REGULAR CITY COMMISSION MEETING
WEDNESDAY, NOVEMBER 12, 2014
CALL TO ORDER: Mayor Harry Dressler called the Regular Commission Meeting of the City
of Tamarac to order at 7:02 p.m. on Wednesday, November 12, 2014 in City Commission
Chambers, Tamarac City Hall, 7525 NW 88t" Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Pamela
Bushnell, Commissioner Diane Glasser and Commissioner Debra Placko were in attendance.
Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia Teufel.
PLEDGE OF ALLEGIANCE: Mayor Dressler led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of a proclamation by Mayor Harry Dressler proclaiming November 12, 2014
as "Deputy Brad Miller Day". (Requested by Chief Neal Glassman)
2. CITY COMMISSION REPORTS:
a. Commissioner Bushnell: Commissioner Bushnell said her grandson was on the Wheel of
Fortune on October 31 St and won a sizeable prize. Commissioner Bushnell said she attended
the last Ethics Task Force Meeting via telephone; the Chili Cook Off; the Homeowner
Association Town Hall meeting at the Community Center; the Veterans Day Ceremony and
said the Historical Society is reaching out to the Tamarac Community to compile a list of
Tamarac Veterans so that can create a wall at Veteran's Park; mentored students at
Millennium Middle School and the Broward League of Cities Youth Leadership Committee
meeting. Commissioner Bushnell offered her congratulations to Mayor Dressler, Vice Mayor
Gomez and Commissioner Placko on their recent election to office.
b. Vice Mayor Gomez: Vice Mayor Gomez said she will definitely miss Deputy Miller. Vice
Mayor Gomez said she attended the Halloween Hoopla; Broward County Housing Authority
meeting; the Veterans Day Ceremony and thanked all those who were involved in putting this
event together. Vice Mayor Gomez spoke of the partnership between the City and the new
Walmart Neighborhood Market and said there will be ribbon cutting for the grand opening on
January 21 St. Vice Mayor Gomez said she will be attending the ribbon cutting for the new
Planet Fitness on November 15t"
Vice Mayor Gomez spoke of the recent election and said over 10,000 people voted at the
Tamarac Library during early voting and said she met a lot of people, including first time
voters, while at the site. Vice Mayor Gomez indicated that it was a great experience and
added the poll workers are amazing and very much appreciated their efforts. Vice Mayor
Gomez said she was appointed two times as a Commissioner and it is a great honor being
elected and said it is very humbling and she looks forward to serving District 2 and the City of
Tamarac.

c. Commissioner Glasser: Commissioner Glasser congratulated Mayor Dressler, Vice Mayor
Gomez and Commissioner Placko on their recent election to office. Commissioner Glasser
spoke of attending the Alzheimer luncheon at the Woodlands Country Club and said the City
has been working with them for a long time and spoke of the various programs they have for
Alzheimer victims.
d. Commissioner Placko: Commissioner Placko congratulated Mayor Dressler and Vice
Mayor Gomez on their recent election to office. Commissioner Placko said she attended the
WPOA meeting and added that they are the first group to sign up for the Adopt -a -Street
program and encouraged other groups to do the same. Commissioner Placko talked about
the program that the Kiwanis Club has for inviting veterans to Thanksgiving dinner; said the
COPS program is growing and encouraged people to attend the Turkey Trot on Thanksgiving
morning at City Hall.
e. Mayor Dressler: Mayor Dressler talked about the recent election cycle and said he and
Vice Mayor Gomez are lucky to have won the election by a large margin. Mayor Dressler
thanked everyone for their support and added that it is a whole city team that wins awards
year after year. Mayor Dressler noted that he has never worked with a more committed group
of individuals in his long career and added that they care more about others than themselves.
3. CITY ATTORNEY REPORT: City Attorney Goren noted that Hallandale Commissioner
Lazarow is here regarding the ordinance on tonight's agenda dealing with the retail sale of
kittens and puppies and suggested that the Commission let her speak during Public
Participation. City Attorney Goren said there is an Ethics Task Force meeting scheduled for
November 24th the objective of which is to begin to analyze data and create a discussion with
the Commission to make changes both parties can live with. City Attorney Goren said there
is also a meeting at 10:00 a.m. on November 14th the Annual Presentation of the Inspector
General's Annual Report. City Attorney Goren said he is not sure if the Broward League of
Cities will be commenting on the report and indicated that there will also be another meeting
in December.
City Attorney Goren said Tamarac has a contractual relationship with ATS, the red light
camera company, and there was a recent decision which reversed a decision on red light
camera citation regarding whether or not it is legally authorized to have the local government
delegate to a non -police third party for first review of the actual red light camera violation.
City Attorney Goren said that on October 29th there was a class action lawsuit filed in the US
District Court of the Northern District of Florida and Tamarac is a named defendant in that
case. City Attorney read a list of the defendants in the lawsuit into the record. City Attorney
Goren said he needs the Commission's advice and as such is asking for a Shade Session
sometime in December, after the City has been served with the lawsuit, to seek guidance
from the Commission. City Attorney said he needs to ask in public for a Shade Meeting by
Motion so that we can schedule a time certain for sometime in early December, possibly to
coincide with the City Commission Workshop. Commissioner Bushnell seconded by Vice
Mayor Gomez moved approval to hold a Shade Session at a date to be set in early
December. Motion passed unanimously, (5-0).

