HomeMy WebLinkAbout2015-10-14 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, OCTOBER 14, 2015 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7.02 p.m. on Wednesday, October 14, 2015, 2015 in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Pamela Bushnell, Commissioner Michelle J. Gomez, Commissioner Diane Glasser and Commissioner Debra Placko were in attendance. Also in attendance were: City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Commissioner Glasser led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of October 2015 as "Domestic Violence Awareness Month". (Requested by Mayor Harry Dressler) b. Presentation of a proclamation by Mayor Harry Dressler proclaiming the week of October 12th as Customer Service Week. (Requested by the Customer Service Focus Team) c. Presentation of a proclamation by Mayor Harry Dressler proclaiming October 2015 as "Breast Cancer Awareness Month". (Requested by Assistant City Manager Diane Phillips) 2. CITY COMMISSION REPORTS: a. Vice Mayor Bushnell: Vice Mayor Bushnell said she attended a Small Business Seminar hosted by Representative Hazelle Rogers at the Community Center and the ground breaking for Chelsea Place. Vice Mayor Bushnell noted that the Community Center celebrated its 15t Anniversary and also said the Arts & Craft Festival, which will take place next April, is moving along nicely. Vice Mayor Bushnell said she attended the ceremony where City Attorney Goren was honored with the "Commitment to Justice" award, the Community Garage Sale and noted that she is mentoring 4 students at Millennium Middle School. Vice Mayor Bushnell said she attended the Colony West Workshop and also attended the bowling event hosted by the Parks & Recreation Foundation. b. Commissioner Gomez: Commissioner Gomez attended the Chamber of Commerce Breakfast sponsored by City Furniture and encouraged people to join the American Cancer Society's Making Strides Event on Halloween. Commissioner Gomez attended the Ft. Lauderdale's Women's Club Murder Mystery fund raiser; Young Lawyer's Golf Tournament; Greenhaven Covered Dish event; Lime Bay Bingo; American Cancer Society's fund raising event; Smart Growth Partnership meeting; Nicholas Ribaldo's 100th Birthday party; and the recognition event for Commissioner Glasser, Lori Parish and Alcee Hastings. Commissioner Gomez noted that the Billy Casper Staff at Colony West is taking a wonderful partnership approach to what they are doing with the golf course. Commissioner Gomez said she also attended the Ft. Lauderdale International Trade and Cultural Expo and the Employee Page 1 of 6 COMMISSION MEETING OCTOBER 14, 2015 Appreciation Luncheon. Commissioner Gomez invited people to visit the traveling Vietnam Memorial Wall in Coral Springs October 22 — 26th and Coffee with the Commissioner on October 29th from 10:30 a.m. to noon at the Orange Tree. c. Commissioner Glasser: Commissioner Glasser congratulated City Attorney Goren on receiving the "Commitment to Justice" Award. Commissioner Glasser said she attended a luncheon for Impact Broward which is an organization made up mostly of volunteers. The volunteers receive training in order to assist or serve people without any expectation of getting paid. Commissioner Glasser said she was very impressed with the organization and volunteered her help for anything should they need it. d. Commissioner Placko: Commissioner Placko said she also attended many of the events already mentioned. Commissioner Placko congratulated City Attorney Goren on receiving the "Commitment to Justice" Award and Commissioner Glasser for her Achievement Award. Commissioner Placko attended the Senior Appreciation Luncheon at the Community Center and encouraged people to visit the Center and look into the many programs they offer. Commissioner Placko reported that there will be a COPS training session on October 27th at 6:00 p.m. at BSO District 7 building and welcomed two new communities Westwood 5 and Faircrest 14 into the COPS Program. e. Mayor Dressler: Mayor Dressler ceded his time to the City Attorney for his report 3. CITY ATTORNEY REPORT: City Attorney Goren said his firm will be hosting an Ethics Presentation on October 16th from 9:00 a.m. to 1:00 p.m. at the North Lauderdale Commission Chambers and invited anyone who needs ethics hours to attend. City Attorney Goren said that on October 17th there will be a visioning session of the Broward County Charter Commission, which formed in June 2015. This Commission, which will be in session until June 2018, will look at some global issues that might be of concern. City Attorney Goren said his office has begun tracking some legislation that pertains to local government that has been filed to date. Some of the bills they tracking are as follows: texting while driving in school zones; discharge of firearms, police body cameras; public records and public meetings; children and animals left in cars; converting statewide municipal elections with elections in