CITY COMMISSION MEETING
WEDNESDAY, OCTOBER 28, 2015
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 9:06 a.m. on Wednesday, October 28, 2015, in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Pamela Bushnell, Commissioner Michelle J.
Gomez, Commissioner Diane Glasser and Commissioner Debra Placko were in attendance.
Also in attendance were: City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Commissioner Placko led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of the ICMA Certificate of Excellence Award to the Mayor and Commission by
City Manager Michael Cernech for exceeding the standards established by the ICMA Center
for Performance Analytics in the identification and public reporting of key outcome measures,
surveying of both residents and employees, and the pervasiveness of performance
management in the organization's culture.
b. Presentation of a proclamation by Mayor Harry Dressler Commending Tamarac Fire
Rescue Rapid Intervention Team. (Requested by Fire Chief Mike Burton)
c. Presentation of a proclamation by Mayor Harry Dressler proclaiming the month of October
2015 as "National Cyber Security Awareness Month". (Requested by Mayor Harry Dressler)
d. Presentation by Mayor Harry Dressler of Employee Service Awards:
10 Year Awards: Nora Carles, Benefits Specialist, Human Resources; Christine Bosco,
Permit Clerk, Building; Paul Johnson, Transmission Supervisor, Utilities

e. Presentation of a proclamation by Mayor Harry Dressler proclaiming October 28, 2015 as
"Shirley Herman Strassler Day" in honor of her 106th Birthday. (Requested by Commissioner
Michelle J. Gomez)
2. CITY COMMISSION REPORTS:
a. Vice Mayor Bushnell: Vice Mayor Bushnell noted that she has been doing United Way
Payroll deductions for 35 years. Vice Mayor Bushnell said that United Way has a program
called Mission United which is all about veterans and is proud to take part in that program.
Vice Mayor Bushnell said she attended the Mayor's Gala last week at which each city was
invited by Mission United to honor a veteran. Vice Mayor Bushnell said Tamarac resident
Herbert Daley was chosen and introduced Mr. Daley to the Commission. Mr. Daley indicated
that he was in the service from 1954 to 1957.

b. Commissioner Gomez: Commissioner Gomez said she also attended the Mayor's Gala
and it was a beautiful tribute and ceremony. Commissioner Gomez thanked Mr. Daley for his
service to this country. Commissioner Gomez said she attended the Broward League of
Cities Dinner and there was a good discussion about the importance of local government
involvement in either supporting or objecting to initiatives being put forth by the legislators.
Commissioner Gomez thanked City Attorney Goren, Assistant City Attorney Michael Cirullo,
Assistant City Attorney David Tolces and the City of North Lauderdale for hosting a very
interesting Ethics seminar. Commissioner Gomez thanked the Chamber of Commerce for a
great Taste of Tamarac and said she is looking forward to the Art Festival in April 2016.
Commissioner Gomez attended the Broward County Planning Council Traffic Sub -Committee
and Regular meetings; the Broward County Bar Association Crisis Commission Seminar, the
Leadership Broward Gala; and the Affordable Housing Task Force event. Commissioner
Gomez invited people to attend the Coffee with the Commissioner tomorrow morning at 10:30
a.m. at the Orange Tree on University Drive.
c. Commissioner Glasser: Commissioner Glasser said she attended the Family Central
Alzheimer fund raising Luncheon and noted that because of the lack of funding from the
government, groups such as this need to find different ways to fund their programs.
Commissioner Glasser said she attended the Taste of Tamarac which was very well done.
Commissioner Glasser noted that she attended the University Hospital Board Meeting and is
pleased to report that things are coming along beautifully. Commissioner Glasser said she
also attended the ADRC meeting and they are planning a golf tournament to raise funds in
order to continue providing programs to people.
d. Commissioner Placko: Commissioner Placko wished City Attorney Goren a belated Happy
Birthday. Commissioner Placko noted that she also attended many of the events that have
already been mentioned by her colleagues. Commissioner Placko said there was a BSO
COPS training session last night and it was a full house with every district in the City
represented. This is due to the efforts of Deputies Jennifer Marion and Steve Del Sol who
came up with the idea to have recruiters go out into communities and recruit people for the
program. Commissioner Placko said she believes the visibility of the Community Observer
Patrols in communities' acts as a deterrent to crime. Commissioner Placko said she is proud
of the group from Woodmont and reported that they have added three more communities to
the group: Heathgate/Sunflower, Westwood 5 and Pineapple Park. Commissioner Placko
also noted that there are now more women getting involved in the program. Commissioner
Placko encouraged people to attend the Veteran's Day Ceremony on November 11th at 10:30
a.m. at Veteran's Park, where you will also hear about the Veteran's Tribute Wall.
e. Mayor Dressler: Mayor Dressler said he himself has attended 8 different events over the
last two weeks. Mayor Dressler said he spoke to two groups at Kings Point, the Men's Club
and Snowbirds, about the issue of a Strong Mayor form of government. Mayor Dressler said
he had the privilege of reading to children at the Alahazar School; attended the Family
Central Alzheimer Luncheon and the United Managed Care Alzheimer Care Givers fund
raiser. Mayor Dressler said he met Lauderdale Lakes Mayor Barrington Russel at that event
who expressed his appreciation for Tamarac approving the Atlantic Private Park Project.
Mayor Dressler commented that the Taste of Tamarac was an amazing event.
3. CITY ATTORNEY REPORT: City Attorney Goren said that there is a memo on the dais
this morning regarding a conflict waiver, a copy of which is attached hereto and incorporated