City Attorney Goren said that

Hall
for
those
that
need
credits.
City Attorney Goren congratulated Mayor Dressler, Vice Mayor Gomez and Commissioner
Placko on their recent election to office.
4. CITY MANAGER REPORT: City Manager Cernech congratulated Mayor Dressler, Vice
Mayor Gomez and Commissioner Placko on their recent election to office and said Tamarac
now has a fully elected board. City Manager Cernech invited everyone to attend the swearing
in ceremony on Monday, November 17th at 2:30 p.m. with refreshments immediately
afterward. City Manager Cernech said the City has received notification that we have won,
for the second year in a row, the 2014 Gold MARCOM Award for the Tam -A -Gram magazine
and congratulated Public Information and Media Specialist Elise Boston for a job well done.
City Manager Cernech congratulated Deputy Brad Miller for an outstanding career in law
enforcement and thanked him for his service to the residents of Tamarac. City Manager
Cernech announced that Deputy Carl Fitzgerald will also be retiring shortly and this will be
the end of an era in Tamarac ad Brad and Carl have been the go to people for any job.
City Manager Cernech said the Community Development Department, Economic
Development Division is pleased to announce their partnership with the new Neighborhood
Wal-Mart in hosting a job fair series designed to attract and hire Tamarac residents. The job
fairs will be held on November 22"d and December 6th at the Community Center from 9:00
a.m. to 1:00 p.m. City Manager Cernech invited interested residents to stop in and get
information, or apply for the over 60 part time positions. City Manager Cernech said the new
Neighborhood Wal-Mart has a projected store opening date of January 21, 2015.
Upcoming Events: City Manager Cernech invited people to attend the 34th Annual Turkey
Trot 5K race at Tamarac City Hall at 7:30 a.m. on Thanksgiving morning November 27th and
said registration is $25 before November 16th, $30 November 17 — 26 and $50 on race day;
the Holiday Lighting Festival at 6;00 p.m. on December 3rd at the Community Center; the
Water Safety Expo, on November 23rd from 10:00 a.m. to 1:00 p.m. at the Caporella Aquatic
Center and added that this Water Safety Expo is in memory of 9 year old Tamarac Cougars
Football player Brandon Myrick who recently drowned.
City Manager Cernech noted the Tamarac Lakes South Buffer Wall project is in the design
phase and construction will begin during the summer of 2015 and added that two field shades
have been installed on the soccer and football fields at the Tamarac Sports Complex.
5. PUBLIC PARTICIPATION: Mayor Dressler opened public participation and the following
individuals spoke. Patti Lynn, 6411 NW 58th St., spoke about how much Brad Miller has done
for the City and said he will be missed; congratulated Mayor Dressler, Vice Mayor Gomez
and Commissioner Placko on being elected to office; said the Veteran's Day Ceremony was
very well done and asked the Commission to continue to press for a bus stop and crosswalk
at the VA Clinic. Don Anthony, of the Animal Rights Foundation, and Hallandale
Commissioner Lazarow spoke in favor of the ordinance banning the retail sale of dogs and
cats. With no one else wishing to speak, Mayor Dressler closed public participation.

