HomeMy WebLinkAbout2016-04-13 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, APRIL 13, 2016 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:11 p.m. on Wednesday, April 13, 2016, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Diane Glasser, Commissioner Pamela Bushnell, Commissioner Michelle J. Gomez, Commissioner Debra Placko were in attendance. Also in attendance were: City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Vice Mayor Glasser led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation to the Mayor and Commission of the "20 Year Fair Share Plaque" by Aging & Disability Resource Center Executive Director Edith Lederberg b. Presentation of a Proclamation by Mayor Harry Dressler proclaiming the month of April 2016 as "Child Abuse Prevention Month". (Requested by Mayor Harry Dressler) c. Presentation of a Proclamation by Mayor Harry Dressler Commemorating the 50th Anniversary of the Vietnam War. (Requested by Parks & Recreation Director Greg Warner) 2. CITY COMMISSION REPORT a. Commissioner Bushnell: Commissioner Bushnell talked about the recent rash of car break- ins at day care centers and urged parents to be vigilant and not leave items visible on the car seats when dropping children off/picking children up at their day care center. Commission Bushnell said yesterday was "Equal Pay Day" and noted the difference between the pay men and women receive and said there is a bill pending addressing the inconsistency and urged people to back the bill. b. Commissioner Gomez: Commissioner Gomez noted that later today there will be the ground breaking for the Manor Parc Development in District 1. Commissioner Gomez said she attended the following events: Employee Appreciation Luncheon; the Gilda's Club Event honoring Shelley Goren; the State of the County Address; the Broward County Planning Council meeting; the Million Steps Walk in memory of the Holocaust victims; the Chamber Breakfast; the Tamarac Arts & Crafts Festival and was there to see the 11 Veterans attending the Honor Flight to Washington D.C. leave from the Kings Point Parking lot. c. Vice Mayor Glasser: Vice Mayor Glasser said she attended the District 3 Neighborhood Meeting, which all of the department directors attended, and noted it was well attended by the residents of District 3. Vice Mayor Glasser encouraged people to attend these meetings next spring. Vice Mayor Glasser said she went to the Public Safety Institute to recommend a Page 1 of 5 COMMISSION MEETING April 13, 2016 young man who wished to attend the police academy. She was very interested to see how dedicated these young people were to becoming police officers. Vice Mayor Glasser noted that she was happy she was able to assist this young man and get started. d. Commissioner Placko: Commissioner Placko said in honor of all Veterans Tamarac has free yoga classes at the Community Center on Saturdays. Commissioner Placko said the BSO Seniors vs. Crime Program will be starting shortly and she has received a lot of calls with people wanting to sign up. Commissioner Placko said she hopes that program will have spots for more than just four individuals. Commissioner Placko shared a story about an attempt to scam her mother out of money. Commissioner Placko's mother received a call from someone claiming to be Commissioner Placko indicating that she needed help and money. Fortunately, Commissioner Placko's mother was smart enough to know it was a scam and was not scammed out of any money unlike a friend of hers. Commissioner Placko said she met with a group of her mother's peers and they came up with the idea of using a safe word in order to determine the proper identity of the caller. e. Mayor Dressler: Mayor Dressler said he had also attended many of the events already reported on by his colleagues. Mayor Dressler said he recently attended the Code Enforcement Special Magistrate Hearing and was very interested to hear about some of the issues. Mayor Dressler noted that he attended the Gilda's Club Event and the District 3 Neighborhood Meeting. Mayor Dressler said he was recently appointed as the Secretary of the Broward County League of Cities Board of Directors and will be sworn in at the Broward League of Cities Gala on May 7th. Mayor Dressler said he is pleased to be able to represent the City of Tamarac in this capacity. 3. CITY ATTORNEY REPORT: City Attorney thanked everyone for their kind words about the Gilda's Club Event that honored his wife, Shelley. City Attorney Goren reported that the Broward League of Cities is hosting two Ethics Seminars; one on May 13, 2016 from 9:00 a.m. to 1:00 p.m. and the other on June 24, 2016 from 9:00 a.m. to 1:00 p.m. at the Cultural Arts Center. City Attorney Goren invited anyone who needs the ethics training hours to attend either one of these seminars and he will provide additional information about the seminars as it becomes available. 4. CITY MANAGER REPORT: City Manager Cernech noted that the Parks & Recreation Dept. staff continues to exceed expectations with Tamarac Gift Card sales. They finished 2015 with more than $8,000 in sales and over the first quarter of 2016 have doubled this amount with total sales surpassing $16,000. City Manager Cernech announced that the Financial Services Department has been awarded the Distinguished Budget Presentation Award by the GFOA for FY16. This is the 19th consecutive year the City has received this award. Upcoming Events: There will be an Earth Day Event in partnership with Earthsave and the Tamarac Farmers Market on April 24th from10:00 a.m. to 2:00 p.m. at Tamarac Veteran's Park; the Spring "Swim Bash" will take place at the Caporella Aquatic Center on April 30th Page 2 of 5 COMMISSION MEETING April 13, 2016 from noon to 4:00 p.m.; the Concert on the Green will take place on Friday, May 6th at Colony West Golf Club from 7:00 p.m. to 8:30 p.m. and will feature the band "Big City Dogs". Past Events: the Concert in the Park on April 8th had approximately 1,500 attendees and the Community Garage Sale held on April 9th had an estimated 1,300 shoppers. City Manager Cernech reported the Spy Glass Community pipe bursting project which started in December 2015 is substantially complete with minor punch list items to be completed. