HomeMy WebLinkAbout2007-04-11 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING LAKES OF CARRIAGE HILLS CLUBHOUSE WEDNESDAY APRIL 11, 2007 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 7:00 pm on Wednesday, April 11, 2007 at Lakes Of Carriage Hills Clubhouse, 4985 Sabal Palm Boulevard, Tamarac, FL. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Marc L. Sultanof, Commissioner Edward C. Portner, Commissioner Patte Atkins -Grad, and Commissioner Harry Dressler. ALSO PRESENT: Deputy City Manager Michael C. Cernech, City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Commissioner Harry Dressler led the pledge of allegiance. INTRODUCTION 1. PROCLAMATIONS AND PRESENTATIONS: a. Mayor Flansbaum-Talabisco moved out of the regular order of business to take up item 1(b), as Robin Bartleman, School Board Member At -Large had not yet arrived. b. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming May 20-26, 2007 as "National Public Works Week". (Requested by Public Works Director Jack Strain) Public Works Director Strain accepted and thanked the Mayor and City Commission for the proclamation. Mayor Flansbaum-Talabisco on behalf of the Commission, thanked Public Works Director Strain and staff for all they do for the City. RFPnRTR 2. City Commission: Mayor Flansbaum-Talabisco thanked Commissioner Portner for suggesting we bring the first road show to Lakes of Carriage Hills. This Commission started working together one year ago and it has been a phenomenal year and wonderful things have happened in Tamarac. This Commission respects each other and works well together. We all care about Tamarac and Mayor Flansbaum-Talabisco said she could not be more grateful or appreciative working with this group of people. Mayor Flansbaum-Talabisco announced the City Manager is in Orlando today as he has been appointed to the Florida League of City Managers. There are many challenges coming out of Tallahassee and an article in today's newspaper mentioned Tamarac and Financial Services Director Chapman. As of today, Tamarac's hit due to tax reform is over $7 million, and there is talk of a special session in Tallahassee. Tamarac won the Government Leadership Award for the Arts; this past four years the Commission stepped up visibility in bringing art programs to Tamarac. We will receive the award this May. Saturday there will be an ArtServe program at the Tamarac Community Center beginning at 4:00 p.m. consisting of two hours of dance presented by TranZenDance, April 11, 2007 Page 1 of 9 which will consist of Flamenco, Tango, Mid Eastern Dance, Modern Jazz, and Contemporary Dance. The program is free to the public. Commissioner Portner said seven years ago he proposed taking the Commission meetings on the road and he was opposed at that time. Three years ago the Commission agreed to taking government to the people. It is a pleasure to see so many people at this meeting. With regard to the show on Saturday evening at the Tamarac Community Center, since many people do not drive, if the residents contact the President of Lakes of Carriage Hills, perhaps arrangements can be made for bus transportation to take residents from Lakes of Carriage Hills to Tamarac Community Center and back. Commissioner Atkins -Grad said it is a pleasure to be here and see so many people in the audience. Commissioner Atkins -Grad said the Twilight Concert will be held on Friday night, from 7:00 p.m. — 9:00 p.m. featuring a Blues Band. The concert will be at the Sports Complex and there will be free food and a bounce house. Vice Mayor Sultanof said he is delighted to see this many people in the audience, and it is a wonderful thing to bring government to the people. Tamarac is the only City in Broward County that does this for its residents. Tamarac is also the only City in Broward County that hosts a Veterans Assembly, which will be held on April 25t". Vice Mayor Sultanof said 1,500 veterans are dying each day. Tamarac is the fastest growing City in Broward County and it is important that people know about our Social Services Division, which provides transportation to medical appointments. Vice Mayor Sultanof said he is liaison to the Social Services Board. Vice Mayor Sultanof spoke of the Aquatic Center and said many people, both young and old, do not know how to swim; lessons are available at the Aquatic Center. The land was donated to the City by the Caporella family. Vice Mayor Sultanof said it is important to recognize who you are; this City belongs to the residents and local government is here for you. Commissioner Dressler thanked the Lakes of Carriage Hills for their hospitality and added there is a