PRESENT: Mayor Joe Schreiber, Vice Mayor Beth Flansbaum-Talabisco, Commissioner Edward C. Portner, Commissioner Marc L. Sultanof, and Commissioner Karen L. Roberts. ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Commissioner Portner led the pledge of allegiance. Roberts by Vice Mayor Beth Flansbaum-Talabisco and members of the City Commission in recognition of extended years of service. Mayor Schreiber said he is proud to receive this award, thanked everyone and added he did a great job making this city what it is today. Mayor Schreiber acknowledged and credited the commissioners for their efforts on behalf of the City of Tamarac and said Tamarac is an exceptionally good city and he hoped it would stay that way and get better. Commissioner Roberts thanked everyone, especially City Manager Miller and staff for all their help over the years. Commissioner Roberts also thanked the residents for their support and help over the past nine years. b. Presentation of a proclamation by Mayor Schreiber proclaiming the week of March 12, 2006 as National Safe Place Week. Fire Chief Budzinski accepted and said safe places throughout Broward County allow us to be a filtering station for youth in need. Fire Chief Budzinski spoke of the Lipman Center, a volunteer center from Broward County, who dispatch assistance within 15 minutes of being called from a safe place. REPORTS 2. City Commission: Mayor Schreiber said this is his last official meeting for the City as Mayor and he is proud to have been Mayor of Tamarac. Mayor Schreiber said he did a great job with the assistance of the commission. The city has improved immensely and has a great reputation throughout the state. The key is to help people in the city, as they own the city and deserve the attention of the elected officials. Commissioner Portner spoke of his trip to Washington with City Manager Miller to visit with our representatives, and said programs for which Tamarac would like funding were March 08, 2006 Page 1 of 7 presented to our representatives. Commissioner Portner commended City Manager Miller on a great job presenting the City of Tamarac to our representatives and Commissioner Portner said he believes we will get federal funding for at least two of our programs. Commissioner Portner added Tamarac is a great city and our representation in Washington, D.C. will help us to expand and grow. Commissioner Roberts said this is her last commission meeting as commissioner, and nine years have gone by very quickly. Commissioner Roberts thanked everyone for their help and support and introduced Harry Dressler, the Commissioner -Elect for District 4. Commissioner Sultanof had no report. Vice Mayor Flansbaum-Talabisco said she has been commissioner for three years and this is her last meeting as commissioner from District 2. Vice Mayor Flansbaum- Talabisco said it has been an honor and privilege to serve with her colleagues and she is proud of all the accomplishments over the past three years. Vice Mayor Flansbaum- Talabisco thanked staff for all their help over the past three years and thanked the residents for their support. 3. City Attorney: City Attorney Goren informed the Mayor and City Commission and public that a lawsuit was filed in Tallahassee by the law firm of Greenberg Traurig on behalf of the Florida Home Builders' Association. The suit challenges affordable housing includable zoning and this lawsuit may have a great impact statewide as it alleges the taking of property for this purpose is unconstitutional. The lawsuit is worth watching as it may impact our comprehensive plan. City Attorney Goren thanked those who are leaving the commission for having him as the city's attorney and said it has been an honor and privilege working with this commission. City Attorney Goren wished those stepping down good luck, health and happiness and added he looks forward to a long term relationship with their successors. City Attorney Goren added he is available should any of the departing commissioners need his assistance. 4. City Manager: City Manager Miller thanked Mayor Schreiber, Commissioner Roberts and Vice Mayor Flansbaum-Talabisco for their service and dedication to the City of Tamarac and said Tamarac is a better city because of their efforts. City Manager Miller said both he and his staff wish them God speed and good luck. Community Development reports the State has allotted an additional $66,000 for disaster relief funds for those affected by Hurricane Wilma who have already put in applications for repairs. The City completed its donation of eight surplus vehicles to Pascagoula, Mississippi and City Manager Miller thanked the Mayor and City Commission for their approval of this donation. City Manager Miller congratulated Assistant City Clerk Schneider on receiving his Certified Municipal Clerk (CMC) designation, and read into the record a letter from IIMC confirming the certification. (Said letter is attached hereto and incorporated herein as part of these minutes.) 