herein. The memo references the representation provided by Gary Resnick of the Grey
Robinson law firm whose firm represents Tamarac in various telecommunications matters.
Another member of the law firm represents J.P. Morgan Chase Bank in connection with a
pending code violation matter. It is not a conflict which would render the inability for Mr.
Resnick to perform services for us and his law partner to represent J.P. Morgan Chase in
connection with the pending code violations and liens. City Attorney Goren said there is a
letter from Mr. Resnick requesting the City's waiver of any potential conflict that may arise as
of result of the representation of Chase with respect to the code violations and liens matter.
The City Attorney does not have the legal ability to waive the conflict and, hence, will need a
Motion and vote from the Commission to waive the potential conflict. Commissioner Gomez
seconded by Commissioner Placko moved to acknowledge and waive the potential conflict of
interest and consents to the representation of Gray Robinson of J.P. Morgan Chase. Motion
passed unanimously (5-0).
City Attorney Goren said there has been talk regarding a proposal by Representative
Caldwell to amend the State Election Code to make uniform election dates for municipalities
statewide and conduct municipal elections on odd numbered years. City Attorney Goren said
his office has reviewed the proposal and yesterday they talked to the League of Cities
General Counsel who has indicated that this may not be a 2016 issue. It appears only to be
in the discussion stage and to date no such bill has been filed. City Attorney Goren said if this
should move forward it would change how Tamarac's Commission members get elected and
change the ability to access the ballot for purpose of referendum questions. City Attorney
Goren noted for the record the memo that the Commission has received from the Florida
League of Cities is still in play.
City Attorney Goren said the Commission also received the lengthy Legislative Update report.
Some of the items that they are tracking include: texting while driving; public records and
meetings; law enforcement body cameras; children and pets in unattended vehicles and
county canvassing boards. City Attorney Goren said his firm will continue to monitor these
bills and keep the Commission updated.
City Attorney Goren said the Broward League of Cities recently voted to support the revisions
that you have seen with regards to the changes in the Ethics Code. The document is subject
to further review by the Inspector General's office. On October 15th the IG actually filed a
memorandum referencing comments that John Scott made with regards to the draft. Drew
Myers has set a conference call with the IG on Friday and the League will meet Drew this
coming Friday. Some of the issues are jurisdictional lobbyists and secondary/concurrent
employment and compensation. When the 2010 ballot question was adopted it impressed
upon local government officials the obligation to make your disclosures on an annual basis. In
the proposal Mr. Myers is recommending to the County Commission to object to reporting on
a range basis any compensation for secondary/concurrent employment. There are some
concerns on the IG's part about the ranges. There are issues about income that the IG is
concerned about because excluded from the term compensation are such things as K1,
distributions from certain corporate structures as well as certain pension payments, etc.
which are not part of the disclosure. City Attorney Goren said it appears the IG wants to know
a little bit more. City Attorney Goren said Tamarac City Officials have to file a Form 1 with the
Supervisor of Elections and this is not a Form 6 disclosure. Form 6 is a much more detailed
disclosure that County Commissioners must make, among others.