value taking the Commission meeting into the community and sharing ourselves with the residents. It gives the residents a better feel for what the Commission does. This past year has been an incredible learning experience, and the consent agenda reflects the many different areas worked on by staff; staff carries out the Mayor and City Commission's policies. Commissioner Dressler spoke of the item to be added to the consent agenda as 6(I) supporting the House Bill sponsored by Representative Ad Porth and Senator Jeremy Ring, prohibiting investments in retirement plans with any company with ties to terrorist states. Commissioner Dressler said Representative Porth sends his regards and thanks Tamarac for supporting the Bill. Mayor Flansbaum-Talabisco said the Mayor and City Commission have wonderful spouses, who support our work for Tamarac. Mayor Flansbaum-Talabisco acknowledged Helen Portner and Jack Talabisco, who were in the audience. Mayor Flansbaum-Talabisco acknowledged City Attorney Goren who has represented Tamarac very well. April 11, 2007 Page 2 of 9 3. City Attorne City Attorney Goren reported on HB825, which if adopted will liberalize to some extent the circumstances for shade sessions. City Attorney Goren discussed the pending annexation and spoke of the mail ballot election for Boniello Gardens and the Bill that is on a parallel path in Tallahassee. There will be a public hearing on Saturday, which City Attorney Goren and Economic Development Officer Berns will attend. If the Bill passes in Tallahassee, annexation for the commercial areas will take place in September 2008. City Attorney Goren discussed the Red Light Camera Bill which is pending this session, which, if passed, would do what the Mayor and City Commission has been asking for to allow local government to decide to adopt an ordinance embracing red light cameras. Commissioner Portner said he is against this Bill because if someone drives another person's car and goes through a red light, the owner of the car will be ticketed. Commissioner Portner said he would support the Bill if there were a way to identify the driver of the vehicle and ticket the offender. City Attorney Goren said these concerns have been addressed in the Bill. Mayor Flansbaum-Talabisco acknowledged Ralph Baer, representing Senator Jeremy Ring. 4. City Manager: Deputy City Manager Cernech said Parks and Recreation reports summer camp packets are available at Tamarac Community Center and the Recreation Center; camp is open to children ages 5 — 12 and sessions will be held June 4th — August 10th. Peter Cottontail Wet and Wild Egg Hunt was held at the Aquatic Center on March 315t — it was a sold out event! Spring Fest was held on April 7th with 450 in attendance. There was an egg hunt, games and snacks. The Tamarac Twilight Concert Series continues on April 13th at the Tamarac Sports Complex from 7:00 p.m. — 9:00 p.m. ArtServe will sponsor a free dance show on April 14th at the Tamarac Community Center. Seating is limited. There will be a Teen Summit for ages 12 — 17 on April 215t from 9:00 a.m. — 3:00 p.m. Mayor Flansbaum-Talabisco moved out of the order of items on the agenda to return to Item 1(a), as Ms. Bartleman arrived. Ms. Bartleman said she is School Board Member at Large and thanked the Mayor and City Commission for their concerns about schools and education. Ms. Bartleman said she can be reached via e-mail rbartleman or7browardschaals.com and gave her home phone number 954-389-0825 and cell phone number 954-242-7212. Ms. Bartleman said this is a great Commission. Ms. Bartleman said Broward has the fourth largest school district in the country, with a $4 billion budget and they are concerned about what is happening in Tallahassee. We need to strike a balance but not at the cost of services or our children. Ms. Bartleman said the School Board would soon decide when to begin the search for a new Superintendent. Mayor Flansbaum-Talabisco said Tamarac staff began setting up for tonight's meeting at 3:00 p.m. today and thanked Public Works, I.T. and the City Clerk's office for their efforts. Mayor Flansbaum-Talabisco asked anyone who wished to speak during public participation to please come to the microphone. April 11, 2007 Page 3 of 9 PUBLIC PARTICIPATION 5. Barry Koltun, 5713 NW 67 Terrace spoke about utility charges for snowbirds. Mr. Koltun distributed a debt service coverage ratio calculation for fiscal year 2007 and a copy of his water bill (copies are attached hereto and incorporated as part of these minutes). Claudia Krysiak, 4965 E Sabal Palm #212 asked if Tamarac signed the U.S. Mayors Climate Protection Agreement and asked what