HomeMy WebLinkAbout2013-04-22 - City Commission Workshop Meeting MinutesCITY OF TAMARAC CITY COMMISSION WORKSHOP MONDAY, APRIL 22, 2013 CALL TO ORDER: Mayor Talabisco called the Workshop of the City Commission to order at 9:33 a.m. on Monday April 22, 2013 in Conference Room 105, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Beth Talabisco, Vice Mayor Harry Dressler, Commissioner Pamela Bushnell, Commissioner Patricia Atkins -Grad and Commissioner Diane Glasser were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney Julie Klahr and Interim City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Commissioner Glasser led the Pledge of Allegiance. 1. TR12327 - Awarding Bid No. 13-08B for the Construction of Phase III of the Citywide Culvert Headwall Installation Project Item No. 6 (d) on the Consent Agenda. (TR12327) A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 13-08B to and approving an Agreement with Ray Qualmann Marine Construction, Inc. for the construction of Phase III of the Citywide Culvert Headwall Installation Project, in accordance with Bid No. 13-08B for a contract amount of $425,554.00; a contingency in an amount of $63,833.00 will be added to the project account, for a total project budget of $489,387.00; authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. Assistant Public Works Director John Doherty and Purchasing/Contracts Manager Keith Glatz appeared. Assistant Public Works Director John Doherty responded to a few questions from Vice Mayor Dressler and Commissioner Bushnell. 2. TR12325 - Adopt Revised Oct 2012 Broward County LMS: Item No. 6 (c) on the Consent Agenda. (TR12325) A Resolution of the City Commission of the City of Tamarac, Florida supporting and adopting the Broward County October 2012 Multi -Jurisdictional Local Mitigation Strategy; providing for conflicts; providing severability; and providing for an effective date. Chief Building Official/Director Claudio Grande said FEMA requires local governments to have a FEMA approved Local Mitigation Strategy Plan in order to apply for and/or receive project grants and support and adoption of the multi -jurisdictional LMS Plan is required to remain eligible for grant funding. 3. T02278 - Telecommunication Ordinance - Amending Article IX, Chapter 24 "Telecommunications Towers and Antennas" Item No. 8 (c) on Ordinance(s) First Reading. (T02278) Motion to adopt an Ordinance of the City Commission of the City of Tamarac, Florida; on first reading amending Article IX, Chapter 24 entitled "Telecommunications Towers and Antennas" of the Code of Ordinances of the City of Tamarac, Florida, as amended, and to regulate personal wireless service facilities in the public rights -of -way; containing a repealer provision, a severability clause, and providing for an effective date. Community Development Director Bramley gave an update on the Ordinance and staff responded to questions and concerns of the Commission. After much discussion, the Commission decided they needed staff to provide more information in order for them to make Page 1 of 3 COMMISSION WORKSHOP MEETING April 22, 2013 an informed decision. Mayor Talabisco said she would like to workshop this ordinance again before they vote on it as she felt it was in the public's best interest. Vice Mayor Dressler agreed with Mayor Talabisco. Assistant City Attorney Klahr said since this matter will be tabled at the Commission Meeting on Wednesday they will need to extend the Zoning in Progress because it was anticipated this ordinance would go for second reading within the time frame of the Zoning in Progress currently in place. Mayor Talabisco asked that this be placed on the Workshop Agenda for May 6, 2013. Mayor Talabisco called for a recess at 10:46 a.m. and reconvened the Commission Workshop at 10:59 a.m. with all present as before. 4. TO2280 - Municipal Service Taxing Unit (MSTU): Item No. 8 (d) on Ordinance(s) First Reading. (TO2280) Motion to adopt an Ordinance of the City of Tamarac, Florida, on first reading consenting to be included in a Municipal Service Taxing Unit (MSTU) for a Consolidated Regional E-911 communications system created by Broward County Ordinance No. 2013— for the period of one year with the option for continued participation pursuant to the adoption of a future ordinance; providing for conflicts; providing for severability; and providing an effective date. City Manager Michael Cernech said Broward County is going forward with a county -wide MSTU and ILA tomorrow. There has been a lot of discussion and input put into the County's MSTU and, more importantly, the ILA between the cities and the County. There are some difficult issues because there are a number of cities who have PSAP's and those cities fund their own PSAP's. Some cities are taking action against the county in pre -litigation action, Chapter 164, and the County has been able to settle those Chapter 164 actions. This is important because we have 29 cities in the county willing to participate in this 911 program in some way shape or form and everyone's circumstances are different. There are 14 cities with BSO under contract with different contract terms. At one point we were very close to a county -wide 911 system and by a