REGULAR CITY COMMISSION MEETING
CITY HALL CHAMBERS
WEDNESDAY APRIL 9, 2008
CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City
Commission to order at 7:00 P.M. on Wednesday, April 9, 2008 in Chambers at
Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Marc L. Sultanof,
Commissioner Edward C. Portner, Commissioner Patte Atkins -Grad, and Commissioner
Harry Dressler.
ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr,
and City Clerk Marion Swenson.
Mayor Flansbaum-Talabisco led the pledge of allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Proclaiming the week of April 13-19, 2008 as "Paralyzed Veterans of America
Awareness Week". Vice Mayor Sultanof asked for a moment of silence in honor of
Martin Sucoff, an ex -Marine and Chairperson of the Veterans' Affairs Committee, who
passed away Friday.
b. Proclaiming the month of April as "Jazz Appreciation Month".
C. Recognizing April as "Fair Housing Month". Gail Williams accepted and thanked
Tamarac for a wonderful partnership.
d. Proclaiming April 22, 2008 as "Earth Day" in the City of Tamarac. Director of
Parks and Recreation Warner accepted and spoke of an upcoming activity with children
from Challenger Elementary School that will deal with education, water conservation,
and the planting of a tree.
REPORTS
2. Cit Commission: Mayor Flansbaum-Talabisco acknowledged Ralph Baer who
was in the audience, and wished his wife well. Mayor Flansbaum-Talabisco asked
everyone to write or call Senator Nelson's office in support of his concerns with FEMA's
lack of progress.
Vice Mayor Sultanof said we are doing the best we can for our residents and we can not
do this without our great staff.
Commissioner Portner said Tamarac has been lucky in its dealings with FEMA; we have
recouped almost all the money we spent on the hurricanes. Residents need to continue
writing to their representatives to move FEMA along. Mayor Flansbaum-Talabisco

added that it appears the Bush Administration is trying to figure out how to deal with
possible formaldehyde contamination in the trailers used along the Gulf Coast.
Commissioner Atkins -Grad said the past few weeks have been very gratifying. A
project near and dear to her heart has come to fruition; a University of Miami Medical
School program used to train army surgical teams prior to deployment is now being
used to train firefighters in the event of a natural disaster or emergency. Additionally,
Commissioner Atkins -Grad would like to see this extend to BSO personnel and she has
been in contact with the Broward Sheriff who is receptive to sending BSO personnel for
training. Commissioner Atkins -Grad reported that she and Commissioner Dressler will
host a combined meeting for Districts 2 and 4, to which all presidents of the Homeowner
Associations and Condominium Associations will be invited. The meeting will be open
to the public. A speaker from the University of Miami will outline the program the
firefighters went through. Representatives of the County will also be invited to speak
about the Broward County Hurricane Plan. The meeting is scheduled to begin at 9:30
a.m. on May 215t
Commissioner Dressler represented the City of Tamarac at the Broward League of
Cities as an alternate delegate, and reported on an item on the Broward League of
Cities' agenda pertaining to a cost cutting plan by Broward County for emergency
services. Commissioner Dressler said not having professional people manning the
emergency services is a great mistake. Tomorrow morning the MPO will discuss a
funding source for Tri-rail. Tamarac's position is "yes" to dedicating the $2.00 tax on
automobile licenses to Tri-rail.
Mayor Flansbaum-Talabisco said the Charter Review Commission is meeting at the
County today, which is where City Attorney Goren is tonight. One of the issues
discussed is the dedication of another oversight committee with regard to transportation.
Commissioner Portner said he sits on the State Road 7/441 Collaborative and he has
asked the County Commissioners on more than one occasion to provide for a dedicated
revenue stream so we can build the 441 light rail. It is difficult to get funding for
transportation; if we want services, we have to pay for them, through taxes.
3. City Attorney: Assistant City Attorney Klahr had no report.
4. City Manager: City Manager Miller reported the Sterling Examiners have been
here since Sunday morning reviewing our Challenge Application, which is Phase II of
the Sterling process. They have been interviewing the executive team and 200 staff
throughout the organization to verify that what we said in the Challenge Application is
verifiable. We will receive a verbal report Friday morning. City Manager Miller showed
a short film regarding a recent water break in Tamarac, and said the film is indicative of
our customer service, which is second to none. The City of Tamarac has been selected
by the Broward County Board of County Commissioners to receive the Emerald Award
Trophy for 2007. The award will be made on April 29th, followed by a reception. Formal
invitations will be forthcoming. The award recognizes the Mayor and City Commission
and staff for outstanding water conservation programs, high quality water, and our water
treatment plant. This is a very competitive award. Additionally, Tamarac ranked third

out of 20 applicants for the MPO's grant application for bikeways; the City is slated to
receive $750,000. The presentation will be made at the MPO meeting on Friday.
Tamarac has placed a green box on our website (green initiative) with some great
information. There was an automobile accident in Tamarac last week, and BSO
reported the gentleman behind the wheel suffered a heart attack. A BSO officer pulled
the gentleman out of the car and started CPR as well as using an AED, and the victim
was brought back to life. Parks and Recreation reports 100 people attended the Dive -In
Movie and vendor spaces were sold out at the Tamarac Community Center garage
sale. There will be a classical concert at the Tamarac Community Center on April 25 at
7:00 p.m. The cost is $5.00 and refreshments will be served. Vice Mayor Sultanof will
preside at the annual Veterans Assembly on Wednesday evening, April 30, from 6:00
p.m. — 8:00 p.m. at the Tamarac Community Center.
PUBLIC PARTICIPATION
5. Ben Roberts, 5002 NW 58 Street thanked Commissioner Dressler for the way he
expressed himself at Monday's workshop with regard to individuals who are trying to
undermine our cities. Mr. Roberts also commended Community Development Director
Bramley on her work and said she is the right person for the job.
Barbara McNeil, 6961 NW 82 Court spoke in favor of holding evening workshop
meetings once each month. Ms. McNeil also spoke in favor of video casting the
workshop meetings.