Tamarac is doing to help with environmental issues. Mayor Flansbaum-Talabisco said the agreement was signed by Former Mayor Schreiber with the consent of the Commission and it was signed again this year with support of the Commission. Mayor Flansbaum-Talabisco said she belongs to the US Conference of Mayors and last August attended a summit aimed toward climate and greening. There will be a special workshop to discuss mechanisms appropriate for Tamarac with regard to these areas. Tamarac has been touted in the newspaper for water conservation efforts. At our last workshop we were informed by Director of Utilities Gagnon that Tamarac has reduced its water consumption by 20% over the last year. Additionally, we have sign boards on Commercial Boulevard asking people to conserve water. Commissioner Atkins -Grad said her first initiative as an elected official was to get people to stop wasting water, especially in restaurants, where water was placed on tables whether the customer wanted it or not. Mayor Flansbaum- Talabisco said other cities have followed Tamarac's lead in this area. Vice Mayor Sultanof said if residents call the Utilities Department, they will send someone out to show residents how to handle water conservation in their homes. We are doing a great job handling water in Tamarac and we have the best water in five states. Commissioner Portner said he has requested that the cleaning crew use green products when cleaning City Hall. Commissioner Portner suggested when eating out, people question whether Trans Fats are used in cooking. Mayor Flansbaum-Talabisco said in addition to cleaning products we will also be using stationery and paper goods made from recycled materials. Commissioner Dressler said there are a long list of approaches being taken by City staff and the Mayor and City Commission. We supported legislation from U.S. Senators Nelson and Martinez regarding fixing the dike at Lake Okeechobee. A lot of time and energy has gone into planning for five, 10, and 20 years out making sure our infrastructure is in place for drinkable water, and making sure we have the ability to access water in the Floridian Aquifer. Water in the Floridian Aquifer is not as clean as that of the Biscayne Aquifer, and it will need to be treated. We will try to encourage greening in new construction. Commissioner Dressler spoke of the LEEDS Program, wherein buildings would meet environmental standards and be ecologically sound and safe. Commissioner Dressler said Tamarac is dedicated to the environment. CONSENT AGENDA 6. Commissioner Dressler seconded by Vice Mayor Sultanof moved the addition of Temporary Resolution 11172 as item 6(I) to the consent agenda. SUPPORTING HOUSE BILL 703JHB 7031 Supporting House Bill 703 (HB 703) that prohibits the State Board of Administration from making investments for the Florida Retirement System (FRS) Pension Plan and FRS Investment Plan in companies with ties to or engaged in business with known state sponsors of terror as designated by the US April 11, 2007 Page 4 of 9 Secretary of State; directing the City Clerk to provide a copy to the Broward County Legislative Delegation, the mayor of each municipality in Broward County, the Broward League of Cities, the Florida League of Cities, and each member of the Broward County Board of County Commissioners, and all other interested parties. On roll call Vice Mayor Sultanof voted "yes", Commissioner Atkins -Grad "yes", Mayor Flansbaum- Talabisco "yes", Commissioner Dressler "yes", and Commissioner Portner "yes". Motion carried. Vice Mayor Sultanof seconded by Commissioner Atkins -Grad moved approval of all items on the consent agenda. City Attorney Goren read Temporary Resolution 11172 by title. Commissioner Portner asked to pull Item 6(g) for discussion. Assistant City Manager Phillips gave a presentation. Commissioner Portner urged everyone to call Representative Porth and Senator Ring to oppose the Bills. Commissioner Dressler thanked Commissioner Portner for pulling the item from the consent agenda for discussion and said these types of Bills allow corporations to provide services to rich people and not to poor people. It creates a have/have not society, which is not the democratic way. Commissioner Dressler said he is opposed to any Bill that demeans the access for middle class, fixed income, or low income people. Commissioner Dressler said Senator Ring can be reached at 850-487-5094, in Tallahassee. APPROVE the minutes of the March 28, 2007 Regular City Commission meeting. APPROVED b. NW 941h AVENUE 6-INCH WASTEWATER FORCE MAIN PROJECT: (TR11155) Awarding Bid No. 07-18B to Development and Communication