City Attorney Goren said the Charter Review Commission is in session for the next few years
and the IG has access to the Charter Review Commission to look at what he thinks is best to
modify the Charter. City Attorney Goren said his office will monitor this very carefully. City
Attorney Goren responded to a few comments and questions from the Commission. Mayor
Dressler said he recently attended a webinar about "Elected Officials as Fiduciaries" and he
would like to discuss the information with the IG. Mayor Dressler asked City Manager
Cernech and City Attorney Goren to explore a public forum on this issue.
4. CITY MANAGER REPORT: Registration for the 2016 class of Tamarac University is
November 1st — January 29, 2016. This is a seven week program with classes beginning on
March 15th. The only requirement is that you must be a resident or business owner in the City
of Tamarac.
Upcoming Events: Movie in the Park featuring "PARANORMAN" will be held on Friday
November 6th at the Sports Complex. Food trucks will begin serving at 5:30 p.m., activities at
6:00 p.m. with the movie starting at 7:30 p.m. The Veteran's Day Ceremony will take place on
Wednesday, November 11th at 10:30 a.m. at Veteran's Park. The Tukey Trot will take place
on Thursday, November 26th. The race begins at City Hall at 7:30 a.m. Early registration is
$25 and ends on November 15th and late registration is $30 from November 16th thru
November 25th. Registration on the day of the race is $50. Veterans can take $10 off the
registration fee by providing proof and if you use a Tamarac Gift Card by November 15th, you
will get $5.00 off the registration fee.
Past Event: The Halloween Hoopla held on October 23rd had the largest attendance ever. It is
estimated that 2000 were in attendance.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following
individual spoke: Peter Mason, Executive Director of the Tamarac Chamber of Commerce
reported that the Board of Directors wished to thank the City for the wonderful partnership for
the Taste of Tamarac. Everyone had a good time and they are looking forward to working
with Tamarac in 2016. Mr. Mason said there was a record attendance at the event. Mr.
Mason said he also attended the Broward Alliance Annual Dinner where Keith Koenig, of City
Furniture, won a prestigious award. With no one else wishing to speak, Mayor Dressler
closed Public Participation.
6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any
changes/additions to the Consent Agenda and City Manager Cernech said there were no
changes to the Consent Agenda. Vice Mayor Bushnell seconded by Commissioner Gomez
moved approval of the Consent Agenda as presented. Motion passed unanimously (5-0).

b. TR12715 - Towmaxx - Traffic Deposit Fee Refund: A Resolution of the City Commission of
the City of Tamarac, Florida, authorizing a refund of $1,550.00 submitted by Dwayne L.
Williams of Towmaxx Towing Service, LLC, for a Traffic Engineering Review deposit fee,
collected in conjunction with a Special Exception project; providing for conflicts; providing for
severability; and providing for an effective date.

c. TR12712 - Execution of Agreement Addendum for EMS County Grant: A Resolution of the
City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to
execute and Agreement Addendum between the City of Tamarac, a sub -grant participant,
and Broward County for acceptance of a multi -agency Emergency Medical Services (EMS)
County Grant for improvement and expansion of pre -hospital emergency medical services
under the project for Mass Casualty Incident(MCI)/Active Shooter equipment; providing for
conflicts; providing for severability; and providing for an effective date.

d. TR12707 - St. Malachy Church Carnival: Fee Waiver, Extended Hours, and Alcohol Permit
Request: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to grant a waiver of Business Revenue licensing fees in the amount
of $1,558.90, to extend the hours of operation to 11:00 p.m. on Thursday, November 5, 2015
through Saturday, November 7, 2015; and to permit the sale and consumption of alcoholic
beverages on premise on Friday, November 6, 2015 through Sunday, November 8, 2015 for
the Saint Malachy Catholic Church annual carnival, located at 6200 John Horan Terrace,
beginning on Thursday, November 5, 2015 and ending on Sunday, November 8, 2015;
providing for conditions of approval; providing for conflicts; providing for severability; and
providing for an effective date.

e. TR12705 - BSO Permit for Special Details - FY16: A Resolution of the City Commission of
the City of Tamarac, Florida, authorizing the appropriate City Officials to execute a Broward
Sheriff's Office Permit Application for Special Details for police services to be used by the
Parks and Recreation department in an amount not to exceed $80,098 in FY16, October 1,
2015 - September 30, 2016; approving funding from the appropriate Parks and Recreation
accounts, providing for conflicts; providing for severability; and providing for an effective date.

f. TR12708 - Muscular Dystrophy Association Muscle Walk: A Resolution of the City
Commission of the City of Tamarac, Florida, approving a request from the Muscular
Dystrophy Association of South Florida to waive fees for the MDA Muscle Walk to be held at
Tephford Park on Sunday, February 14, 2016, from 10:00 a.m. to 1:00 p.m.; providing for
permits, proper insurance, and execution of a Hold Harmless Agreement; providing for
execution of a License Agreement; providing for conflicts; providing for severability; and
providing for an effective date.