1 March 08, 2006 Page 2 of 7 5. PUBLIC PARTICIPATION: Theresa Hobmeier, 1070 NW 71 Place, Tamarac, FL congratulated Mayor Schreiber for his hard work on the commission and for doing a great job for the residents. Ms. Hobmeier thanked both Commissioner Roberts and Vice Mayor Flansbaum-Talabisco for a wonderful job as members of the commission. Ms. Hobmeier said she has been in contact with Vince Bacardi regarding coordination of lights in Tamarac and also Betty Smith, 954-847-2600, regarding downed signs along McNab Road and asked the commission to follow up on these repairs. CONSENT AGENDA 6. Commissioner Portner seconded by Vice Mayor Flansbaum-Talabisco moved approval of all items on the consent agenda. On roll call Commissioner Sultanof voted "yes", Vice Mayor Flansbaum-Talabisco "yes", Mayor Schreiber 'yes", Commissioner Roberts "yes", and Commissioner Portner "yes". Motion carried. a. APPROVE the minutes of the February 22, 2006 Special City Commission meeting. APPROVED b. APPROVE the minutes of the February 22, 2006 Regular City Commission meeting. APPROVED C. TASK AUTHORIZATION NO. 06-03E — MATHEWS CONSULTING, INC. — 12- INCH WASTEWATER FORCE MAIN ALONG NW 82NO STREET FROM NW 75T" AVENUE TO NUTMEG COURT: (TR10902) Executing Task Authorization No. 06-03E with Mathews Consulting, Inc., to provide professional services for the design, permitting, and bidding of the 12-inch wastewater force main along NW 82"d Street from NW 75t" Avenue to Nutmeg Court, in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2001-185, for an amount not to exceed $50,000.00; approving funding from the appropriate budgeted Utilities Operational and CIAC accounts; authorizing the appropriate City officials to administer the contract. RESOLUTION NO.2006-33 d. GRANT APPLICATION — RECREATIONAL TRAILS PROGRAM GRANT FUNDS FOR SOUTHGATE LINEAR PARK DEVELOPMENT PROJECT: (TR10910) Authorizing submission of an application to the Florida Department of Environmental Protection for Recreational Trails Program Grant Funds for the Southgate Linear Park Development Project in the amount of $200,000 providing for a 50:50 cash match of $200,000 in City funds for a total project cost of $400,000 in the event of approval of the application; providing for acceptance of the award and executing of documents upon approval. RESOLUTION NO.2006-34 e. AUTOMATIC AID AGREEMENT WITH CITY OF LAUDERHILL: (TR10909) Executing an agreement between the City of Tamarac and the City of Lauderhill for the provision of cooperative emergency medical and fire protection services through Automatic Aid. RESOLUTION NO.2006-35 March 08, 2006 Page 3 of 7 f. REPAIR AND REPLACEMENT OF HURRICANE DAMAGED STREET LIGHTS: (TR10905) Approving the repair and replacement of hurricane damaged street lights; utilizing the School Board of Broward County Bid Number 24-052R; previously awarded to Florida Electric Contracting Service, Inc. for said work in an amount not to exceed $56,400.00. RESOLUTION NO.2006-36 g. INTERLOCAL AGREEMENT — PROCESSING OF MUNICIPAL PARKING TICKETS: (TR10915) Approving an Interlocal Agreement with Howard C. Forman, Clerk of Court for the Seventeenth Judicial Circuit of the State of Florida to provide for the processing of municipal parking tickets and referral of contested citations to hearing officers to conduct hearings; authorizing the appropriate City officials to execute the necessary documents to effectuate this resolution. REVISED DEVELOPMENT ORDER AND MAJOR REVISED SITE PLAN — CITY FURNITURE: (TR10913) Motion to approve Resolution issuing Revised Development Order No. 334.1 and granting Major Revised Site Plan approval to City Furniture for an approximate 6.47 acre park at the southwest corner of McNab Road and Hiatus Road, specifically a portion of Tract 16, Section 7, Township 49 South, Range 41 East of the "Florida Fruit Lands Company's Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 1, Page 102 of the Public Records of Broward County, Florida (Case No. 27-SP-05); providing for conditions of approval. Mayor Schreiber asked if both items could be heard together and City Attorney Goren explained since Items No. 7 and 8 are companion items, they could be heard together with separate motions on each item. City Attorney Goren read Temporary Resolution 10912 by title. Commissioner Portner seconded by Vice Mayor Flansbaum-Talabisco moved approval. City Attorney Goren read Temporary Resolution 10913 by title. Commissioner Portner seconded by Vice Mayor Flansbaum-Talabisco moved approval. City Attorney Goren explained the quasi- judicial procedures and Howard Nelson, Esq., 1 East Broward Boulevard, Ft. Lauderdale, FL waived his quasi-judicial rights for Items 7 and 8 on behalf of the petitioner, City Furniture. Director of Community Development King gave a presentation and said City Furniture wants to have a public/private partnership with the City and create a campus feel to the property. There will be more park amenities and the park will have a linear shape and a buffer along McNab