REGULAR CITY COMMISSION MEETING

CALL TO ORDER: Mayor Schreiber called the regular meeting of the City Commission to
order at 7:00 p.m. on Wednesday, January 14, 2004 at Westwood 17 Clubhouse, 6900
NW 77 Street, Tamarac, FL 33321.
PRESENT: Mayor Joe Schreiber, Vice Mayor Karen L. Roberts, Commissioner Beth
Flansbaum-Talabisco, and Commissioner Marc L. Sultanof.
ABSENT AND EXCUSED FOR CAUSE: Commissioner Edward C. Portner.
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft, and City
Clerk Marion Swenson.
PLEDGE OF ALLEGIANCE: Commissioner Flansbaum-Talabisco led the Pledge of
Allegiance.
INTRODUCTION
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation by Utilities Director Gagnon to the Mayor and Commission, of the
Florida Department of Environmental Protection's 2003 Water Treatment Plant Operations
Award for a Large Community Water System. Utilities Director Gagnon explained the
award is given for excellent drinking water, professionalism, and maintenance of the
facilities. Utilities Director Gagnon thanked the staff for their dedication and
professionalism and for making the receipt of this award possible. Mayor Schreiber
accepted and said Tamarac's water is the best, and he is proud to receive this award.
b. Presentation by Laboratory Manager Oney to the Mayor and City Commission,
of the Florida Section American Water Works Association's Water Conservation 2003
Award for Excellence for our Rain Shut -Off Device Retrofit Program. Mayor Schreiber
accepted and said the rain shut-off device program cuts down on excessive use of water.
C. Presentation by Mayor Schreiber of a proclamation proclaiming January 2004 as
"Broward County Multi -Ethnic Community Month". Paulet Green accepted and read into
the record remarks sent with her from Roland A. Foulkes, Chair of the Multi -Ethnic
Advisory Board. (See attached.)

REPORTS
2. City Commission: Mayor Schreiber said many people are here tonight because of
the School Board boundary issue as it affects Tamarac Elementary School. Mayor
Schreiber said he called School Board Member Stephanie Kraft on Monday and asked for
her help, and added that he gave Mrs. Kraft some alternatives. At yesterday's School
Board workshop the decision was made not to bus children from Tamarac Elementary
School. Mayor Schreiber explained that the School Board is an autonomous Board, and
the City can only exercise its influence to help make the school system better. Two new
schools were built in Tamarac over the past two years, and it is the Commission's job to
make Tamarac a better place to live. Mayor Schreiber read into the record a
communication he received from Mrs. Kraft (see attached) and said we should try to keep
Tamarac students in Tamarac schools, and the Commission is willing to help however it
can.
Vice Mayor Roberts thanked the parents, residents and citizens of all Tamarac districts for
e-mailing and faxing the School Board, and added that while the current boundary change
proposal was not approved, it does not mean that Tamarac does not need relief; alternate
proposals that everyone can agree upon are necessary.
Commissioner Sultanof wished everyone a happy and healthy new year. Commissioner
Sultanof said the Commission always has the interest of the community at heart. There
has been an increase of young families with children in Tamarac, he wanted everyone to
know that they can rely on the City Commission. Commissioner Sultanof questioned the
School Board's method of calculating the number of children per household. Tamarac is
proud of our communities and added that this is your government; the residents and
citizens have the right to petition the government. Tamarac is flourishing and we are proud
of what we have; the City Commission could not have done what it has without you, the
residents and citizens of Tamarac.
Commissioner Flansbaum-Talabisco wished everyone a happy new year, and thanked
Westwood 17 for inviting the Commission to meet at their facility. Commissioner
Flansbaum-Talabisco said it is great to take the meetings on the road and wished there
were as many people attending the meetings at City Hall as there are tonight.
Commissioner Flansbaum-Talabisco said she appreciated being hooked up to the e-mail
system while she was out of the country, and is encouraged that everyone pulled together.
Commissioner Flansbaum-Talabisco said Tamarac children belong in Tamarac schools;
issues were dealt with regarding Challenger Elementary and Millennium Middle School,
and we will do the same for Tamarac Elementary School. Commissioner Flansbaum-
Talabisco said residents and citizens keep the Commission informed.
3. City Attorne : City Attorney Kraft had no report.
4. City Manager: City Manager Miller congratulated Chief Budzinski and Assistant to
the City Manager Phillips for their part in obtaining a grant in the amount of $137,000 from
the U.S. Fire Assistance FEMA, for a training officer, equipment and training material. The