g. TR12706 - Citywide Buffer Wall Phase 2B Design Work: A Resolution of the City
Commission of the City of Tamarac, Florida, approving execution of Task Authorization No.
16-02E with Stantec Consulting Services Inc. to provide Professional Engineering Services
for the design and permitting of the Citywide Buffer wall Project, Phase 1113, which is generally
located along Commercial Boulevard between Rock Island Road and NW 64th Avenue, in
accordance with the City's Continuing Service Agreement as authorized by Resolution R-
2011-87; authorizing an expenditure for said purpose in an amount not to exceed
$145,597.50; authorizing an appropriation of $145,597.50-1 providing for conflict; providing for
. severability; and providing for an effective date.

h. TR12700 - Flu Vaccinations for City Employees: A Resolution of the City Commission of
the City of Tamarac, Florida, authorizing the appropriate City Officials to accept free flu
vaccination and execute a Hold Harmless Agreement between the City of Tamarac and
University Hospital relating to University Hospital donating and administering approximately
one hundred (100) free flu vaccinations to City employees at the City of Tamarac annual
Employee Health and Education Fair on November 5, 2015; providing for conflicts; providing
for severability; and providing for an effective date.

i. TR12709 - Bid Award 15-21 B for Colony West Maintenance Facility: A Resolution of the
City Commission of the City of Tamarac, Florida, awarding Bid No. 15-21 B to and approving
an Agreement with Sun Up Enterprises, Inc. for the Colony West Golf Course Maintenance
Facility Improvement Project, in accordance with Bid No. 15-21 B for a contract amount of
$195,169.00; a contingency in an amount of $29,275.35 will be added to the project account,
for a total project budget of $224,444.35; authorizing an expenditure from the appropriate
accounts; providing for conflicts; providing for severability; and providing for an effective date.

8. ORDINANCE(S) - FIRST READING:
a. TO2331 - FY2015 - 2nd Budget Amendment: An Ordinance of the City Commission of the
City of Tamarac, Florida, amending Ordinance 2015-05, which amended the City of Tamarac
Operating Budget, Revenues and Expenditures, the Capital Budget, and the financial policies
for the Fiscal Year 2015, by increasing the total revenues and expenditures by a total of
$6,200,579 as detailed in Exhibit A attached hereto; providing for conflicts; providing for
severability; providing for an effective date. City Attorney Goren read TO2331 by title into the
record. Commissioner Placko seconded by Commissioner Gomez moved approval of
TO2331. Financial Services Director Mason appeared and gave a brief presentation. Motion
passed unanimously (5-0).

9. PUBLIC HEARING(S):
a. TR12717 - CDBG FY 2014/15 Amendment: A Resolution of the City Commission of the
City of Tamarac, Florida, approving a first amendment to the fiscal year 2014/2015 Annual
Action Plan for expenditure of the U.S. Housing and Urban Development Community
Development Block Grant funds for the fifteenth program year to provide for reallocation of
funds; providing for conflict; providing for severability; and providing for an effective date. City
Attorney Goren read TR12717 by title into the record. Commissioner Placko seconded by
Vice Mayor Bushnell moved approval of TR12717. Housing and Neighborhood Programs
Manager Bauldree appeared and gave a brief presentation. Everyone wished Ms. Bauldree
good luck and success at her new job with the County. Mayor Dressler opened the public
hearing and with no one wishing to speak, closed the public hearing. Motion passed
unanimously (5-0).

scheduled for this meeting.
11. QUASI-JUDICIAL HEARING(S):
a. TR12713 - Fire Station 78: Major Revised Site Plan: A Resolution of the City Commission
of the City of Tamarac, Florida, granting a Development Order for a Major Revised Site Plan
to construct a new Fire Station on the existing Fire Station property located on the north side
of West Commercial Boulevard, at 4801 West Commercial Boulevard (a portion of Tracts 2
and 7 of the Fort Lauderdale Truck Farms Plat, Section 13, Township 49 South, Range 41
East, according to the Plat thereof, as recorded in Plat Book 4, Page 31, and A portion of
Parcel A of the Leadership of Tamarac Phase One Plat, according to the Plat thereof, as
recorded in Plat Book 76, Page 35; all Plats are recorded in the public records of Broward