6. Vice Mayor Sultanof seconded by Commissioner Atkins -Grad moved approval of
all items on the consent agenda. On roll call Vice Mayor Sultanof voted "yes",
Commissioner Portner "yes", Commissioner Dressler "yes", Commissioner Atkins -Grad
"yes", and Mayor Flansbaum-Talabisco "yes". Motion carried.
a. APPROVE the minutes of the March 26, 2008 Regular City Commission
meeting.

b. REVISED PERMIT FEE SCHEDULE: (TR11231) Increasing the City's Building
Fees pursuant to Exhibit "C" attached hereto and incorporated herein; authorizing the
appropriate City officials to take any and all steps necessary to increase and restructure
the Building Department Permit Fees.

C. DONATION OF SURPLUS HEATER MEALS MRES TO THE SUNRISE
SENIOR CENTER: (TR11373) Donating surplus "Heater Meal Two, Meals -Ready -To -
Eat" (MRE) to the Aging and Disability Resource Center in Sunrise Florida, and the
disposal of those packages which have expired.

f. AGREEMENT FOR ANNUAL MAINTENANCE OF THE MARC UNIT:
(TR11372) Executing a Sub -Recipient Agreement for 2006-2007 State Homeland
Security Grant Program (SHSGP), expenditure of Local Government Unit Funding for
Sustainment Funds for an Annual Maintenance Contract for Mutual Aid Radio
Communications (MARC) Unit, with the State of Florida, Department of Financial
Services Division of State Fire Marshal.

g. AQUATIC CENTER HVAC INSTALLATION: (TR11378) Awarding Bid No. 08-
11 B and executing an Agreement with HYVAC, Inc. for the installation of an additional
HVAC Unit at the Caporella Aquatic Center 9300 NW 58 Street, in an amount not to
exceed $31,650.00 from the appropriate accounts; authorizing budget amendments as
needed for proper accounting purposes.

7. COMMERCIAL VEHICLE CITATION ORDINANCE: (T02159) Motion to adopt
Ordinance on first reading amending Chapter 14 entitled, "Motor Vehicle and Traffic",
by specifically amending Section 14-84 entitled, "Maximum Weights"; providing for
width, length and height regulations in accordance with Chapter 316, Florida Statutes,
for commercial motor vehicles; providing for codification. Assistant City Attorney Klahr
read Temporary Ordinance 2159 on first reading by title. Commissioner Atkins -Grad
seconded by Vice Mayor Sultanof moved adoption. On roll call Commissioner Portner
voted "yes", Commissioner Dressler "yes", Commissioner Atkins -Grad "yes", Vice Mayor
Sultanof "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried.

8. FEE ADJUSTMENTS: (T02160) Motion to adopt Ordinance on first reading
amending Chapter 5, entitled, "Buildings and Building Regulations", Article I, "In
General', Section 5-1, entitled, "Building Department Permit Fees", adding the
requirement for automatic annual adjustments to the Building Department Permit Fee
Schedule; providing for codification. Assistant City Attorney Klahr read Temporary
Ordinance 2160 on first reading by title. Vice Mayor Sultanof seconded by
Commissioner Atkins -Grad moved approval. Commissioner Dressler seconded by

Commissioner Atkins -Grad moved to amend TO2160 to include language requiring the
City Manager or his designee to review, every two years, inflation and any increases in
labor or material costs that would reflect on these fees. On the amendment,
Commissioner Atkins -Grad voted "yes", Vice Mayor Sultanof "yes", Commissioner
Portner "yes", Commissioner Dressler "yes", and Mayor Flansbaum-Talabisco "yes".
Motion carried. Commissioner Dressler seconded by Commissioner Atkins -Grad
moved adoption of Temporary Ordinance 2160 on first reading, as amended. On roll
call Vice Mayor Sultanof voted "yes", Commissioner Portner "yes", Commissioner
Dressler "yes", Commissioner Atkins -Grad "yes", and Mayor Flansbaum-Talabisco
"yes". Motion carried.

Commissioner Portner said he is pleased to see that people realize the work that goes
into preparing for commission meetings. The workshops are where all the work is done.
Vice Mayor Sultanof and Commissioner Dressler agreed with Commissioner Portner's
comments. Mayor Flansbaum-Talabisco added I.T. Director Sucuoglu is looking at the
numbers and the matter of webcasting will be discussed at a future meeting.
There being no further business to come before the Mayor and City Commission, Mayor
Flansbaum-Talabisco adjourned the meeting of the City Commission at 8:00 p.m.