Fire Department reports that the smoke detector program will be held in this community on
February 21 from 8:00 a.m. — 1:00 p.m. The Parks and Recreation Department informs us
that the Discovery newsletter is now on the website. The Twilight Concert Series will kick
off on Friday, February 6th, from 7:00 p.m. — 9:00 p.m., at the Sports Complex.
5. PUBLIC PARTICIPATION: Harriet Cohen, 9360 Fairfax Drive, Tamarac, spoke
about an incident in October when she was unable to get through to 911 and had to wait
an inordinately long time before rescue arrived at her home. Chief Budzinski apologized
for the service and said dispatch goes through Broward County, not through Tamarac.
Upon investigation of the incident he found that the Cohen's first called 911 at
approximately 7:00 p.m. on the day in question. They hung up before the dispatcher
answered the phone. When the dispatcher called their number, as is the normal
procedure when there is a hang up, the line was busy. The Cohen's called again and
again hung up. The same procedure was followed. The Cohen's called BSO and an
officer went to the house and contacted the emergency vehicles. Chief Budzinski stressed
that when anyone calls 911 they should stay on the line until the dispatcher answers. If a
911 call is made by mistake, stay on the line and tell the dispatcher it is an error, or they
will try to call you back.
The following people spoke against bussing: Charmaine Johnson, 8114 NW 74 Terrace,
Tamarac; Shawn Strachan, 8212 NW 74 Terrace, Tamarac; Andrew Flaxman, 9654 NW
76 Street, Tamarac; Jan Corcoran, 8102 NW 75 Avenue, Tamarac; Sheila Kreuter, 8230
NW 68 Terrace, Tamarac; Melissa Keating, 8260 NW 66 Terrace, Tamarac; Teresa
Costanzo, 7921 NW 71 Avenue, Tamarac; and Victor Sciabbica, 8200 NW 68 Avenue,
Tamarac. Vice Mayor Roberts responded that there are no boundary changes being
considered for Millennium Middle School or Taravella High School at this time, but the
boundary changes are considered every year, so parents need to be aware and attend
school meetings, go to the website and attend School Board meetings. Commissioner
Flansbaum-Talabisco said parents need to find out the facts and speak to the School
Board. If they are unable to reach the School Board members they should call the City
Commissioners and they will assist.
Norma Berson, 7207 NW 77 Street, Tamarac, spoke about cars being double parked and
the inability of emergency vehicles to navigate the streets.
Diane Torres, 6904 NW 79 Street, Tamarac, thanked BSO for curtailing speeding on 701h
Street, and complained about barking dogs. Mayor Schreiber replied that Ms. Torres must
call BSO, who will then address the issue with the dog's owner.
Teresa Costanzo, 7921 NW 71 Avenue, Tamarac, complimented BSO on their quick
response and Parks and Recreation for the childrens' programs.
Charmaine Johnson, 8114 NW 74 Terrace, Tamarac, complained about broken
playground equipment in the community, and Vice Mayor Roberts said the equipment Ms.
Johnson referred to is not City equipment, it belongs to the association. Commissioner
Sultanof explained that issues such as boundary changes are why every vote counts.

Tamarac's School Board member is doing a fine job; the City has no control over the
School Board, as it is an autonomous Board. Commissioner Sultanof said parents need to
know everything that is going on with their children. Commissioner Sultanof said Cities are
mandated to have 1.3 acres of parkland for every 1,000 people, and no city grows without
parks, museums and libraries.

6. Vice Mayor Roberts seconded by Commissioner Sultanof moved approval of all
items on the consent agenda. On roll call Vice Mayor Roberts voted "yes", Commissioner
Flansbaum-Talabisco "yes", Mayor Schreiber "yes", and Commissioner Sultanof "yes".
Motion carried.
a. APPROVE the minutes of the December 15, 2003 Special City Commission
meeting.

