CITY COMMISSION MEETING
WEDNESDAY, JANUARY 27, 2016
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 9.07 a.m. on Wednesday, January 27, 2016, in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Diane Glasser, Commissioner Pamela
Bushnell, Commissioner Michelle J. Gomez and Commissioner Debra Placko were in
attendance.
Also in attendance were: City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Vice Mayor Glasser led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of a check by the Mayor, City Commission and Employees of the City of
Tamarac, in the amount of $36,000 to the United Way of Broward County, representing the
City of Tamarac's 2015 Employee Campaign total. Accepting on behalf of the United Way
President/CEO Kathleen Cannon, Jennifer Lacker, Development Officer, Tony Hopper, Vice
President of Workplace Campaigns and Development Associate Joanne Lopez, (Requested
by Community Development Director Maxine Calloway and Public Services Director Jack
Strain)
b. Presentation by Mayor Harry Dressler of Employee Service Awards:
5 - Year Awards: Willie Conde, Service Worker I, Public Services, Carl Mc Comas,
Equipment Operator I, Public Services
10 - Year Awards: Milagritos Lopez, Permit Clerk, Building; Troy Gies, Budget & Contracts

2. CITY COMMISSION REPORTS:
a. Commissioner Bushnell: Commissioner Bushnell said that she always wondered how
things were voted on before she became a Commissioner and attended meetings.
Commissioner Bushnell said applications are now being taken for Tamarac University. TU
gives an excellent overview of Tamarac and enables individuals to get a better understanding
of how items are voted on as well as a better understanding of how city government works.
b. Commissioner Gomez: Commissioner Gomez said TU is also a good way for people on
Homeowner Association boards to get a better understanding of how the City works.

Commissioner Gomez said she attended the following: Tamarac Arts & Crafts Launch Party
at City Furniture; Partners in Education Meeting; Aging and Disability Resource Center
Installation Dinner and the Coral Springs Mayor's Chess Challenge. Commissioner Gomez
noted that she would be attending the Broward County Planning Council Meeting tomorrow.
c. Vice Mayor Glasser: Vice Mayor Glasser said she attended the ADRC Installation Dinner
where Tamarac was honored with the "20 Consecutive Years Landmark Level Award". Vice
Mayor Glasser noted that the ADRC also provides assistance not only to seniors but to the
younger population as well.
d. Commissioner Placko: Commissioner Placko said she spent a week in Tennessee and
actually saw snow. While there, she was curious as to what issues Tennessee faced and
found out that they have concerns about road transportation and where to get funding.
Commissioner Placko said the local paper has a Police Chief's report where he advises the
residents what the latest scams are and lists the names and addresses of people that had
been arrested. Other issues they have are: Poorly run Refugee Resettlement Program and
the need to have all government officers make available their credit scores because people
want to make sure they are living within their means. Commissioner Placko said the lifestyle
in Tennessee is very different from here and she is glad to be home.
e. Mayor Dressler: Mayor Dressler said he attended the Etiquette on the Run Way Event and
the Knights of Pythias Dinner celebrating Judge Allen Marks. Mayor Dressler said the
highlight of the last two weeks was being invited to the White House and meeting President
Obama. Mayor Dressler said he and other members of the US Conference of Mayors
attended a panel discussion with the President after which he and City Manager Cernech
attended a private reception in the White House. Mayor Dressler said he also met with
Senator Nelson and Representative Hastings staff while in Washington, D.C.
3. CITY ATTORNEY REPORT: City Attorney Goren said with the passing of Dr. El Sanadi we
need to appoint an Interim Medical Director and as such we need to entertain a three (3) part
motion. (1) To declare an emergency with regard to the replacement and assignment of a
medical director to the City's Fire/Rescue Department with the passing of Dr. Nabil El Sanadi;
(2) To authorize and to direct the City Manager (or his designee) in conjunction with the City's
Fire Chief, to engage via an Agreement, a certified emergency physician as the City's
replacement medical director, Board Certified in Emergency Medicine by the American Board
of Emergency Medicine or American Board of Osteopathic Emergency Medicine, for a period
of up to 120 days, subject to budget, and to the approval of the State EMS director; and (3)
To bring back to the City Commission a formal Agreement to engage an EMS Director for the
City, subject to the City's Procurement Code during this 120 day period, which may be
extended upon notice from the City Manager to the City Commission should there be
unforeseen delays in selecting/engaging a qualified replacement EMS Director as described
in this Motion. Commissioner Gomez seconded by Commissioner Bushnell moved approval
of the aforementioned Motion. Motion passed unanimously (5-0).
City Attorney Goren said that within a limited time of the passing of Dr. El Sanadi Fire Chief
Burton engaged in conversation with City Manager Cernech and Dr. Brooks and as such
there was never a gap in medical director coverage for the City of Tamarac.