March to November and all municipal elections to odd numbered years; wireless communications and cannabis. City Attorney Goren said his office will continue to monitor the legislation and will keep the Commission updated. City Attorney Goren noted there is no litigation to report and no need of a Shade Session. City Attorney Goren thanked everyone for honoring him by attending the event where he received the "Commitment to Justice" Award. Mayor Dressler talked about pending concealed weapon legislation and said he does not understand the necessity to openly carry weapons. Mayor Dressler says this comes from the NRA and he believes it will have a high probability of passing. Mayor Dressler talked about the issue that was raised in an article in the Sun Sentinel this past week regarding the issue of a Strong Mayor. City Attorney Goren said the Charter Review Commission is to actually looking to place an item on the ballot which would convert the current Semi -Strong Mayor to an actual elected Mayor, which will probably change out Page 2 of 6 COMMISSION MEETING OCTOBER 14, 2015 one or two existing commission districts. The last two Charter Commissions were moving in the direction of amplifying the authority of the Mayor. Mayor Dressler said the thing that disturbed him the most about the article is that a former State Attorney General Bob Butterworth was quoted in a way that he found disturbing. His quote essentially said if people would like to have a Strong Mayor in Broward County they should be aware of voter resistance to the concept of having a Strong County Mayor. In order to get around this he suggested a strategy where you have a Strong Mayor with limited executive powers initially and that would increase until they got all the power they could possibly want. Someone else was also quoted in the article about extinguishing local government because it is redundant. We know that there are people in Tallahassee who think that municipal government is not necessary which he also found disturbing. Mayor Dressler said he decided to submit a 100 word article to the Sun Sentinel Top 100 Feature, which will appear this Sunday that addresses this issue. Mayor Dressler commented that he is happy to see the County Commission, as well as this Commission, remain status quo. 4. CITY MANAGER REPORT: City Manager Cernech congratulated City Attorney Goren on receiving the "Commitment to Justice". Award as it is well deserved. City Manager Cernech commented that the Bowling event last evening was very well attended and recognized all the effort that went into this event making it successful. City Manager Cernech said he was proud that so many Tamarac employees also participated. City Manager Cernech said the workshop at Colony West was held in order for the professionals at Colony West to provide the Commission with an update on improvements made since last year and to let the Commission know about the plans they have for the coming year. City Manager Cernech noted that it was nice to see how many people received awards at the Employee Recognition Luncheon earlier today. City Manager Cernech said that every year the City holds a United Way and Mission United Campaign and Tamarac raises more money per employee than any other city in Broward County. Last year we raised $30,000 and we are looking to surpass that this year. City Manager Cernech thanked Public Services Director Strain and Community Development Director Calloway for co-chairing the drive this year. City Manager Cernech reported that the Parks & Recreation Department has rolled out Tamarac Gift Cards and they have already sold $2,750 worth of gift cards. Cards start at $25, have no fees and do not expire. The cards can be used to pay for any city -run recreational activity. If you use the card to pay for the Turkey Trot Registration you will receive $5.00 off the registration fee. City Manager Cernech reported that Tamarac is once again recognized by the Center for Digital Government as a Top Ten Digital City in the 75,000 and under population group. The award will be presented at the National League of Cities Awards Reception on November 5tn in Nashville, Tennessee. Upcoming Events: Halloween Hoopla will take place at Tamarac Park on Friday, October 23rd from 6:00 p.m. to 8:00 p.m. The Movie in the Park has been rescheduled for November 6th at the Tamarac Sports Complex, will be featuring the movie "PARANORMAN" with food trucks serving at 5:30 p.m., activities starting at 6:00 pm. and the movie starting at 7:30 p.m. Page 3 of 6 COMMISSION MEETING OCTOBER 14, 2015 The Veteran's Day Ceremony will be held on Wednesday, November 11th at 10:30 a.m. at Tamarac Veteran's Park. City Manager Cernech reported the Citywide Buffer Wall Project, Phase 1113, which will include walls on the North and South sides of Commercial Blvd. between NW 64th Ave. and Rock Island Road is currently in the initial design phase which includes surveys and Geotechnical reports. The design segments of this project will begin in January 2016 with and estimated completion sometime in September 2016. City Manager Cernech said he recently attended the grand opening of the Art Walk in Coral Springs which is located on 31st St. just south of Sample Road on University Dr. and encouraged people to visit the Art Walk. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individual spoke: Sharon Baron, 4709 Woodlands Blvd., said she also attended Coral Springs Art Walk and is looking forward to the Taste of Tamarac; noted that Tamarac Talk is giving away two tickets to the Taste of Tamarac; would like to see the community more involved in Commission meetings; talked about having children attending the meetings; suggested giving service hours for attending and said Tamarac should have an Educational Advisory Board. 6. CONSENT AGENDA: Mayor Dressler said he is pulling item 6 (h) TR12703 — Ground Lease Agreement for Tamarac Village from the Consent Agenda for discussion. Mayor Dressler asked City Manager Cernech if there were any other additions/changes to the Consent Agenda and City Manager Cernech said there were no other additions/changes to the Consent Agenda. Vice Mayor Bushnell seconded by MG moved approval of items 6 (a) through 6g) on the Consent Agenda. Motion passed unanimously (5-0). , a. TR12701 - Pumper/Aerial Fire Apparatus Purchase: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the acquisition of an Emergency One 78 foot Pumper/Aerial fire apparatus from Hall -Mark Fire Apparatus, Inc., based on the Request for Proposal process (RFP) 15-01 R and in accordance with the City fire apparatus replacement program at a total cost not to exceed $681,575; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-94 e. TR12665 - Janitorial Agreement Renewal (USSI): A Resolution by the City Commission of the City of Tamarac, Florida, approving Amendment Number 1 to the Agreement with United States Service Industries, Inc. for Citywide Janitorial Services; authorizing the appropriate City Officials to execute Amendment Number 1 and any future renewals to the Agreement with United States Service Industries, Inc.; authorizing the renewal of the existing Agreement effective July 1, 2015, nunc pro tunc through September 30, 2017, in an annual contract amount of $213,383.52 for fixed -cost services; authorizing an amount not to exceed Page 4 of 6 COMMISSION MEETING OCTOBER 14, 2015 $23,824.55 to be added to the contract for variable -cost services for a total annual budget of $237,208.07; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-95 f. TR12702 - Appointing two Resident Trustees to the Police Pension Board: A Resolution of the City Commission of the City of Tamarac, Florida, appointing two Resident Trustees to the Police Pension Board to serve a two-year term ending October 15, 2017, or until new appointments are made; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-96 g. TR12679 - Hidden Harbour Re -metering Agreement and First Amendment to the Water and Sewer Developer's Agreement A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to accept and execute a Re - metering Agreement and First Amendment to the Water and Sewer Developer's Agreement with BH IGF Hidden Harbour Apt. LLC % Marvin F. Poer & Co., for the Hidden Harbour Apartments located at 8800 NW 78th Court & 8900 NW 77th Court, to allow re -metering of the water service for the purpose of allocation of the direct cost of water and sewer service among multiple users and establishing 143 ERC's for water and 143 ERC's for sewer; authorizing execution of the acknowledgement of Agreement and consent to assignment of the Water and Sewer Developer's Agreement; authorizing and directing the City Clerk to record said Agreement in the public records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2015-97 h. TR12703 - Ground Lease Agreement for Tamarac Village A Resolution of the City Commission of the City of Tamarac, Florida, authorizing and directing, Alan J. Polin, P.A. as trustee under the Tamarac Land Trust Agreement dated July 10, 2013 to execute the Ground Lease Agreement, attached hereto as Exhibit 1", by and between Alan J. Polin, P.A. as trustee and JKM Tamarac Village, LLC; for the purpose of developing the Tamarac Village Property being more particularly described in Exhibit 1" attached hereto and incorporated herein; providing for conflicts; providing for severability; and providing for an effective date. Financial Services Director Mason appeared and gave a brief presentation, a copy of which is on file in the City Clerk's Office. JKM Principal Adam Freedman appeared and gave a brief presentation, a copy of which is on file in the City Clerk's Office. Financial Services Director Mason and Mr. Freedman responded to a few questions from the Commission. Commissioner Gomez seconded by Commissioner Placko moved approval of TR12703 — Ground Lease Agreement for Tamarac Village. Motion passed unanimously (5-0). RESOLUTION R-2015-98 7.