C. CHANGE ORDER NO. 1 — PSAC PARKING LOT OVERLAY: (TR10313)
Executing Change Order Number 1 to the agreement between the City and Miller
Construction Company for the overlay of the existing parking lot for the Public
Services Complex; authorizing an additional expenditure in an amount not to
exceed $54,000.00.
RESOLUTION NO. R2004-01
d. BID AWARD — PHASE 5A OF THE STREET IMPROVEMENT PROGRAM:
(TR10309) Awarding Bid No. 04-06B for Phase 5A of the Seven Year
Comprehensive Street Improvement Program to Weekley Asphalt Paving, Inc.;
authorizing the appropriate City Officials to execute an agreement with Weekley
Asphalt Paving, Inc. for said work; authorizing an expenditure in an amount not to
exceed $390,013.77 which represents a contract award of $354,557.97 and a
project contingency of $35,455.80; authorizing the City Manager to make necessary
additions, deletions or revisions to the Phase 5A work plan pursuant to Section 6-
156 of the Code of the City of Tamarac.
RESOLUTION NO. R2004-02
e. BID AWARD — GRANT'S PLAZA REPUMP STATION REHABILITATION
PROJECT: (TR10315) Awarding Bid No. 04-02B to, and executing an agreement
between the City of Tamarac and Interstate Engineering Corporation, for an amount
of $292,000.00 for the Grant's Plaza Repump Station Rehabilitation Project;
approving funding for this project from the appropriate Utilities Operational account;
authorizing the appropriate City officials to administer the contract.
RESOLUTION NO. R2004-03
f. AGREEMENT RENEWAL — SUN RECYCLING LLC: (TR10316) Authorizing a
one year renewal of the agreement between the City and Sun Recycling, LLC for
the disposal of City generated construction debris; authorizing the appropriate City
officials to execute an amendment to the agreement which exercises the option to

renew for a third one-year period; authorizing an annual expenditure in an amount
not to exceed $40,000.

g. AMENDMENT TO REQUIRED IMPROVEMENTS AGREEMENT — "SOUTHGATE
AT NOB HILL PLAT": (TR10314) Executing the "Amendment to Required
Improvements Agreement" between Broward County, Prestige Homes of South
Florida, Inc. and the City of Tamarac for required improvements (as described in
Exhibit "B-1 ") relating to "Southgate At Nob Hill Plat" located on the southeast
corner of Nob Hill Road and Southgate Boulevard (Case No. 1-AP-04).
RESOLUTION NO. R2004-05
h. AGREEMENT WITH IAFF, LOCAL 3080 OCTOBER 1, 2003-SEPTEMBER 30,
2006: (TR10319) Approving the agreement with the International Association of
Firefighters, Local 3080; authorizing the appropriate City officials to execute an
agreement with the International Association of Firefighters, Local 3080 for the
period from October 1, 2003 through September 30, 2006; authorizing the
preparation of amendments to Chapter 16 of the City Code for consideration by the
pension board.
RESOLUTION NO. R2004-06
i. CHANGE ORDER NO. 2 — MCNAB ROAD PARK DESIGN/BUILD CONTRACT:
(TR10320) Executing Change Order Number 2 to the McNab Road Park
Design/Build Contract with Recreational Design & Construction, Inc. for the
substitution of St. Augustine sod for Bahia sod within the interior of the asphalt
jogging path area; authorizing an additional expenditure in an amount not to exceed
$17, 742.
RESOLUTION NO. R2004-07
j. DEDICATION OF ADDITIONAL RIGHT-OF-WAY — "SOUTHGATE AT NOB HILL
PLAT": (TR10312) Approving the dedication of an additional four (4') foot right-of-
way (R.O.W.) to accommodate the requirements of a turn lane on Nob Hill Road @
Southgate Boulevard as a condition of a delegation request approval for Broward
County and authorizing the execution of a quit -claim deed from Prestige Homes of
South Florida, Inc. for the Prestige Commons Development located at the southeast
corner of Southgate Boulevard and Nob Hill Road, specifically a portion of Parcel
"A" of the "Southgate at Nob Hill Plat", according to the plat thereof as recorded in
plat book 170, page 41 of the Public Records of Broward County, Florida, being
more particularly described as the northeast corner of said Parcel "A", thence south
01032'13" east, along the east line of said Parcel "A", a distance of 4.00 feet, thence
south 89101'44" west, along a line 4.00 feet south of and parallel with the north line
of said Parcel "A", a distance of 140.43 feet, thence north 43048'49" east, along said
north line of Parcel "A", a distance of 5.64 feet, thence north 89001'44" east, along

