REGULAR CITY COMMISSION MEETING
CITY HALL - COMMISSION CHAMBERS
WEDNESDAY JUNE 10, 2009
CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City
Commission to order at 7:00 p.m. on Wednesday, June 10, 2009, in Chambers, at
Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, Florida.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Patricia Atkins -Grad,
Commissioner Pamela Bushnell, Commissioner Diane Glasser, and Commissioner
Harry Dressler.
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and
City Clerk Marion Swenson.
PLEDGE OF ALLEGIANCE: Commissioner Bushnell led the pledge of allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation by Mayor Flansbaum-Talabisco of a proclamation in support of
Chicago's bid to host the Olympics, proclaiming June 23, 2009 as "Olympic Day"
(Requested by Mayor Beth Flansbaum-Talabisco)
b. Presentation by Mayor Flansbaum-Talabisco of a Proclamation honoring Fire
Chief Jim Budzinski upon his retirement from Tamarac Fire Rescue (Requested by
Mayor Beth Flansbaum-Talabisco and the City Commission) City Manager Miller said
there were several retirement get togethers for Fire Chief Budzinski and people were in
attendance from all over, both locals and those from out of state. The Chiefs
distinguished career began in 1979 and within 12 years he became Fire Chief. It has
been a pleasure to work with Fire Chief Budzinski over the last 15 years; he built a
wonderful department second to none in the State of Florida. City Manager Miller
congratulated Fire Chief Budzinski on his years of service and presented him with a
check and certificate in recognition of 30 years of dedicated service to the City of
Tamarac. Commissioner Bushnell spoke of Fire Chief Budzinski's office, decorated with
wildlife accumulated from his hunting forays, and said it has been a pleasure to know
him. Commissioner Dressler said Fire Chief Budzinski has done amazing things;
building a department that has saved many peoples' lives. Commissioner Dressler
congratulated Fire Chief Budzinski, wished him a long life, and said he will be deeply
missed. Vice Mayor Atkins -Grad said it has been a unique experience knowing Fire
Chief Budzinski, and she wished him fun, many years of hunting, and an enjoyable, long
life. Commissioner Glasser spoke of Fire Chief Budzinski's assistance in her
community with regard to hurricane preparations and said she hates to see him go. Fire
Chief Budzinski said he appreciates all the kind words, acknowledged the firefighters in
the room and wished all of them long careers. Fire Chief Budzinski said over the last 17
years he has tried to provide the firefighter/paramedics the tools they need to do their

job; and it is an outstanding job. Fire Chief Budzinski thanked everyone for what they
have done for the community and for him, and said Tamarac is in good hands.
Presentation by Mayor Flansbaum-Talabisco of Certificates of Graduation to the third
Graduating Class of Tamarac University, June 2009: Brian Beaton, Ray Hayden,
Adrienne Bennett, Nikye Joseph, Jon Breslav, Mike Jula, Ileana Castillo -Roman, Neda
Kalhor, Michelle Changar-Coe, Cheryll Ann Kammerer, Joel Davidson, Regina Levine,
Kenneth Dobies, Stuart Marcus, Constance Earle, Rea Mills, Carol Fortin, Stanley
Orsolek, Mike Gelin, Anna Salomon, Michelle Gomez, Lois Schwartz, Ron Hawthorn,
Michael West.
(Note: Ron Hawthorn and Neda Kalhor were unable to attend the meeting — their
certificates will be mailed to them.)
Joel Davisdon wished Vice Mayor Atkins -Grad and City Clerk Swenson happy
birthdays, and commended Andy Berns, Anthony Campbell and Chad Quinn on the way
they ran the classes. In appreciation for all Tamarac has done for the students of
Tamarac University, the 3rd Graduating Class presented the Mayor and City
Commission with a rendering of the Recreation Center with all the students' names
engraved on it, and thanked staff for the time and effort they put into the program.
REPORTS
2. City Commission: Commissioner Bushnell said she is proud to have been part
of Tamarac University and she cannot say enough about the staff, who take the time to
teach the classes in a professional manner. Commissioner Bushnell reported on the
meeting held before the County Commission yesterday, wherein Tamarac's case was
presented regarding Prestige Homes. Deputy City Manager/Interim Financial Services
Director Cernech and Community Development Director Bramley prepared the City's
representatives well and it was an honor to stand up and support our constituents and
the City.
Vice Mayor Atkins -Grad spoke of the Neighborhood Meeting for District 2 and said it
was very informative. Tough choices are going to have to be made over the next weeks
in light of the current financial situation, and keeping our citizens informed is an
important aspect of the process. If the constituents understand the issues, they will
better understand the decisions made by the Mayor and City Commission.
Commissioner Glasser said she was in Cambridge, Mass. last week attending the
graduation of her granddaughter from Harvard Law School. Yesterday Commissioner
Glasser attended the Town Hall meeting hosted by Representative Ari Porth and
Senator Jeremy Ring. They reported on happenings in the legislature; Commissioner
Glasser assured everyone that Tamarac will be okay.
Commissioner Dressler congratulated the Tamarac University Graduates, and
congratulated Fire Chief Budzinski on his retirement. The MPO started the first of five
workshops dealing with long term mass transit planning for the county. This is an