providing for an effective date. City Attorney Goren went over the Quasi -Judicial procedures
in detail. City Attorney Goren read TR12713 by title into the record. Commissioner Placko
seconded by Commissioner Gomez moved approval of TR12713. City Clerk Teufel swore in
all affected parties. Community Development Director Calloway appeared and gave a
presentation, a copy of which is on file in the City Clerk's Office, and ended by saying that
staff and the Planning Board recommend approval of TR12713. City Attorney Goren said that
all documents submitted to the DRC and the Planning Board, as well as today's Power Point
presentation, are part of the record. Mayor Dressler opened the public hearing and with no
one wishing to speak, closed the public hearing. Motion passed unanimously (5-0).

b. TR12714 - Korean United Methodist Church: Major Revised Site Plan: A Resolution of the
City Commission of the City of Tamarac, Florida, granting a Development Order for a Major
Revised Site Plan for Korean United Methodist Church, to allow for the proposed
redevelopment of the subject property located on the North side of West Commercial
Boulevard between NW 64 Avenue and NW 66 Terrace at 6501 West Commercial Boulevard
(Specifically Parcel A and B of the "Commercial Boulevard Lands", according to the Plat
thereof as recorded in Plat Book 105, Page 34 of the public records of Broward County,
Florida) (Case No. 7-SP-15); providing for conflicts; providing for severability; and providing
for an effective date. City Attorney Goren read TR12714 by title into the record.
Commissioner Gomez seconded by Commissioner Glasser moved approval of TR12714.
City Clerk Teufel swore in all affected parties. Community Development Director Calloway
appeared and gave a presentation, a copy of which is on file in the City Clerk's Office, and
ended by saying that staff and the Planning Board recommend approval. Mr. Alex Nunez
appeared on behalf of the applicant. City Attorney Goren asked Mr. Nunez if he was an
attorney and if he was legally able to bind the applicant. Mr. Nunez responded yes to both
questions. Mr. Nunez introduced Dr. Ky HG. Yuhn Pastor of the Korean United Methodist
Church. Community Development Director Calloway, Mr. Nunez and Dr. Yuhn responded to
a few questions from the Commission. Mayor Dressler opened the public hearing and with no
one wishing to speak, closed the public hearing. Motion passed unanimously (5-0).

12. OTHER
City Attorney Goren announced that the Mayor will momentarily adjourn this Regular
Commission Meeting and then the Commission will convene for a Closed Door Executive
Session to discuss IAFF collective bargaining negotiations. City Attorney Goren said the
Closed Door Executive Session has been properly noticed and is not a public hearing, which
is a legally allowed meeting.
There being no further business to come before the City Commission, Mayor Dressler
adjourned the meeting at 11:08 a.m.

0 RE: City of Tamarac ("City") / Gray Robinson Conflict Waiver
On October 23, 2015, pursuant to the Rules Regulating the Florida Bar, the City Attorney's
Office received a request for a conflict waiver from Gray Robinson. Gary Resnick, Esq., at Gray
Robinson, represents the City in various telecommunications matters. Mr. Resnick's law partner,
Paul Minoff, has. been retained to represent JP Morgan Chase Bank, N.A. ("Chase") with respect
to code violations and liens issued by the City against real property located at 8306 N.W. 571,
Court. While such matters do not typically result in litigation, in the event of any litigation
related to this matter, Gray Robinson has agreed to end their representation of and not represent
any party in the action.
A copy of Gray Robinson's conflict waiver request is attached for your review. All requests for
conflict waivers must be approved by the City Commission.

We are writing to request the City's waiver of a potential conflict of interest, to the extent
required by the Rules of the Florida Bar. As you know, I and GrayRobinson, P.A. represent the City on
telecommunications matters. My partner, Paul Minoff, who works with me in Fort Lauderdale, has been
asked to represent JPMorgan Chase Bank, N.A. ("Chase") with respect to code violations and liens issued
by the City against real property located at 8306 NW 57th Court, Tamarac (the "Property"), which is now
owned by Chase. Mr. Minoffs representation would include working with Chase and the City to ensure
that the Property is brought into compliance, and then seeking appropriate finellien reductions from the
City consistent with City ordinances and procedures.
These types of matters are typically non -adversarial and do not result in litigation. In the event of
litigation between Chase and the City, we will cease representation of Chase on this matter, and will not
represent any party is such case. We are respectfully requesting the City's waiver of any potential
conflict that may arise as a result of this representation of Chase with respect to this Property.