vote of 5 to 4 we are now back where we started. Mr. Cernech said there will be a meeting this afternoon with City Managers to recap where we are going into this week. City Manager Cernech said the funding is what is driving this and it is what is making people decide if they will join in a consolidated 911 or not. At one point we had 29 of 31 cities agree to a regional 911 and now we have people with PSAP's looking to provide that service to other cities in competition with the County and BSO. City Manager Cernech said since the City is contracted with BSO we either pay the county to pay the Sheriff or we pay the Sheriff directly. Tamarac's choice is not about whether we pay or not, but it is about how are we going to pay and how much is it going to cost. Depending on how you choose to pay impacts how much it costs. City Manager Cernech discussed the move by the Sheriff's Office to standardize their contracts with cities to deal with this issue going forward as they will need a mechanism to establish the cost and how much cities pay for the 911 services. City Manager Cernech said under the model that the County has put forward with the MSTU for this year, which is capped at .17 mills, will provide about $350,000 to $400,000 of additional ad valorem revenue that would go to the County and cover our share of Tamarac's 911 service. If we forego the MSTU and the ILA and pay the Sheriff directly, the Sheriff has calculated, based on the number of calls per city, our bill will be just under $1 million. If we contract with the Sheriff directly, we will pay somewhere between $950,000 and $1 million for the 911 service and if we go through the county we will pay between $350,000 and $400,000. Page 2 of 3 COMMISSION WORKSHOP MEETING April 22, 2013 We will have to make a decision about spending $375,000 or $975,000 for the same service, and it is pretty obvious what we would do financially. Cities are pursuing the least expensive option for the same service because it would be hard to justify paying $1 million for the service by writing a check if we could pay $375,000 for the same service by collecting it through the ad valorem. There was a general discussion on the benefits of the 60% - 40% split and how it works in paying the Sheriff. City Manager Cernech responded to questions from the Commission. Vice Mayor Dressler said the MSTU concept is completely irrational and that at this time he will not vote for something that is ethically incorrect. City Manager Cernech said the Mainlands Park item has been on and off the agenda and will be before the Commission at the May 8, 2013 meeting. City Manager Cernech asked Parks & Recreation Director Warner to provide the Commission with an update on the Youth Football League. Parks & Recreation Director Warner said together with a member from Human Resources and members from the American Youth Football League (AYFL) they went through an interview process to choose a new board to run the Tamarac Youth Football League (TYFL). They had two groups come forward and they selected a board made up of some members of the general old board. Some issues arose with the AYFL board because the new board had to appoint a person to sit on the AYFL board and the sponsor that was placed with TYFL was not happy with what he was receiving. There was an emergency meeting with AYFL last week to determine whether they would expel the TYFL or not. One of the issues they had was at the last AYFL meeting the Tamarac rep had some words with some of the other coaches and they also heard rumors that Big Mike was still working behind the scenes to influence decisions made by the TYFL. City Manager Cernech clarified that the AYFL made the determination that Big Mike could still coach but not be in a leadership role on the TYFL and not the City. Parks & Recreation Director Warner said that at the meeting last week they decided to keep Tamarac in the league with some underlying conditions. One of the conditions was to remove Big Mike totally from any responsibility with TYFL. Big Mike is no longer being allowed to coach and the current VP of the TYFL stepped down as he is the one who had the issues with the AYFL. TYFL had their emergency meeting on Thursday night and they have worked out all the issues. They have also been able to get all the equipment back from Big Mike and it is in storage in our facility. TYFL is moving forward positively with removal of those two individuals. They do have a new sponsor and Parks & Recreation staff will be working with them more closely. Mayor Talabisco expressed the hope that people will not hold the City responsible. Parks & Recreation Director Warner said one other issue that came up was that TYFL was looking to join another football league to get out of AYFL to avoid all these restrictions. That league is the Florida Youth Football League aka the Flo Rida Youth Football League which is funded by the rap singer Flo Rida. Parks & Recreation Director Warner said he made the decision that he was not going to allow TYFL leave AYFL because the Flo Rida league is made up of a lot of teams that were thrown out of their own leagues. Mayor Talabisco said she stands behind Parks & Recreation Director Warner's decision.
