent both Tamarac and Oakland Park. The Mayor will also sign a letter to that effect. Both Mayor Talabisco and Vice Mayor Dressler said they had no problem with it and Vice Mayor Dressler asked if there was any remuneration involved and Assistant City Attorney Tolces said no. Vice Mayor Dressler seconded by Commissioner Bushnell moved approval of a waiver of any potential conflict. Motion passed unanimously (4-0). Assistant City Attorney Tolces said the City Attorney's Office is requesting the City Commission hold a Shade Session tomorrow evening after the budget and assessment hearings with respect to the litigation styled: Patricia Patte Atkins -Grad v. Alvin E. Entin, Individually and as Chairman of the Committee to Recall Patricia Patte Atkins -Grad, etc, et. al., Seventeenth Judicial Circuit Court in and for Broward County Case No. 13-11186 (02) and Patricia Page 2 of 6 REGULAR COMMISSION MEETING SEPTEMBER 11, 2013 Patte Atkins -Grad v. Alvin E. Entin, Individually and as Chairman of the Committee to Recall Patricia Patte Atkins -Grad, The Committee to Recall Patricia Patte Atkins -Grad, et al, in the District Court of Appeal Fourth District, State of Florida, Case No. 4D13-2631. Commissioner Bushnell seconded by Vice Mayor Dressler moved approval of holding a Shade Session tomorrow evening to be able to discuss said litigation. Motion passed unanimously (4-0). Assistant City Attorney Tolces said the proper notices will be posted and gave a brief explanation of how the meeting and Shade Session would flow. 4. CITY MANAGER REPORT: Said he was pleased to announce that the City of Tamarac has been chosen to be inducted into the International Palladium Hall of Fame for our outstanding overall performance management system. The award is the "Worldwide Gold Standard" of Performance Management and Tamarac is only the 3rd City in the US to receive this recognition. We are being recognized for our integrated performance management system which includes, but is not limited to, strategic planning, biennial budget, scorecards and workforce and community surveys. City Manager Cernech said he will be accepting this award at the induction ceremony at the Harvard Club in Boston in October. City Manager Cernech spoke of the founders and history of the Palladium Hall of Fame and gave an extensive list of other cities and companies worldwide that have received this award. City Manager Cernech recognized Assistant City Manager Phillips, Management Analyst Bernadette Hughes and Management Intern Laura Karpaviciute who authored the application to get this award. City Manager Cernech said he is also pleased to announce Tamarac won the 3CMA Savvy Award for the marketing and communications efforts surrounding the "Rock of All Ages" Concert. The judges loved the bright graphics, well-defined goals and execution of the event. City Manager Cernech extended his congratulations to Public Information & Media Specialist Elise Boston and Parks & Recreation Director Greg warner for a fantastic event. City Manager Cernech read the following letter addressed to Chief Building Official Grande into the record from Len Ronick, President at Kings Point: "I would like to extend my thanks to you for all the assistance you provided us, and to commend you on your extraordinary knowledge on any questions we ask. You are certainly an asset to the City of Tamarac, as well as a tremendous help to Kings Point.' October is fire prevention month and as of September 5th fire drills will be taking place every Thursday at city buildings, county schools, charter schools and daycare centers for the next 6 weeks. The Fire Department will also be reviewing emergency plans for all daycare centers and schools in Tamarac. The Fire Department has requested that these facilities begin using a family re -unification process so there are ways established for parents to locate children in the event that a school is not able to reopen if an incident happens. Parks & Recreation has been awarded the Star Award from the Beverly Foundation for their outstanding contributions to Senior Transportation. On Tuesday, September 3rd Tamarac Swimming, Inc. will begin operating a Competitive Swim Program for Children 5 to 13 and a US Masters Swimming Program for adults 18 to 90 at the Caporella Aquatic Center. Free tryouts will be on Saturdays at 10:00 a.m., fees apply and for more information contact the Parks & Recreation Department at 954-597-3620 or email Tamaracswimming@gmail.com. Thursday, September 26 from 1:30 — 3:30 p.m. at event that will include games challenges, prizes Public Services Dept. has completed .the following projects: Woodlands Blvd. No. Bike Path Project (Woodlands Blvd. &Commercial Blvd) and the Tamarac Sports Complex Press Box (9901 NW 77t" St). 