Group of Florida, Inc., and executing an agreement between the City of Tamarac and Development and Communication Group of Florida, Inc., for an amount of $136,485.00 for the NW 94th Avenue 6-inch wastewater force main project; approving funding for this project from the appropriate Utilities Operational CIAC and Operational Accounts; authorizing the appropriate City officials to administer the contract. RESOLUTION NO. R2007-35 C. SECOND AMENDMENT TO SITE LEASE AGREEMENT — TAMARAC SPORTS COMPLEX: (TR11156) Executing Second Amendment to the Communications Site Lease Agreement with Nextel Communications to change the location and the dimensions of the additional space to twelve foot (12) by twenty-one foot (21') that was allocated in the First Amendment for the 60kw propane generator installation at the cell tower site located at the Sports Complex. RESOLUTION NO. R2007-36 d. TEMPORARY STORMWATER WORKERS — DEANNA ENTERPRISES INC: (TR11158) Authorizing an expenditure not to exceed $44,000 for temporary workers utilizing the Southeast Florida Governmental Purchasing Cooperative Agreement with Deanna Enterprises, Inc.; authorizing budget amendments for proper accounting purposes. RESOLUTION NO. R2007-37 April 11, 2007 Page 5 of 9 e. INVESTMENT ADVISORY AGREEMENT RENEWAL: (TR11159) Exercising the fourth renewal option to the existing Agreement between the City of Tamarac and Davidson Fixed Income Management, (formerly Kirkpatrick Pettis Capital Management), for investment advisory services for a one-year period effective April 14, 2007, through April 14, 2008. RESOLUTION NO. R2007-38 f. AWARDING BID #07-16B AND EXECUTING AGREEMENT FOR 2007 FOURTH OF JULY FIREWORKS CELEBRATION: (TR11160) Awarding Bid #07-16B, entitled "Aerial Fireworks Display", and executing an agreement with Melrose South Pyrotechnics, Inc., for an amount not to exceed $20,000 for the 2007 Fourth of July fireworks celebration; approving funding in the amount of $20,000 from the appropriate Parks and Recreation account. RESOLUTION NO. R2007-39 g. OPPOSING HOUSE BILL 529 — "CONSUMER CHOICE ACT OF 2007" AND HOUSE BILL 0855 AND SENATE BILL 1772 — "CONSUMER BROADBAND CHOICE ACT OF 2007": (TR11157) Expressing the City's opposition to House Bill 529 known as the "Consumer Choice Act of 2007" (HB 529) and opposition to House Bill 0855 and the companion Senate Bill 1772, together known as the "Consumer Broadband Choice Act of 2007," urging the Florida legislative representatives to refrain from any form of support for these bills and to vote in opposition to them; requesting that Governor Crist advise the House and Senate leadership that he does not support HB 529, HB 0855, and SB1772; directing the City Clerk to provide a certified copy of this Resolution to Florida Governor Crist, Speaker of the Florida House of Representatives, President of the Florida Senate, the Broward County Legislative Delegation, and all other interested parties. RESOLUTION NO. R2007-40 h. STATE HOUSING INITIATIVE PARTNERSHIP (SHIP) ANNUAL REPORTS: (TR11161) Approving the annual report for the State Housing Initiative Partnership for FY 2003/2004 and the interim reports for FY 2004/2005 and FY 2005/2006. RESOLUTION NO. R2007-41 i. STATE HOUSING INITIATIVE PARTNERSHIP (SHIP) ALLOCATION ERROR: (TR11154) Acknowledging a good -faith oversight on the part of certain members of the City's administrative staff that resulted in several applicants receiving more than the maximum allowable allocation of State Housing Initiative Partnership (SHIP) program funding; ensuring that the City staff has taken the necessary administrative action to avoid a recurrence of this error. RESOLUTION NO. R2007-42 j. AGREEMENT FOR CULVERT CLEANING SERVICES: (TR11146) Executing an agreement with Shenandoah General Construction Company for culvert cleaning services utilizing the Northern Palm Beach County Improvement District Agreement, Project No. 1250 in an amount not to exceed $100,000 from the appropriate accounts; authorizing budget amendments as needed for proper accounting purposes. AMENDING CHAPTER 2 OF THE CITY OF TAMARAC CODE OF ORDINANCES — ARTICLE 111111, DIVISION 2, "CODE ENFORCEMENT BOARD" — CREATING SECTION 2-76 TO BE ENTITLED "ABATEMENT PROCEDURES": (T02135) Motion to adopt Ordinance on first reading amending Chapter 2 of the City of Tamarac Code of Ordinances, entitled "Administration", by amending Article III, entitled "Boards, Committees, Commissions"; specifically amending Division 2, entitled "Code Enforcement Board" by creating Section 2-76 to be entitled "Abatement Procedures"; providing the City's Special Magistrate with the authority to consider all abatement