HomeMy WebLinkAbout2013-11-13 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING WEDNESDAY, NOVEMBER 13, 2013 CALL TO ORDER: Mayor Beth Talabisco called the Regular Commission Meeting of the City Commission to order, at 7:01 p.m. on Wednesday, November 13, 2013 in City Commission Chambers, Tamarac City Hall, 7525 NW 88t" Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Beth Talabisco, Bushnell, Commissioner Michelle J. attendance. Vice Mayor Harry Dressler, Commissioner Pamela Gomez and Commissioner Diane Glasser were in Also in attendance were City Manager Michael Cernech, City Attorney Samuel Goren and City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Dressler led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: Mayor Talabisco moved out of order and took up items 1 b and c as Sheriff Scott Israel was not yet present. b. Presentation of a proclamation by Mayor- Beth Talabisco proclaiming the month of November 2013 as "Prematurity Awareness Month". (Requested by Mayor Beth Talabisco) c. Presentation of a proclamation December 2 - 61 2013 as "Older Recreation Director Greg Warner) by Mayor Beth Talabisco proclaiming the week of Driver Awareness Month". (Requested by Parks & Mayor Talabisco moved back into the regular order of business. 2. CITY COMMISSION REPORTS: a. Commissioner Bushnell: Commissioner Bushnell said she had no report but did want to apologize to her colleagues for her behavior at the workshop on Tuesday regarding the election of a Vice Mayor. Commissioner Bushnell said they have worked very well together in the past and will continue to do so in the best interests of the residents of Tamarac. Commissioner Bushnell wished everyone a Happy Thanksgiving and Hanukkah. b. Commissioner Gomez: Commissioner Gomez thanked the Parks & Recreation Department, Public Services, BSO and Tamarac Fire Rescue for the efforts at all of the events that have taken place over the last few weeks. Commissioner Gomez met with several HOA representatives; attended St. Malachy's Carnival; the Broward Housing and Community Development Task Force forum on November 2nd and thanked Housing and Neighborhood Programs Manager Bauldree and her daughters for volunteering for the event; Relay for Life Kick Off event; the employee Chili and Dessert Cook Off Event in an effort to raise money for United Way and the Veterans' Day Ceremony and thanked the veterans for the service to their country. Commissioner Gomez wished everyone a Happy Thanksgiving and Hanukkah. Page 1 of 6 REGULAR COMMISSION MEETING November 13, 2013 Commissioner Gomez spoke about legislation regarding Vacation Rental being leased nightly, weekly and monthly in our communities. Section 509.032 (7)(b) F.S. eliminates the City's rights to regulate vacation rentals. In the course of finding out about these rentals, she found that Senator Thrasher has filed a bill to remove any language that would eliminate a City's home rule. Commissioner Gomez asked City Attorney Goren and City Manager Cernech to see what Tamarac can do to get this added to our 2014 legislative agenda supporting Senator Thrasher's bill. Mayor Talabisco suggested working with Assistant City Manager Phillips on our legislative agenda and the Broward League of Cities and ask them to support Senator Thrasher's bill as well. c. Commissioner Glasser: Commissioner Glasser attended the Alzheimer's Autumn Fest Luncheon on Friday, November 1st which raised money for the Alzheimer's Family Center and the Veteran's Day Ceremony on Monday, November 11 th. Commissioner Glasser said that when the City was running out of money when they were constructing the memorial at Veteran's Park she donated $2,000 in her husband's name to honor him as he was a veteran. d. Vice Mayor Dressler: Vice Mayor Dressler attended the Broward League Board of Directors Meeting with City Attorney Goren and said this is a significant and relevant group of individuals that with deal meaningful issues. Two issues were raised at this meeting: 1) anonymous complaints filed with the Inspector General website were found to be inappropriate; and 2) The IG should not have any involvement with CRA's. Vice Mayor Dressler said the Veteran's Day Ceremony was an amazing experience with a great guest speaker. This event is more important as we have vounaer people attendina. Vice Mavor Dressler said he and City Manager Cernech spoke with a gentleman from Canada who had a poppy that he wished to place on the wreath as in Canada it is a custom and a way to honor veterans. Vice Mayor Dressler asked if this is something that we can look into for next year in order to have the attendees be more involved in the ceremony. Vice Mayor Dressler wished everyone a Happy Thanksgiving and Hanukkah. e. Mayor Talabisco: Mayor Talabisco said she just returned from Boise and commented on the large homeless population in Boise and how it was upsetting to see homeless people in such cold temperatures. Mayor Talabisco said she is grateful for what we have when she sees what else is going on in the world. Mayor Talabisco thanked Vice Mayor Dressler for serving as Mayor in her absence. Mayor Talabisco also spoke about amending our procedures ordinance to clarify the rotation of Vice Mayor and the addition of a Vice Mayor Designate to make the selection process easier in the future. 