HomeMy WebLinkAbout2013-06-10 - City Commission Workshop Meeting MinutesCITY OF TAMARAC CITY COMMISSION WORKSHOP MONDAY, JUNE 10, 2013 CALL TO ORDER: Vice Mayor Dressler called the Workshop of the City Commission to order at 9:33 a.m. on Monday, June 10, 2013 in Conference Room 105, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. ROLL CALL: Vice Mayor Harry Dressler, Commissioner Patricia Atkins -Grad, Commissioner Diane Glasser, were in attendance. Mayor Beth Talabisco and Commissioner Pamela Bushnell participated via telephone conferencing. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney Julie Klahr and Interim City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Dressler led the Pledge of Allegiance. Vice Mayor Dressler announced that he was moving out of the order of the agenda and items would be heard in the following order: 1st - TO2278 — Telecommunications Towers and Antennas Ordinance; 2nd — TO2285 — Red Light Camera Ordinance Amendment; 3rd — Neighborhood Meeting Report and 4th TR12331 — Park Place at Woodmont/Flex Units. 1. TO2278 - Telecommunications Towers and Antennas Ordinance: Item No. 8(c) on Ordinances - First Reading: Motion to adopt an Ordinance of the City Commission of the City of Tamarac, Florida; on first reading amending Article IX, Chapter 24 entitled "Telecommunications Towers and Antennas" of the Code of Ordinances of the City of Tamarac, Florida, as amended, and to regulate personal wireless service facilities in the public rights -of -way; containing a repealer provision, a severability clause, and providing for an effective date. — Assistant City Attorney David Tolces and Community Development Director Jennifer Bramley appeared. Community Development Director Bramley gave a presentation (on file in the City Clerk's Office). All were in agreement that the stealth tower was the best and most aesthetic way to go. Community Development Director Bramley and Assistant City Manager Phillips addressed questions and concerns regarding the ordinance being applicable to all providers not just Crown Castle, graffiti, screening and landscaping of the ground boxes. Mayor Talabisco said this has come a long way from when we first started this conversation and commended staff for getting it to the present acceptable version. 2. TO2285 - Red Light Camera Ordinance Amendment: Item No. 8(b) on Ordinances - First Reading: An Ordinance of the City Commission of the City of Tamarac, Florida; amending Part II of the Code of Ordinances of the City of Tamarac; amending Chapter 2, Article III, Division 2 of the Code of Ordinances to update the definition of "Magistrate" and to authorize the special magistrate to enforce all matters authorized by law; amending and restating Part II, Chapter 14.5, entitled "Tamarac Dangerous Intersection Safety Act" to conform to state law, and to add a new section 14.5-5, to be entitled "Notice of Violation Hearings", to implement 2013 changes in State Law that provide for the City to conduct hearings on notices of violation; providing for severability; providing for codification; providing an effective date. Financial Services Director Mark Mason and Assistant City Attorney Shana H. Bridgeman appeared. Financial Services Director Mason gave a presentation (on file in the City Clerk's Office) and said this essentially brings our ordinance into compliance with state Page 1 of 2 COMMISSION WORKSHOP MEETING June 10, 2013 law which was recently passed by the legislature and, once signed by Gov. Scott, will take effect on July 1st. Assistant City Attorney Bridgeman explained the notice of violation process in great detail according to our current code as well as the new amended ordinance. Financial Services Director Mason and Assistant City Attorney Bridgeman addressed the questions and concerns of the Commission. Vice Mayor Dressler requested staff provide the Commission with regular updates once the program is up and running and also to provide a list of the locations of the 20 cameras. Financial Services Director Mason said he will provide updates on the program and will also provide the Commission with a map of the location of the cameras. 3. Neighborhood Meetings Report. Community Development Director Jennifer Bramley and Housing and Neighborhood Programs Manager Angela Bauldree appeared and gave a report, (on file in the City Clerk's Office) discussed the overall attendance and satisfaction that was expressed by the attendees. Commissioner Bushnell said she enjoys attending not only her district meeting, but the other districts as well, as it is a good way to know what is going on city wide. Commissioner Atkins -Grad said the meetings are never repetitious as different topics are discussed from year to year. Mayor Talabisco and Commissioner Glasser said they too felt the meetings gave the Commission a chance to see what is going on in different districts. Mayor Talabisco said it is important to engage the newer segment of the population and that is something that needs to be addressed. Vice Mayor Dressler said staff did an excellent job in organizing the meetings and said it is important to bring the government to the people. Community Development Director Bramley commended Housing and Neighborhood Programs Manager Bauldree for the work she did in organizing the meetings. 4. TR12331 - Park Place @ Woodmont / Flex Units: Item No. 6 (d) on the Regular Agenda. A Resolution of the City Commission of the City of Tamarac, Florida, approving a Flex Unit petition to allow for the future construction of 20 townhouse units on land currently designated as commercial, in accordance with the City of Tamarac's Comprehensive Plan; for the property located at the southwest corner of Pine Island Road and NW 77 street (Parcel A, I.C. Plat, according to the Plat thereof as recorded in Plat Book 130, Page 35 of the public records of Broward County, Florida); (Case No. 1-FLX-13); providing for conflicts; providing for severability; and providing for an effective date. Community Development Director Jennifer Bramley appeared and said that we have not allocated any flex units for about 10 years. Community Development Director Bramley gave a detailed explanation of Flex Units and said this process allows a local government to rearrange residential densities without going through a Land Use Plan Amendment but instead it can rezone the property from commercial to a residential zoning district.