Road between City Furniture and the Isles of Tamarac residences. Two public meetings were held with residents and there was no opposition to the proposal. Commissioner Sultanof confirmed City Furniture would move and relocate all amenities for the park as well as pave the parking lot, all at City Furniture's expense. The increased park will be 9.96 acres and City Furniture will provide landscaping to create the buffer. Upon approval of the plat, City Furniture agreed that ingress/egress from their new development would be onto Hiatus Road, not McNab Road. Vice Mayor Flansbaum-Talabisco questioned interruption of services to people who use the park and Director of Community Development King said as the facilities are relocated amenities will be taken apart and replaced and there will be as little disruption as possible until we can open the entire park. Vice Mayor Flansbaum- Talabisco noted there are potential plans for expansion along Hiatus Road and asked City Furniture to consider public art along the road. Mr. Nelson said City Furniture is happy to grow with the City of Tamarac and delighted to discuss public art with the City. Vice Mayor Flansbaum-Talabisco asked if the proposed day care center is only for City Furniture employees or would it be open to city residents as well and Mr. Nelson said it will be open to city residents as well as City Furniture staff; however, it is primarily designed for City Furniture. Commissioner Sultanof asked if the city would be held harmless with regard to the day care center and Mr. Nelson replied the day care center would remain on City Furniture property. Commissioner Roberts confirmed the playground would contain universal amenities as it was originally built and confirmed the local traffic impact fees are not due at this time but would be at the time of the site plan. Commissioner Portner said this project proves Tamarac does extremely well and thanked City Furniture for being a good city partner. City Manager Miller congratulated Messrs. Koenig and Hasslinger on bringing this complicated arrangement to fruition, and added this project accommodates the desires of everybody. Mr. Nelson replied City Furniture could not imagine wanting to grow with another city; Tamarac's staff has been great. Mayor Schreiber opened the public hearing and Patti Lynn, 6410 NW 58 Street, Tamarac questioned the difference between light industrial and industrial. Director of Community Development King explained for Tamarac there is no difference. Ms. Lynn said she would like to see a jogging trail at the park with step offs for heart healthy exercise. Bernie Herman, 7877 Granville Drive questioned the buffer between the park and the buildings and asked if there would be a fence. Director of Community Development King explained there would be 100+ ft. wide wetland area with no access from the park to City Furniture's property, with a live barrier. Theresa Hobmeier, 1070 NW 71 Place, Tamarac, FL questioned the location of the entrance to City Furniture and expressed concern about traffic. Director of Community Development King said there would be one main entrance to City Furniture and a northern entrance on Hiatus Road for the day care facility when it is developed. Traffic was discussed at the public meetings and Mr. Koenig indicated at that time that truck drivers would be instructed to go south on Hiatus Road to Commercial Boulevard, and the truck drivers would be reminded of this periodically. Burt Schneider, 8016 NW 72 Street, Tamarac, FL said the City Furniture complex is a wonderful accomplishment of the City of Tamarac, bringing industry, job opportunities, and green areas for residents. Mr. Schneider thanked everyone on the dais for a wonderful job and for their hard work. Mr. Schneider added whoever fills Mayor Schreiber's shoes has a big job ahead of them and thanked the Mayor and City Commission for their work. Herb Hayes, Westwood 20, spoke in favor of the project. With no one else wishing to speak, Mayor Schreiber closed the public hearing. Commissioner Portner said Tamarac does not allow indiscriminate building. Tamarac has a tough process to get through and if developers do as well as City Furniture has done, they will be more than welcome in Tamarac. R2006-39 END OF QUASI-JUDICIAL HEARINGS END OF PUBLIC HEARINGS Naomi Nigel, 10902 NW 83 Street spoke of safety issues with regard to the roundabout being constructed at Southgate Boulevard. Jay Benenson, 10100 NW 83 Street spoke of the effect the roundabout would have on private property. Commissioner Sultanof said the issue concerning the driveway of one of the homeowners has already been resolved. Commissioner Roberts said she spoke with Parks and Recreation Director Warner regarding the residents' concerns about the location of the roundabout. City Manager Miller said he would look into the matter. Commissioner Sultanof added Public Works Director Strain is working with the county so some adjustments should be made for the roundabout and curbing.