5. PUBLIC PARTICIPATION: Mayor Talabisco opened Public Participation and the following individuals spoke: Ronald B. Barish, 7555 NW 99th Ave., spoke about his Spring Lake 2 HOA removing broken gates in his community and replacing them with ropes and read a list of demands into the record (a copy of which is on file in the City Clerk's Office); Patti Lynn, 6411 NW 58th St., spoke about the 9-11 Memorial, the Corridor Study and the park on the 7500 block of NW 61 St St., congratulated Chief BuildingOfficial Grande on being President of the g Broward County Building Association this year, asked people to keep Deputy Rivera in their prayers and thanked Commissioner Bushnell for the work on the 9-11 memorial; Ellis Donsky 7715 Southampton Terr., asked about speaking at tomorrow's meeting, the purchase of the property on 94th Ave., overgrown trees and the hazard they could pose during a storm and asked staff to look into this; Carol Goldrich, 7545 NW 99th 9 Ave., spoke about the gate situation in Spring Lake 2. 6. CONSENT AGENDA: Mayor Talabisco asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said there were no changes/additions. Commissioner Glasser seconded by Commissioner Bushnell moved approval of the consent agenda as presented. Motion passed unanimously (4-0). a. Approval of the August 28, 2013 Regular Commission Meeting Minutes - APPROVED b. TR12385 - Grant Application -US Soccer Foundation: A Resolution of the City Commission of the City of Tamarac, Florida, approving and authorizing the appropriate City Officials to submit an application to the U.S. Soccer Foundation for grant funds for the development of a soccer field at the Tamarac Sports Complex in the amount of $200,000, providing for a 1-to-1 match of $200,000 in local funds in the event of approval of the application; providing for acceptance of the award and execution of documents upon approval; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-89 c. TR12388 Florida Municipal Insurance Trust (FMIT) Renewal: A Resolution of the City Commission of the City of Tamarac Florida; authorizing the renewal of general liability, automobile liability, automobile physical damage, workers' compensation, and property lines of coverage with the Florida Municipal Insurance Trust (FMIT) for a one (1) year period beginning October 1, 2013 at a cost of $961 391 and payment of any increase resulting from the annual premium audit; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-90 d. TR12386 - TASTE OF TAMARAC 2013: A Resolution of the City Commission of the City of Tamarac, Florida, approving a request from the Tamarac Chamber of Commerce for in -kind support and to waive fees for the Taste of Tamarac event to be held at the Tamarac Page 4 of 6 REGULAR COMMISSION MEETING SEPTEMBER 11, 2013 Community Center on Saturday, October 26, 2013, from 11:30 a.m. to 3:30 p.m. providing for permits, proper insurance, and execution of a hold harmless agreement; providing for conflicts, providing for severability; and providing for an effective date. RESOLUTION R-2013-91 e. TR12389 - Major Corridor Study Supplement: A Resolution of the City Commission of the City of Tamarac, Florida, approving a supplemental change order to the Major Arterial Corridor Study Agreement between the City of Tamarac, Florida and Keith and Schnars, P.A. providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2013-92 f. TR12398 - Land Acquisition of 9399 W Commercial Blvd.: A Resolution of the City Commission of the City of Tamarac, Florida approving and authorizing the proper City Officials to execute that certain real estate purchase .and sale contract for the purchase of real property located at 9399 West Commercial Boulevard, Tamarac, Florida; attached hereto as Exhibit "A" and incorporated herein_ ; providing for the approval of the contract and authorizing the proper City Officials to consummate the transaction contemplated by the contract for purchase and sale providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-93 g. TR12401 - WNID Appointment: A Resolution of the City Commission of the City of Tamarac, Florida appointing Michael DeLemma to serve on the Board of Directors of the Woodlands Community Neighborhood Improvement District; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-94 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) -FIRST READING: There were no Ordinance(s) First Reading items scheduled for this meeting. 9. PUBLIC HEARING(S): There were no Public Hearing(s) items scheduled for this meeting. 10. ORDINANCE(S) -SECOND READING: a. T02287 - Firefighters' Pension Plan Amendment: Motion to adopt an Ordinance of the City Commission of the City of Tamarac, Florida; on second reading amending Chapter 16, Pensions and Retirement, Article VI, Pension Plan, providing for the definition of total cash remuneration; providing for clarification of disability benefits; providing for a savings clause; providing for codification; providing for conflicts; for severability; and providing for an effective date. Assistant City Attorney Tolces read T02287 by title into the record. Commissioner Bushnell seconded by Commissioner Glasser moved approval of T02287 on second reading. Mayor Talabisco opened the public hearing and with � no one wishing to speak, closed the public hearing. Motion passed unanimously (4-0).