important process as it will affect Tamarac, the main Street Corridor and the County.
Commissioner Dressler requested a moment of silence in memory of victims of
domestic terrorism; a 23 year old soldier from Arkansas and a security guard at the
Holocaust Museum.
Mayor Flansbaum-Talabisco said Commissioner Bushnell represented Tamarac well
before the County Commission yesterday, and also thanked Deputy City
Manager/Interim Financial Services Director Cernech and Community Development
Director Bramley for the work they put into preparing the Mayor and Commissioner
Bushnell for the presentation. They presented their case and won. Mayor Flansbaum-
Talabisco thanked her colleagues who called yesterday to offer encouragement while
they were in the County Commission Chambers. Mayor Flansbaum-Talabisco said the
Mayor and City Commission received notification from Congresswoman Wasserman -
Schultz that the House Commerce Justice and State Appropriations FY10 Bill included
$300,000 for Tamarac's Interoperability Project (our radio system). We have previously
received $200,000 toward this project. Mayor Flansbaum-Talabisco extended kudos to
Assistant City Manager Phillips and her team for the work that went into writing the
grant. Sunday Congressman Hastings will be coming to a local political club, and a
number of the City Commission will attend the event. Saturday night and Sunday
afternoon the Elegant School of Modern Dance presented a show to a standing room
only audience. The group consists of dancers of all ages. The Broward County
Business Forum was hosted by Tamarac and led by Public and Economic Affairs Officer
Berns on Friday. The purpose of the meeting was to encourage and educate small
business owners on how to get through this trying time. Saturday morning the League
of Women Voters of Broward County hosted a presentation. It is important that our
legislators hear from the public; we all need to be educated on current matters.
3. City Attorney: City Attorney Goren reported on SB360 which the Governor
signed. There was a meeting of the Regional Planning Council today, and a webinar is
scheduled for this week to review the Bill. Impacts are already being felt in Tamarac.
City Attorney Goren spoke of the electioneering communications case, its effect on Sec.
106 F.S., and the restrictions on local government's ability to educate the public on
matters that they will be asked to vote on. Commissioner Dressler asked if with regard
to SB216 there was discussion regarding the constitutionality regarding curtailment of
free speech, and City Attorney Goren replied in the affirmative. Commissioner Bushnell
asked if this could be inclusive with regard to educating in a forum such as a
Commission meeting and City Attorney Goren said it is possible if liberally construed.
4. City Manager. City Manager Miller spoke of the fact that Tamarac was well
represented in speaking engagements over the past month. Assistant City Manager
Phillips and Management Analyst Hughes were invited to speak at the Sterling
conference; City Manager Miller spoke at the City Managers' Conference in St.
Augustine; Deputy City Manager/Interim Financial Services Director Cernech was
invited to speak on infrastructure funding; and Community Development Director
Bramley spoke of our efforts with regard to becoming a green community. City
Manager Miller finished his term on the Board of the City Managers' Association, and

served on a panel with other City Managers, where there was a discussion of
management. City Manager Miller said he is very proud that Tamarac was showcased.
Finance reports that if we are successful in obtaining the $300,000 for the radio system,
we can then end the lease and we will own the system. We have also applied for a
grant from the Justice Department in the amount of $20,000 for expanded police
service, and a grant from the Florida Department of Health in the amount of $42,000 for
automatic stretchers. Parks and Recreation reports on a successful Memorial Day
Ceremony with over 300 people in attendance, and the '3 on 3' Basketball Tournament
was also a success. The Board and Committee Luncheon was well attended and a
very enjoyable event. Summer camp begins Monday and 375 children are enrolled.