requests for fines imposed by the Special Magistrate or the City's Code Enforcement Board; providing for periodic hearings at which time all abatement requests are to be heard by the Special Magistrate; providing criteria that must be satisfied in order for the Special Magistrate to consider an abatement request; providing for codification. ADOPTED ON FIRST READING APRIL 11, 2007 PUBLIC HEARINGS 7:00 P.M. OR THEREAFTER ORDINANCES — SECOND READINGS There were no ordinances scheduled for second reading. April 11, 2007 Page 7 of 9 QUASI-JUDICIAL HEARINGS 8. AMENDING PRIOR ZONING — SABAL PALM: (T02136) Motion to adopt Ordinance on first reading amending prior zoning of certain real estate property otherwise known as Sabal Palm from S-1 (Recreational District) to R-3 (Low Density Multi -Family Residential District), located between Florida's Turnpike and Rock Island Road on the north and south side of Commercial Boulevard (Case No. 13-Z-06); providing for amendment of the official zoning map to reflect such change. City Attorney Goren said Items 8 and 9 are quasi-judicial proceedings and City Attorney Goren explained the rules covering these proceedings. City Attorney Goren read Temporary Ordinance 2136 on first reading by title. Commissioner Dressler seconded by Vice Mayor Sultanof moved approval. City Attorney Goren read Temporary Ordinance 2137 on first reading by title (see next item for motion and vote). City Clerk Swenson swore in all those who wished to speak on this item, including staff. City Attorney Goren said any documents, photographs or other evidence will be made part of the permanent record. Decisions of the Mayor and City Commission must be based on competent, substantial evidence. Community Development Director Bramley gave a presentation on Items 8 and 9. (Printed powerpoint presentation is attached and incorporated as part of these minutes.) Commissioner Dressler confirmed the proposed density for Monterey is 7 units per acre. Mayor Flansbaum-Talabisco spoke of the original land use amendments for both projects, and said conditions of approval all were positive for the community and the City of Tamarac. Mayor Flansbaum-Talabisco asked for a review of the conditions of approval. Community Development Director Bramley said there were numerous conditions of approval, such as dedication of 36 acres for a park and fire station, money paid to the HOAs for land leases and improvements to the property, traffic calming, and money for improvements to water and wastewater systems. Mayor Flansbaum-Talabisco confirmed without the projects, these improvements would not be made and confirmed traffic would be addressed at the time of the site plan hearings. Mayor Flansbaum-Talabisco asked if the water situation had been evaluated and Community Development Director Bramley said it was evaluated at the time the land use amendments were approved, and the petitioner will pay into the CIAC fund. Commissioner Partner asked which boards/commissions were part of the approval process and Community Development Director Bramley said City of Tamarac, Broward County, SFRPC, South Florida Department of Community Affairs, SFWMD, historical and archeological departments, to name a few. Commissioner Portner confirmed there is sufficient water capacity. Vice Mayor Sultanof confirmed traffic is being addressed. Susan Delegal, Attorney At Law, appeared on behalf of the applicant. Ms. Delegal spoke of rezoning bringing the property into compliance with Tamarac's land use designation and working diligently to put together the declaration of covenants. Mayor Flansbaum-Talabisco opened the public hearing for items 8 and 9. The following people spoke in favor of the projects: Ben Roberts, 5002 NW 58 Street, Margaret Bicon-Bars, 4812 NW 49 Drive, Pam Bushnell, 4706 NW 43 Terrace, Bob Vilella, 4605 NW 45 Street, and Don Colson, 4409 NW 45 Street. The following people spoke against the projects: Bob Storch, 4622 NW 45 Court and Helen Tomas, 4111 NW 47 Court. Pauline Adamski of Lakes of Carriage Hills asked how this would affect Bailey April 11, 2007 Page 8 of 9 1 �l 1 Road and Rock Island Road. Mayor Flansbaum-Talabisco said we are aware of the traffic situation. With no one else wishing to speak, Mayor Flansbaum-Talabisco closed the public hearing. Community Development Director Bramley spoke of traffic and vehicle generation. Mayor Flansbaum-Talabisco said this would be discussed on April 25th at the appropriate time. On roll call Mayor Flansbaum-Talabisco voted "yes", Commissioner Dressler "yes", Vice Mayor Sultanof "yes", Commissioner Portner "yes", and Commissioner Atkins -Grad "yes". Motion carried.