City Attorney Goren reminded everyone that on Friday, January 29th from 2:00 p.m. to 4:00
p.m. at the Tamarac Community Center, his firm will be hosting a seminar on the new Ethics
Code. Members of his law firm will discuss the new Ethics Code and walk through the
changes in the new Ethics Code.
4. CITY MANAGER REPORT: City Manager Cernech said Fire Station 78 has been
tentatively set for demolition on February 1st. City Manager Cernech said this was approved
by the Commission some time ago and knows it can be frustrating because the process takes
so long. The new fire station will be a great addition to the east side of Tamarac.
City Manager Cernech said he traveled to Washington, D.C. for the US Conference of
Mayors Winter Meeting and, as always, was impressed with the agenda for these meetings.
They contain very forward thinking and cutting edge ideas which focus on issues that impact
all cities. City Manager Cernech said he met with Senator Nelson and Representative
Hastings staff and complimented Val Gelnovatch, of the Ferguson Group our federal
lobbyists, for the good work she does on Tamarac's behalf. City Manager Cernech said he
did not get to listen to President Obama speak, but did attend the reception where he was
able to talk with a few mayors.
City Manager Cernech said the Office of the Inspector General (OIG) has issued a number of
reports about cities who have fallen under the OIG's microscope. City Manager Cernech said
he has provided copies to the Executive Team so that we can review these reports to make
sure that we are not doing anything that would cause us to fall under the OIG's microscope.
These organizations made mistakes with the best of intentions and it is important that this
Commission understands we look at these reports and make sure we are proactive.
Fitness Center Promotions: Renew your fitness center membership for 12 months and get
one additional month free. The renewal must take place between January 1st and June 30,
2016. Members can obtain a one week pass for friends and family to try out the fitness center
and members will receive three months free if their friends or family join for six months. This
offer is valid January 1st to April 30, 2016.
Upcoming events: Movie in the Park featuring "The Intern" will take place at Mainlands Park
located at 4500 Monterey Dr., on Friday January 29th at 6:30 p.m. The City of Tamarac and
Chamber of Commerce will be hosting a free community wide Preventative Health and
Wellness Expo at the Community Center on Saturday, February 6th from 9:00 a.m. to noon.
City Manager Cernech said the United Way Committee did an exceptional job this year and
he is proud of how incredibly generous Tamarac's employees are. City Manager Cernech
thanked Public Services Director Strain and Community Development Director Calloway for
chairing the committee and also thanked the committee members.
City Manager Cernech said Vince Sciacca has worked for the City for 35 years and has
created one of the best Fleet Divisions in the US. Tamarac has been recognized over the
last several years as one of the top 25 Fleet Divisions in the US. City Manager Cernech said
the Fleet Division not only does an exceptional job for Tamarac but North Lauderdale as well.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one
wishing to speak, closed Public Participation.