CONSENT AGENDA
6. For the benefit of the Tamarac University graduates in the audience, Mayor
Flansbaum-Talabisco explained that items voted on as part of the consent agenda are
discussed at the workshop meetings, or individually with the City Manager, City Attorney
or staff.
Vice Mayor Atkins -Grad seconded by Commissioner Glasser moved approval of all
items on the consent agenda. On roll call, Vice Mayor Atkins -Grad voted "yes",
Commissioner Glasser "yes", Commissioner Dressler "yes", Commissioner Bushnell
"yes", and Mayor Flansbaum-Talabisco "yes". Motion carried.
a. Approval of the Minutes of the May 27, 2009 Commission Meeting
APPROVED
b. TR11618 PURCHASE OF SOLAR SALT FROM MORTON SALT:
A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to approve the participation in a Purchasing Agreement for
solar salt for water treatment from Morton Salt, utilizing the Southeast Florida
Governmental Purchasing Cooperative Group Bid #2009-004 for an estimated total cost
of $42,124.50 annually, approving funding from the appropriate account; providing for
conflicts; providing for severability; and providing for an effective date.
RESOLUTION NO. R2009-75
C. TR11628 PURCHASE LIFEPAK 15 DEFIBRILLATORS/MONITORS:
A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to purchase from Physio-Control, a division of Medtronic, Inc.,
a sole source provider, five (5) LifePak 15 adaptive, biphasic cardiac defibrillators and
monitors with related accessories and four (4) mobile battery service stations for a total
cost of $120,677.86; authorizing the disposal of four (4) outdated cardiac defibrillators
and monitors; providing for conflicts; providing for severability; and providing for an
effective date.

d. TR11631 SECOND AMENDMENT - LARGE USER WASTEWATER
AGREEMENT: A Resolution of the City Commission of the City of Tamarac, Florida,
authorizing the appropriate City Officials to execute the Second Amendment to the
Large User Wastewater Agreement between Broward County and the City of Tamarac
for additional wastewater reserve capacity; providing for conflicts; providing for
severability; and providing for an effective date.
RESOLUTION NO. R2009-77
e. TR11633 SUPPORTING BROWARD COUNTY'S FUNDING OF SCHOOL
RESOURCE OFFICERS: A Resolution of the City Commission of the City of Tamarac,
Florida urging the Board of County Commissioners for Broward County and the School
Board of Broward County to ensure that there is sufficient funding to provide School
Resource Officers for all schools located in Broward County; providing for conflicts;
providing for severability; and providing for an effective date.
RESOLUTION NO. R2009-78
f. TR11629 HAMPTON INN & SUITES INGRESS -EGRESS EASEMENT:
A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City Officials to accept and execute a Blanket Public Safety Ingress/Egress
Easement with Palmetto Hospitality of Tamarac I, for the Hampton Inn & Suites Project,
located at 5701 Madison Avenue, to provide proper access to the property for municipal
services such as utility, canal, fire and police protection, emergency and other public
safety services; authorizing and directing the City Clerk to record said document in the
public records of Broward County; providing for conflicts; providing for severability; and
providing for an effective date.
RESOLUTION NO. R2009-79
g. TR11630 NW 50TH AVENUE SIDEWALKEASEMENT:
A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City officials to execute a Sidewalk Easement with the estate of Jacob Lutz,
for the NW 50th Avenue Sidewalk Project, Authorizing and directing the City Clerk to
record said agreement in the public records of Broward County; providing for conflicts;
providing for severability; and providing for an effective date.
RESOLUTION NO. R2009-80
h. TR11637 ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT
PROGRAM APPLICATION: A Resolution of the City Commission of the City of
Tamarac, Florida authorizing submission of a grant application, acceptance and
execution of the grant agreement upon approval pending legal review in the amount of
$544,900 to the U.S. Department of Energy for Recovery Act — Energy Efficiency and
Conservation Block Grant program (EECBG) funds for the provision of an Energy
Efficiency and Conservation Strategy, and all related equipment recommended for
inclusion under this strategy.