6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any
changes/additions to the Consent Agenda and City Manager Cernech responded that there
were no changes/additions to the Consent Agenda. Commissioner Placko seconded by Vice
Mayor Gomez moved approval of the Consent Agenda. Motion passed unanimously (5-0).
a. Approval of the October 22, 2014 Regular Commission Meeting Minutes - APPROVED
b. TR12566 - Resolution Authorizing Temporary Employment Services for Certain City
Services: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing
the appropriate City Officials to approve expenditures for temporary labor services for canal
maintenance workers and pressure washer cleaning in the amount of $68,128.10 to
NiteLines USA, Inc. utilizing the State of Florida agreement #991-460-07-1 for Temporary
Employment Staffing Services for expenditures made during FY14 nunc pro tunc; providing
for severability; and providing an effective date.

c. TR12567 - Appointing a Chairperson and Vice Chairperson to the Veterans Affairs
Committee: A Resolution of the City Commission of the City of Tamarac, Florida, appointing
Dominic Gray as Chairperson and Herbert Daley as Vice -Chairperson to the Veterans Affairs
Committee to serve until September 10, 2015 or until new appointments are made; providing
for conflicts; providing for severability; and providing an effective date.

d. TR12568 - Resolution Authorizing Purchase of Tires for City Vehicles and Equipment: A
Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to approve expenditures for tires used by various City Departments
in the amount of $76,051.35 for FY14 nuns pro tunc, and for FY15 purchases of tires in an
amount not to exceed $80,000 to Tiresoles of Broward, Inc. utilizing the Florida Sheriff's
Association Agreement #14/15-06-0131 for tires; providing for severability; and providing an
effective date.

e. TR 12571 Award of Bid No 14-23B Installation of Emergency Generator at Public Services
Complex: A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid
No. 14-23B to and approving an Agreement with AGC Electric Inc. per Bid No. 14-23B for a
contract amount of $269,384.77 and a contingency in an amount of $26,938.48, will be added
to the project for a total project budget of $296,323.25; authorizing an expenditure in the
amount of $296,323.25 from the appropriate accounts; authorizing an appropriation of
$46,323.25; providing for conflicts; providing for severability; and providing for an effective
date.

with Cigna, providing for Stop Loss Insurance; and to make certain modifications to the
Health Insurance program for employees and retirees; providing for conflicts; providing for
severability; and providing for an effective date.

h. TR12576 - Wastewater Main Rehabilitation Inflow & Infiltration Project FY15 — SAK
Construction LLC: A Resolution of the City Commission of the City of Tamarac, Florida,
authorizing the appropriate City Officials to accept and execute an agreement between the
City of Tamarac and SAK Construction, LLC., utilizing Choice Facility Partners (CFP)
Contract #10/039MP for an amount not to exceed $1,540,000 for the FY15 Wastewater Main
Rehabilitation Inflow and Infiltration Project; authorizing the appropriate City Officials to
administer the contract; providing for conflicts; providing for severability; and providing for an
effective date.

i. TR12577 - Administrative Services Agreement - Fire Pension Plan: A Resolution of the City
Commission of the City of Tamarac, Florida authorizing the appropriate City officials to
execute an agreement with the City of Tamarac Firefighter's Pension Trust Fund to provide
administrative services to the Firefighter's Pension Trust Fund and to perform those duties
and responsibilities which are described in this agreement effective January 1, 2015;
authorizing an appropriation of $27,000 to convert a part-time position to full-time; providing
for conflicts; providing for severability; and providing for an effective date.