6. CONSENT AGENDA: City Manager Cernech said that there have been two changes to
Ordinances First Reading on today's agenda. City Manager Cernech said as discussed at the
workshop on January 25, 2016 Item No. 8 (c) T02337 is being tabled to the February 10,
2016 Commission Meeting. City Manager Cernech Read T02337 by title into the record. City
Manager Cernech said item No. 8 (a) T02336 has been amended removing the language in
Section 8 (a) that stated that the actuarial impact statement is of no impact. City Manager
Cernech read T02336 by title into the record. Commissioner Gomez seconded by
Commissioner Placko moved to table T02337 to the February 10, 2016 and accept the
amendment to T02336. Motion passed unanimously. Commissioner Gomez seconded by
Commissioner Bushnell moved approval of the Consent Agenda as presented. Motion
passed unanimously (5-0).
a. Approval of the January 13, 2016 Regular Commission Meeting Minutes - APPROVED
b. TR12742 - Surface Preparation and Coating System for WTP - Bid No. 16-04B: A
Resolution of the City Commission of the City of Tamarac, Florida, authorizing that the City
Commission awards Bid No. 16-04B to Shamrock Restoration Systems, Inc., and authorizes
the appropriate City Officials to execute the agreement between the City of Tamarac and
Shamrock Restoration Services, Inc., for an amount of $184,863 for the Surface Preparation
and Coating System for the City of Tamarac Water Treatment Plant Project; a contingency in
the amount of $20,000 will be added to the project account for a total amount of $204,863;
approving funding for this project from the appropriate Utilities Operational Account;
authorizing the appropriate City Officials to administer the contract; providing for conflicts;
providing for severability, and providing for an effective date.

c. TR12741- Purchase of Pumps and Appurtenances from Hydra Service, Inc. — FY16: A
Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to designate Hydra Service, Inc., as a sole source provider for
pumps and appurtenances utilized at fifty-three (53) city wastewater pump stations, and to
authorize expenditures for the purchase of pumps and appurtenances from Hydra Service,
Inc., for an amount not to exceed $110,000 for Fiscal Year 2016; providing for conflicts;
providing for severability; and providing for an effective date.

d. TR12748 - First Amendment to Ground Lease: A Resolution of the City Commission of the
City of Tamarac, Florida, authorizing and directing, Alan J. Polin, P.A. as Trustee under the
Tamarac Land Trust Agreement dated July 10, 2013 to execute the First Amendment to
Ground Lease, attached hereto as Exhibit "1 ", by and between Alan J. Polin, P.A. as Trustee
and JKM Tamarac Village, LLC to be effective nunc pro tunc to January 15, 2016; authorizing
the City Manager to periodically direct Alan J. Polin, P.A. as Trustee to approve minor non —
monetary amendments to the Ground Lease Agreement; providing for conflicts, providing for
severability; and providing for an effective date.

City of Tamarac, Florida; amending Chapter 16, Pensions and Retirement, Article VI, Pension
Plan; amending Section 16-493 Optional Benefits, providing for modification of DROP
eligibility; amending Section 16-515 Retirement Subsidy, providing for modification of
retirement subsidy; amending Section 16-516 Supplemental Pension Benefit, providing for
modification of supplemental pension; providing for a savings clause; providing for
severability; providing for codification and providing for an effective date. City Attorney Goren
read T02336 by title into the record. Commissioner Placko seconded by Commissioner
Gomez moved approval of T02336 as amended on first reading. Motion passed unanimously
(5-0).

b. T02335 - Ordinance Creating a Planned Development (PD) District: An Ordinance of the
City Commission of the City of Tamarac, Florida amending Chapter 24, entitled "Zoning",
Article III entitled "District Regulations" of the City of Tamarac Code of Ordinances,
specifically creating Division 27 entitled "PD Planned Development District", providing for a
new zoning designation to allow for flexibility in development standards on Master Planned
Developments within the City to include the following Sections: 24-542 "Purpose, Applicability
and Creation of Commissioner Placko District", 24-543 "Rezoning to the PD District", 24-544
"General Standards for Planned Development District", and 24-545 "Minor Deviations and
Amendments to Approved PD Plan/Agreement'; providing for codification; providing for
conflicts; providing for severability; and providing for an effective date. City Attorney Goren
read T02335 by title into the record. Commissioner Placko seconded by Commissioner
Gomez moved approval of T02335 on first reading. Motion passed unanimously (5-0).

c. T02337 - Redistricting Ordinance: An Ordinance of the City of Tamarac, Florida, providing
for the re-creation and re-establishment of the geographic boundaries for four (4) Election
Districts in the City of Tamarac in accordance with Section 6.03 of the City Charter; providing
for the implementation of revised Election Districts to be effective for the elections to be held
in the City of Tamarac, Florida, commencing at the General Municipal Election in November,
2016, and thereafter; providing a form of request to the Supervisor of Elections of Broward
County, Florida, to implement the revised plan established pursuant to this Re -districting
Ordinance and to create functional districts consistent with the identification of geographic
boundaries for Election Districts; providing for the attachment of Election District Maps,
Charts and street address descriptions, which are attached hereto as Exhibit "A" and
incorporated herein by reference; providing for authorization and direction to the City
Manager to implement the terms, conditions and provisions of this Ordinance to be effective
for the next ensuing General Municipal Election of November 2016; providing for conflicts;

