HomeMy WebLinkAbout2015-02-11 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING WEDNESDAY, FEBRUARY 11, 2015 CALL TO ORDER: Mayor Harry Dressler called the Regular Commission Meeting of the City of Tamarac to order at 7:06 p.m. on Wednesday, February 11, 2015 in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Pamela Bushnell (via telephone), Commissioner Michelle J. Gomez, Commissioner Diane Glasser and Commissioner Debra Placko were in attendance. Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia Teufel. PLEDGE OF ALLEGIANCE: Commissioner Placko led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Harry Dressler proclaiming February 12, 2015 as "Wear Red Wellness Day". (Requested by Mayor Harry Dressler) 2. CITY COMMISSION REPORTS: a. Vice Mayor Bushnell: Vice Mayor Bushnell commented that it is fantastic to be an elected official in Tamarac as she has received calls and visits from residents and thanked everyone for being supportive during her recovery. Vice Mayor Bushnell said she is looking forward to meeting the upcoming Tamarac University Class and returning to City Hall. b. Commissioner Gomez: Commissioner Gomez thanked Mayor Dressler for the proclamation as she too had lost a loved one to a heart attack. Commissioner Gomez said she attended the following: numerous HOA meetings; Kiwanis 100th Anniversary Celebration; Town Forum hosted by Senator Ring at Kings Point; Chamber of Commerce Breakfast; Health & Wellness Expo; BSO Shred-A-Thon and the Grand Opening of the Walmart Neighborhood Market. Commissioner Gomez wished everyone a Happy Valentine's Day. c. Commissioner Glasser: Commissioner Glasser said she also attended the Grand Opening of the Walmart Neighborhood Market and talked about how good the Taravella H.S. Band was and the other activities they offered visitors. Commissioner Glasser said the Walmart will continue to give price reductions this week and encouraged people to stop by and take advantage. Commissioner Glasser said the Walmart Neighborhood Market is a welcome addition to Tamarac. d. Commissioner Placko: Commissioner Placko Wished Vice Mayor Bushnell a speedy recovery and return to City Hall. Commissioner Placko noted that she also attended the Walmart Neighborhood Market Grand Opening. Commissioner Placko said that COPS hosted a Security Meeting with 33 Woodmont communities, as well as other communities in District 4, and thanked Captain Glassman and Deputy Fitzgerald for attending and providing great information. Commissioner Placko said BSO has a secure site called "Home Watch" Page 1 of 5 REGULAR COMMISSION MEETING February 11, 2015 and encouraged everyone to get on the site and log in and enter all important information such as serial numbers and pictures of your valuables which will allow them to go to pawn shops to try and locate stolen valuables should your home be broken into. Commissioner Placko thanked Brookside Cove and Lake Colony for showing interest in joining the COPS Program and thanked everyone for stepping up and being proactive in their communities. e. Mayor Dressler: Mayor Dressler said he attended the Broward League of Cities meeting at the Bonnet House in Ft. Lauderdale and encouraged people to visit the exceptional Museum and Gardens. Mayor Dressler said at that meeting they discussed several issues before the legislation in Tallahassee which could be relevant to Tamarac in the future; Sober Homes, Vacation Homes and Pension Reform. Mayor Dressler asked City Attorney Goren to check into HB 21, Sober Homes, and get back to the Commission with the status of the bill. Mayor Dressler said he also attended the Walmart Neighborhood Market and encouraged people to stop by and visit the pharmacy which had great prices on medications. 3. CITY ATTORNEY REPORT: City Attorney Goren said the next meeting of the North West Council of Elected Officials will take place on March 16th hosted by the City of North Lauderdale, indicated that his firm will be giving a seminar on Ethics and invited anyone who needed two hours of credit for Ethics training to attend. City Attorney Goren thanked the Mayor and Commission for the advice and direction they provided during the Shade Session relative to the Red Light Camera lawsuit. City Attorney Goren advised that all entities in the lawsuit have been served and he will keep the Commission informed as this case moves forward. City Attorney Goren noted he will be asking the Commission for a Shade Session sometime in the future and will get back to the Commission with a status on HB 21. Mayor Dressler said he has been notified that an article he wrote entitled "Defacto Fiduciary" will be published in the National Plaintiff's Bar Magazine in the Spring or Summer and will be interesting reading for everyone. 4. CITY MANAGER REPORT: City Manager Cernech reported that the Piccadilly Cafeteria Demolition Project will include, but not be limited to, an approximately 13,100 sq. ft. structure and will begin in April 2015 and completed in August, 2015. This project is currently being bid through the City's Competitive Bidding Process. City Manager Cernech said there will be a citywide Pavement Rejuvenation Project of streets throughout Tamarac which will revitalize and protect the asphalt that has deteriorated due to age and exposure. This process is significantly cheaper than the removal and replacement of existing asphalt. The project is scheduled to start on February 171h with an anticipated completion in May, 2015. Upcoming Events: The Tamarac Sizzler Swim Meet with take place on February 13th at the Caporella Aquatic Center from 4:30 to 7:00 p.m. for teams consisting of 8 year old and younger children and a General Admission Fee of $2.00 will be charged for the public to watch the event. The Tamarac Teen Summit will take place at the Tamarac Community Center on February 21St from 9.00 a.m. to noon; the cost to participate is $10.00 and for more information call 954-597-3674. The first Concert in the Park will take place on Friday, March 13th from 7:00 p.m. to 9:00 p.m. at the Tamarac Sports Complex featuring the Bon Jovi Tribute Band "Keep the Faith". Past Events: Approximately 500 people attended the Preventative Health and Wellness Expo held on February 7th at the Tamarac Community Center. City Manager Cernech reported that Page 2 of 5 REGULAR COMMISSION MEETING February 11, 2015 the first annual Jingle Brawl Lacrosse Tournament was held on December 21, 2014 at the Sports Complex and had approximately 2,000 attendees participate. The organizers are looking to hold another event in December 2015 and they are currently working with staff to hold a second tournament in June, 2015. There was a brief video of the event played and City Manager Cernech said the video was taken by new drone technology and does a great job of showcasing the complex. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke: Gerald Keller talked about the lease of the property for the proposed Charter School; Lauren Kalwesh, Dominique Berenger and M'Kayla Degraf talked about Students Working Against Tobacco and requested a Resolution in support of their work; Jordan Barletta introduced himself as the Chairman of the Tamarac Chamber of Commerce and thanked the Commission for its continued support and Norman Zagorski was opposed to a Charter School being built at the Sports Complex. The following individuals were in opposition to the dissolution of the WNID: Randy Scott; Shawn Robbins, Joel Davidson and Ilene Michaelson. Mr. Robbins asked for second reading of the ordinance be moved to the next night meeting. The following individuals were in favor of the dissolution of the WNID: Judy Margolis and Leonard Hixon. All pertinent information on all speakers is on file in the City Clerk's Office. With no one else wishing to speak, Mayor Dressler closed Public Participation. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said there were no changes/additions to the Consent Agenda. Commissioner Gomez seconded by Commissioner Placko moved approval of the Consent Agenda as presented. Motion passed unanimously (5-0). a. Approval of the January 28, 2015 Regular Commission Meeting Minutes - APPROVED b. Approval of the February 2, 2015 Special Commission Meeting Minutes - APPROVED c. TR 12606 - Ferguson Group LLC Federal Lobbying Services Amendment #6: A Resolution of the City Commission of the City of Tamarac, Florida; approving Amendment #6 to the agreement between the City of Tamarac and The Ferguson Group, LLC, for Federal Lobbying Services, extending the term of the agreement for a one year period effective February 13, 2015 through February 12, 2016 at a cost not to exceed eighty-five thousand five hundred ($85,500.00) dollars per year; authorizing the appropriate city officials to execute the amendment to the agreement for lobbying services; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-14 d. TR12607 - Filter Media Replacement - Package Filters 1 and 2 Project - Bid No. 15-308. A —' Resolution of the City Commission of the City of Tamarac, Florida, authorizing that the City Commission awards Bid No. 15-03B to TLC Diversified, Inc., and authorizes the appropriate City Officials to execute the agreement between the City of Tamarac and TLC Diversified, Page 3 of 5 REGULAR COMMISSION MEETING February 11, 2015 Inc., for an amount of $311,495 for the Filter Media Replacement - Package Filters 1 and 2 Project located at the Tamarac Utilities Water Treatment Plant site; a contingency in the amount of $50,000 will be added to the project account for a total amount of $361,495, approving funding for this project from the appropriate Utilities Operational accounts, authorizing the appropriate City Officials to administer the contract; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-15 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) - FIRST READING: a. T02314 - Abolishment of Investment Advisory: An Ordinance of the City of Tamarac, Florida, amending Chapter 2 entitled "Administration" of the Code of Ordinances of the City of Tamarac by repealing Sections 2-156 through 2-161, inclusive, to provide for the abolishment of the Investment Advisory Committee; providing for codification; providing for conflicts; providing for severability; and proving for an effective date. City Attorney Goren read T02314 by title into the record. Commissioner Gomez seconded by Commissioner Glasser moved approval of T02314 on first reading. Motion passed unanimously (5-0). PASSED ON FIRST READING FEBRUARY 11, 2015 b. T02315 - Ordinance to Repeal the WNID: An Ordinance of the City of Tamarac, Florida repealing Ordinance No. 2010-14, adopted on July 14, 2010, in its entirety; dissolving the Woodlands Community Neighborhood Improvement District created pursuant to Ordinance No. 2010-14 and in accordance with Section 163.506, F.S.; providing for transmission of a certified copy of this Ordinance to the Florida Department of Economic Opportunity and the Department of Legal Affairs in accordance with Florida Statutes 163.5055; providing for conflicts; providing for severability; and providing for an effective date. Commissioner Placko seconded by Vice Mayor Bushnell moved approval of T02315 on first reading. City Attorney Goren read T02315 by title into the record. Mayor Dressler opened the item up for Commission discussion. Commissioner Gomez stated in great detail her reasons not to dissolve the WNID and added that she will be working with legislators in Tallahassee to have the statute amended so that the property owners would have the right to vote on any referendum instead of registered voters as is currently stated in the statute. Commissioner Gomez again stated her position was not to abolish the WNID and allow the current board to go out and educate the community on what they are trying to accomplish and then let the community decide if they want the district or not. Mayor Dressler talked about the intent of the Commission when it created the WNID and the history, discord and the inability of the WNID to accomplish anything over the last four years. Mayor Dressler said he is in favor of dissolving the WNID and at some future time have the community come back before the Commission and demonstrate that they in fact want the District. Commissioner Gomez reiterated her reasons for not dissolving the WNID and leave the current Board in place to run the district. Motion passed 4 -1 with Commissioner Gomez dissenting.