3. CITY ATTORNEY REPORT: City Attorney Goren reported that he and Vice Mayor Dressler attended the Broward League Board of Directors Meeting on November 8th and went over the highlights contained in the Inspector General's Review of Broward Public Integrity Structure PowerPoint presentation, a copy of which is on file in the CCO. City Attorney Goren discussed the current structure and the inherent problems, potential reforms, single source of advisory opinions, a comparison of oversight by an ethics commission or ethics officer, current oversight, proposed new structure and additional ethics issues. City Attorney Goren responded to questions and concerns from the Commission and said he will keep the Commission posted on any actions that might be taken. City Attorney Goren reminded the Commission that there will be an ethics training session at Tamarac City Hall on Tuesday, November 26th from 9 a.m. to 1:00 p.m. Page 2 of 6 REGULAR COMMISSION MEETING November 13, 2013 Mayor Talabisco moved out of order to take up Item 1 a. Introduction to Commission by Sheriff Scott Israel as he arrived at 7:55 p.m. Sheriff Israel thanked the Commission for allowing him to appear before them and provide an update on what has been going on in the first ten months that he has been in office. Sheriff Israel said BSO recognizes that their job is two -fold; reduce crime and enhance the lives of people who live in Tamarac and BSO will continue to do everything in their power to keep Tamarac happy as they want to continue to provide services to Tamarac. Sheriff Israel spoke about the very successful Civil Diversion Program for children 17 and under which provides an opportunity for first time offenders to not go to jail. Sheriff Israel said that studies show that 6% of habitual offenders commit 70% of crime and they have been targeting these individuals. So far they have had 800 arrests and confiscated over 50 guns and rifles and violent crime has been reduced by 12.3%. Sheriff Israel spoke about the situation with Southwest Ranches looking to hire the Davie Police Department to provide police services to the town instead of BSO. Sheriff Israel and BSO Chief Neal Glassman responded to a few questions from the Commission. Sheriff Israel ended by thanking the Mayor and Commission for allowing BSO to continue to provide services to Tamarac. Mayor Talabisco moved back into the regular order of business. 4. CITY MANAGER REPORT: City Manager Cernech read a letter into the record from the Department of Defense regarding Tamarac's request for a piece of limestone from the Pentagon indicating that we have been approved to be a recipient and advised the Assistant Parks &Recreation Director Linda Probert will be flying to Washington D.C. to make arrangements to ship it home to Tamarac. City Manager Cernech reported that Tamarac has received the Gold Marcom Award for the Tam -A -Gram which is an international creative competition that recognizes outstanding achievement by marketing and communications professionals. The Gold Award is presented to entries judged to exceed the high standards of the industry norm. City Manager Cernech announced that the deadline for entries for "The City for Your Life" video contest is November 22"d and complete details can be obtained at www.tamarac.ora. Community Development has been advised by Broward County that they will begin installation of 17 bus shelters awarded to Tamarac under the Stimulus Grant Program later this month and should be completed in the Spring of 2014. Also, the Broward County Commission has approved $1.5 million in grant funding for the infrastructure for Tamarac Village. Finance Department reports that they have received notice that Tamarac has been awarded the Certificate of Achievement for Excellence in Financial Reporting by the GFOA for the CAFR for the year ending September 30, 2012. This is the 25"' consecutive year the City has received the award and the 28th overall. Fire reports that October was Fire Prevention Month and they had several schools tour the fire station and staff members also visited schools throughout Tamarac as well. On November 21St Tamarac Fire Rescue will be holding a badge pinning ceremony for the new Fire Fighter Recruits. Page 3 of 6 REGULAR COMMISSION MEETING November 13, 2013 Information Technology reports that in the next few months they will be updating our Land Database utilizing the Broward County Property Appraiser's records made possible by a recent modification by Sungard Public Sector. The Land Database is used by many components of our software and will allow us to make this update periodically or as needed. The IT department has been working with numerous departments on the implementation of Electronic Plan Review/On-Line Permitting system and we will be testing the system in the coming weeks with each department. Starting on December 16th they will begin to process select projects/applications with general availability of the system planned for the first quarter of 2014. Parks and Recreation is happy to report that the Red Route Extension had an average of 8.8 passengers per hour which far exceeds the County's requirements of 7.1 per hour. Upcoming Events: The Turkey Trot will be held on Thanksgiving morning, November 28th at City Hall beginning at 7:30 a.m. sharp and anyone interested can apply on line at www.active.com or www.splitsecondtiming.com or can register in person at the Community Center and the Light Up Tamarac Holiday Lighting Ceremony will take place on Wednesday, December 4th at 6:00 p.m. Past Events: The Halloween Hoopla Event held on October 25th had an estimated 2,000 people in attendance and the Veterans Day Ceremony held on November 11th had approximately 250 attendees. Sports: The Youth Soccer League started practices in November with 552 participants with games starting in December. 