a. TR12744 - Trails at Central Pare: Declaration of Restrictive Covenants: A Resolution of the
City Commission of the City of Tamarac, Florida, approving the request of Dunay, Miskel and
Backman, LLP on behalf of Palm Cove Holdings, LP of a Second Amendment to the
Declaration of Restrictive Covenants for Trails of Central Pare attached hereto as Exhibit "Y
and incorporated herein; providing for conflicts; providing for severability; and providing for an
effective date. City Attorney Goren read TR12744 by title into the record. Commissioner
Gomez seconded by Commissioner Bushnell moved approval of TR12744. City Attorney
Goren went over the Quasi -Judicial processes and procedures and City Clerk Teufel swore in
all affected parties. Community Development Director Calloway appeared and gave a
presentation which covered TR12744 — Trails at Central Pare — Declaration of Restrictive
Covenants; TR12746 — Trails at Central Pare — Plat and TR12745 — Trails at Central Park —
Major Revised Site Plat as they are companion items. A copy of Community Development
Director Calloway's presentation is on file in the City Clerk's Office. Community Development
Director Calloway ended by saying that staff and the Planning Board recommend approval of
all three items. Attorney Scott Backman appeared on behalf of the applicant. City Attorney
Goren noted that while TR12744, TR112746 and TR12745 were discussed simultaneously,
they would be voted on separately. Community Development Director Calloway, Mr.
Backman and Mike Nunziata responded to questions and concerns raised by Commissioner
Bushnell. Mayor Dressler opened the Public Hearing and Bob Storch, 4622 NW 451h Court
expressed his opposition to the project. With no one else wishing to speak, Mayor Dressler
closed the public hearing. Commissioner Gomez seconded by Commissioner Bushnell
moved approval of TR12744. Motion passed unanimously (5-0).

b. TR12746 - Trails at Central Pare: Plat: A Resolution of the City Commission of the City of
Tamarac, Florida, granting final Plat approval for the "Trails at Central Pare" Plat, to allow for
lots and tracts to accommodate the proposed single-family dwelling units in association with
the redevelopment of the Trails at Central Pare property, formerly known as Palm Cove, for
the proposed use of two hundred and fourteen (214) single family detached units, replacing
the previously approved sixty-one (61) single family detached units and one hundred and
sixty-four (164) townhouse units; as requested by Scott Backman, Esq., of Dunay, Miskel,
and Backman, LLP, designated agent for the property owner, Palm Cove Holdings, LP, for
the property located south of West Commercial Boulevard, adjacent to the east of the Florida
Turnpike; (Case No. 3-P-15); providing for conditions of approval; providing for execution of
said plat; providing for conflicts; providing for severability; and providing for an effective date.
City Attorney Goren read TR12746 by title into the record. Commissioner Bushnell seconded
by Vice Mayor Glasser moved approval of TR12746. Mayor Dressler opened the Public
Hearing and with no one wishing to speak, closed the public hearing. Motion passed
unanimously (5-0).

c. TR12745 - Trails at Central Pare: Major Revised Site Plan: A Resolution of the City
Commission of the City of Tamarac, Florida, granting a Development Order for a Major
Revised Site Plan to allow for the redevelopment of the Trails at Central Pare property,
formerly known as Palm Cove, for the proposed use of two hundred and fourteen (214) single
family homes, replacing the previously approved sixty-one (61) single family homes and one
hundred and sixty-four (164) townhomes, for the subject property located south of West
Commercial Boulevard, adjacent to the east of the Florida Turnpike (legally described as the
plat of "Palm Cove" as recorded in Plat Book 181, Page 157 of the public records of Broward

Commissioner Gomez seconded by Commissioner Placko moved approval of TR12745.
Mayor Dressler opened the Public Hearing and Bob Storch, 4622 NW 45th Court expressed
his opposition to the project. With no one else wishing to speak, Mayor Dressler closed the
public hearing. Motion passed unanimously (5-0).