28B entitled "Outsourcing Utility Billing Services" authorizing the appropriate City
officials to execute an agreement between the City of Tamarac and Advanced
Xerographics Imaging Systems (AXIS), Inc. for a two-year term commencing on
January 14, 2004

January 1, 2004, and ending on December 31, 2005, at a unit cost of $0.1314 per
bill, with two (2) optional one-year renewals.
RESOLUTION NO. R2004-09
I. AGREEMENT ADDENDUM — PRESTIGE PROPERTY MANAGEMENT AND
MAINTENANCE, INC.: (TR10317) Executing an agreement addendum between
the City of Tamarac and Prestige Property Management and Maintenance, Inc. for
grounds maintenance and landscaping services effective nunc pro tunc to
December 9, 2003 through such time as a new bid may be awarded; authorizing an
expenditure in an amount not to exceed $75,966,25 monthly.

M. PURCHASE AND SALE OF REAL PROPERTY BETWEEN ROBERT L.
CUMMINGS TRUSTEE AND CITY OF TAMARAC: (TR10323) Executing an
agreement for purchase and sale of real property between Robert L. Cummings,
Trustee (seller) and the City of Tamarac (buyer) in the amount of seven hundred
fifty thousand dollars ($750,000.00) for the City to purchase 1.72 acres +/- of vacant
land for open space and recreational purposes.

Procedures," Section 6-153, "Surplus Stock," amending procedures for the disposal of
surplus property to provide for the greater flexibility of the disposal of City surplus stock
property by incorporating competitive sealed bid, established market sales, sales at posted
prices, donation or trade-in as additional methods for disposal of surplus stock; providing

9. AMENDING CHAPTER 10 AND CHAPTER 24 OF THE TAMARAC CODE
REGARDING STREET LIGHTING: (T02031) Motion to adopt Ordinance on second
reading amending Chapter 10, "Land Development Regulations", Article V,
"Improvements", Division 2, "Roads and Public Rights -Of -Way", Section 10-191, "Street
Lighting", (b)(1), "Design and Construction Standards", Amending the identification of
minimum standard for street lighting design and construction within the code to the current
edition of the IESNA Lighting Handbook, published by the Illuminating Engineers Society
of North America; amending Chapter 24, "Zoning ", Article V, "Off -Street Parking and

Court, Tamarac, spoke about problems getting FPL to repair street lights. Commissioner
Sultanof suggested people call the Tamarac Public Works department if they notice street
lights in need of repair, and Public Works will contact FPL. Mr. Koutcher stated with
regard to the previous agenda item, the City Commission may want to look into having the
trash company provide containers for each household, rather than using the plastic bags.
With no one else wishing to speak, Mayor Schreiber closed the public hearing. On roll call
Mayor Schreiber voted "yes", Vice Mayor Roberts "yes", Commissioner Sultanof "yes", and
Commissioner Flansbaum-Talabisco "yes". Motion carried.
ORDINANCE NO. 0-2004-02
10. AMENDING SECTION 2-201 OF THE TAMARAC CODE — ADDING TWO
ALTERNATE MEMBERS TO THE SOCIAL SERVICES BOARD: (T02033) Motion to
adopt Ordinance on second reading amending Article III, "Boards, Committees,
Commissions", Chapter 2 of the Tamarac Code, "Administration", Section 2, Division 7,
"Social Services Board", Section 2-201, "Creation", by adding two alternate members to
the Social Services Board; providing for codification. City Attorney Kraft read Temporary
Ordinance 2033 on second reading by title. Commissioner Sultanof seconded by
Commissioner Flansbaum-Talabisco moved approval. Mayor Schreiber opened the public
hearing. Jay Koutcher, 8173 Royal Palm Court, Tamarac, spoke about holding board and
committee meetings at more convenient times for working people. With no one else
wishing to speak, Mayor Schreiber closed the public hearing. On roll call Commissioner
Flansbaum-Talabisco voted "yes", Mayor Schreiber "yes", Commissioner Sultanof "yes",
and Vice Mayor Roberts "yes". Motion carried.