5. PUBLIC PARTICIPATION: Mayor Talabisco opened Public Participation and the following individuals spoke: Katie Megel, 5405 White Oak Lane, spoke about problems existing in the Volley Ball program; Sharon and Brooke Baron, 4709 Woodlands Blvd., spoke about problems with the Volley Ball program and the inequities of fees for participants, said the Food Truck Event on Wednesdays is excellent and asked the Commission to give some thought to establishing a Neighborhood Beautification Program; Patti Lynn, 6411 NW 58th St., wished everyone a Happy Thanksgiving and Hanukkah, complimented Chief Building Official Grande on his presentation in front of the Broward Coalition, spoke about the selection process for the Vice Mayor, was in favor of the security fence being installed at BSO, asked the Commission to support a ban on e-cigarettes, advised that there were Solar Panel Program subsidies that can be applied for, Public Services Director Strain has advised that the trees will be trimmed and overgrown vegetation will be cleaned up at the park on NW 61St St., talked about getting information out about helping the people who are victims of Typhoon Hiyan, spoke about upcoming legislation regarding vacation rentals and lamented about the lack of involvement of residents in City government. 6. CONSENT AGENDA: Mayor Talabisco asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said as discussed at the Workshop on Tuesday, November 12, 2013 Consent Agenda Item No. 6 (c) TR12411 has been amended to reflect the election of Michelle J. Gomez to serve as Vice Mayor effective November 19, 2013 and ending November 2014. Vice Mayor Dressler. seconded by Commissioner Glasser moved approval of the Consent Agenda as amended. TR12411 - Election of a Vice Mayor: A Resolution of the City Commission of the City of Tamarac, Florida, electing a Vice Mayor to serve a term of one year beginning November 19, 2013 and ending November 2014, with no succession; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-116 d. TR12416 - Authorize Award of Bid 13-22B for the BSO Security Fence Installation Project A Resolution by the City Commission of the City of Tamarac, Florida, awarding Bid No. 13- 22E to and approving an agreement with ATCI Communications, Inc. to provide and install a perimeter protection system at the Broward Sheriff's Office located at 7515 NW 88th Avenue, Tamarac, Florida, in accordance with Bid No. 13-22B for a contract amount of $63,048.36; a contingency in the amount of $6,305 will be added to the project account, for a total project budget of $69,353-36; authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-117 e. TR12417 - Authorize Renewal of ILA with North Lauderdale for Fleet Maintenance Services: A Resolution of the City Commission of the City of Tamarac, Florida, approving an Interlocal Agreement between the City of Tamarac and the City of North Lauderdale providing for fleet maintenance and repair services; authorizing the appropriate City Officials to execute said agreement and take all steps necessary to effectuate the intent of the Resolution; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-118 f. TR12419 - Oasis Pub of Tamarac: A Resolution of the City Commission of the City of Tamarac, Florida, granting approval of the Special Extended Hours Permit Renewal, requested by Gary Bruce Walker, owner of the Oasis Pub of Tamarac, Inc. (d/b/a: Oasis Pub), to extend the hours of the on -premise sale and consumption of alcoholic beverages and to open for business at 7:00 a.m. on weekdays, and Sunday's, pursuant to the City of Tamarac Ordinance No. 0-85-38, for the Oasis Pub of Tamarac, Inc. (d/b/a: Oasis Pub) located in the Three Lakes Plaza at 3224 West Commercial Boulevard (Case No. 18-MI-13); providing for conditions of approval; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2013-119 g. TR12424 - Equipment for Golf Course: A Resolution of the City Commission of the City of Tamarac, Florida, approving the appropriate City Officials to select, approve and award New and Used Equipment, Operating Supplies, and Small Tool Purchases through direct purchase, capital lease or operating lease as appropriate on an expedited basis for use at the Colony West Country Club utilizing price agreements provided by Billy Casper Golf, LLC on behalf of the City, providing for conflicts, providing for severability; providing for an effective date. TR12425 - Health Insurance Stop Loss: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City officials to execute an agreement with CIGNA, providing for Stop Loss Insurance; providing for a transfer of $650,000 from the Risk Fund; providing for conflicts; providing for severability; and providing for an effective date. T02291 - 2nd Budget Amendment: An Ordinance of the City Commission of the City of Tamarac, Florida, amending Ordinance 2013-04, which amended the City of Tamarac Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2013, by increasing the Total Revenues and Expenditures by a Total of $1,209,405 as detailed in Exhibit A attached hereto; providing for conflicts; providing for severability; providing for an effective date. City Attorney Goren read T02291 by title into the record. Vice Mayor Dressler seconded by Commissioner Glasser moved approval of T02291. on second reading. Mayor Talabisco opened the public hearing and with no one wishing to speak closed the public hearing.