j. TR12580 - Dental Insurance Renewal: A Resolution of the City Commission of the City of
Tamarac, Florida, authorizing the appropriate City officials to execute the agreement for the
City's dental insurance program with MetLife for two (2) plan years effective January 1, 2015;
providing for the continuation of the existing cost allocation of the dental insurance premium
between the City and employees; providing for conflicts; providing for severability; an

9-141 2015 at various locations throughout Broward County; authorizing the city clerk to
transmit this resolution; providing for conflicts, providing for severability and providing for an
effective date.

8. ORDINANCE(S) -FIRST READING:
a. T02312 - Public Art Committee Ordinance Amendment: An Ordinance of the City
Commission of the City of Tamarac, Florida amending Chapter 5 of the City's Code of
Ordinances, entitled "Buildings and Building Regulations" by amending Article XI, entitled
"Public Art Program" by specifically' amending Section 5-305 entitled "Public Art Committee",
to revise the term of office for the Public Art Committee Members in accordance with Division
1, Section 2-59 of the City Code of Ordinances; providing for codification; providing for
conflicts; providing for severability; and providing for an effective date. City Attorney Goren
read T02312 by title into the record. Commissioner Bushnell seconded by Vice Mayor
Gomez moved approval of T02312 on first reading. Motion passed unanimously (5-0).

b. T02311 - Puppy and Kitten Sale Legislation: An Ordinance of the City Commission of the
City of Tamarac, Florida amending Chapter 4 of the City's Code of Ordinances, entitled
"Animals" by creating Article 111 entitled "Retail Sale of Dogs and Cats", to provide for
regulations on the retail sale of dogs and cats originating from a puppy or kitten mill in
conformity with the City of Tamarac Comprehensive Plan; providing for codification; providing
for conflicts; providing for severability; and providing for an effective date. City Attorney Goren
read T02311 by title into the record. Commissioner Placko seconded by Commissioner
Glasser moved approval of T02311 on first reading. Mayor Dressler said he received an
email from the Pet Industry Joint Advisory Council in opposition to this ordinance and entered
it into the record, a copy of which is on file in the City Clerk's Office. Vice Mayor Gomez said
there were some concerns raised about certain exemptions and asked staff to look into those
concerns before the second reading. City Attorney Goren said they have Mr. _Anthony's email
and they will review and make any necessary changes for the second reading at the
December 10th meeting. Motion passed unanimously (5-0).

a. TR12565 - FY2013/2014 CAPER: A Resolution of the City Commission of the City of
Tamarac, Florida authorizing the appropriate City officials to approve the Consolidated
Annual Performance Evaluation Report (CAPER FY2013-2014) for the US Department of
Housing & Urban Development (HUD's) Community Development Block Grant (CDBG)
programs for HUD's fiscal year 2013-2014; Case No:7-MI-14; providing for conflicts, providing
for severability; and providing for an effective date. City Attorney Goren read TR12565 by
title into the record. Vice Mayor Gomez seconded by Commissioner Glasser moved approval
of TR12565. Mayor Dressler opened the Public Hearing and with no one wishing to speak,

10. ORDINANCE(S) - SECOND READING: a. T02309 - Planning Board Term -Alternate
Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida amending
Chapter 24 of the City's Code of Ordinances, entitled "Zoning" by amending Article II, entitled
"Administration", Division 3 entitled "Planning Board" by specifically amending Section 24-61
entitled "Created Members", to revise the term of office for Planning Board Members and to
create the position of Alternate Member of the Planning Board in accordance with the City

b. T02310 - 2nd Budget.Amendment: An Ordinance of the City Commission of the City of
Tamarac, Florida, on amending ordinance 2014-05, which amended the City of Tamarac
Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial
Policies for the Fiscal Year 2014, by increasing the total revenues and expenditures by a total
of $3,317,945 as detailed in Exhibit A attached hereto; providing for conflicts; providing for