In this January 2004, throughout all the Januarys to come;
and, indeed, throughout each month of this year,
your Multi -Ethnic Advisory Board will commemorate and celebrate

In the spirit, that is, of the "Universal Declaration on Cultural Diversity"

Broward County is that `WORLD HOUSE'.
The City of Tamarac is one of 30 magnificent rooms in our `WORLD HOUSE',
The `WORLD HOSUE' of which Dr. King
wrote, spoke, dreamed, and, sadly, for which he died --- over 35 years ago!
Thus, in this third millennium, this twenty-first century, this year of 2004 A.D.,
WE --- each citizen of, resident in, guest and visitor to, this city and county ---
have a choice. That choice is either to live in chaos or to live in community.

Subject: Board Rejects Proposal to Move to Morrow
Contrary to what was printed in the paper today, the School Board threw out the
Sunflower/Heathgate proposed boundary move to Morrow Elementary at our workshop yesterday.
The paper got it wrong and is printing a correction.
Tamarac Elementary actually would not be overcrowded were it not for class size reduction.
Tamarac only got 100 additional students this year from last year's count, but due to
class size reduction, Tamarac's capacity decreased by 252 students, the equivalent of 13
classrooms. If we did not have class size reduction, Tamarac would only be 104 students
over capacity. Last year they were onlyl 4 students over capaciiy. Because of class size
reduction, Tamarac is now 356 students over capacity, thus some relief had to be found or
we would not be able to make the class size reduction requirements.
Tamarac is bordered to the south and west by Challenger, which is in the same situation as
Tamarac. To the north is Riverside Elementary. Neither Riverside, nor Tamarac nor
Challenger have any room on their campus to put additional classrooms. Some people think
if the class size reduction was fully funded there would not be any problems, but the fact
is that even fully funding class size reduction will not add space to Tamarac, Challenger,
Riverside, or some other schools' campuses to allow us to put more classrooms at those
schools.
The board threw out the proposed boundary scenario that would have split TAZ 134 and sent
some to Morrow. I argued that neither scenario was good, since it disrupts two
communities where the children have been attending schools since the schools opened.
While the board did not rule out the Tamarac to Riverside to Ramblewood scenario, we are
looking at other options such as trying to find space nearby for portables or modulars to
keep all the children at Tamarac.
I suggested moving the students who are currently being bused to Tamarac, to either
Ramblewood or Morrow, but the board refused to consider that option. We have to have
contiguous boundaries and the children who are bused live far west in the Tamarac
Elementary boundary, and would have to go through other areas to be moved, and the board
refused to do that.
One other option that was suggested was to move the northern part of Heathgate that is the
northern portion of TAZ 134 to Ramblewood Elementary instead of to Morrow. I told the
board that I didn't think that any of you wanted to leave Tamarac at all, but I would
advise you of that suggestion. If any of you would be amenable to being transferred to
Ramblewood Elementary instead of Morrow, let me know and we can consider that. Otherwise,
I told the board to leave your area alone and try to find another solution.. We are
looking to see if we can possibly put portables adjacent to Tamarac but we don't own that
land. Alternatively, we are looking at acquiring land adjacent to Challenger and then we
could move some of the students near Challenger to that school. Either way, it appears
that the proposal to move your area to Morrow is dead.
It troubles me greatly that due to class size reduction mandates we have to disrupt
schools where students have been attending since they opened.
I am still open to any solutions that will move students out of Tamarac, or a way to put
more classrooms on Tamarac's campus so we don't have to move anyone. If anyone has any
suggestions, please email them to me.