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke about the success of Tamarac's Arts & Craft Festival that took place on April 2"d and 3rd: Peter Mason, Eileen Simmons and Patricia Randall. Pat Scarpelli talked about the need for speed bumps on NW 57th Street. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said pursuant to the consensus of the Mayor and Commission at the Workshop on April 11, 2016 TR 12772 — Local Government Infrastructure Surtax - is being added to the Consent Agenda as Item No. 6 (d). City Attorney Goren read TR12772 by title into the record. City Manager Cernech said another item is being added to the Consent Agenda as Item No. 6(e) — TR12773 — Declaration of Appointment of Co -Trustee to the Tamarac Land Trust Agreement. City Attorney Goren read TR12773 by title into the record. Commissioner Bushnell seconded by Commissioner Gomez moved approval of the Consent Agenda as amended. Motion passed unanimously (5-0). a. Approval of the March 23, 2016 Regular Commission Meeting Minutes - APPROVED b. TR12763 - Hall -Mark Fire Apparatus Name Change: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the approval of the reassignment of purchase order of an Emergency -One 78 Foot Pump/Aerial Fire Apparatus from Hall -Mark Fire Apparatus LLC to Hall -Mark RTC in accordance with a customer notification document from the REV Group Firm stating all terms of purchase will remain as originally specified; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R2016-31 c. TR12771 - Initial Term - Amendment ATS Agreement: A Resolution of the City Commission of the City of Tamarac, Florida, approving the Initial Term — Amendment to Professional Services Agreement with American Traffic Solutions, Inc., attached hereto as Exhibit "A" and incorporated herein; authorizing and directing the appropriate city officials to execute all documents necessary to effectuate the intent of this resolution; providing for conflicts; providing for severability; providing for an effective date RESOLUTION R2016-32 d. TR12772 — Local Government Infrastructure Surtax: A Resolution of the City Commission of the City of Tamarac, Broward County, Florida, imposing a one cent per dollar Local Government Infrastructure Surtax on all authorized taxable transactions occurring within Broward County, Florida, as authorized by section 212.055(2), Florida Statutes, providing that the imposition of the Surtax shall not be effective unless approved at a Referendum Election; providing that the imposition shall be effective beginning January 1, 2017 and shall continue Page 3 of 5 COMMISSION MEETING April 13, 2016 until repealed; providing for distribution of Surtax revenues pursuant to law; directing the Supervisor of Elections to hold a Referendum Election on November 8, 2016; providing ballot language and a brief description of Infrastructure Capital Projects; providing for adoption of a Resolution detailing project examples; providing for public distribution of this Resolution; directing the City Clerk to advertise the Special Referendum Election in accordance with State Law or coordinate such advertisement in accordance with State Law with the Supervisor of Elections; providing for severability; providing for conflicts; and providing for an effective date. RESOLUTION R2016-33 e. TR12773 — Declaration of Appointment of Co -Trustee to the Tamarac Land Trust Agreement: A Resolution of the City Commission of the City of Tamarac, Florida, approving the Declaration of Appointment of Co -Trustee of the Tamarac Land Trust Agreement dated July 14, 2013, and the appointment of Howard Steinholz as the Co -Trustee for the Tamarac Land Trust pursuant to Section 689.071(9), Florida statutes; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R2016-34 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) - FIRST READING: a. T02333 - Commercial Vehicle Ordinance: An Ordinance of the City Commission of the City of Tamarac, Florida amending Chapter 14 of the City's Code of Ordinances, entitled "Motor Vehicles and Traffic" by specifically amending article II, entitled "stopping, standing and Parking," Section 14-30 entitled "Parking or Storage of Commercial Vehicles, Boats and Boat Trailers" to prohibit the parking and storage of certain commercial and recreational vehicles in residential areas except as provided herein; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. City Attorney Goren read T02333 by title into the record. Commissioner Gomez seconded by Commissioner Placko moved to table T02333 as discussed at the Workshop on April 11, 2016. Motion passed unanimously (5-0). ITEM TABLED TO THE APRIL 27, 2016 COMMISSION MEETING AGENDA b. T02343 - Amending Ordinance 2015-17 FY 2016 Budget: An Ordinance of the City Commission of the City of Tamarac, Florida, amending Ordinance 2015-17, which adopted the City of Tamarac operating budget, revenues and expenditures, the capital budget, and the financial policies for the Fiscal Year 2016, by increasing the total revenues and expenditures by a total of $1,651,665 as detailed summarized in Attachment B; providing for conflicts; an effective date.
